Whereas,"Sen."Je"Klein"has"introduced"legisla6on"(S6279<2015)"in"Albany"that
would"deny"Second"Amendment"rights"to"New"York"State"residents"on"secret
federal"watch"lists"by"DENYING"rearm"sales"to"ci6zens;"and
Whereas,"this"legisla6on"would"also"require"the"state"police"to"CONFISCATE
rearms"lawfully"owned"by"New"York"State"residents;"and
Whereas,"civil"rights"groups"iden6fy"these"watch"lists"as"so"fraught"with"errors
that"40"percent"of"the"names"are"false"posi6ves"of"people"who"have"no
connec6on"to"terrorism;"and
Whereas,"ci6zens"are"DENIED"due"process"because"they"have"no"way"of"knowing"in"advance"if"they"are"on"the"list
and"no"easy"or"clear"way"to"be"removed"from"the"list;"and
Whereas,"the"Supreme"Court"in"the"Heller"v."D.C."decision"upheld"that"the"Second"Amendment"is"an"individual
civil"right;"and
Whereas,"Sec6on"1"of"the"14th"Amendment"to"the"Cons6tu6on"of"the"United"States"says,"No"State"shall"make"or
enforce"any"law"which"shall"abridge"the"privileges"or"immuni6es"of"ci6zens"of"the"United"States;"nor"shall"any
State"deprive"any"person"of"life,"liberty,"or"property,"without"due"process"of"law;"nor"deny"to"any"person"within"its
jurisdic6on"the"equal"protec6on"of"the"laws.
Therefore,"we"the"undersigned"call"on"our"state"senators"and"assembly"members"to"REJECT"Sen."Je"Kleins
legisla6on,"(S6279);"and"that"Gov."Andrew"Cuomo"ABANDON"any"aaempt"to"obtain"these"secret"and"awed
federal"lists"for"use"by"New"York"State;"and"that"all"other"aaempts"by"lawmakers"to"enact"similar"legisla6on"be
blocked.
