causes of the failure and suggest a mechanism (instrument) that can lead

2.1 Why and how JAWHAR is formed.
2.1.1HISTORY OF JAWHAR

Departmentof Awqaf, Zakat and Hajj (JAWHAR) was founding on March 27, 2004 by
former Prime Minister YAB Tun Abdullah Ahmad Badawi when he announce Malaysian
government cabinet.
His commitment expressed in his speech during the launch of the 9th Malaysia Plannings on
March 31, 2006 in Dewan Rakyat:
In addition, steps will be taken to enhance the capital resources of bumiputra, like land
and awqaf assets under the management of the State Religious Councils. These State
Religious Councils should fulfill Fardhu Kifayah obligation and play an active role in the
economic development of the muslim ummah and help in the development of human
capital.

Former Prime Minister of Malaysia his official launch was completed by Dato Seri Abdullah
bin Md Zin, a former Minister in the Prime Minister (who was responsible for the Islamic

2,3 To what extent JAWHAR has influence and power to govern the baitul mal in
Malaysia.

There have many influence and power to govern the baitul mal in Malaysia that the JAWHAR
do some activity such as coordinate the establishment of a new entity [YWM] with the
participation of State Religious Islamic Councils to implement programmers to develop wakaf
and baitul mal land into viable economic investments and thus, contribute to the development
of the BCIC [Bumiputera Commercial and Industrial Community]. During the planning
period, emphasis will be given to develop wakaf land within the commercial urban areas in
the Johor Bahru, Klang Valley and Pulau Pinang. The development programmed will involve
integrated redevelopment of housing settlements with infrastructure and economic facilities,
including business and industrial premises on wakaf land. The bumiputera development also
have which is agenda through the development of waqf assets is one way of increasing the
participation and ownership of bumis (plural bumiputera ) in the corporate sector. This is
undertaken to minimize wealth disparity between the bumis and non-bumis. Besides that,
wakaf, baitul mal, haji and zakat resources will be appropriately mobilized towards enhancing
the development of bumiputera and other Muslims. Wakaf land and properties under the state
religious Islamic authorities will be developed to tap their productive potential as well as to
spawn new entrepreneurs. Development of commercial assets such as hotel and business
premises on wakaf land will be expanded to increase bumiputera ownership of non-financial
assets and a strategic plan will be drawn up to ensure that the income generated from the
development of wakaf land will enable state religious authorities to be more self-reliant in
developing new wakaf land.
JAWHAR needs to improve baitul mal role in generating economic strength and balance
should be intensified so real wealth of Muslims can be exploited jointly as maximizes as

possible. In this case, history has shown clearly the roles and capabilities of treasury
institutions in generating economic strength of the country's people and Islam, for example, in
the era of the Prophet Muhammad and the Caliph Umar Ibn Abdul Aziz. JAWHAR have
advocated National Treasury Convention 1430H / 2009M (Konvensyen Baitulmal
Kebangsaan 1430H/2009M). Organized jointly by JAWHAR and the Federal Territory
Islamic Religious Council (council) will be held on 24 to 25 June 2009 at the Multipurpose
Hall, Federal Territory Mosque in Jalan Duta, Kuala Lumpur. This programmed are to
generate new ideas and more practical in strengthening institutional baitul mal and check back
treasury functions and roles of the real as the golden age of Islam. In addition, the
programmed of convention objective are to generate and collect ideas and thoughts of Muslim
scholars from various fields such as administrative, academic, legal and institutional
empowerment in baitul mal, sharing knowledge and experience in the administration and
development of baitul mal institution by academics, legal experts and representatives of
Islamic religious agencies from across the country, review the function, role and concept of
the golden age of baitul mal in Islamic to be reapplied in order to strengthen the institutions in
all the state treasury, establishing baitul mal institution in our country in line with current
realities and developments such as the advancement of information and communication
technology (ICT) and Electronic Government (e-Government), and shoe potential milestone
treasury as community economic development through the strengthening of existing resources
and exploration of new potential sources to fund its baitul mal.
However, JAWHAR have plan, implement, monitor and coordinate the development of
Awqaf, Zakat, Mal and Hajj / Umrah in order to function more effectively in socio-economic
development of the Community, plan and coordinate the requirements and uniformity of the
legal system for the development of Awqaf, Zakat, Mal and Hajj / Umrah, forge smart
partnerships with government agencies and the GLC / private sector in the development of
Awqaf, Zakat, Mal and Hajj / Umrah, conduct studies and research, publication and
coordination on issues of development on treasures Muslims programs to be fully utilized by
the community, and assist and support services in human resources management, finance and
ICT to Religious Authority and relevant agencies.
Moreover, JAWHAR have baitul mal section to govern it in Malaysia industry that consists of
two units, zakat and general resources. For unit of zakat JAWHAR do to plan, coordinate
standardize and strengthen legislation, regulations, procedures, management of zakat
collection and distribution procedures for the use of Majlis Agama Islam Negeri (MAIN) and

Zakat Department (JZN), establishing standard procedures for financial management and
certificate MAIN / JZN and charity care company, to organize a national-level coordination
meetings and conferences related charity, to provide advice and simple way in organizational
development and matters relating to zakat, to conduct research, prepare reports and submit
recommendations on the issues of charity, Establish and coordinate the development and
adoption of information technology standards and communications technologies (ICT) by the
MAIN and JZN, and to represent the country in official forums related consulting and charity
affairs. Then, for the unit of general resources also do to plan, implement and monitor
development programs in general economic development plan for five years Malaysia, plan
and obtain general budgetary resources development, inheritance, wills and trusts across the
country, plan and implement partnerships among institutions of general resources such as

JAWHAR department of Mal does not manage the process of hand over and receipt of general
source of property because that process is manage by baitul mal or the State Islamic Council
(SIC). The role of JAWHAR is only to coordinate the process of managing baitulmal in
Malaysia, and help in developing the asset. Based on JAWHAR effort to govern the baitul mal
in Malaysia the success was also influenced by four main factors which the caliph regards as
the pillar of power there are the pillars were the caliph, the governor or districts ruler, the
judges, and the officials of baitul mal. Any financial institution such as baitul mal, state bank,
world bank and so on, if were managed through solid strategies by competent and honest
person could bring substantial benefits to the people and the country. It was proven by history
as was prevailed during the reign of Caliph Umar Ibn Abdul Aziz.

2.4 What are the effort have been done by JAWHAR to bring the administration of
Baitulmal under common regulation?
In Malaysia, the affair of the baitulmal is under the management State Islamic Religion
Council (MAIN) as embodied in provisions of Federal Constitution. The management of
baitulmal at the state level was originally going well. However, pro-active moves should be
continued to improve the efficiency of governance in the baitulmal management system,
especially in terms of coordination and consistency of services offered.
As a body that is in charge for coordinating activities related to Syariah, JAWHAR acts as a
facilitator as well as providing value added to MAIN.
Since baitulmal is an institution under the jurisdiction of state governments, the scope of the
administration and coordination of the baitulmal in Malaysia is quite limited. To overcome
this limitation, JAWHAR had taken many initiatives to promote products and services
baitulmal such as:

1. The establishment of Jawatankuasa Penyelarasan Baitulmal Kebangsaan


(JPBK).
JAWHAR organized JPBK which comprises all the members of MAIN and chaired by the
minister in Prime Ministers Department (JPM). Through JPBK, all proposals to enhance and
strengthen the baitulmal function in the socio-economic empowerment of the Muslim
community can be addressed.

Through JPBK also, the federal government and the state baitulmal can work more closely
towards empowering and enhancing the role and contribution of baitulmal to the whole
community.
The result of integration of ideas and views of all parties involved, JAWHAR successfully
developed e-Bayanat system and e-Stops, published a series of manual management and
coordinated the laws and regulations related to waqf, zakat and mal.

2. National Baitulmal Convention 1430H/2009M


The aim of National Baitulmal Convention 1430H/2009M is to generate new ideas that are
more practical in strengthening the baitulmal institutions and to revise the real function and
role of baitulmal as in the golden age of Islam.
The objectives of National Baitulmal Convention include:

To generate and collect ideas of Islamic scholars from various fields such as
administrative, academic, legal and others to strengthen the baitulmal

institution.
To share the experiences and knowledges in governance and development
baitulmal institution by academics, legal experts, and representatives of Islamic

religious agencies across the country.


To study the function, role and concept of the golden age of Islamic baitulmal

to be reapplied as a measure to strengthen the baitulmal institution in all states


To uphold the baitulmal institutions line with current developments such as
advancement of information technology, communication (ICT) and electronic

government (eGovernment).
To make the baitulmal as a milestone in the economic development of the
community through improvement of existing resources and exploration of new
potential sources.

The National Baitulmal Convention 1430H/2009M that held for two days were ended with six
resolutions, including empower the baitulmal role as a stakeholder of the Muslims property
through the establishment of the National Baitulmal Capital (PBK).
The other six resolutions are:
To makes baitulmal as a public funds that have the right to act on behalf of the Muslim
community to protect the interests and development the Muslims economy.
To improve the implementation of cash waqf, also issued sukuk and other financial
instruments in large quantities in order to strengthen the fund of PBK.
To produce human capital and professional integrity towards improving the quality of
service delivery and the management of baitulmal property.
To involve intellectuals from the public to assist in designing and mobilizing the
nation's socio-economic activities.
3. Baitulmal Promotion Program 2011
JAWHAR as a federal agency functioning to coordinate and strengthen governance baitulmal
institutions in Malaysia has organized Baitulmal Promotion Program for two days to promote
baitulmal products and services, and disclose the results of innovation and transformation of
baitulmal that has be performed.
This program gathers all related agencies with baitulmal management in Malaysia in a cluster
which includes JAWHAR, MAIN, Agensi Mengurus Zakat (AMZ), YWM, World Zakat
Organization (WZO) and others with the purpose to promote the baitulmal products and
services provided to the public.
Baitulmal Promotion Program aims to raise awareness and financial literacy among the
Muslims through the instruments held by waqf, donations, wills, vows, hibah and others as a
financial management tool as well as an Ibadah to get rewards from Allah.

4. Conference of Baitulmal Coordination of States Islamic Religion Council 2012


The conference was organized to discuss and coordinate on issues related to baitulmal which
is the core of JAWHAR. It was stated in News that this conference is attended by 45 people
from States Islamic Religion Council and States Zakat Collection Center (PPZ).

PPBM is the most appropriate medium to enhance the management of baitulmal at the state
level through the sharing of ideas and adjustments.

5. Meeting of the Waqf Committee 2013


Aware of the fact that waqf as one of the important systems in the economic structure of
Islam, JAWHAR has taken proactive steps to hold a meeting of waqf committee with the
government and private agency on 24-26 Jun 2013.
The purpose of this meeting is because JAWHAR think that involvement of other agencies is
needed in order to protect the interests of al-wakif and build confidence to the public on the
importance of waqf. In addition, the waqf managed professionally and systematically is able
to reduce the liability incurred by a government through an efficient administration and
management.

6. Meeting with Malaysias Central Bank (BNM) 2014


This meeting was held on July 1, 2014 by JAWHAR.
The purpose of this meeting was to discuss the framework for the assessment and compliance
processes of Malaysia in compliance with international standards to combat money laundering
in the financing of terrorism that may be donated from zakat and charity events.
The meeting also aims to seek views and information from the JAWHAR on zakat
management system in Malaysia to demonstrate to the judges that zakat management system
in Malaysia is a systematic and orderly manner and protected from being misused for terrorist
activities.

In the meeting also, BNM has briefed to JAWHAR on matters related to money laundering
and terrorism financing abuse.

7. Charity Program Coordination Meeting With MAIN And AMZ 2014


JAWHAR held a Charity Program Coordination Meeting cooperated with State Islamic
Religion Council (MAIN) and Agensi Mengurus Zakat (AMZ) for two days from 29 to 30
September 2014 at Klana Beach Resort (JAWHAR-MAINS), Port Dickson, Negeri Sembilan.
The purpose of this meeting is to coordinate and set the direction for zakat strengthening
programs with MAIN and AMZ throughout Malaysia. In addition, these meetings also aim to
strengthen the ties and rapport between the JAWHAR, MAIN and AMZ.
The main agenda discussed in the meeting were concerned about the Final Report of Uruf
Determination of Gold in Islamic women wearing, the implementation of the 2014 National
Zakat Month Celebration, advertising programs and promotion of charity and others.

8. National Baitulmal Convention 2015


The main focus of National Baitulmal Convention 2015 is to generate new ideas that are more
practical in strengthening the baitulmal institution and explore opportunities to establish good
governance by creating a resolution that is appropriate and relevant to strengthen the
management of baitulmal in Malaysia.
In conjunction with this Convention, the Minister in the Prime Minister launched the Portal eKhairat with the purpose to coordinating centralized data related to charitable collection in
states where according to the law and regulations, charitable collection activities must receive
a letter of authorization from the Majlis Agama Islam Negeri (PLAY) in their respective
states.
The National Baitulmal Convention 2015 were ended with six resolutions which are:

2.6 FAILURES OF BAITULMALS IN MALAYSIA

1.

Inefficient administration.
The amils dont have full responsibility to collect and
distribute the zakat.
As a result, there are a lot of waste due to the failure of
Baitulmal to distribute the zakat to the qualified people.
Only Baitulmal in Selangor has given authority or
responsibility to the amil, Pusat Zakat Selangor, to collect
and distribute the zakat.

Result:
-They manage to distribute almost all of the zakat that they had collected.
- The system of Bureaucracy
- Provide certain positions in Baitulmal for the loyal followers.
- High cost compared to the zakat collected high wages.

Lack of leadership

According to Dr Yusof Qardhawi, the leaders should also


participate and make sure that the affairs in Baitulmal are
completed and implemented.
Misuse of power.
Example:
- Menteri Besar Selangor had proposed that the money of Baitulmal that had been

obtained by the contribution of zakat to be used for the states development.


- In June 2011, Datuk Seri Jamil Khir used the zakat money of MAIWP to pay for the
legal suit case involving Anwar Ibrahim (RM63,650)
Allah said in the Quran: (An-nisa: 10):
those who unjustly eat up the property of orphans, eat up a Fire into their own
bodies: They will soon be enduring a Blazing Fire!

3.

Lack of awareness on the teachings of Islam among the society.


Its very difficult to build an Islamic institution due to the
lack of awareness on the teachings of Islam among society,
especially Muslims.

4.

Administration of Baitulmal is too scattered


Every single states has their own way of administrating the

Baitulmal.
High cost in administrating every Baitulmal in each states
than the money that had been collected.

5.

Lack of trustworthy in the administration.


According to Dr Yusof Qardhawi, an administration that has
lack of trustworthy will show a bad image to the institution.
This kind of administration will eliminate the trust of the
society towards this institution.
The leaders should hire the amil are highly qualified.

Incomplete databases
Lack of comprehensive databases concerning the status of
waqf land, size, geographical location, type and other relevant
information have also hampered the development of potential
waqf land. Similar situation is also occurring in every state
and the discrepancies of data at SIRC offices are found to be

caused by incomplete, outdated and unsystematic data


recording. Although the Department of Awqaf, Zakat and Hajj
(JAWHAR) has taken the efforts to gather information of the
waqf land in all states, lack of cooperation from SIRC has
hindered the success of the initiative.

2.6 Suggest a mechanism that could lead to the uniformity of baitul mals in
Malaysia.
2.6.1

Compliance fully JAWHAR Code of Ethics

JAWHAR Code of Ethics is formed based on the principles of HIJRAH which are:
H - Hemah dan beradab (Respectful and courteous)
I - Integriti dan telus (Integrity and transparent)
J - Jati diri kental, komited dan profesional (Strong self esteem, committed and
professional)
R - Responsif dan menepati masa (Responsive and punctual)
A - Akrab dan kerja berpasukan (Close and team work)
H - Hikmah dan berpengetahuan (Wise and knowledgeable).
The word HIJRAH was chosen for the solution because it show that the code of ethics will be
a paradigm shift to produce more ethical staff, provide better services, produce higher quality
work and create a better working climate. The content of the ethics itself exhibits the working
style and personality that should be demonstrated by the staff in dealing with JAWHAR
stakeholders who are the public, SIRC or other agencies. Integrity, transparency,
professionalism, courtesy, punctuality and knowledge are among the values that should be
upheld by JAWHAR staff.
In addition, this code of ethics becomes the foundation of JAWHAR management philosophy.
It reflects the JAWHAR mission, vision, objective, quality policy and functions. It also
becomes the guideline and working ethics of JAWHAR staff in managing and generating the
institution. Thus, it is able to function at its best level. This code of ethics is supposedly
applied fully by other institutions that are also involved with the administration and
management of waqf, zakat and other.

2.6.2 Strengthen the role of Department of Waqf, Zakat and Hajj (JAWHAR)
For the Federal Government has established the JAWHAR to coordinate the activities
conducted by all waqf institutions in Malaysia. JAWHAR also helps, facilitates and
complements the efforts SIRC has taken in improving the efficiency and effectiveness of waqf
administration, management and development. JAWHAR is also responsible for observing
and assisting SIRC if it fails to complete any development projects due to shortage of
financial resources and experts. Among other roles of JAWHAR include:
1.

to develop all baitulmal assets in the country by implementing development projects


which benefit the Muslims.

2.

to generate more income from waqf properties and also increase waqf land revenue by
adopting various contemporary and innovative approaches.

3.

to mobilize baitulmal assets and improve the economy of the Muslim community.

4.

to address issues concerning socio-economic inequality among the Muslims in a


progressive and productive

5.

way in order to eliminate poverty among the Muslims.

2.6.3.The Establishment Of A Practicable System in JAWHAR


The object of the JAWHAR is :
1.

Empowering and develop socio-economic development of the Ummah in the field of


Awqaf, Zakat, Mal and Hajj / Umrah through close collaboration with the National
Religious States and related agencies;

2.

Enhance the good governance institutions of Awqaf, Zakat, Mal and Hajj / Umrah;

3.

Increased the awareness and understanding of the concept of Awqaf, Zakat, Mal and
Hajj / Umrah; and

4.

Nourish and cultivate the legacy of awqaf practices among Malaysians people.

Since the objective mentions above need to empowering, enhance, increased the awareness
and nourish the practices in Malaysia. That it would be the need to establishing of a system.
which is practicable, and it must having standard rules apply to all institutions baitulmal in

Malaysia. In order to make sure the benefit of the community can fully benefit.
