AMENDMENTS TO THE MARPOL CONVENTION.

The MARPOL Convention was approved by Colombia through Law 12 of
1981, approving the Convention of 1973, the Protocol of 1978 and five
Annexes.
Although Article 1 of the MARPOL Convention, states 2) Unless
otherwise stated all references to the present Convention comprises
references to the Protocols and the Annexes, it is still necessary to have
clarity in the amendments for each, in other words: a) Amendments to
the Articles of the Convention and the Protocols and b) Amendments to
the rules of the Annexes.
A) Amendments to the Articles of the MARPOL Convention and its
Protocols.
1. Amendments of 1985 (Protocol I) (Notification Protocol) (MEPC.21 (22))
entered into force on April 6 1987.
2. Amendments of 1996 (Protocol I) (Article 1 of the MARPOL) (MEPC.68
(38)) entered into force on January 1 1998.
3. Protocol of 1997 which amends the MARPOL Convention (Annex VI on
prevention of air pollution from ships) (Amendments of 2005 (MEPC.132
(53)), entered into force on November 22 2006 and Amendments of
2008 (MEPC.176(58)), will enter into force on July 1 2010). This Protocol
of 1997 has not yet been approved by Colombia, because this
amendment implies significant changes to MARPOL Convention and
requires and law to engage the commitment to Annex VI.

INTERNATIONAL CONVENTION ON STANDARDS OF TRAINING,


CERTIFICATION AND WATCHKEEPING FOR SEAFARERS.

Initial version, 1978.

Entered into force on April 28 1984. However it has undergone a series


of amendments, as follows:

1991. Regarding the Global Maritime Distress and Safety System


(GMDSS) and performance of tests. These amendments were approved
through resolution MSC 21(59) y entered into force on December 1 1992.

1994. On prescription of special training for tanker personnel, they were


approved through resolution MSC 33 (63) y entered into force on January
1 1996.

1995. A profound revision of the Convention was carried out and a


considerable amendment was made, creating what is known today as
the STCW Code (approved by Resolution II of the Conference). Said
amendments were approved by Resolution I of the Conference of the
Parts of the International Convention on Standards of Training,
Certification and Watchkeeping for Seafarers, summoned by the
Organization in June of 1995.

and evaluation procedures.

Allocation of responsibilities to different parts, including those who


issue licenses and flag states which employ foreigners in order to

The amendment entered into force on February 1 1997.

The date of implementation of the new STCW Code was February 1 2002.

1997. Entered into force on January 1 of 1999. These amendments are


regarding training of personnel for passenger ships and ferries. They
were approved through resolutions MSC. 66(68) and MSC.67 (68) and
entered into force on January 1 1999.
1998. These amendments directed at modifying Part A of the Training
Code are regarding intensified competence for handling and stowage of
cargo particularly with respect to bulk cargoes. They were approved
through resolution MSC.78 (70) and entered into force on January 1
2003.
1998 and 2000. They were approved during the 69th and 72nd
sessions of the Maritime Safety Committee and were enacted by on
January 1 2003. They focus on amending Part B of the Training Code.
Amendments to the STCW Code are aimed at improving minimum
standards of competence of crews, in particular relating to cargo

securing, loading and unloading bulk carriers, since these procedures


have the potential to place undue stresses on the ship's structure. The
amendments concern sections A-II/1 and A-II/2 under "Cargo handling
and stowage at the operational and management levels".
2004. Amendments regarding minimal competence regulations for
managing survival vessels and rescue boats which are not fast rescue
boats. Approved on July 1 2006.
In 2004 they also approved some form amendments through
resolution MSC 156 (78) which entered into force on January 1 2006 to
part A of the Code.
2006. Amendments add new minimum compulsory training and
requirements for certification of people appointed as Ship Security
Officers (SSOs). The amendments to the STCW Convention and parts A
and B of the STCW Code include requirements for extending the
Certificates of Proficiency for Ship Security Officers; the specification for
minimal competency regulations for Ship Security Officers; and
guidelines for training for Ship Security Officers. Other amendments to
part A of the STCW Code add more requirements for launching and
recovering fast rescue boats. The amendments were performed in
response to reports on injuries of crewmembers in numerous accidents
which involve launching and recovering fast rescue boats. Said
amendments entered into force on January 1 2008.
The MSC adopted during the 81st sessions, resolutions 203 and 209
which entered into force July 1 2007 regarding emergency duties, work
safety, medical care and survival.
Colombia adopted the STCW Convention of 1978 by means of Law 35 of
1981. Decree 1597 of 1988 regulates this law in regards to regulations
and requirements for training, certification and professional practice of
seafarers which are part of crews of Colombian Merchant Marine Ships
devoted to maritime transportation, fishing, recreational activities and
others.
All amendments to the STCW Convention are treated as tacit
acceptance of the amendments. Colombia has never stated being in
disagreement with any provision included in any amendment. Therefore
all amendments here enlisted are sure to be fulfilled in Colombia,
including the STCW Code.

All certificates issued by the Colombian Maritime Authority make


reference to the STCW Code of 1995.

The SOLAS Convention was approved in Colombia by Law 8 of 1980,
which approved the Convention of 1974 and the Protocol of 1978.
The Protocol of 1988 is still in internal process of approval and is still not
in force for Colombia, and from its adoption it has had nine tacit and one
express amendment.

AMENDMENTS TO COLREG CONVENTION.

The COLREG convention was approved by Colombia by means of Law 13
of 1981.
According to Article VI of the Convention all amendment to the rules will
enter into force on the date determined by the general assembly at the
moment of adoption, unless more than a third of the Contracting parties
notify the Organization that they refuse such amendment.

AMENDMENTS TO THE TONNAGE CONVENTION

Colombia approved it by means of Law 5 of 1974.
According to Article 18 del Convention an amendment will enter into
force twelve months after the date of its acceptance by all Contracting
Governments unless an earlier date is agreed upon. A Contracting
Government which does not communicate its acceptance or rejection of
the amendment to the Organization within twenty-four months of its first
communication by the latter shall be deemed to have accepted the
amendment.
It has no amendments.

AMENDMENTS TO THE LOAD LINE CONVENTION OF 1966


(October of 2009)
Colombia adhered to the Convention by means of Law 3 of 1987.
Generally Article 29 determines that if a Contracting Government does
not notify the organization its approval or non-approval on the
amendment with the terms established by the amendment it will be
considered that is has approved the amendment.
The Convention in its original version of 1966 has endured 6
amendments which have not entered into force, because the majority
were texts of the Protocol of 1988 which this Convention gathered. The
Protocol which is pending internal adoption, has been amended 3 times.
