wanttogothatroutekeepscrollingdowntheexemptionsthatwerestruckout.Severalprivatebusinessesand
clubsbynamewereeliminated(YMCAandYWCAsarejusttwoIcanrememberoffthetopofmyhead),aswell
asgenericnamesofbusinesses.RegardlessyourfactsshouldreflectthatCharlotteleftitsoopenendedthat
womenandchildrenwereputatrisk.AsIsaidbefore,anycriminaldefenseattorneyworththeirsaltwouldraise
thedeletionoftheexemptionsasadefense.

Acourt,followingproperrulesofconstruconwouldbecompelledtohold
thatitisunlawfultohaveseparategenderbathrooms.Whileacourtmay
have,inthepast,haveheldthattherewasanimplicitexceponfor
separategenderbathrooms,showerrooms,lockerrooms,orothersimilar
facilies,acourtwillnotimplyanexceponwhenthatexceponhasbeen
consideredandrejectedbythelegislangbody.Here,theCharloeCity
Councilexpresslyrepealedthefollowingexcepononsexdiscriminaon
fromold1259(b)(1)whichstatedthatsexdiscriminaonclaimsdidnot
applyto:restrooms,showerrooms,bathhousesandsimilarfacilieswhich
areintheirnaturedisnctlyprivate.Bydelengthatexceponthatwasin
thepriorordinance,theCharloeCityCouncilhasspokenontheissueand
thusaclaimofsexdiscriminaoncouldbemadebyanyman(whether
transgenderornot)ifheweretobedeniedaccesstoafemalebathroom.
Infact,evenposngthesignwouldrunafoulof1258(b)andsubjectthe
oendingbusinesstones.Itwouldbequitetheabsurdlegalanalysisthat
giveseecttoarepealedseconofanordinanceasifthatseconwas
neverrepealed.
