Since 2014, Board President Joseph Licata has been using Lodi school employee Jamie
Ciofalo during school days to generate money for his employer "The Boys & Girls Club of
Lodi/Hackensack" and for "Lodi Cares" (a nonprofit created by Joe Licata and Jamie Ciofalo
listed at Licata' s home address, 42 Riverview Ave). (Exhibit A)
Joseph Licata benefits directly (financially and personally) from this arrangement.
Ciofalo's "workshops" are mostly filled by out of district attendees and have become a large
revenue source for the Club. Joseph Licata receives a very high salary from the Club and that
salary is determined by revenue sources. As for the money going to "Lodi Cares", Ciofalo and
Licata are fundraising for their nonprofit during school days.
Listed below are written statements made by either Licata or his attorney in their motion
to dismiss. I will provide proof arguing otherwise.
A) Licata 's Attorney: Mr. Licata receives no remuneration or benefit as a result of the
Club's Educators' Training Institute. (page 5)
1) The Executive Director's compensation is based on revenue sources and
fundraising ability. A director cannot collect a six figure salary if the revenue
sources are not there. If Licata opens the Club's books to the public, it will show
that The Educators' Training Institute has become a very large revenue source.
2) Licata receives a benefit when funds are sent to his home address for "Lodi
Cares". That money is spent with very little oversight.
When Licata and Ciofalo had access to Lodi Drug Alliance funds, they used that
money to enrich themselves. They spent it on products (i.e. anti-bullying
software) that Ciofalo profited off of. They paid business associates of Ciofalo.
Licata received thousands in "consulting fees".
"Lodi Cares" was established after I began questioning the misuse of Lodi Drug
Alliance funds.
Jamie Ciofalo has created a very large number of "educational" businesses since
being hired by the Lodi BOE. None existed when he was employed by the Fort
Lee BOE. (Exhibit B)
When Licata disperses any "Lodi Cares" funds for good causes, he sends a picture
and story of himself to the "Community News". This benefits his political
profile. He receives credit for the funds raised by a school employee during a
regular school day.
B) Licata 's Attorney: Since the Board of Education is required to p ay attendance fees
and mileage when employees attend workshops given by other entities, the Boys
and Girls Club Training Institute confers a cost savings benefit to the Lodi Board
of Education. (Page 5)

C) Licata 's Attorney: Mr. Ciofalo was given permission to use a professional
development day when giving a workshop at the Boys & Girls by the
Superintendent. The Lodi Board of Education did not vote on this matter. (Page 6)
1) The Superintendent received a $4,187.50 merit bonus from this arrangement.
(Exhibit C)
2) The Superintendent does not have the authority to casually tell an
administrator that they can use numerous professional development days each
month, not to attend workshops to help him become better at his job, but to
generate money for the President of the Board of Education.
3) Each month the Board of Education votes to approve Professional
Development days for employees regardless of the costs involved. If an
employee is out during a regular work day, the Board has to approve those
days. Jamie Ciofalo' s name does not appear on those attachments, confirming
the above statement from Licata's attorney.
4) This arrangement did not exist in Ciofalo's contract for the previous school
year. Attached is the only mention of Conventions/Workshops in Ciofalo's
2014-15 contract. (E:Xhibit D)
DJ Licata's Attorney: Mr. Ciofalo is not paid by the Boys & Girls Club when he gives
professional development workshops at the Club. (Page 5)
1) Mr. Ciofalo is paid by the taxpayers of Lodi when he gives professional
development workshops at the Club to predominantly out of district attendees. Mr.
Ciofalo uses his workshops as a means to promote himself as an anti-bullying guru.
He uses it as a platform to promote his many side businesses and his book. Yet, he
does not use any personal, vacation, or sick days when he is at the Club. Each time
he is absent from school to be at the Club, his absence is listed at "other". Attached
are two years attendance records which show 41 and 44 absences. (Exhibit E)
2) Joe Licata was always listed as the "Contact Person" for Ciofalo's workshops at
the Club. He arranged the workshops. He solicited business. He collected the
money. He managed the money. Attached are some older advertisements listing
Licata as the "Contact" person. (Exhibit F)
4) After I began questioning the ethics of this arrangement, Joe Licata's name was
removed from future ads as the "Contact" person. Attached are more recent ads not
listing Licata's name. (Exhibit H)
B) Licata's deliberate omission of income sources from his annual financial disclosure
statements has been long term and on-going. Licata omitted the same income sources
from his 2016 Annual Financial Disclosure Statement. That form is attached. (Exhibit J)

Since 2013, the Lodi Mayor and Council(Licata's mother is the Deputy Mayor)
has been paying Joe Licata a minimum of $1,400 each year for what they refer to
as "Consulting Fees" for supposed coordination involving the Lodi Drug Alliance
(aka Lodi Municipal Alliance). Licata has been paid additional bills exceeding
the $1,400. Disclosure forms require that any consulting fees exceeding $250 be
reported. Prior to my questioning the mayor and council, the bills actually used
the words "Consulting fees". The language on the bills changed after questioning.
Attached is a bill from 2013. (Exhibit K)
2) Attached aTe a few of the paid Borough bills from 2014 and 2015 that should have
been disclosed on the 2015 and 2016 annual financial disclosure statements.
More bills are available upon request. (Exhibit L)
3) The disclosure of Licata's consulting fees is very important because:
a) Licata's mother is the Deputy Mayor of Lodi and a teacher in the Lodi
schools.
b) Three of the five council members approving the bills for Licata were
employed by the Lodi Board of Education.
c) The Mayor and Council claimed that Jamie Ciofalo was a member of the Lodi
Municipal Alliance (there was no official record that a committee even
existed).
d) Evidence shows that Licata submitted fraudulent invoices. On multiple
occasions, the Borough's response to OPRA requests showed that Licata was
paid for completing financial reports that were never submitted and
facilitating meetings that never took place. (Evidence M)

A) Attached is Advisory Opinion A08-15 . Circled is the section that applies to Joe
Licata's situation. (Exhibit 0)
B) Since the superintendent pay cap was enacted in 2011, Lodi Superintendent Frank
Quatrone has received the maximum merit bonus of $25,108 each year.
1) Joe Licata has set and approved the merit criteria each year. He has voted YES to
award the $25, 108 at the end of each school year. He cast all these votes without
the Board invoking "Doctrine of Necessity". The Board never invoked Doctrine
of Necessity when Joe Licata voted YES to approve the merit goals set at the
August 26, 2015 meeting. That vote can be found on the minutes Licata attached
to his certification.
2) The Lodi BOE failed its QSAC review in 2015. You can review the Department
of Education's Report Card for Lodi High School and Middle School to see how
poorly the district is performing. Frank Quatrone will always be guaranteed his
$25,108 bonus because he recommends the Board's family members for jobs and
promotions. Being this complaint is against Licata, I will focus on what Quatrone
has done for his family.
a) Quatrone recommended Niki Paci be hired as a teacher (began September
2012). She is now Licata's wife. She was Board Member Joe Licata's
girlfriend at the time of the recommendation. Attached is Licata' s twitter
page showing their relationship in July 2012. (Exhibit P).
b) Quatrone recommended Niki Licata for tenure.

ratio, and implementing additional guidance programs in all grade levels throughout the

year by topic, grade level, and month.

This merit goal was achieved. A dually certified SAC/School Counselor was hired to replace a
full-time SAC Counselor, a part time secretary and a part-time Student Services Consultant
was hired to replace a full-time secretary.

CONVENTIONS/WORKSHOPS
A. The Board agrees that EMSSAA members shall be encouraged to attend national,
state and county meetings of professional organizations. Members shall request, in
writing, permission to attend conventions and seminars with $500 per year being
the maximum amount to be spent by each member for either a state convention(s),
workshop(s), and/or seminar(s).

At a time when the Lodi BOE is trying give Frank Quatrone a $4, 187 .50
merit bonus to: "Restructure the Guidance Department at Lodi High
School to increase the overall effectiveness and efficiency of the
department, ... ", it would probably be beneficial to have the Supervisor of
Guidance pay more attention to his job at Lodi High School and less on
his personal consulting businesses.

Mrs. Licata has used politics to land political jobs for almost every
family member. But that hasn't been enough. She demands more from
the taxpayers of Lodi. With the October bills, she continues to use her
public office to funnel even more money her family's way. Her son,
Joseph Licata of the Lodi BOE, received ANOTHER $500.

She has been creative with his "consulting fees". This month, the bills
list him as the "Lodi Drug Alliance Coordinator" for $500. Before that,
they listed him as "Grant Coordinator Drug Alliance" or just "Lodi Drug
Alliance Consulting Fee" for $350.
When asked at a council meeting months ago if it was an ethics violation
to have an immediate family member being paid for "consulting fees",
everybody played dumb. Mrs. Licata said she believed he was
reimbursed for something and Schrieks fabricated some story like he
normally does.
Instead of ending their bad practices of nepotism abuse and unethical
behavior, they just change descriptions on the bills.
Here is just a snapshot of the Licatas appearing on some monthly bills I
chose randomly:

Months ago, Marc Schrieks said that it is Joe Licata's job at the Boys
Club to apply for grants. I am sure the Boys & Girls Club pays him a
salary. Why would the town pay him additionally for what he is already
being paid for?
Years ago, when first asked to explain her son's consulting fees, Mrs.
Licata answered, "I don't know what they are for. I can call and ask him
if you really care." I am sure Mrs. Licata did ask him.
Three years have passed. Still no answer. In fact, she has only grown
angrier and more defiant when questioned.
Joe Licata was NOT receiving consulting fees from the borough prior to
his mother sitting on the council. Joe Licata was NOT employed by the
Boys & Girls Club prior to joining the Board of Education.
Hopefully, someone can help Mrs. Licata answer the following questions
as she enters year four:
Why did Joe Licata's consulting fees begin only after his mother joined
the council?
Is Joe Licata doing his "consulting" or "coordinating" during his hours at
the Boys & Girls Club?
How many hours does he supposedly work when he bills $550 to Lodi?

MAC (according to their own meeting minutes or anyone in
attendance at council meetings).

Joe Licata's DJ page has recently been deleted . This is what it said:
Joe Licata joined DJ Express when he was a 16 year-old sophomore in High School, and graduated from Seton
Hall University with a B.A. in Political Science. Joe has grown from a novice assistant to owner Joe Zisa, to an
articulate and energetic MC and advanced DJ, which makes him vital to the success of DJ Express Entertainment.
Throughout his youth Joe was constantly exposed to music. His father Frank Licata (aka Franche Coma) was the
original lead guitar player for the ground breaking punk rock band, The Misfits. Joe's father opened his ears to
the sounds of all types of music from Jazz, to Rhythm and Blues, to Disco, to Motown, and Rock and Roll. This
great musical foundation provided the drive and resources for Joe to develop into the great asset that he is
today to DJ Express Entertainment. Throughout his time at DJ Express Joe has developed a tremendous
knowledge of various musical genres by working with and learn from owner Joe Zisa. Joe's experience in music
includes oldies, Motown, disco, rock and roll, mainstream radio, hip-hop, regge/reggaeton, club, Italian, and
Latin. His experience in music and his lively personality as an MC, contributes to his likeability among employees
and clients. He knows what to play and when to play it. Simply said, he knows how to get the crowd going. Joe

The Board member's spouse is a member of his "immediate family" as defined by the
Act at N.J.S.A. 18A:12-23. The Board member must recuse from participation, including
discussion and voting, on the Superintendent's evaluation and contract. This prohibition also
applies to the same matters with regard to the elementary principal who supervises the Board
member's spouse, and other administrators supervising the spouse including the supervisors of
those administrators. Failure of the Board member to recuse from every matter touching upon
the Superintendent's position and that of other relevant supervisors would represent a violation
of the Act.
The Commission acknowledges your concern that the Board of Education is a five
member body and that as the Board member is conflicted and unable to vote on many matters,
the Board may now be more likely to result in many tied, 2-2 votes. The Commission views that
scenario as little different from that of a nine member board with a single conflicted member,
which may result in that board to having many tied, 4-4 votes. Finally, in the situation as
explained in your request, the Commission notes that the Board maintains a quorum of nonconflicted members to successfully vote on matters related to the Superintendent and other
school administrators. Therefore, the Board cannot invoke the Doctrine of Necessity should a
vote on one of those matters result in a tie. The Doctrine of Necessity may only be invoked
when a majority of the Board is conflicted on a matter.
