Councilman Kalb came to our Happy Hour last night and talked to us about the shooting at
Bottom of the 9th on New Years Eve.
OPD, via Nixle, sent out pictures of the shooter. I forgot to ask CM Kalb for a blown of
picture of the second photo. Santa Fe CAN wants to post his picture on telephone poles. Can
you get a blown up picture from OPD via email and email to me. Please advise. It would be
much appreciated.

The message below was sent a week ago from PANIL. I hope it was included in your packets
with the staff report (I have had trouble downloading the report to confirm this). I wanted to
update you on the neighborhood sentiment.
Approximately 120 neighbors attended the regular monthly meeeting of PANIL last
Wednesday, which was focused on problems at the Egbert Sous bar on the corner of
MacArthur and Piedmont Avenue. Neighbors were upset about the bar patrons' behavior. But
when a neighbor also involved in this appeal mentioned the efforts to make the Kaiser
landscaped area publicly accessible during the day, I was interested to see that broad and
enthusiastic applause broke out throughout the room.
I can report with confidence that even those neighbors upset about the bar's *night time*
problems support the *daytime* public access to this garden.
Please support this appeal, and make this landscaped area publicly accessible.

Oakland City Planning Commissioners:
PANIL has been late in writing about this case due to some ongoing family issues of this writer.
PANIL supports the appeal of Sarah Cohen et al asking to have the landscaped corner of
Piedmont Avenue and MacArthur Blvd open to the public during daylight hours.

During the planning phase for the hospital replacement and medical center expansion project,
PANIL neighbors participating in the process shared the appellants' understanding that the
landscaped area would be accessible--at least to Kaiser staff and patients, and by implication
to the public.
The city was making every effort to keep the project on schedule during the approvals phase,
and neighbors were clear with the city and Kaiser that while neighbors needed certain
mitigations, they were not opposing or trying to slow the project, and were working with all
parties in good faith. The conditions of approval were literally being substantively revised
during the City Council meeting where they were approved, and details were nearly
impossible to track. No one--not the contract case planner, nor city staff, nor electeds--ever
told us that any details from the Master Plan approved by City Council that were not also
enshrined in the Conditions of Approval would not be honored. As we all use lower Piedmont
Ave frequently, we share the disappointment of Richmond Blvd. neighbors that Kaiser is
evoking that legal technicality to also avoid landscaping Piedmont Ave to the corner with
Broadway as approved in the Master Plan, as well as other Master Plan details.
During the hearings process, Kaiser unexpectedly announced that with the economic
downturn just starting, reductions in corporate employee benefits meant that they would not
need to build the medical offices on the subject corner as soon as expected. Faced with an
indefinite period of a vacant lot, PANIL, as part of KENIC (Kaiser Expansion Neighborhood
Impact Coalition), scrambled to make sure that something was done to keep that corner
activated as intended in the construction plans. Our worst fears were of a long-term staging
area (Phase 3 construction is still to come) or of a surface parking lot. A landscaped area for
use of Kaiser staff, Kaiser members, and neighbors (many of whom are also Kaiser members)
seemed the most effective activation and most visually appealing for passers-by. A PANIL
steering committee member who worked at Children's Hospital has told us that "a hospital is
a very stressful environment, and [she] used to be desperate to get outside on a break to
clear [her] head."
The problems with Egbert Sous's bar are at night, mostly after 10:00 p.m. PANIL is working
with neighbors and the city to end these problems, but in the meantime, we do not believe
that these problems should be used as an excuse to keep the landscaped area closed during
the daytime. You are also in possession of a letter from a prospective Piedmont Avenue
business which hired a private investigator to look at the problems with the bar. That letter is
emphatically clear that the investigator's report was not intended to be used by other entities
for any purpose other than that for which it was commissioned. The letter concludes, "The
company that I represent does not wish our investigative reports to be used in any way other
than what was intended. The Kaiser representative, in an underhanded way, used our
documentation of night time crime issues to state that these same conditions exist during the

day time. This is simply not the case. No safety or criminal activities have been noted at the
bar or in the surrounding areas during the day time."

There are a number of ways that design can be used as part of crime prevention strategies.

PANIL sincerely hopes that Kaiser will discuss this issue in a more problem-solving manner
than has occurred to date. We believe that a solution is possible for the greater good of the
community, many members of which are also part of the Kaiser community, as staff and
patient/members living in the area. If neighbors have been unable to schedule a meeting with
Kaiser prior to this public hearing, we would encourage you to hold the hearing open and ask
Kaiser to do so.

Council Member,
I'll keep this short as I know you are busy running the city. Just writing as another Oaklander
who is in favor of doing the strictest possible punishment or probation for the clubs that
operate downtown that seem to always attract a violent element. I frequent the area around all
of these clubs and was actually at one of them the night of a shooting many months ago at the
New Karibean City. I was shocked to hear that someone was shot a mere half block from
where I was at hours earlier.
This needs to stop. Whatever you ended up doing to Egbert Souses should be what you do to
these clubs. Tough love for Venue, New Karibean City, Bella Ultra Lounge and Leige- shut
em down.

plan to share finger food and cookies and then sing some carols, a folk

Concerned citizen - Egbert Souse"s Bar - bad for our neighborhood

Myself, along with many resident's living around MacArthur Blvd and Piedmont Ave. have
been extremely concerned about the danger thatEgbert Souse's bar has created for our
neighborhood.
We have heard aboutdrugs, prostitution, street robberies and gunshots which have resulted in at least
one person's life. Oakland is rough enough, do the residents of this lovely area not have the right to
stand up to this kind of distasteful business going on here?

I believeEgbert Souse's should be shut down and if nothing else, as soon as possible, forced
to close their doors at DECENT neighborhood hours. See their hours of operation below, it is
ridiculous since it is right near Kaiser Hospital, a newly renovated apartment building and
many homes in the neighborhood. If you allow places like this to flourish, then what are
people to think about this wonderful city?

Crime events in Beat 9X (before your meeting)

In advance of the meeting at Tech, I wanted to give you a crime list for our neighborhood--just
the things I know about....I have to say, I do not remember feeling this insecure even during
the crack epidemic, perhaps because there was little shooting in our neighborhood.
Beat 9X (Piedmont Avenue neighborhood) current events:
Friday Nov. 29 at about 4:00 pm, there was a robbery at a house under renovation at the top
of Montell St at the corner of Robley Terrace, a one-lane alley (the other end of the block
from the old Blockbuster on Piedmont Ave), within sight of my back porch. Five construction
workers were held at gunpoint, and robbed of their phones and wallets. They had just been
paid for the week in cash; one man reportedly lost $700, others slightly less. Victims got a
license number for a getaway vehicle (red Volvo). I just talked to a couple of the guys (working
today, too), and it is not clear that the guy who hired them (who is flipping the house) will
replace their pay, even though it happened on the job site. Some of the men were afraid to
give their names or cooperate with the police.
That project is within sight of another house under renovation on Fairmount Ave where a job
site armed robbery also happened about a month ago; the back property line for that house is
on Robley Terrace. I don't know that the Fairmount Ave robbery netted pay, I believe it was
just whatever cash the workers were carrying in their wallets that day, in addition to their
phones.
A third construction site on John St. was also robbed a few weeks ago.
In addition, there have been at least 3 street robberies on my block in the last 6 weeks, two
involving weapons, and one (armed) around the corner on Fairmount. They have occurred
anywhere from 6:30 pm (walking home from the grocery store) to 1:00 a.m. (two college-age
kids coming home from a concert).
And, of course, there were the two shootings with injuries stemming from Egbert Sous's bar
on Piedmont and MacArthur. One was the last weekend in Oct., the other the first weekend
in Nov. Both involved fights that started inside the bar; the patrons involved were told to
leave the bar, and the mayhem played out in the street instead, as a result.
The other morning, a friend on Howe St had his house broken into while he was sleeping late
by a guy with a screwdriver who tore up the door to release the deadbolt. The police arrived
in time to find the perp hiding in the shrubbery and gave chase, but he got away.

Possibly the same day, a young white couple with a crowbar were arrested in a stolen vehicle
taken from another neighbor on a nearby street. The victim asked for my advise, and wrote,
"They have both been arrested. She has a hearing on Monday [Dec. 2] and is being charged
with providing false information to police. He has a hearing on 12/20 and is being charged
with stealing my car. These charges are only due to the fact that the Sheriff's department
recovered my car with the perps in it. OPD so far has done nothing to follow-up and attach
additional charges (like breaking into my house, stealing my things, and taking my keys that
made stealing my car quite simple)." Our area captain has responded to the victim's e-mails in
spite of being away on vacation for the week, but it's clear that OPD's ability to follow up on
anything that does not involve blood running is low. And the recent article in the Express
about the backlog of unprocessed evidence for murders is very concerning.
On Piedmont Avenue itself, two stores in the last week have had objects thrown through the
window for burglaries. Lireille (hand made jewelry, 3980 Piedmont) had a large rock thrown
through their window last week. They state that lost $30,000 worth of wedding rings, gold
and diamonds. When the co-owner came in response to a call from a jogger who saw it in the
early morning hours, they found display stands and a few rings down Piedmont Ave between
Yosemite and MacArthur. This seems like a very low level of sophistication if the burglar was
on foot...This morning, I saw that there was plywood over the window at Anatoly's Tailoring
and Men's Wear (3864 Piedmont Ave) was covered with plywood, and a brick was visible
inside. I don't know what the loss is.

Dear Capt. Toribio, Mr. Rose, Mr. Ferran, and Councilmember Kalb,
A message addressed to multiple people is unconventional, but we are very concerned that
maximum coordination be used in this issue.
Thank you to all of you for your contributions to the November 13 PANIL meeting regarding
problems at Egbert's bar.
I received the message below from a neighbor who attended Wednesday evening's meeting. I
thought the comments were useful, and agree with the suggestions for conditions to be
included. I would also urge that at least two of the conditions be included from the 2008 ABC
document that Aubrey Rose had: that the bar not serve alcohol until 11:00 a.m., and that the
bar not allow patrons to loiter on the sidewalk or in doorways of adjacent buildings. That will
give us both ABC and city routes for revocation. I am shocked to learn of the existence of this
document and do not understand how police were not made aware of it, and how neighbors
put the bar on their PSO's list of priorities almost monthly for years and still did not know of it.
We could have shut them down ages ago through ABC based on violations of these
conditions.
Like the writer below, I am still unclear how this process proceeds if the Egbert's owners are in
compliance with conditions and problems do not abate. Please clarify. (Clearly, the specific
conditions will be critical.)
Please also provide us a complete set of the applicable statutory and regulatory provisions so
that we can advocate based on our best understanding of what the law allows. I can pick up a
hard copy at City Hall or an electronic copy can be e-mailed.

[The neighbor's comments:]
My problem with the "agreement in lieu of hearing" approach was partially addressed by
Council member Kalb when he informed the owners' attorney that he should not expect the
City to negotiate the conditions. Although I agree entirely that the City should load up the
agreement with every condition under the sun to make it as unpleasant and unprofitable for
them to stay in business, what if they do not agree? What is next? An adversarial hearing?
When?
As for the conditions, the City should be forced to take a strong "take no prisoners" approach,

laying down the law, giving the owners no choice, and proceeding promptly to the
enforcement hearing if agreement is not reached immediately.
I'd like to recommend that the City impose as a condition the installation of a metal detection
device at the door, the hiring of a uniformed and physically fit security detail that meets
standards of safety and security as prescribed by OPD; the installation of state-of-the-art video
surveillance cameras. Also, the agreement should specify that a single breach of any of the
conditions is sufficient to elevate the matter to the 2nd enforcement hearing stage. Also, what
about imposing a trigger that one verified gun-related incident involving a bar patron
constitutes a breach of the agreement sufficient to elevate the matter to the 2nd hearing
state.
Finally, if OPD hasn't done this already, it needs to install shot-spotter at the intersection to
capture every shot that is fired. I heard that shot-spotter has been known to capture other
helpful sounds, like names that are shouted out during a crime, which has assisted OPD in the
past in solving specific crimes.
Back to the City Attorney. You asked the question, what if the owners are in full compliance
with the agreement and the problems don't abate. The answer was that it would go to the
2nd hearing. That makes no sense. Earlier he said that the only way to get to a 2nd hearing is
if there is a breach of the agreement. What is it?

I should add that I feel great urgency to have these permits revoked before the owners sell the
bar to another entity and we have to start all over documenting the problems under the new
owner while the Yoos bank their profits. We have been down this road before, and had hoped
that Kevin Yoo would be our savior from the previous owner's operations, but the problems
got worse.

of you to resolve these issues permanently.

My name is Edward Yoo my family owns the bar, Egbert Souses.

I was on the community website Next Door and saw there was a campaign being launched against
us in hopes to close us down. As you probably already know, some members of the Piedmont
Avenue Neighborhood Improvement League (PANIL) have been broadcasting your contact
information and encouraging folks to send you (along with other city officials) complaints about our
bar.

For the past week, Ive been making a genuine attempt to reach out to them and to let everyone
know my doors are open. However, they dont seem very willing to discuss possible
strategies/solutions with us and are 100% intent on having us closed (or at least from what Im
reading on these message boards).

I feel that is a little unfair, which is why I wanted to reach out to you. Given that you are
corresponding with various stakeholders within the neighborhood, can you please let them know
that we would very much like to be included in the dialogue? Also, feel free to pass on our contact

personally havenot yet had any serious run-ins with these people, but it's unnerving every
time I have to do so. I've often been heckled or had men make "distasteful" comments to me. I
certainly remove all my jewelry before walking by and hold on tight to my handbag! (Yes, I
could choose to get off one bus stop further up MacArthur @ Fairmount, but since my
female neighbor was recently mugged and assaulted TWICEnear Fairmount
and Yosemite, I don't consider that next bus stop a better alternative!)

Here's what I have observed and personally witnessed at/around Egbert Souse's:
DAYand NIGHT,there are constantlyrowdy, trashy people gathered outside of Egbert
Souse's -- especially large numbers of people on weekend nights (Thursdaythru
Sunday, esp. Friday & Saturday). Those people are oftenloitering all along the
Piedmont Avenue blockstretching betweenMacArthur & Yosemite. They often are
standing and sitting on the sidewalk, in & around the parked cars and planter boxesin
front of the other businesses on that block, like the China Garlic Restaurant.They're
smoking cigarettes and marijuana, drinking, yelling, cursing, loitering,etc. I often see
many of this area's knownhomeless and/or trouble-makers who seem to have made
Egbert Souse's their "home".(One rather scary guyin particular drinksand/or hangs out
atSouse's on a regular basis and then harasses and/or vandalizes the residences on our
block.Ihave called OPD about him previously when he's trespassed and made trouble
on our property.) I've spoken to the owner of China Garlic restaurant and she has told
me that these loiterers become indignant and defensive when she asks them not to block
the entrance to her restaurant. I think she's brave for even speaking to them.
While I've noticed that a small number ofSouse'svisitorspark in the outdoor pay
parking lot at the corner of Piedmont/Yosemite, MANYprefer free street
parkingonour
block, sometimes blockingmy driveway. I have
called OPD toreport itin the past.Over time, more and more of these people are
parking up and down our Yosemite block and the noise and rowdiness has escalated
DRAMATICALLY in the last year. I am a night owl and am often up late and I
heargroups of people walking to their multiple cars and are screaming and swearing at
each other -- sometimes from opposite sides of the street -- as late as 2:30AM EVERY
WEEKEND.Many are verbally fighting so loudly and violently that I'vefeared that
gunfire might break out, so Irun from my front living room that faces the street to the
back of my apartment, just in case someone fires a shot. Often, I've heard males and
females verbally and abusivelyfighting and swearing at the tops of their lungs with
each other up and down the block.Many also cruise the block with the super-loud,
mega-bass music blasting from their cars that literally vibrates my windows and
cabinets in my apartment. SO ANNOYING.
Souse's also attracts the worst kind of BIKERS...Iconstantly see and hearthe leatherwearing cyclists on the LOUD big Harley-type "hog" cycles. Although they don't park
on
(they park in thetiny lot behind Egbert Souse's), the bikers often like
totear up & down our block, in spite of the so-called speed bumps. The motorcycle
noise is deafening (especially at night) and, of course, they also set off multiple parked
car alarms causing even more noise in the evening/night. They're so loud, I can even
hear them out on MacArthur when they're starting up their bikes and gotearing out of
the Souse's back lot.
While I don't know for sure, I suspect that many of these unsavorypeople aren't

evenactual "patrons" of Egbert Souse's but are attracted by the "type" of people,
activities and substances available at Souse's and come into the neighborhood just
tohang out. This makes me quite fearful when I am returning home alonein the
evening/nightand having to park my Zipcar/City Car Share cars in the open parking lot
on the same block. MANY times, I've walked by cars parked along that block, in that
parking lot, and on my
block and smelled all the marijuana smoke
wafting from the cars and vans.(Side crime note: I was told that the owner ofthe
Indian Curry restaurant on Piedmont @ Yosemite was just assaulted & robbed at
gunpoint while sitting in his car in this same parking lot a few weeks ago. Honestly,
theperpetrator probably just blended right in with the appearance and demeanor of the
other Egbert Souse'scrowd!)
Speaking of substance availability, I have personally seen what I figured to be at least
2substancetransactionshappening in the middle of the day outside of Egbert Souse's
while waiting for the #57 AC bus that stops directly in front of the bar. Unfortunately,
it happens so fast and/or I've had to quickly board my arrivingbus, Idid not call
OPDabout it.

For me, not only do all these issues create anger, frustration, inconvenienceand disgust, but
the presence of Egbert Souse's and the genre of "visitors" it attracts instills fear. Fear, every
time I have to walk or park by them. Fear, that I might be harassed or assaulted or robbed.
Fear, that I might walk by at the wrong momentand witness something I don't want to. Fear,
that if I call OPD to have a car towed from my driveway, the angry (likely drunk)driver will
return to find his/her car gone, know that it was me who called OPD,and then do damage to
either me or my building to retaliate. I hate living like this any longer!

The Bottom Line:It is time to ridour neighborhoodof Egbert Souse's and close it down
permanently. Egbert Souse's is a magnet for everything residents of this Piedmont Avenue
community do NOT want.While this area is home toa large number ofsmall businessesand
a plethora of eating and drinking establishments, Egbert Souse's clearly sticks out as the
ONLY one of its kindon the Avenuethat is continually bringing and perpetuating unsavory,
troublesome, noisy and illegal elements toourneighborhood and the activity is escalating..In
my opinion, whether theperpetratorsare actually patronsof Egbert Souse's is
irrelevant.Souse'sis the attractor andit intentionally provides the environment for
perpetuating these issues without regard for the surrounding community.Aside fromthe tax
revenue that I'm sure the City loves, as a small business in this community, Egbert Souse'shas
NOcontributing valueandNOpositive aspectswhatsoever to thiscommunity.No other
Piedmont Avenue establishment invites these types ofproblems into this neighborhood.I
know that arepresentative of PANIL and one of our Yosemite Ave residents went to speak
with the owner of Egbert Souse'srecentlybut clearly, nopositive results came from it that I
can see.I am not a stranger to living in areas with high crime levels (I'm a native San
Franciscan) and I am not nave to the fact that crime is up significantly all over our fair
Oakland and the Bay Area as a whole. But why invite and perpetuate it by allowing
businesses like Egbert Souse's to provide a home and a hangoutfor it?I'm sure that Kaiser
Permanente will also appreciate the elimination of an
alcohol/drug/motorcycle/homeless/rowdy crowd encampment situated outside the front doors
to their lovely and expensive new medical center opening soon! I plan on writing to Kaiser
for their support of thisissue as well.)

Oakland, CA 94611. It is a 4 unit residential building. I
have a business license and have elected to invest in Oakland. I have lived in San Francisco and
Piedmont. I currently reside in Berkeley, CA. My tenants have resided in the neighborhood from 1
to 3 years. My tenants have voiced their concerns over the increase in criminal activities in the
neighborhood. They believe the guests frequenting a local bar, Egbert Souses Bar located at 3758
Piedmont Ave (MacArthur) are disturbing their quality of enjoyment while at home. 2 tenants have
moved within the last 2 years due to the crime and noise in the neighborhood. This bar attracts a
local group of individuals engaging in loitering, drinking and engaging in speaking loudly and
exchanging obscene language on a regular basis.

The bar does not fit in with the neighborhood. There are currently 3 bars listed on Piedmont Avenue.
One is Kona Club (Lounge) at 4401 Piedmont Ave., Catos Ale House (drinks and food) at 3891
Piedmont Avenue and Egbert Souse (dive bar) at 3758 Piedmont Ave., Oakland, CA. In half a mile,
there are 3 drinking establishments.

We are hoping the Egbert Souse business closed its doors. Numerous calls have been made to the
police department with very little change.

Please keep me posted on future changes if any.

As someone who knows Tony Gulisano, the creator of Chow, and
knows what such a restaurant could bring to the corner of MacArthur and
Piedmont Avenue, I am mad that the backers are pulling out because of
this corner, which has been a carbuncle for over a decade because of
Egbert Souse's Bar. I would hope you would use whatever effort you can
to encourage the police to clean up that bar, by either removing their
licence or severely curtailing the criminal activity that has been
going on there. It makes it miserable and progressively more dangerous
to walk through that neighborhood.

consecutive Friday nights in altercations stemming from Egbert Souse's
establishment at Piedmont Avenue and MacArthur Boulevard. I believe you
are also aware of our efforts at Chow Restaurant Group to assist the
Oakland Police Department (OPD) and the Piedmont Avenue Neighborhood
Improvement League in remedying EgbertSouse's negative impact on the
community.Chow has been working for about six months in developing a
new restaurant on Piedmont Avenue near MacArthur Boulevard and also
near Egbert Souse's.Part of our work included hiring a private
investigator to perform undercover surveillance both inside and outside
Egbert Souse's to determine how serious a problem exists because of
this establishment. This surveillance covered four different nights.
The conclusion we reached is that it is a very serious problem. Our
investigative reports were provided to Captain Anthony Toribio of
OPD.Please be advised that we cannot go forward on a project that will
put our employees or customers in harms way. A final decision has to be
made by us before purchasing the property within the next five months.
While we commend the efforts of Captain Anthony Toribio, we are not
satisfied that the City of Oakland is pulling its resources together to
rid the City once and for all of Egbert Souse's.Your City of Oakland
web site lists the following as public nuisances:*What is a public
nuisance?**A public nuisance is any criminal activity that violates
health or safety, or that interferes with the comfortable enjoyment of
life. Types of activities include (but are not limited to):**Inadequate
sanitation *Structural and electrical hazards Abandoned or deteriorated
property*Criminal activity ** Excessive noise *Litter
Graffiti*Possession or drinking of open containers of alcohol in
public*Poor weather protection*Public drunkenness** Fire Hazards
*Zoning violations Inadequate fire protection*Documented drug dealing**
Loitering *Abandoned vehicles Weeds & trash in yard*I would like to
comment on the bolded items and mention a few more that should be on
this list as it relates to Egbert Souse's.**Inadequate sanitation

across the street on Piedmont Avenue.*Criminal activity *Suspected
gambling upstairs at Egbert Souse's, suspected prostitution in and

early morning arguments outsideEgbert Souse's, revving of motorcycle
engines, loud music from parked and passing vehicles and gun
fire.*Possession or drinking of open containers of alcohol in
public*Documented drinking in front of Egbert Souse's.*Public
drunkenness*Documented public drunkenness by patrons of Egbert
Souse's.*Fire Hazards *The stated capacity of the premises is 84
people. Our undercover investigator reported that the premises are at
times packed with people and difficult to count. After midnight on
September 29, 2013, our investigator reported "the club is packed, wall
to wall people, body to body".*Inadequate fire protection*There is no
way to protect the public when severe overcrowding condition sexist
within a small building, particularly when many of the crowd are
consuming alcohol and/or recreational drugs.*Documented drug
dealing*Documented drug dealing around the bar. Documented drug usage
both inside and outside the bar.*Loitering*Documented excessive
loitering often times with the owner of the bar present particularly
between 10 p.m. at night and midnight to 2 a.m. in the morning. The
crowd had to be ordered to disburse by OPD at 1:40 a.m. on September
29, 2013 which was observed by our investigator.*Smoking instead public

bars and restaurants and within 25 feet of doorways and


windows*Documented smoking both inside and within twenty-five feet of
the doorway with owner present. Our investigator reports "The bar
allows cigarette smoking, and the air was consumed by it".*Carrying of
weapons and repeated gunfire, shootings and robberies*Documented
gunfire and actual shootings on October 24, 2013 and November 2, 2013.
Shootings and robberies were reported in the press and OPDresponded to
all shootings and gunfire. Three gun shots were fired outsideEgbert
Souse's at 1:42 a.m. on September 7, 2013 during our undercover
surveillance. There were five nights of gunfire during the last five
months.*Creating an environment conducive to violence*Patrons get high
on drugs or alcohol, get into arguments and are asked to leave by
bouncers so that arguments can continue outside of the bar. This led to
the critical condition of a victim shot on November 2, 2013.*If our
documentation is not adequate enough, please inform us as to what
standard we need to achieve to rid the neighborhood of Egbert
Souse's.*We are sensitive to the fact that there are many problem areas
within the City of Oakland and that law enforcement is constrained
because of budgetary reasons causing a reported 24% shortfall in needed
personnel.But when a problem has as much attention as Egbert Souse's
and there are so many cited reasons of public nuisance as well as
earlier promises from thebar's owner to fix such issues, the momentum
is there for final action. IfEgbert Souse's is closed, OPD will not be
required to spend its valuable resources in this area.In conclusion, if
Oakland is really serious in wanting to attract new business in this
particular situation, it will have to deal with EgbertSouse's. Chow
will bring significant new employment and sales tax revenue to the City
in it first Oakland location. But we cannot operate in the *Wild West*
with victims being chased and shot with guns at or near our
establishment. All else is going well with our project except for this
dangerous situation created by one small bar. We believe we made
valuable contribution by hiring a private investigator and turning over
those reports of four different nights surveillance to OPD. Now it is
time for the City to use them.We are spending considerable financial
resources as well as time in architectural design, engineering,
surveying, utility studies, and so on.We have received wonderful
support from the Oakland Business Assistance Center and Oakland
Economic & Workforce Development Group. However if Oakland cannot
resolve this matter for whatever reason,we wish to be informed as soon
as possible so that we could stop our development efforts. Respectfully

years. I have worked to improve the performance of failing businesses front
of the house, back of the house and in bars and taverns.
On November 5, 2013, I called a meeting with the owner, Mr. Keun Bae Yoo and
his son (manager) to discuss ways he could improve the performance of his bar
and ameliorate some of the problems he was having with neighborhood
complaints. I invited Jennifer Sena (Police Officer) of the Alcohol Beverage
Action Team.
We both outlined several changes that we thought would make this a
neighborhood friendly bar. As a result he changed the play list on the
jukebox to more mellow music (mainly R and B); at my suggestion he changed
the size of his glassware so his portions of alcohol were reduced; he also
cleared the house of all troublemakers (86ed them) permanently. He has done
an excellent job in this respect to be a good neighbor and responsible bar
owner.
The incident that prompted this hearing involved a woman that was being
attacked outside of Egberts. The police were called (sirens blazing) and an
incident report was filed. The actions of the womans attacker prompted a
call to police, just more fodder for to a neighborhood that has been gunning
for Egberts for years now.
I highly recommend that Mr. Yoo forges a close alliance with the Alcohol
Beverage Action Team, and that you give Egberts another chance.

Hello Dan,
Thank you for communicating with us about Dannette's transition. I have to say I and many of
my neighbors have become very frustrated by the lack of response from your office in the
wake of the recent shootings in North Oakland. In the week after the shooting on January
15th, I and seven other neighbors sent you emails asking for a response and action taken
against Uptown Market, the location of the shooting. We did not hear any response from
your office.
On January 21st, I left a voicemail with Dannette asking for a response. I later followed up
with an email. On the 23rd, I did receive a call back from Dannette, who had confused our
case with another store and didn't even know which location I wanted to discuss with her.
She suggested I sit back and let your office take care of it. She said she would talk with her
colleague Olga who worked with Egbert Souze's on Piedmont Ave and would get back to me.
On January 27th, we sent you and the city attorney a letter with 62 neighbor signatures asking
for action taken against Uptown Market. We did not hear a response.
On February 3rd, I left Dannette a voicemail asking if she had the information that she had
said she would look into from our previous conversation. I also asked her to come to our next
NCPC meeting. I have yet to hear a response.
Last night was the first NCPC meeting since the shooting and we did not have any
representation from your office.
I understand that the next few months will be a time of transition, but as your constituents,
what are we to expect from you in terms of communication? Our meeting last night had a
palpable feeling of anger and frustration. We feel like we are without support. We would
like to see you, not a representative at our next NCPC meeting, March 11th at 7pm at the
CHORI library. We would like a response by the end of the week on your position on this
matter and what your office can offer to help solve this issue. I look forward to hearing a
response.

The monthly Santa Fe CAN General Meeting (held on the 1st Tuesday of each month ) is

City Attorney Barbara Parker and Piedmont Avenue bar reach agreement to prevent
crime & neighborhood nuisances

OAKLAND, CA The City Attorney and the Oakland Police Department have reached an agreement with the owners of
a Piedmont Avenue bar to address complaints about noise, alleged drug activity and other crimes near the bar.

Last year, the Police Department responded to numerous complaints of nuisance activity and violence associated with
Egbert Souse's bar including three separate shootings in May, October and November of 2013 near the business.

Egbert Souse's owners met with the City Attorney and police officials in November 2013 after the most recent
shooting on the corner of Piedmont Avenue and MacArthur Boulevard which involved patrons of the bar.

The agreement imposes strict operating conditions on the bar. Owners have agreed to hire licensed and uniformed
security guards, prevent loitering outside the business and close no later than midnight every day of the week. In
addition, the agreement requires that owners promptly remove graffiti from the building and make sure music is not
audible outside the premises. The bar also agreed to permanently ban anybody caught using drugs, fighting or
possessing a weapon.

City Attorney Parker thanked Oakland police for promptly responding to numerous emergency calls at the bar and for
helping to secure stricter operating conditions. She also recognized Egbert Souse's owners for working with the City
to address neighborhood concerns about the business.

Last year, Oakland spent a disproportionate amount of police resources investigating and responding to crime
associated with this business, Parker said. Neighbors, police, my Office and the owners all recognized that violence
and other problems at this bar constituted a public nuisance and had to stop.

The City and the bar reached agreement in late January and it became effective immediately. Violation of any of the
conditions could result in revocation of the bars Deemed Approved status, which allows it to operate and sell
alcohol.

Dear All,
I know I promised a timeline prior to this evening's meeting, but I've failed.
I forgot that I had a computer crash and didn't realize how many files I lost.
I've been trying to recreate from the paper docs I saved, however, it's very slow going.
Here's what I can say:
I first noticed that ABC had posted a transfer notice to Berkeley ESL Exchange Inc in late October 2008.
At that time, when I checked with the ABC Board, it showed the ESL application as "pending." I believe it
went through in 2009.
Prior to the change in ownership we had received complaints from residents who live on or near Kempton
(across MacArthur) about the noise patrons were making with their motorcycles. That continued after the
ownership change until our PSO became involved and then some of the complaints stopped and the
number of bikers seemed to diminish..
There were also complaints about noise, fights, smoking in violation of the 25 foot rule, drinking after
hours, and sex in vehicles at the parking lot at Yosemite and Piedmont Avenue.
And there were complaints about some of those activities taking place at the gas station on Piedmont
Avenue directly across from the bar.
Neighbors on Moss, Leighton, Montell, Yosemite, and Rio Vista complained about noise, fights, the
smoking, drinking after hours, and the empty bottles they find in their front yards.
I acknowledge that the mentioned areas are "outside" of Egbert's, however, the activities were and are
being committed by patrons of Egbert's.
Egbert's has appeared on Beat 9X's "priority" list several times.
It was a major factor in the recent BEVMO hearings.
Every PSO we've had for the last several years has been involved with problems at Egbert's.
Now it's escalated again. Yes, some of the problems at the parking lot have lessened. Yes, Douglas
Parking is now obtaining stay away orders and closing the lot in the evening. However, there are still
patrons lined up outside the establishment smoking, we still hear complaints about bottles in resident's
front yards, fights in various parts of the neighborhood, noise, and other activities that diminish resident's
quality of life.
And now we have a crowd who think it's OK to settle their differences with guns!
Our merchants are just coming out of a several year recession. This bar is located at the beginning of our
business district. Our business district contributes a healthy chunk to the city in tax receipts. Does
anyone think shoppers are going to want to come to a business district where they might get shot? Yes, I
realize the shootings have taken place late in the evening or early morning, but the bar is open from (I
believe) 10am to 2am. I don't think anyone can guarantee that the bar is any safer during the day than in
the evening or early morning hours. I wish I'd kept track of the number of people who have contacted me

asking about the "shootings on Piedmont Avenue."

I am writing you with a sincere plea toPLEASE assist usin ridding the Piedmont Avenue neighborhood of the
plague called Egbert Souse's bar, located at the corner of Piedmont and MacArthur.

I am a resident on Yosemite Avenue, just off Piedmont Avenue, and around the corner from theestablishment,
Egbert Souse's bar. Itypically am not an "activist" nor do I write my political representatives about issues or
concerns very often. However, I am so fed up and fearful about the continually escalating affect of Egbert Souse's
on this neighborhood -- and especially on our
block -- that I feel compelled to write to you. I
have lived on
for 7 years after moving over to Oakland from San Francisco. When I moved in to
thislovely neighborhood, I was not aware of what a singularlyhorrible element Egbert Souse's is in this area!! Had
I known the kind of people, crime, noise, vehicle traffic/parking issues, and rowdiness it attracts and delivers tothis
neighborhood, I likely would not have rented here. Evenneighborhood locals residing several blocks away refer to
this as the "bad end" of Piedmont Avenue because of what Egbert Souse's brings.

I am a single, middle-aged, Asian-Americanwoman living alone in a rental unit at
working professional that commutes to my job at a San Francisco law firm each day. I choose not to own a car any
longer andinstead choose to utilize the more environmentally caring option of car-sharing when I need to drive(I
am a member of both Zipcar and City Car Share, both of which have car pods located in the open parking lot on the
corner of Piedmont & Yosemite) and I utilize public transportation to get to work every day. I'm telling you all this
about myself because it means is that I am ALWAYS walking alone in this neighborhood as a way of life andsee
and experience thenegative, escalating, and potentially dangerouseffects of what Egbert Souse's brings to this
immediate area firsthand. It also means that, being on foot so much, I see and witness a lot more ateye levelthan
perhaps some of the other residents who drive these blocks in their vehicles. I often take the #57 AC Transit bus
from the MacArthur BART station (often after dark because of my work hours) and disembark at the bus stop on

MacArthurBlvdacross the street from Egbert Souse's and have to walk through the groups of unruly, drunk, loud,
trashymenand womengathered outsidesurrounding the bar and the block in order to get home.Thankfully, I
personally havenot yet had any serious run-ins with these people, but it's unnerving every time I have to do so. I've
often been heckled or had men make "distasteful" comments to me. I certainly remove all my jewelry before
walking by and hold on tight to my handbag! (Yes, I could choose to get off one bus stop further up MacArthur @
Fairmount, but since my
female neighbor was recently mugged and assaulted TWICEnear
Fairmount and Yosemite, I don't consider that next bus stop a better alternative!)

Here's what I have observed and personally witnessed at/around Egbert Souse's:
DAYand NIGHT,there are constantlyrowdy, trashy people gathered outside of Egbert Souse's -- especially
large numbers of people on weekend nights (Thursdaythru Sunday, esp. Friday & Saturday). Those people
are oftenloitering all along the Piedmont Avenue blockstretching betweenMacArthur & Yosemite. They
often are standing and sitting on the sidewalk, in & around the parked cars and planter boxesin front of the
other businesses on that block, like the China Garlic Restaurant.They're smoking cigarettes and marijuana,
drinking, yelling, cursing, loitering,etc. I often see many of this area's knownhomeless and/or troublemakers who seem to have made Egbert Souse's their "home".(One rather scary guyin particular
drinksand/or hangs out atSouse's on a regular basis and then harasses and/or vandalizes the residences on
our block.Ihave called OPD about him previously when he's trespassed and made trouble on our
property.) I've spoken to the owner of China Garlic restaurant and she has told me that these loiterers
become indignant and defensive when she asks them not to block the entrance to her restaurant. I think she's
brave for even speaking to them.
While I've noticed that a small number ofSouse'svisitorspark in the outdoor pay parking lot at the corner of
Piedmont/Yosemite, MANYprefer free street parkingonour
block, sometimes
blockingmy driveway. I have called OPD toreport itin the past.Over time, more and more of these people
are parking up and down our Yosemite block and the noise and rowdiness has escalated DRAMATICALLY
in the last year. I am a night owl and am often up late and I heargroups of people walking to their multiple
cars and are screaming and swearing at each other -- sometimes from opposite sides of the street -- as late as
2:30AM EVERY WEEKEND.Many are verbally fighting so loudly and violently that I'vefeared that
gunfire might break out, so Irun from my front living room that faces the street to the back of my
apartment, just in case someone fires a shot. Often, I've heard males and females verbally and
abusivelyfighting and swearing at the tops of their lungs with each other up and down the block.Many also
cruise the block with the super-loud, mega-bass music blasting from their cars that literally vibrates my
windows and cabinets in my apartment. SO ANNOYING.
Souse's also attracts the worst kind of BIKERS...Iconstantly see and hearthe leather-wearing cyclists on the
LOUD big Harley-type "hog" cycles. Although they don't park on
(they park in thetiny lot behind
Egbert Souse's), the bikers often like totear up & down our block, in spite of the so-called speed bumps.
The motorcycle noise is deafening (especially at night) and, of course, they also set off multiple parked car
alarms causing even more noise in the evening/night. They're so loud, I can even hear them out on
MacArthur when they're starting up their bikes and gotearing out of the Souse's back lot.
While I don't know for sure, I suspect that many of these unsavorypeople aren't evenactual "patrons" of
Egbert Souse's but are attracted by the "type" of people, activities and substances available at Souse's and
come into the neighborhood just tohang out. This makes me quite fearful when I am returning home
alonein the evening/nightand having to park my Zipcar/City Car Share cars in the open parking lot on the
same block. MANY times, I've walked by cars parked along that block, in that parking lot, and on my
block and smelled all the marijuana smoke wafting from the cars and vans.(Side crime note:
I was told that the owner ofthe Indian Curry restaurant on Piedmont @ Yosemite was just assaulted &
robbed at gunpoint while sitting in his car in this same parking lot a few weeks ago. Honestly,
theperpetrator probably just blended right in with the appearance and demeanor of the other Egbert
Souse'scrowd!)
Speaking of substance availability, I have personally seen what I figured to be at least
2substancetransactionshappening in the middle of the day outside of Egbert Souse's while waiting for the

#57 AC bus that stops directly in front of the bar. Unfortunately, it happens so fast and/or I've had to
quickly board my arrivingbus, Idid not call OPDabout it.

For me, not only do all these issues create anger, frustration, inconvenienceand disgust, but the presence of Egbert
Souse's and the genre of "visitors" it attracts instills fear. Fear, every time I have to walk or park by them. Fear, that
I might be harassed or assaulted or robbed. Fear, that I might walk by at the wrong momentand witness something I
don't want to. Fear, that if I call OPD to have a car towed from my driveway, the angry (likely drunk)driver will
return to find his/her car gone, know that it was me who called OPD,and then do damage to either me or my
building to retaliate. I hate living like this any longer!

The Bottom Line:It is time to ridour neighborhoodof Egbert Souse's and close it down permanently. Egbert
Souse's is a magnet for everything residents of this Piedmont Avenue community do NOT want.While this area is
home toa large number ofsmall businessesand a plethora of eating and drinking establishments, Egbert Souse's
clearly sticks out as the ONLY one of its kindon the Avenuethat is continually bringing and perpetuating
unsavory, troublesome, noisy and illegal elements toourneighborhood and the activity is escalating..In my
opinion, whether theperpetratorsare actually patronsof Egbert Souse's is irrelevant.Souse'sis the attractor andit
intentionally provides the environment for perpetuating these issues without regard for the surrounding
community.Aside fromthe tax revenue that I'm sure the City loves, as a small business in this community, Egbert
Souse'shas NOcontributing valueandNOpositive aspectswhatsoever to thiscommunity.No other Piedmont
Avenue establishment invites these types ofproblems into this neighborhood.I know that arepresentative of
PANIL and one of our Yosemite Ave residents went to speak with the owner of Egbert Souse'srecentlybut clearly,
nopositive results came from it that I can see.I am not a stranger to living in areas with high crime levels (I'm a
native San Franciscan) and I am not nave to the fact that crime is up significantly all over our fair Oakland and the
Bay Area as a whole. But why invite and perpetuate it by allowing businesses like Egbert Souse's to provide a home
and a hangoutfor it?I'm sure that Kaiser Permanente will also appreciate the elimination of an
alcohol/drug/motorcycle/homeless/rowdy crowd encampment situated outside the front doors to their lovely and
expensive new medical center opening soon! I plan on writing to Kaiser for their support of thisissue as well.)

Councilman Kalb, I know that this is not the first you or OPD have heard about the problems caused by the presence
of Egbert Souse's. I read in the Piedmont Patch that these issues came up at your Neighborhood Crime Meeting last
month. Wish I'd been there to lend a voice to my neighbors who spoke out.Since I could not attend, I am
writingwith my plea toPLEASE, PLEASE assist us by delving deeper into what all my neighbors and I are
reporting and help us in ridding the community of Egbert Souse's.I come to you with this plea because, sadly, I
don't feel confident or optimistic that sending it to OPD would reap any action or response.I pray that as
ourDistrict One representative, youwill share our deep concerns, "feel our pain" and take action toward ending this
Souse's nightmare.

full of messages about this latest shooting at MacArthur and Piedmont, I imagine it soon will
be. It is pretty clear that Egbert Souse's is a magnet for trouble and has forfeited it's right to
operate as a lawful business in our neighborhood, and in our city. I have been following
efforts to close this business down through Nextdoor Piedmont. I hope that you and your staff
will redouble your efforts to support the work of people in your district to shut this place
down once and for all. The owners should be blacklisted from moving their business
somewhere else, just to become a danger to people in another area of our city. The
MacArthur/Piedmont intersection is the gateway to our neighborhood, and with the new
Kaiser Hospital, it should be a safe and secure focal point at all times of day and night. That is
clearly not the case at the present time.
I work as an infant development specialist, and visit the homes of families with young children
with developmental delays throughout the city of Oakland. I often work with families in East
and West Oakland and know the risk of violence they face in their own neighborhoods...and
now that same violence threatens my neighborhood. Nothing else our city government tries to
do will matter unless the citizens of Oakland are safe and secure in all our neighborhoods.
You and your council members should make safety your number one priority and get the
OPD up to optimum staffing ASAP. Our police department is ridiculously understaffed in
relation to the population of our city. I love Oakland. I experience it's diversity and vitality on
a daily basis as I travel from neighborhood to neighborhood. No one in our city should have
to be afraid to walk down the streets of their neighborhood, and it's about time the mayor and
the city council took effective action to make every neighborhood safe and secure.

We are very sorry for the inconvenience - the bar may voluntarily close, if we cancel the hearing and
discuss this is noteworthy because the hearing does not of course guarantee an outcome
revocation if meetings dont work out and a hearing is rescheduled, there will be public notice if
the bar closes for 90 days for any reason under this operator, they would need a variance from the
planning commission to reopen which may be difficult for them any change in ownership, etc
could still be subject to a rescheduled hearing in the near future will let you know what we find
out next week

Thank you for the notification, though the community has spent a lot of time organizing for
this date. Now we have to make sure no one takes the time to go.

If Egbert's closes voluntarily, does that mean theycan keep their "deemed approved" staus
andopen another alcohol outlet business at that address with the same permits? How do we
prevent that? I know the community will be completely opposed to such manipulations and
will be very upset if the city cuts such a deal with Egbert's.

This cancellation came through late yesterday: the bar and their attorney have requested to
meet and discuss other options which may include closing the bar voluntarily the meeting

involves the City Attorney, OPD, and Zoning - sorry for the inconvenience, more to come very

with the City agenda

It comes up for renewal 30 Jun 13. Per the agreement The City Administrator may elect to
extend all or parts of this contract for two (2) additional years until June 30, 2015, one
(1) year at a time, with terms and conditions remaining the same. We are in the process of
evaluating the contract.

Yes, I will pass on the information about the number of calls for service, and urge people again to call in
more. I do know that one neighbor told me that they called about a disturbance, but it took OPD an
hour to get there; no surprise the participants were gone. It's that kind of response time that
discourages people from calling at all. They don't understand about getting the history of calls on the
record. We'll be in touch with you about this bar issue.
I'm staying late at work rendering atomic structures and molecules. Must go back to the task at hand.

Dear Councilman Kalb,

I am writing you with a sincere plea toPLEASE assist usin ridding the Piedmont Avenue neighborhood of the
plague called Egbert Souse's bar, located at the corner of Piedmont and MacArthur.


I am a resident on Yosemite Avenue, just off Piedmont Avenue, and around the corner from theestablishment,
Egbert Souse's bar. Itypically am not an "activist" nor do I write my political representatives about issues or
concerns very often. However, I am so fed up and fearful about the continually escalating affect of Egbert Souse's
on this neighborhood -- and especially on our
block -- that I feel compelled to write to you. I
have lived on
for 7 years after moving over to Oakland from San Francisco. When I moved in to
thislovely neighborhood, I was not aware of what a singularlyhorrible element Egbert Souse's is in this area!! Had
I known the kind of people, crime, noise, vehicle traffic/parking issues, and rowdiness it attracts and delivers tothis
neighborhood, I likely would not have rented here. Evenneighborhood locals residing several blocks away refer to
this as the "bad end" of Piedmont Avenue because of what Egbert Souse's brings.

I am a single, middle-aged, Asian-Americanwoman living alone in a rental unit at


and a
working professional that commutes to my job at a San Francisco law firm each day. I choose not to own a car any
longer andinstead choose to utilize the more environmentally caring option of car-sharing when I need to drive(I
am a member of both Zipcar and City Car Share, both of which have car pods located in the open parking lot on the
corner of Piedmont & Yosemite) and I utilize public transportation to get to work every day. I'm telling you all this
about myself because it means is that I am ALWAYS walking alone in this neighborhood as a way of life andsee
and experience thenegative, escalating, and potentially dangerouseffects of what Egbert Souse's brings to this
immediate area firsthand. It also means that, being on foot so much, I see and witness a lot more ateye levelthan
perhaps some of the other residents who drive these blocks in their vehicles. I often take the #57 AC Transit bus
from the MacArthur BART station (often after dark because of my work hours) and disembark at the bus stop on
MacArthurBlvdacross the street from Egbert Souse's and have to walk through the groups of unruly, drunk, loud,
trashymenand womengathered outsidesurrounding the bar and the block in order to get home.Thankfully, I
personally havenot yet had any serious run-ins with these people, but it's unnerving every time I have to do so. I've
often been heckled or had men make "distasteful" comments to me. I certainly remove all my jewelry before
walking by and hold on tight to my handbag! (Yes, I could choose to get off one bus stop further up MacArthur @
Fairmount, but since my
female neighbor was recently mugged and assaulted TWICEnear
Fairmount and Yosemite, I don't consider that next bus stop a better alternative!)

Here's what I have observed and personally witnessed at/around Egbert Souse's:
DAYand NIGHT,there are constantlyrowdy, trashy people gathered outside of Egbert Souse's -- especially large
numbers of people on weekend nights (Thursdaythru Sunday, esp. Friday & Saturday). Those people are
oftenloitering all along the Piedmont Avenue blockstretching betweenMacArthur & Yosemite. They often are
standing and sitting on the sidewalk, in & around the parked cars and planter boxesin front of the other businesses
on that block, like the China Garlic Restaurant.They're smoking cigarettes and marijuana, drinking, yelling,
cursing, loitering,etc. I often see many of this area's knownhomeless and/or trouble-makers who seem to have
made Egbert Souse's their "home".(One rather scary guyin particular drinksand/or hangs out atSouse's on a
regular basis and then harasses and/or vandalizes the residences on our block.Ihave called OPD about him
previously when he's trespassed and made trouble on our property.) I've spoken to the owner of China Garlic
restaurant and she has told me that these loiterers become indignant and defensive when she asks them not to block
the entrance to her restaurant. I think she's brave for even speaking to them.
While I've noticed that a small number ofSouse'svisitorspark in the outdoor pay parking lot at the corner of
block, sometimes blockingmy
Piedmont/Yosemite, MANYprefer free street parkingonour
driveway. I have called OPD toreport itin the past.Over time, more and more of these people are parking up and
down our Yosemite block and the noise and rowdiness has escalated DRAMATICALLY in the last year. I am a
night owl and am often up late and I heargroups of people walking to their multiple cars and are screaming and
swearing at each other -- sometimes from opposite sides of the street -- as late as 2:30AM EVERY
WEEKEND.Many are verbally fighting so loudly and violently that I'vefeared that gunfire might break out, so
Irun from my front living room that faces the street to the back of my apartment, just in case someone fires a shot.
Often, I've heard males and females verbally and abusivelyfighting and swearing at the tops of their lungs with
each other up and down the block.Many also cruise the block with the super-loud, mega-bass music blasting from
their cars that literally vibrates my windows and cabinets in my apartment. SO ANNOYING.
Souse's also attracts the worst kind of BIKERS...Iconstantly see and hearthe leather-wearing cyclists on the LOUD
big Harley-type "hog" cycles. Although they don't park on
(they park in thetiny lot behind Egbert
Souse's), the bikers often like totear up & down our block, in spite of the so-called speed bumps. The motorcycle
noise is deafening (especially at night) and, of course, they also set off multiple parked car alarms causing even
more noise in the evening/night. They're so loud, I can even hear them out on MacArthur when they're starting up

their bikes and gotearing out of the Souse's back lot.


While I don't know for sure, I suspect that many of these unsavorypeople aren't evenactual "patrons" of Egbert
Souse's but are attracted by the "type" of people, activities and substances available at Souse's and come into the
neighborhood just tohang out. This makes me quite fearful when I am returning home alonein the
evening/nightand having to park my Zipcar/City Car Share cars in the open parking lot on the same block. MANY
times, I've walked by cars parked along that block, in that parking lot, and on my
block and smelled
all the marijuana smoke wafting from the cars and vans.(Side crime note: I was told that the owner ofthe Indian
Curry restaurant on Piedmont @ Yosemite was just assaulted & robbed at gunpoint while sitting in his car in this
same parking lot a few weeks ago. Honestly, theperpetrator probably just blended right in with the appearance and
demeanor of the other Egbert Souse'scrowd!)
Speaking of substance availability, I have personally seen what I figured to be at least
2substancetransactionshappening in the middle of the day outside of Egbert Souse's while waiting for the #57 AC
bus that stops directly in front of the bar. Unfortunately, it happens so fast and/or I've had to quickly board my
arrivingbus, Idid not call OPDabout it.

For me, not only do all these issues create anger, frustration, inconvenienceand disgust, but the presence of Egbert
Souse's and the genre of "visitors" it attracts instills fear. Fear, every time I have to walk or park by them. Fear, that
I might be harassed or assaulted or robbed. Fear, that I might walk by at the wrong momentand witness something I
don't want to. Fear, that if I call OPD to have a car towed from my driveway, the angry (likely drunk)driver will
return to find his/her car gone, know that it was me who called OPD,and then do damage to either me or my
building to retaliate. I hate living like this any longer!

The Bottom Line:It is time to ridour neighborhoodof Egbert Souse's and close it down permanently. Egbert
Souse's is a magnet for everything residents of this Piedmont Avenue community do NOT want.While this area is
home toa large number ofsmall businessesand a plethora of eating and drinking establishments, Egbert Souse's
clearly sticks out as the ONLY one of its kindon the Avenuethat is continually bringing and perpetuating
unsavory, troublesome, noisy and illegal elements toourneighborhood and the activity is escalating..In my
opinion, whether theperpetratorsare actually patronsof Egbert Souse's is irrelevant.Souse'sis the attractor andit
intentionally provides the environment for perpetuating these issues without regard for the surrounding
community.Aside fromthe tax revenue that I'm sure the City loves, as a small business in this community, Egbert
Souse'shas NOcontributing valueandNOpositive aspectswhatsoever to thiscommunity.No other Piedmont
Avenue establishment invites these types ofproblems into this neighborhood.I know that arepresentative of
PANIL and one of our Yosemite Ave residents went to speak with the owner of Egbert Souse'srecentlybut clearly,
nopositive results came from it that I can see.I am not a stranger to living in areas with high crime levels (I'm a
native San Franciscan) and I am not nave to the fact that crime is up significantly all over our fair Oakland and the
Bay Area as a whole. But why invite and perpetuate it by allowing businesses like Egbert Souse's to provide a home
and a hangoutfor it?I'm sure that Kaiser Permanente will also appreciate the elimination of an
alcohol/drug/motorcycle/homeless/rowdy crowd encampment situated outside the front doors to their lovely and
expensive new medical center opening soon! I plan on writing to Kaiser for their support of thisissue as well.)

Councilman Kalb, I know that this is not the first you or OPD have heard about the problems caused by the presence
of Egbert Souse's. I read in the Piedmont Patch that these issues came up at your Neighborhood Crime Meeting last
month. Wish I'd been there to lend a voice to my neighbors who spoke out.Since I could not attend, I am
writingwith my plea toPLEASE, PLEASE assist us by delving deeper into what all my neighbors and I are
reporting and help us in ridding the community of Egbert Souse's.I come to you with this plea because, sadly, I
don't feel confident or optimistic that sending it to OPD would reap any action or response.I pray that as
ourDistrict One representative, youwill share our deep concerns, "feel our pain" and take action toward ending this

Sorry about the delay. Our email system has been down all weekend.
The decision to go back to the location to canvass for witnesses is up to the investigator and is a
common practice. Usually it involves knocking on doors to locate witnesses that were no longer on
scene or who may not have wanted contact at the time of the incident. I know the investigator has
communicated with the owners since the incident and we have recovered video evidence and are
following leads.
Re. the music, one request that we have made is to change the type of music and volume of the juke
box. The owner was receptive to making this modification.

I have received another message from a neighbor with ideas for conditions and a question for

I'm on foot a lot and walk past Egbert's several times every weekend I'm in town, on my way
here and there. Yesterday I noticed they posted a sign announcing that OPD is offering a
$5000 reward for information leading to the identification and arrest of the shooters. It
occurred to me that if no one comes forth in a week or so, OPD should make unannounced
visits to the bar several times each week, particularly during the bar's swing shift, and
interview every single person in the bar to find out what they know. This might be a way to
send word to the gun-toting criminal element that frequents the bar that they may want to
find another place to go. Is there some reason OPD hasn't done this already? If there are any

percipient witnesses to the crimes, aren't they are likely to be found at the bar?

p.s. While I was there yesterday, the door opened and I could hear the music playing on the
jukebox. It was Blurred Lines. Really? That funky misogynistic rip-off of a "song." Can one
condition of approval be that they play elevator music or pop or soft rock or something equally

On the subject of music, after meeting with Margitta Gardner a couple of months ago, Kevin
Yoo said that they were requesting that their jukebox supplier remove all songs from the
playlist that had violent words. I checked the words; it appears that their definition of
violence does not include some of what I--or many women--would include.
PANIL has been asked to compile a summary of the meeting information, which I will want to
run by you for proofreading, and additional information before we distribute it. Thank you for

personally have not yet had any serious run-ins with these people, but it's unnerving every time I have to do so. I've
often been heckled or had men make "distasteful" comments to me. I certainly remove all my jewelry before
walking by and hold on tight to my handbag! (Yes, I could choose to get off one bus stop further up MacArthur @
Fairmount, but since my
female neighbor was recently mugged and assaulted TWICE near
Fairmount and Yosemite, I don't consider that next bus stop a better alternative!)

We got a call from a constituent expressing concern about the renewal of the liquor license for the Bottom of the 9th
Bar & Grill (54th and MLK). He lives nearby and was worried about loitering, blocking of driveways, and even

You missed a very informative meeting last night. We had Capt. Toribio, Eli Ferran from the
city attorney, Greg Minor from the city administrator, besides the usual attendees. We had
unprecedented neighborhood participation.
Anyone and everyone in your office are welcome to attend our monthly NCPC meetings and
any other independent neighborhood meetings we organize.
Regarding your generous offer for a meeting, I must apologize for my bluntness. Working on
this project has become a part time job for many of us at the expense of our real jobs, our
families, and our "free" time. We cannot expend any more energy simply getting someone up
to speed on what we have already done. If you can come educated and prepared to a
meeting with resources and creative solutions for us, we are happy to meet with you. I can

host either of the nights you suggested. Please let us know if you would like to do that as
soon as possible so we can notify our neighborhood.
I do not pretend to speak for the whole group, so I am interested to hear if anyone has

(Egbert Souse's) in the Piedmont Ave. neighborhood. The City Attorney's office,
Planning Dept. and OPD worked with the owner to come to a legally-binding
agreement on action steps to prevent future problems. This is a public

document, so I am attaching it in case you are interested in looking it over.


Also, as you probably know, I am on the Public Safety Committee of the City
Council, which meets at 6:00 PM on the second and fourth Tuesday night of
each month. Unfortunately, that conflicts with your monthly 11X NCPC
meetings. On rare occasion, the Public Safety committee ends before 7:30PM,
but it's difficult to predict that in advance. As I have mentioned to others in your
neighborhood last year, I would be thrilled to come to a separate meeting in the
Bushrod to discuss neighborhood-specific crime problems. I've found that
smaller meetings at someone's home can be a more productive setting to really
get into the meat of a specific issue/problem. However, I am happy to
participate at any meeting you organize. Please run possible dates by my Olga
in my office before confirming and publicizing any such meeting.

Dover Street has left many neighbors shaken. Sixty-two neighbors signed on to a
nuisance lawsuit against the Uptown and hopefully, there will be one against
5518 Dover Street as well. According to a discussion at our NCPC meeting last
night, there was no response from your office when you were copied on the
Uptown matter that was sent to the city attorney's office. That is unacceptable.
There are many neighbors who are considering moving away because of the
recent gunfire that could have hit innocent bystanders and their children. We
don't want our good neighbors to move away because of some thugs.
Please let us know when you can meet with neighbors regarding the violence. At
the very least, please send a representative of your office to the next Shattuck
NCPC meeting, on Tuesday, March 11th at 7 pm at CHORI Library.

I was unhappy last night with Eli Ferran's assertion that the Uptown Market will not be held
accountable for incidents taking place on their property that they may have reported themselves
to the OPD. Unfortunately, the Uptown has become a magnet for criminals from all over North
Oakland (and beyond) - the more people who congregate at the Uptown, and the longer they
stay, the greater is the likelihood that two or more of them will elect to settle a beef (violently) in
our neighborhood. As long as the Uptown is not taking responsibility to discourage criminals from
patronizing their business and hanging out in their parking lot, Uptown owners should indeed be
held accountable for whatever incidents may take place on their premises, no matter who does
the reporting. Based on recent reports to the NCPC hotline, it appears that loitering incidents at
the Uptown are on the rise, and Uptown employees are actually hanging out with the loiterers,
rather than requiring them to move along.

Thanks for your message.It's very discouraging when multiple constituents of District Onehave asked for representation at
the Beat 11X NCPC meetings that not one personfrom Councilperson Kalb's officewas able tocome hear from the 30 -40
neighbors gathered to discuss pressing safety concerns.That does not seem unreasonable.

Our NCPC meetings are the second Tuesday of every month at 7 pm in the CHORI library, 58th and MLK.

Uptown's and 5518's problems, and the Deemed Approved document from Egbert Souze's is
quite helpful. I and my neighbors are eager to move forward to find a solution.
I am happy to host and organize a meeting. I'm conveniently located near Uptown Market in
case you need to stock up on King Cobras and Swisher Sweets on your way in...
I think the best possible meeting times for us are Mon-Fri after 7:30pm, as many of us have
little ones with early bedtimes. We can also meet on the weekends 10am to 7:30pm. Can we

Thanks to each of you for contacting me today. I am very aware of the horrible shootings in
the Dover Street and Uptown Market area--including the one last month. And I did receive
the cc on the correspondence (which I read) that Mr. Sunny Woan sent to the City Attorney's
office. I have discussed this with Captain Toribio twice and I know that he understands that
the incidence of violent crime in that immediate area is unacceptable and needs greater
attention.
As an FYI, I meet with the Captain regularly to discuss the status of specific criminal
investigations as well as on-going violent crime hot-spots in all D-1 neighborhoods. My staff
also talk regularly with the Captain as well as with other OPD Area 2 personnel.
I was under the impression that Dannette from my office did initially respond to a couple
residents about this. While it would not be appropriate for me to provide a formal response to
the legal document that was submitted until the City Attorney has reviewed the matter and
determined possible next steps, there is nevertheless more work to do. As you may know, we
had a long-standing situation with on-again, off-again violence at and adjacent to a bar
(Egbert Souse's) in the Piedmont Ave. neighborhood. The City Attorney's office, Planning
Dept. and OPD worked with the owner to come to a legally-binding agreement on action
steps to prevent future problems. This is a public document, so I am attaching it in case you
are interested in looking it over.
Also, as you probably know, I am on the Public Safety Committee of the City Council, which
meets at 6:00 PM on the second and fourth Tuesday night of each month. Unfortunately, that
conflicts with your monthly 11X NCPC meetings. On rare occasion, the Public Safety

committee ends before 7:30PM, but it's difficult to predict that in advance. As I have
mentioned to others in your neighborhood last year, I would be thrilled to come to a separate
meeting in the Bushrod to discuss neighborhood-specific crime problems. I've found that
smaller meetings at someone's home can be a more productive setting to really get into the
meat of a specific issue/problem. However, I am happy to participate at any meeting you
organize. Please run possible dates by my Olga in my office before confirming and
publicizing any such meeting.

A recent violent gun battle from the Uptown Market down Aileen Street to 5518 Dover Street
has left many neighbors shaken. Sixty-two neighbors signed on to a nuisance lawsuit against
the Uptown and hopefully, there will be one against 5518 Dover Street as well. According to
a discussion at our NCPC meeting last night, there was no response from your office when
you were copied on the Uptown matter that was sent to the city attorney's office. That is
unacceptable. There are many neighbors who are considering moving away because of the
recent gunfire that could have hit innocent bystanders and their children. We don't want our
good neighbors to move away because of some thugs.
Please let us know when you can meet with neighbors regarding the violence. At the very
least, please send a representative of your office to the next Shattuck NCPC meeting, on
Tuesday, March 11th at 7 pm at CHORI Library.

have a business license and have elected to invest in Oakland. I have lived in San Francisco and
Piedmont. I currently reside in Berkeley, CA. My tenants have resided in the neighborhood from 1
to 3 years. My tenants have voiced their concerns over the increase in criminal activities in the
neighborhood. They believe the guests frequenting a local bar, Egbert Souses Bar located at 3758
Piedmont Ave (MacArthur) are disturbing their quality of enjoyment while at home. 2 tenants have
moved within the last 2 years due to the crime and noise in the neighborhood. This bar attracts a
local group of individuals engaging in loitering, drinking and engaging in speaking loudly and
exchanging obscene language on a regular basis.

The bar does not fit in with the neighborhood. There are currently 3 bars listed on Piedmont Avenue.
One is Kona Club (Lounge) at 4401 Piedmont Ave., Catos Ale House (drinks and food) at 3891

Piedmont Avenue and Egbert Souse (dive bar) at 3758 Piedmont Ave., Oakland, CA. In half a mile,
there are 3 drinking establishments.

We are hoping the Egbert Souse business closed its doors. Numerous calls have been made to the
police department with very little change.

Please keep me posted on future changes if any.

regarding ways to decrease the possibility of violence in and around Egbert Souses bar.

Macarthur Blvd divides the districts and Egberts actually falls into District 1. Olga Bolotina, who is

The license is active and we have not received any notices regarding a transfer. Bottom of the 9th
was never issued an alcohol license. Mr. Looney retained ownership of the license, with a new
business operating from 5319 MLK. If a transfer should come in, as a citizen, you can protest the
transfer with the attached protest form.

If a transfer should come in, you can work with Officer Sena (777-8673) of the ABAT unit who deals
exclusively with alcohol related businesses.

The Oakland Business Center referred me to you to ask about a business transferring a liquor license
(I just left you a message). I just started in the office of Councilmember Dan Kalb and we received a
call from a constituent living near 53rd and MLK, near the Bottom of the 9th restaurant (which was
closed a few months ago). Bottom of the 9th replaced another restaurant that was there before
(Looneys) and from what I understand, Looneys transferred their liquor license to the Bottom of
the 9th. There have been a number of issues associated with Bottom of the 9th, including a shooting
in the past, and though the current license is set to expire at the end of the month, the neighbors
fear that it might get transferred to someone else again who will open up another bar that will cater
to the same clientele that have been a bit of a nuisance to the residents.

From my call with the business center staff, they advised me that any complaints should be directed
to you so that if indeed another attempt to transfer the license occurs, the city may consider the
neighbors complaints along with the issues that have been reported by OPD.

Please let me know if I am completely off and directing this to the wrong person or if you have any

Im not quite sure which meeting you were referring to. Last night there was a Planning
Commission meeting and I know that commissioners unanimously approved Chow project. I dont
think it will come to the Council for a vote. I think Councilmember in general is in favor of good
projects/businesses that are widely supported by the neighbors coming to our district.

We just learned the hearing has been cancelled. We are extremely disappointed by this news
and hope that the owners of Egbert's will not be allowed to continue to operate as they have in

I live in
As I'm sure you know, there were
two shootings there within a week of each other. I feel unsafe because the customers can get
rowdy enough to shoot one another.
I was wondering if there was anything you or the city of Oakland could do to make the area
around Egbert Souse's bar safer? Close the bar? Patrol the area? Have the bar hire security?
Something else?

Hello Santa Fe CAN,


Just a reminder that the monthly Santa Fe CAN General Meeting (held on the 1st
Tuesday of each month ) is POSTPONED until Tuesday, February 4th, 2014.
(So, no General meeting in December or January.) We will be "pausing" for the
holiday season and to plan and brainstorm great topics to discuss and speakers to
invite to speak to our community. If you have any suggestions for great topics or
speakers, please reply to this e-mail, and let us know.
In the meantime, please consider joining us for any of the following events:
Community Building Committee Meeting, this WEDNESDAY, DECEMBER
4th, 6:45 - 8 pm, meeting at the Bottom of the 9th, 5319 MLK. For more

Santa Fe CAN Community Happy Hour is scheduled as usual for the 2nd
Wednesday of the month (and every month). Let's all meet at Bottom of the 9th,
5319 MLK, for discount food and drink. Family friendly, so bring the kids, or just
bring yourself. WEDNESDAY, DECEMBER 11, 2013, starting 6:30pm.
Mention "Santa Fe CAN" for food and beverage discounts: $2 beers, $5 well
drinks, $2 off all starters, salads, and burgers. Prices are good ALL NIGHT.
Beautification Committee Trash Pick Up. SUNDAY, DECEMBER 15, 2 pm.
Join in and help us pick up trash in the neighborhood, and then join the group
afterwards for some refreshments. Trash pick-up from 2:00-3:00pm. Meet at
5709 Genoa. Bring a plastic bag and some gloves, and plan to take the trash
back to your cans. Refreshments from 3:00-4:00pm. Picking up trash is not
required to join for refreshments.
Santa Fe CAN General Monthly Meetings begin on TUESDAY, FEBRUARY
4th, 2014, 6:30 - 8 pm and will occur every 1st Tuesday of the month for the
rest of the year. Meetings are held at Children's Hospital Oakland Research
Institute Library (CHORI), 5700 Martin Luther King Jr. Way, 94609. (Enter

Good Morning Councilmember Kalb and Dannette:


The Steering Committee of Santa Fe CAN just held our monthly meeting and concern was
expressed about the rising tide of crime along the MLK corridor and in the District. We, and
our neighbors, are particularly concerned about the two recent shootings at Bottom of the 9th
and the shooting at the gas station on 55th and MLK.
We would like you to hold a community meeting on these issues at the North Oakland Senior
Citizen building at your earliest convenience.
Santa Fe CAN's General Meeting is scheduled for Tues February 4th and we would like to
provide notice of your meeting at that time. Of course, we would assist with getting out the
word of any meeting you hold.
