Dont Waste Washington Act of 2017
AN ACT Relating to operation of nuclear fueled thermal power plants; adding a new section to chapter 70.98 RCW;
and creating a new section.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. The people of the state of Washington find that, if the United States government fails to provide
a permanent repository for the safe disposal of high-level radioactive waste, including irradiated fuel from nuclear
fueled thermal power plants, then the people of the state will face the undue financial burden of paying for the
construction and maintenance for the indefinite future of a high-level radioactive waste repository in Washington.
The people of Washington State further find that United States Geological Survey studies of faulting in Washington
indicate the potential for greater seismic activity than was known when the Columbia Generating Station was originally
licensed, and the people seek additional study of the site and confirmation that it meets federally determined
earthquake standards.
The people of Washington state further find that efficient energy alternatives and renewable energy resources are
immediately available to replace the Columbia Generating Station nuclear plant.
NEW SECTION. Sec. A new section is added to chapter 70.98 RCW to read as follows:
Initiative Measure No. 855, filed April 14, 2016
(1) No nuclear fueled thermal power plant, including the Columbia Generating Station, located on the Hanford
Nuclear Reservation and formerly known as the Washington Public Power Supply System nuclear plant No. 2 or WPPSS
2, is allowed to operate in this state until the Energy Facility Site Evaluation Council finds, through an evidentiary
proceeding:
(a) That the operation of a repository for the disposal of high-level radioactive waste produced by the nuclear fueled
thermal power plant, including irradiated nuclear fuel, has been licensed by the United States government and
provides for the immediate acceptance and terminal disposition of this waste, with or without provision for retrieval;
(b) At the time a waste repository becomes available, operation of any nuclear fueled thermal power plant, including
the Columbia Generating Station nuclear power plant, would be cost-effective, as defined in RCW 80.52.030; and
(c) Any operating nuclear fueled thermal power plant, including the Columbia Generating Station nuclear power
plant, can withstand the maximum credible earthquake without harm to the public and complies with the current
seismic protection requirements of the United States Nuclear Regulatory Commission, 10 C.F.R. Part 100 (reactor site
criteria), or any subsequent modification of those criteria. Prior to any such finding, the Energy Facility Site Evaluation
Council shall cause an independent geologic investigation and engineering analysis to be performed, paid for by the
owner or owners of the operating nuclear fueled thermal power plant, to identify and evaluate all geologic faults
underneath and in the vicinity of the plant, the potential magnitude of subduction zone earthquakes and their

connection to geologic faults underneath and in the vicinity of the plant, and the adequacy of the plant design to
withstand major earthquakes.
(2) The legislature may refer to the voters, for their approval or rejection, a measure temporarily suspending or
repealing subsection (1) of this section, upon a declaration that there is an emergency need for electric power that
cannot be obtained from any alternative energy resource, including conservation.
NEW SECTION. Sec. If any provision of this act or its application to any person or circumstance is held invalid for any
reason, including federal, the remainder of the act or the application of the provision to other persons or circumstances
is not affected.

the state Energy Facility Site Evaluation Council makes certain findings regarding nuclear waste disposal,
cost effectiveness, and earthquake safety.

BALLOT MEASURE SUMMARY


This measure would prohibit nuclear-fueled thermal power plants
from operating in Washington until the state Energy Facility Site
Evaluation Council finds, after an evidentiary hearing, that a
federally-licensed high-level nuclear waste disposal repository is
operating and will immediately accept nuclear waste and spent
fuel , that continued operation of the power plant is cost-effective,
and that the power plant can withstand the maximum credible
earthquake. These provisions may be suspended by public vote in
an emergency.

To the Honorable Kim Wyman, Secretary of State of the State of
Washington:
We, the undersigned citizens and legal voters of the State of
Washington, respectfully direct that this petition and the proposed
measure known as Initiative Measure No. 855 and entitled Concerns
the operation of nuclear-fueled thermal power plants, a full, true, and
correct copy of which is printed on the reverse side of this petition,
be transmitted to the legislature of the State of Washington at its
next ensuing regular session, and we respectfully petition the
legislature to enact said proposed measure into law; and each of us
for himself or herself says: I have personally signed this petition; I
am a legal voter of the State of Washington in the city (or town) and
county written after my name, my residence address is correctly
stated, and I have knowingly signed this petition only once.

Dont Waste Washington and Worker Retraining Act of 2017
AN ACT Relating to the operation of nuclear fueled thermal power plants; adding a new chapter to Title 70 RCW; and creating
a new section.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. The people of the State of Washington find that the continued operation of the nuclear fueled thermal power plant known
as the Columbia Generating Station, previously known as the Washington Public Power Supply System nuclear plant No. 2 or WPPSS 2, located
on the Hanford nuclear reservation, is financially injurious to the electric power customers of the state due to costs that, since 2009, are
consistently higher than that of replacement power in the marketplace.
The people of Washington State further find that the prospects for excessively expensive electric power from the continued operation of the
nuclear fueled thermal power plant are unlikely to change, because of (1) declining regional electric power demand due to energy
conservation, (2) competition from cheaper energy sources, and (3) increasingly degraded physical conditions at the facility which is nearing
the end of its forty year designed life, requiring increasingly expensive amounts of repair and capital improvements.
The people of Washington further find that, if the United States government fails to provide a permanent repository for the safe disposal of
high-level radioactive waste, including irradiated fuel from nuclear fueled thermal power plants, then the people of our state will face the
undue financial burden of paying for the construction and maintenance for the indefinite future of a high- level radioactive waste repository in
Washington.
The people of Washington state further find that Energy Northwest, a state-chartered joint operating agency previously known as the
Washington Public Power Supply System (WPPSS), has
consistently shown that it is not a capable or credible agency to manage expensive and complicated nuclear fueled thermal power plants, due
to its history of default on nuclear power plant projects No. 4 and 5, which at the time were the largest municipal bond default in United States
history, and the cancellation of nuclear power plant projects No. 1 and 3, whose bonding costs still make up seventeen percent of the regional
rates of Bonneville Power Administration customers, continuing to this day with its lack of sound fiscal oversight of the aging nuclear power
plant No. 2, now known as the Columbia Generating Station.
The people of Washington State further find that United States Geological Survey studies of faulting in Washington indicate the potential for

NEW SECTION. Sec. (1) No joint operating agency chartered by the state may continue to operate a nuclear fueled thermal power plant beyond
a date two years after the effective date of this section.
(2) Notwithstanding subsection (1) of this section, this section does not prohibit any joint operating agency chartered by the state from
maintaining storage of irradiated spent nuclear fuel and other nuclear wastes, maintaining a nuclear fueled thermal power plant that is shut
down, or planning and executing the decommissioning of a nuclear fueled thermal power plant.
NEW SECTION. Sec. (1) No nuclear fueled thermal power plant, including the Columbia Generating Station, located on the Hanford Nuclear
Reservation and formerly known as the Washington Public Power Supply System nuclear plant No. 2 or WPPSS 2, is allowed to operate in this
state until the Energy Facility Site Evaluation Council finds, through an evidentiary proceeding:

this section, upon a declaration that there is an emergency need for electric power that cannot be obtained from any alternative energy
resource, including conservation.
NEW SECTION. Sec. (1) The Department of Commerce shall establish a task force for the retraining and employment of nuclear power plant
workers, with an emphasis on future employment in
renewable energy and energy conservation industries, environmental cleanup, and nuclear power plant decommissioning work.
(2) In compliance with RCW 43.01.036, the task force shall present its plan to the governor and the legislature within four months of the
effective date of this section.
NEW SECTION. Sec. If any provision of this act or its application to any person or circumstance is held invalid for any reason, including federal,
the remainder of the act or the application of the provision to other persons or circumstances is not affected.
NEW SECTION. Sec. Sections 1 through 3 of this act constitute a new chapter in Title 70 RCW.

repository is operating and accepting waste. The measure would
prohibit state-chartered joint operating agencies from operating
nuclear power plants. It would establish a task force for retraining
and employing plant workers.
