RESOLUTION AUTHORIZING THE LOCKPORT TOWNSHIP SUPERVISOR


AND THE LOCKPORT TOWNSHIP ATTORNEY
TO EXECUTE ANY AND ALL DOCUMENTS TO EFFECTUATE THE
PURCHASE OF BUILDING AND REAL ESTATE
FOR A TOWNSHIP OFFICE AND COMMUNITY CENTER
WHEREAS, the Lockport Township Board of Trustees (Lockport BOT) is statutorily
granted the authority to oversee and maintain matters in Lockport Township; and
WHEREAS, the Lockport Township Board of Trustees is likewise authorized and
obligated to provide quality and efficient Township services to all residents of Lockport
Township; and
WHEREAS, the Lockport Township Board of Trustees annually budgets for various
costs, fees, expenses, and services to be provided within Lockport Township; and
WHEREAS, the Lockport Township Board of Trustees, pursuant to the then-applicable
statutory authority as provided in 60 ILCS 1/235-5 (9), was and is empowered to accumulate
money in a designated fund for acquiring land, promoting and developing the construction of a
potential community center, as well as the development and construction of a Township Office
Building to perpetuate the high quality and efficient provision of Township services to residents
of Lockport Township and did so resolve to do the same on September 14, 2009 pursuant to
Resolution 2009-4; and
WHEREAS, the Lockport Township Board of Trustees has further committed funds for
said projects and potential expenditures as provided in Ordinance 2012-1, passed on February
13, 2012; and
WHEREAS, the Lockport Township Board of Trustees is further statutorily authorized to
purchase and hold property, both real and personal, for the use of its inhabitants for public
purposes and to make all contracts necessary in the exercise of the Townships powers pursuant
to 60 ILCS 1/85-10 (c); and
WHEREAS, the Lockport Township Board of Trustees is statutorily authorized pursuant
to 60 ILCS 1/140-5 (c), by Resolution or Ordinance, to purchase a Township Hall, a multipurpose Senior Center, or a combined Township Hall and multi-purpose Senior Center within the
Township without referendum approval, if said building and real estate is paid or provided for
with funds that are not the proceeds of bonds; and

WHEREAS, Parkview Christian Church desires to sell a building and real estate located
at 1463 Farrell Road, Lockport, Illinois currently consisting of a two-story building, garage,
parking, and real estate of approximately 7.24 acres and legally described as follows:
THAT PART OF THE NORTH 20.0 ACRES OF THE EAST HALF OF THE
NORTHEAST QUARTER OF SECTION 25, TOWNSHIP 36 NORTH, RANGE
10 EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS
FOLLOWS: BEGINNING AT A POINT ON THE EAST LINE OF THE SAID
NORTHEAST QUARTER; 433.00 FEET SOUTH OF THE NORTHEAST
CORNER OF THE SAID NORTHEAST QUARTER; THENCE NORTH 89
DEGREES 58 MINUTES 53 SECONDS WEST 226.94 FEET, ALONG A LINE
PARALLEL TO THE NORTH LINE OF THE SAID NORTHEAST QUARTER;
THENCE NORTH 00 DEGREES 01 MINUTES 08 SECONDS EAST 199.96
FEET, ALONG A LINE THAT FORMS A RIGHT ANGLE WITH THE LAST
DESCRIBED LINE, TO A POINT ON THE SOUTH LINE OF THE NORTH
233.00 FEET OF THE SAID NORTHEAST QUARTER, THENCE NORTH 89
DEGREES 58 MINUTES 52 SECONDS WEST 605.43 FEET, ALONG THE
SAID SOUTH LINE OF THE NORTH 233.00 FEET OF THE NORTHEAST
QUARTER; THENCE SOUTH 00 DEGREES 50 MINUTES 25 SECONDS
WEST 432.55 FEET, TO A POINT ON THE SOUTH LINE OF THE SAID
NORTH 20.0 ACRES OF THE EAST HALF OF THE NORTHEAST

EAST 835.57 FEET, ALONG THE SAID SOUTH LINE OF THE NORTH 20.0
ACRES OF THE EAST HALF OF THE NORTHEAST QUARTER, TO THE
SAID EAST LINE OF THE NORTHEAST QUARTER; THENCE NORTH 00
DEGREES 48 MINUTES 43 SECONDS EAST 232.57 FEET, ALONG THE
SAID EAST LINE OF THE NORTHEAST QUARTER, TO THE POINT OF
BEGINNING, IN WILL COUNTY, ILLINOIS, CONTAINING 7.24 ACRES
MORE OR LESS.

(Subject Property); and


WHEREAS, the Lockport Township Board of Trustees desires to purchase the Subject
Property for its Township Offices and a Community Center; and
WHEREAS, the appraisal of the Subject Property is $2,600,000.00 while the proposed
Purchase and Sale Agreement calls for a Purchase Price of $1,100,000.00 inclusive of Earnest
Money of $25,000.00; and

WHEREAS, the proposed Purchase and Sale Agreement is contingent upon the
completion by Lockport Township of Due Diligence on the Subject Property to ensure the
zoning and environmental condition of the Subject Property would allow the Township to use the
Subject Property for the purposes stated herein; and
WHEREAS, the proposed Purchase and Sale Agreement targets a closing date of
December 29, 2015; and
WHEREAS, the Purchase of the Subject Property will not require an increase in taxes, an
increase in the tax levy, or a diminution in the ability of the Township to provide high quality
and efficient services to the residents of the Township as the funds for the Purchase have already
been accumulated for the stated purpose; and
WHEREAS, the Lockport Township Board of Trustees believes the proposed Purchase of
the Subject Property is truly within the best interests of all residents of the Township.
NOW THEREFORE BE IT RESOLVED, the Lockport Township Board of Trustees
avers as follows:
1.
The Lockport Township Board of Trustees authorizes the Township Supervisor
and the Township Attorney to execute any and all documents required to effectuate the Purchase
of the Subject Property; and
2.
The Lockport Township Board of Trustees authorizes the Purchase Price,
including all customary closing fees, costs, and expenses, minus any and all customary closing
credits, to be withdrawn from the appropriate Township funds and the appropriate line items
from the affected accounts and to be applied to the Purchase of the Subject Property at the
closing currently projected for December 29, 2015, or any time thereafter as mutually agreed
between the Seller and the Township; and
3.
This Resolution shall be in effect from and offers its passage and approval as
provided by law and specifically supersedes any prior Resolution or Ordinance or portions of the
Lockport Township Board of Trustees contrary to this Resolution.
