AAA HOME DRAINAGE

PROPOSAL

THIS AGREEMENT made this day, APRIL 30, 2010, BY AAA HOME DRAINAGE,
hereinafter called the Contractor and, LEIGH HARRIS, here in after called the Owner/s.

Witness here-in: that the Contractor and the Owner, for the consideration named here-
in and as follows, here-in agree to the following: 1. UPON REVIEW OF THE
PROPERTY IT IS APPARENT THAT GROUNDWATER FROM HEAVY RAINS ARE
SATURATING THE FRONT, SIDE AND UNDER DECK AREAS ALONG THE HOMES
FOUNDATION.

THIS CONDITION CAN BE STOPPED BY COLLECTING THE GROUNDWATER IN A


HAND EXCAVATED FRENCH DRAIN GROUNDWATER REMOVAL SYSTEM,
VENTING INTO A 4 FOOT DEEP BY 4 FOOT IN DIAMETER DRY WELL, FILLED
WITH RIVER ROCK, AND TOPPED WITH ¾” MINUS CRUSHED BASALT ROCK, AND
COMPACTED.

THIS WILL REQUIRE THE REMOVAL OF TWO LARGE PORTIONS OF CONCRETE


AND THE EXCAVATION OF THE DRY WELL IN THAT LOCATION, BEYOND THE
LOWER END OF THE HOME.

2. DESIGN, CONSTRUCT AND PLUMB A HAND EXCAVATED FRENCH DRAIN


GROUNDWATER REMOVAL SYSTEM, APPROXIMATELY 12” WIDE, 6”-18” DEEP,
CONTAINING A 3” ADS PERFORATED PIPE, ¾”-1 ½” RIVER ROCK, AND WEED
CLOTH, SLOPING AT A GRADE OF AT LEAST 2” PER 10 LINEAL FEET, VENTING
INTO THE DESCRIBED DRY WELL.

3. EXCAVATED DIRT WILL BE USED TO RAISE AND COMPACT A BETTER


FOUNDATION RAIN RUN OFF GRADE FOR 18” AWAY FROM THE FOUNDATION
WALL, PARALELL TO THE FOUNDATION WALLS, WHERE SIDING OR
FOUNDATION VENTS ARE NOT INSTALLED TOO LOW ON THE FOUNDATION
WALL, PREVENTING THE INSTALLATION OF A COMPACTED SPLASH BLOCK

4. ALL EXCAVATED DIRT NOT USED TO COMPACT ALONG THE FOUNDATION


WALLS WILL REMAIN AT THE SUBJECT PROPERTY FOR THE HOMEOWNERS
USE OR CAN BE STAGED ON A TARP ON THE CONCRETE, AT THE LOWER END
OF THE HOME, FOR NEIGHBORHOOD PICK UP USE. ESTIMATED AMOUNT OF
DIRT NOT BEING ABLE TO BE USED TO COMPACT EQUALS APPROXIMATELY 6
CUBIC YARDS MINIMUM.

5. THE RIVER ROCK FINISH ON TOP OF THE FRENCH DRAIN WILL BE SEEN AS A
12” WIDTH OF RIVER ROCK WRAPPING IN FRONT OF THE FRONT YARD
PLANTING BED, AND SLOPING AROUND THE HOME TO THE REAR PROPOSED
DRY WELL AREA.

6. IF REMOVAL OF THE DIRT IS REQUESTED, THE HOMEOWNERS MAY USE THIS


OPTION BY ORDERING AND PAYING FOR DROP BOXES TO BE DELIVERED TO
THE REAR OF THE HOME, FOR REMOVAL. THE ADDITIONAL COST ABOVE THIS
PROPOSAL TO EXERCISE THIS OPTION, WITH RESPECT TO THE LABOR PRICE,
IS $600. PER 10 CUBIC YARD DROP BOX OR PORTION FILLED, AS THE DIRT IS
HANDLED ONCE TO GET IT EXCAVATED OUT, AND AGAIN TO LEVEL AND FILL
THE BOX AS WHEEL BARROWS GO UP PLANKS TO GET IT ALL TO THE FRONT
OF THE BOX AND BUILD IT BACK.

MUCH EXTRA WORK. ALL BROKEN CONCRETE, REQUIRED TO EXCAVATE A


DRY WELL, WILL BE REMOVED FROM THE PROPERTY.

7. APPROXIMATELY 5-6 DAYS OR LESS FOR COMPLETION, DEPENDING ON SOIL


CONDITIONS, WEATHER, MATERIALS AVAILABILITY, MANPOWER ALLOCATED
TO THE SITE, AND UTILITY PLACEMENTS TAKING MORE TIME EXCAVATING
AROUND.

8. UTILITY LOCATES TAKE 3 DAYS, AND ARE THE RESPONSIBILITY OF THE


CONTRACTOR.

CALL TO SCHEDULE AHEAD OF TIME FOR BEST RESULTS.

A. WHEEL BARROWS ON PLYWOOD.


B. UTILITY LOCATE PRIOR TO CONSTRUCTION.
C 6 HR. PER DAY AVERAGE WORK DAY FOR 2 WORKERS.
D. CLEAN UP EVERY DAY UPON WORK COMPLETION.
E. 100% HAND EXCAVATED FRENCH DRAINS AND RAIN DRAIN DISCHARGES.
Article 1. Scope of the Work
The Contractor shall furnish all of the materials and perform all of the work shown on the
Proposal, and/or described in the Specifications entitled Exhibit A, as annexed hereto as
it pertains to work to be performed on property at: 1118 FOOTHILLS DR. NEWBERG,
OREGON 97132
Article 2. Time of Completion. The work to be performed under this Contract shall be
commenced on or before CALL TO ARRANGE START DATE, AND UTILITY LOCATE.
The following constitutes substantial commencement of work pursuant to this proposal
and contract: DELIVERY OF TOOLS, AND WORKER TO SITE UPON RECIEPT OF
START CHECK, WITH CREW BEGINNING WORK ON THAT DAY. SEE ESTIMATE
FOR COMPLETION ABOVE.

Article 3. The Contract Price


The Owner shall pay the Contractor for the material and labor to be
performed under the Contract the sum of: FOUR THOUSAND-FOUR HUNDRED-SIXTY
AND 00/-----DOLLARS. ($ 4460.)

Article 4. Progress Payments


Payments of the Contract Price shall be paid in the manner following: 50% AT JOB
START, BALANCE ON THE DAY OF COMPLETION at the job site.

Article 5. General Provisions EXHIBIT A ADDENDUM.


Any alteration or deviation from the above specifications, including but not limited to any
such alterations of deviation involving additional material and/or labor costs, will be
executed ONLY UPON WRITTEN ORDER SIGNED BY THE OWNER AND
CONTRACTOR, and if there is any charge for such alteration or deviation, the additional
charge will be added to the contract price of this contract.

In addition, the following general provisions apply:


1. All work shall be completed in a workman-like manner and in compliance with all
building codes and other applicable laws.
2. The contractor shall furnish a description of the work to be done,and the materials to
be used.

3.Contractor may at its discretion engage sub-contractors to perform work hereunder,


provided Contractor shall pay said sub-contractor and in all instances remain
responsible for the proper completion of this Contract.
4. ALL CHANGE ORDERS SHALL BE IN WRITING, AND SIGNED BY THE OWNER
AND CONTRACTOR, and shall be incorporated in, and become part of the contract.
Extra work not included here-in shall be additional in cost to proposal price and mutually
agreed to in writing.
5. Contractor is licensed and bonded in state of Oregon.
6. Owner shall provide and obtain all permits necessary for the work to be performed if
required.
7. Contractor agrees to remove all debris created from construction.
8. In the event Owner shall fail to pay any periodic or installment payment due
hereunder, Contractor may cease work without breach pending payment or resolution of
any dispute.
9. All disputes hereunder shall be resolved by binding arbitration in accordance with
rules of the American Arbitration Association.
10. Contractor shall not be liable for any delay due to circumstances beyond its control
including strikes, casualty or general unavailability of materials, or the difficulty with the
hand excavation of the subject property for any reason.
11. Contractor has reviewed the subject property at here-in states that the correct
installation of French drain groundwater removal system(s), and rain drain discharge
systems, will substantially reduce, or stop water from entering below grade.

12l The undersigned homeowner/homeowners acknowledge/ acknowledges receipt of


the following documents in conjunction with this proposal and herein acknowledge that
they have read and understand the disclosures given to them concerning contractor law
in Oregon. The documents are ”Information notice to owner about construction liens”,
“Owners duty to notify contractor in the event of a residential construction dispute”, and
the “Consumer protection notice”, as well as “Notice of Procedure”. Oregon homeowners
have a right to file a claim with the construction contractor board for work that is not
consistent with the terms of the original contract for work, subject to mandatory
arbitration and mediation hearings, attended by parties to the claim, conducted to
resolve the claim.

Article 6. Additional Terms


1. The following terms and conditions apply: PARKING ACCESS REQUIRED FOR
CREW AND TRAILER IN MOST CASES FOR THE DURATION OF THE
CONSTRUCTION PROPOSED.

CONSULT THE NATIONAL FLOOD INSURANCE PROGRAM FOR GUARANTEED


WATER PROGRAMS. FEMA SPONSORS THE NATIONAL PROGRAM.
