AFFIDAVIT
I, ENRIQUE NARANJA, Filipino, of legal age, with residence address at Sitio
Carael, Brgy. San Vicente, Dasol, Pangasinan, after having been duly sworn to in
accordance with law depose and state:
1. That I am now 69 years old and born on October 1, 1940 at Sitio Carael,
Brgy. San Vicente, Dasol, Pangasinan where our family owns several parcels of lot
(lots below Lot 2223 and Lot 2245 of Dasol Cadastre);
2. That I grew up in the said birth place and I never left the same, whether
temporarily or permanently, up to the present;
3. That I worked with Mr. Menardo R. Jimenez at the age of 12 as cowboy in
his ranch.
4. That as a cowboy, I, along with other workers, took care of about 350
cows, 40 horses, 200 goats and 10 carabaos all belonging to Mr. Jimenez.
5. That I am familiar with the land which is now known as Lot 2195 because it
is not that far from our own lands and in fact I pass by the said property every time I
look for the animals in the ranch.
6. That during the late 1940s to 1950s, Lot 2195 is characterized by a rolling
terrain and is in fact a forest because it was planted by many trees; that the nearby
lots are also deeply forested being planted with kakawate, aroho, pandan and other
forest trees.
7. That Lot 2195 and its adjoining and contiguous Lot 2196 are actually
owned by Pedro Cristobal in the late 1940s up to early 1970s.
8. That during those years, Pedro Cristobal is in possession of Lot 2195,
cultivates the same, and in fact engages in the primitive practice of Kaingin
System having been granted the concession to cut trees for lumber.
9. That during the late 1970s, Pedro Cristobal sold Lot 2195 to Bernabe
Breguerra.
10. That I personally know Bernabe Breguerra; that he is the son of Silvestre
Breguerra and brother of Teofilo, Dominador and Francisco, all surnamed Breguerra.
11. That Bernabe Breguerra and his siblings used to go to Carael Elementary
School situated in Sitio Carael, San Vicente, Pangasinan.
12. That the Breguerras lived in a house erected in a land which is now known
as Lot 2186.
13. That the house of the Breguerras is estimated to be 1 kilometer away
from Carael Elementary School.
14. That Bernabe Breguerra openly, continuously, exclusively and notoriously
occupied Lot 2195 by planting rice thereon through upland rice planting technique
(sabog-tanim) because there was no irrigation and he only relied on rainwater for
the water of the riceland.

15. That Lot 2195 is a fertile land as evidenced by the good quality of the
palay harvested by Bernabe Breguerra and he did not even use fertilizer during
those times.
16. That during April of every year Bernabe Breguerra starts clearing Lot
2195 by setting afire the cogon grass in the land and thereafter plowing the same in
preparation for the planting of the rice.
17. That during May of every year, Bernabe Breguerra would already sow the
palay so that by June when the rainy season already starts, the rice plants would
already start to grow.
18. Three months after, Bernabe Breguerra would already harvest the palay
which are usually tall plants and these ordinary palays are harvested through
hand harvest.
19. That I saw the Breguerras, including Bernabe, when they harvest the
palay every time I pass by their property.
19. That Bernabe Breguerra later sold Lot 2195 to Mr. Menardo R. Jimenez.
20. That after Mr. Jimenez bought Lot 2195, he planted mango trees thereon
and these trees still exist in the said lot.
21. That in the 1980s, the main business of Mr. Jimenez is still his ranch since
the mango trees are still growing and are not yet bearing fruits.
22. That in the 1990s, the mangoes started to bear fruits and we usually
harvest truckloads of mango fruits coming from the trees planted in Lot 2195 as
well as from all other trees planted in Mr. Jimenez lots.
23. That at present, I am employed by Mr. Jimenez as farmer in his 408hectare farm located in Barangays San Vicente and Malimpin in Dasol, Pangasinan.
