CONTRACT SPECIFICATIONS
6. Description of the contract
The contract consists of Construction of Fly ash Load out, Storage silos and Mixing facilities for
Stan Trg Mine in order to provide continuous supply of fly ash from Kosovo Energy Corporation (KEK)
power plant, to fill the voids left after the extraction of ore at Stan Trg mine.
The project includes the construction works for fly ash load out facilities at KEK power plant and
construction of storage and mixing facilities at Stan Trg mine including design, steel and reinforced
concrete works, electronic and mechanical fittings and other appropriate works.
7. Number and titles of lots
1 lot only
TERMS OF PARTICIPATION
8. Eligibility and rules of origin
Participation is open to all legal persons [participating either individually or in a grouping (consortium)
of tenderers] of the Member States of the European Union and and the countries/territories/regions
specified in Council Regulation (EC) No. 2666/2000 (the CARDS Regulation) and Council Regulation
(EC) No 2112/2005 on access to Community external assistance and other specific instruments
applicable to the programme under which the contract is financed (see also heading 22 below). All

works, supplies and services under this contract must originate in one or more of these countries.
Participation of natural persons is directly governed by the specific instruments applicable to the
programme under which the contract is financed.
9. Grounds for exclusion
Tenderers must submit a signed declaration, included in the Tender Form for a Works Contract, to the
effect that they are not in any of the situations listed in point 2.3.3 of the Practical Guide to contract
procedures for EC external actions.
10. Number of Tenders
Tenderers may submit only one tender. Tenders for parts of a lot will not be considered. Any tenderer
may state in its tender that it would offer a discount in the event that its tender is accepted for more
than one lot. Tenderers may not submit a tender for a variant solution in addition to their tender for the
works required in the tender dossier.
11. Tender Guarantee
Tenderers must provide a tender guarantee of 10,000.00 when submitting their tender. This
guarantee will be released to unsuccessful tenderers once the tender procedure has been completed
and to the successful tenderer(s) upon signature of the contract by all parties.
12. Performance Guarantee
The successful Tenderer will be asked to provide a performance guarantee of no more than 10% of
the amount of the contract at the signing of the contract. This guarantee must be provided no later
than 30 days after the Tenderer receives the contract signed by the Contracting Authority. If the
selected Tenderer fails to provide such a guarantee within this period, the contract will be void and a
new contract may be drawn up and sent to the Tenderer which has submitted the second best
admissible tender.
13. Site Visit
A strongly recommended Site Visit shall be made at Obiliq at the main entrance of KEK Kosovo B'
power plant on July 10th (Tuesday) at 10,30 hrs CET.

14. Tender validity


Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.
15. Period of execution
180 calendar days from commencement date.

SELECTION AND AWARD CRITERIA


16. Selection criteria
16.1. Economic and financial capacity:
Sole Tenderer
a) Shall have an average annual value of construction work of at least EURO
1,000,000.oo over the past 3 years (i.e. 2004, 2005, 2006).
Consortium/Joint venture
b) The consortium/joint venture as a whole shall have an average annual value of
construction work of at least EURO 1,000,000.oo over the past 3 years (i.e.
2004, 2005, 2006).
The lead partner shall have an average annual value of construction work of at
least EURO 500,000.oo over the past 3 years (i.e. 2004, 2005, 2006).
16.2. Professional capacity:
Sole Tenderer
a) Shall be a registered firm or a natural person capable of carrying out the
specific works. In the case of a firm, it shall have been incorporated in 2003 or
earlier.
b) Shall carry out at least 70% of the total value of the works contract by his own
resources, which means that he shall have the equipment, materials, human and
financial resources necessary to enable him to carry out that percentage of the
contract.
c) Key personnel: the proposed Site Manager must have at least 5 years'
experience and proven qualifications relevant to works of a similar nature. The
proposed Safety Manager must have at least 3 years experience and proven
qualifications relevant to works of a similar nature. The proposed Design staff,
(one Civil Engineer and one Mechanical Engineer) must have at least 3 years
of experience each and proven qualifications relevant to works of a similar nature.
All shall have an acceptable command of the English language.
Important: tenderers are not allowed to propose design companies for the
performance of the design.
Consortium/Joint venture
d) The lead partner shall be a registered firm or a natural person capable of
carrying out the specific works. In the case of a firm, it shall have been
incorporated in 2003 or earlier.
e) The lead partner in a joint venture/consortium shall carry out at least 50% of
the total value of the works contract by his own means.
f) The partner/s in a joint venture/consortium (i.e. not the lead partner) shall be
registered firms or natural persons shall carry out at least 20% of the total value of
the works contract by his own means.

g) Key personnel: the proposed Site Manager must have at least 5 years'
experience and proven qualifications relevant to works of a similar nature. The
proposed Safety Manager must have at least 3 years experience and proven
qualifications relevant to works of a similar nature. The proposed Design staff,
(one Civil Engineer and one Mechanical Engineer) must have at least 3 years
of experience each and proven qualifications relevant to works of a similar nature.
All shall have an acceptable command of the English language.
Important: tenderers are not allowed to propose design companies for the
performance of the design.
16.3 Technical capacity:
Sole Tenderer
a) Shall have completed at least the following projects in the last 5 years:
- At least 2 projects comprising steel construction works of similar nature to
the ones requested with a value of at least Euro 200,000.00 each.
The Tenderer shall supply copies of the respective certificates of final
acceptance signed by the supervisors/contracting authority of the projects
concerned and/or written letter of satisfaction from the Employer of that
Contract.
Consortium/Joint venture
b) The Consortium/Joint Venture taken as a whole (that is the lead partner or any
other partner) shall have completed at least the following schemes/projects in the
last 5 years:
- Refurbishment of at least 2 projects comprising steel construction works
of similar nature to the ones requested with a value of at least Euro
200,000.00 each.
The Tenderer shall supply copies of the respective certificates of final
acceptance signed by the supervisors/contracting authority of the projects
concerned and/or written letter of satisfaction from the Employer of that
Contract.
17. Award criteria
The lowest price of the administratively and technically compliant offer.

19. Deadline for submission of tenders

Any tender received after this deadline will not be considered.

street, Pristina, Kosovo).
21. Language of the procedure
All written communications for this tender procedure and contract must be in English.
22. Legal basis
This project is covered by the Council Regulation (EC) No 2666/2000 of 5 December 2000, as
currently in force.
