the “Motion of Attorney General Kathleen G, Kane to Quash Based on Selective and Vindictive
Prosecution,” fled upon the docket on April 27, 2016, and the Commonwealth's response
thereto
1, The motion is stricken because it fails to conform to Pa.R.Crim.P. 575(A)(2)(c) and (d).
2. The “Memorandum of Law in Support of Attorney General Kathleen G. Kane’s Motion
to Quash Based on Selective and Vindietive Prosecution,” and the “Reply Memorandum
of Law in Support of Attorney General Kathleen G. Kane's Motion to Quash Based on
Selective and Vindietive Prosecution” are stricken.
3. Defendant is granted leave to file, within 10 days from the date of filing of this order, an
amended motion that states, in consecutively numbered paragraphs, each containing only
one material allegation as far as practicable: (j) the grounds for the motion; (ji) the facts
that support each ground; and (iii) the types of relief or order requested, as she is
obligated to do by Pa.R.Crim.P. 575(A)(2\(¢) and (@).
4, If defendant files an amended motion, the Commonwealth is ordered to file, within 10
days after the date of filing of the amended motion, an answer that conforms to
PaR.Crim.P. 575(B)(3).5, Ifdefendant files an amended motion, she is granted leave to support it by filing a brief
within 10 days after the expiration of the period within which the Commonwealth may
file its answer.
6. If defendant files an amended motion, the Commonwealth is granted leave to file a brief
in response to the amended motion, which brief shall be filed within 10 days after the
expiration of the period within which defendant may file her supporting brief.
