JUDICIAL AFFIDAVIT OF PETITIONER MERNA R. GILIG

This is the judicial affidavit, in lieu of direct testimony, of MERNA R.
GILIG, Filipino, of legal age, married, and a resident of Barangay Kapatagan,
Vincenzo Sagun, Province of Zamboanga del Sur, Philippines, whose examination
was supervised and taken by ATTY. REX ELMER G. TIBON at his law office at
Provincial Capitol Complex, Pagadian City, Zamboanga del Sur on February 4, 2016.
The questions were propounded upon her in English, a language which she
knows and fully understands, and when she answered such questions, she was fully
conscious that she was under oath, and she was aware that she may face criminal
liability for perjury or giving a false testimony.
This direct testimony via judicial affidavit is being offered to prove the
following:
a. That she is the petitioner in ELECTION CASE NO. _______ entitled
MERNA R. GILIG vs. EDGARDO Z. GILIG, PEGIE M. GOMERA and the
ELECTION REGISTRATION BOARD OF V. SAGUN, ZAMBOANGA DEL SUR,
now pending before the 15th MTCC (Margosatubig-Vincenzo Sagun), Ninth Judicial Region,
Margosatubig, Zamboanga del Sur;
b. That herein respondents are non-residents of Barangay Kapataga. Vincenzo
Sagun, Zamboanga del Sur and that they do not have any real property registered under
their respective names in the said barangay or in the municipality where they registered as
voters and on,
c. All other matters that are related to the instant case.
Question 1: In this statement that you are about to give in this above-entitled case,
do you swear to tell the truth, the whole truth and nothing but the truth?
Answer1: Yes I do.
Q2: Please state your name and other personal circumstances:
A2: I am MERNA R. GILIG, Filipino citizen, of legal age, married, and a resident
of Barangay Kapatagan, Vincenzo Sagun, Zamboanga del Sur, Philippines.

Q3: Why did you file this instant petition?

A3: I filed this instant petition due to the fact that the Election Registration Board
(ERB) has allowed the registration of herein respondents despite the latter not
having satisfied the requirement under Section 9 of the Voters Registration Act of
1996 that the applicants for registration shall have resided in the Philippines for at
least one (1) year, and in the place wherein they propose to vote, for at least six (6)
months immediately preceding the election.
Q4: Do the respondents have any real property registered under their name in
Barangay Kapatagan, Vincenzo Sagun, Zamboanga del Sur?
A4: None, your Honor.
Q5: Do you have evidence that herein respondents do not have any real property
registered under their name in Barangay Kapatgan, Vincenzo Sagun, Zamboanga del
Sur?
A5: Yes, your Honour. I have here with me a copy of the certification (Annex A of
the Petition) from the Office of the Provincial Assessor that herein respondents do
not have any real property registered under their name in Barangay Kapatagan,
Vincenzo Sagun, Zamboanga del Sur, where they registered as voters;
Q6: Are the respondents residents of Barangay Kapatagan, Vincenzo Sagun,
Zamboanga del Sur?
A6: No, your Honor.
Q7: Do you have evidence that herein respondents are nonresidents of Barangay
Kapatagan, Vinzenco Sagun, Zamboanga del Sur?
A7: Yes, your Honor. I have here with me a copy of the joint affidavit (Annex B
of the Petition) executed by JUANITO R. URSAL and ROSEMARIE C.
NAMBLING which states that they have not seen herein respondents in Barangay
Kapatagan, Vinzenco Sagun, Zamboanga del Sur;
Q8: Prior to filing this petition, what actions did you take regarding this matter?
A8: Your Honour, I was not aware of the date of application and registration of
herein respondents nor I was cognizant of any notice and hearing set by the Election
Registration Board (ERB) pertaining to the applications for registration of herein
respondents.
Q9: Why did you file this petition despite not having raised the matter before the
ERB?
A9: Your Honour, the proceedings before the ERB pertains only to new
registrations. Also, I am invoking the original and exclusive jurisdiction of the
Municipal and Metropolitan Trial Courts in cases of inclusion and exclusion of voters
in their respective cities or municipalities on grounds provided by law, pursuant to
Section 33 of the Voters Registration Act of 1996 and Section 49 of the Omnibus
Election Code of the Philippines.
Q10: What do you now pray for the court to grant you Ms. Petitioner?
A10: Your Honour, I pray that this Honorable Court will grant this petition and an
order be issued directing the Election Registration Board or the concerned Election
Officer to remove herein respondents registration record from the corresponding
book of voters and that their names be deleted from the Computerized Voters List.

A11: I have nothing more to add.
