This memorandum is issued to communicate to you the resolution of the


management regarding the incident that happened as follows:
FACTS:
At 5:30pm of February 13, 2014, when you were leaving the premises after your
shift (8:00am to 5:00pm) was over, the security guard while conducting your
search found the following items concealed in your very large backpack bag:

The Security Guard Larry Bacaoco requested you to present the official receipt
for these goods. You were not able to present such official receipt. Furthermore,
the Security Guard Danilo Bacomo requested you to give an explanation
regarding your possession of these goods. However, you were not able to give

any. Therefore, the above-mentioned security guards on duty seized the goods
taken in your presence.
You were called upon to submit a written explanation within seventy two (72)
hours after receipt of the memorandum issued to you as to why action should not
be taken against you. You did not comply the memorandum.
EVALUATION:
Section 25 of the existing Personnel Rules and Regulations provides the all
personnel who would be caught committing theft shall be dismissed at first
offense.
The management evaluated the facts and circumstances of your case and found
that you have committed theft and is punishable under the existing ruled and
regulations.
DECISION:
You are dismissed from service effective February 23, 2015.

Administrative Division of the ABC MANUFACTURING COMPANY since January
2, 2014.
On February 13, 2014 you were employed from 8:00am to 5:00pm shift. At
5:30pm, when you were leaving the premises after your shift was over, the
security guard while conducting your search found the following items concealed
in your very large backpack bag:

The above-mentioned incident amounts to misconduct under the Personnel


Rules and Regulations applicable to you. You are hereby called upon to submit a
written explanation
within seventy two (72) hours after receipt of this
memorandum as to why action should not be taken against you. In the event we
could not hear from you within the above mentioned period, it shall be presumed
that you have no explanation to offer and the matter will be dealt with according
to the existing rules of conduct and labor laws.
Please give this memorandum your utmost attention after acknowledging receipt.
