Court decisions are always founded on the truth established through the
presentation of evidence. It is conducted by means of a proper proceeding to consider
and take into its aid the evidence being admitted to prove the case. The variations made
on these rules primarily evolved based on experience which constitutes and shaped
what can be considered as an evidence which can lead to either conviction or acquittal
of a person.
The movie Michael Clayton shows how a single piece of paper, a receipt for that
matter, can lead to a sufficient proof which resolved the problem with so much
probability that reasonable doubts are excluded. Even if the evidence can either be of a
legal or technical character, it is shown how evidence appears to be more of a human
problem than a technical one. Due to the delimitations and variability, evidence cannot
always guarantee the determination of the absolute truth. However, the manner of
presenting it in a given case can definitely resolve a case.
Evidence is the foundation of justice. Proper justice cannot be served if the
courts are not aware of the facts of the case and to know the facts of the case requires
the production of necessary evidence before a competent court. Practically, we often
argue about the fact that past is so irrelevant because it is one thing that we cannot do
anything to change. However, the rules on evidence teaches us how important it is to
embrace the moral obligation to correct a crime which makes us so concerned about
what happened in the past. This was shown in the movie when Arthur died and Mike
took initiative to look at the past and determine if there is something more behind
Arthurs death. We might think, for a fact, that the more we know about the case, the
easier it is for us to make accurate judgments regarding the matter. But sometimes, a
single thing is sufficient to change the game. This can easily be determined by simply
identifying how great the evidentiary weight of the thing presented. A confidential report,
even if it is the only thing presented, can alter and greatly affect the discretion and
judgment of a trial court.
It is important to remember how small details work to unravel bigger issues. This
is what makes the rules on evidence fun. It requires you to dig deeper to every detail of
the case in order to come up with a result which would give you reasonable judgment
based on the evidence examined. It provides links when properly observed. It leads you
to answers when accurately scrutinized. It provides probability of the existence of your
presumptions when precisely connected.
Evidence is obviously more important than the law of evidence itself. It really
does function to achieve the truth and fair result of a given case. Learning it can be very
frustrating. While it is true that the right answers to evidentiary questions can be derived
from the evidence alone, its presentation is so indispensable as it would require you to
work on your internal logic to connect every important detail in the case for the
attainment of proper justice. Evidence is an art. You are required to learn the art of
rhetoric which can be made by establishing a set of arguments based on the evidence
and connect them to arrive to conclusions. The rules might be frustrating yet fun. It is a
matter of playing with your minds to determine what is and what is not.
