AFFIDAVIT
I, FRANCISCO C. GUILLENA, of legal age, Filipino, married, and a
resident of La Aldea del Rio Subdivision, Calawisan, Lapu-Lapu City,
Philippines, after having been duly sworn to in accordance with law, hereby
depose and state that:
1. I was the Housing Officer of Mandaue City from CY 2000 to 2007;
2. That sometime in the first week of August 2014, I happened to meet a
group of informal setters from the back of Hermag Village, Tabok,
Mandaue City who were waiting for me at the City Hall lobby because
they need help on their problem;
3. Their problem was that they are about to be evicted from the lot they
were occupying at Suicos Compound at the back of Hermag Village,
Tabok, Mandaue City;
4. They were given only up to the end of August 2014 to vacate the lot
they were occupying, afterwhich, a formal Eviction Case will be filed
against them by the lot owner;
5. They opted to vacate the said lot voluntarily on the specified date, but
they have no place to relocate themselves;
6. They begged to the undersigned to help them find a place to relocate
through some available housing options;
7. Out of pity of their predicament, the undersigned was moved to help
them by advising them to form an association the soonest possible
time;
8. The undersigned informed them that his intervention would be done
only on weekends because their request is not formal or official;
9. Thereafter, they were able to elect their officer, formed their
association, and had chosen to name it as Our Lady of Lourdes
Homeowners Association;

The following weekend, it was known from a reliable source that

Mr. Emilio B. Codinera, a developer, was offering some lots for

housing purpose;

Mr. Mauricio D. Pantilgan with some officers/members of their

association went to the office of Mr. Emilio B. Codinera at Cubacub,

Mandaue City to validate the information;
12.

During this visit, Mr. Mauricio D. Pantilgan with some other

officer/members were able to meet personally with Mr. Emilio B.

Condinera who, through his son, led the group to the proposed
housing site at Casili, Consolacion under the name of Teofista Guaca;
13.

Mr. Mauricio D. Pantilgan and some officers/members liked the

place and went back to the office of Mr. Emilio B. Condinera at

Cubacub, Mandaue City where they were informed that the price of
the said lot is P3,000.00 per square meter, with their down payment
requirement of P300,000.00;
14.

The total cost of the lot is P6,000,000.00 payable in direct

purchase through installments within seven (7) years more or less;

15.

Subsequently, on the following weekend within the month of

August 2014; a general meeting of the members of the association was

held at the Our Lady of Lourdes Chapel, back of Hermag Village,
Tabok, Mandaue City to finalize the decision of the association on the
above-mentioned transaction;
16.

The decision of the association was, an overwhelming majority

approving the aforesaid transaction;

Consequently, raising the amount for down payment of the said

housing site commenced;

18.

Subsequently, partial down payments were made to Mr. Emilio B.

Codinera starting on September 2014;

19.

It was observed that the inflow of down payments were very slow

and delayed, hence, the undersigned with some association officers

requested for a grace period from October 31 to December 31, 2014 in
time for the Christmas Bonus that could be received by most of the
association members;

The Developer and the Lot owner were silent on this request, but it

was presumed to have been considered by them;

Unfortunately, I succumbed to Myocardial Infraction (heart attack)

was

subjected

to

heart

operation

(angioplasty) at Perpetual Succuor Hospital, Cebu City;

I was advised by my physician to refrain from engaging on

strenuous activities or even on stress-inciting undertakings, hence I

was no longer updated on the development of this undertaking;
23.

I am executing this affidavit to attest to the veracity of the foregoing

statements and with full knowledge as far as my memory can afford,

and for whatever legal purposes it may serve.
