Royal Decree amending the Royal Decree of 7 July 1994 laying down the basic standards
for the prevention of fire and explosions which new buildings must meet.

To all those present and to come, Greetings.
Having regard to the Act of 30 July 1979 on the prevention of fire and explosions and on
obligatory civil liability insurance in the same circumstances, in particular Article 2, as
amended by the Act of 22 May 1990;
Having regard to the Royal Decree of 7 July 1994 laying down the basic standards for the
prevention of fire and explosions which new buildings must meet, as amended by the
Royal Decrees of 4 April 1996, 18 December 1996 and 19 December 1997;
Having regard to the opinion of the High Council for the Prevention of Fire and
Explosions;
Having regard to the fulfilment of the formalities stipulated by Directive 98/34/EC of the
European Parliament and of the Council laying down a procedure for the provision of
information in the field of technical standards and regulations;
Having regard to the opinion of the Inspector of Taxes, of [date];
Having regard to the opinion of the Council of State;
At the proposal of Our Minister for the Interior, and following the opinion of Our
Ministers who have debated this in Council,
We have decreed and hereby decree:
Article 1:
An Article 2(a), worded as follows, shall be added to the Royal Decree of 7 July 1994
laying down the basic standards for the prevention of fire and explosions which new
buildings must meet, as amended by the Royal Decrees of 4 April 1996, 18 December
1996 and 19 December 1997:
Article 2(a):
A committee on equivalence and derogation shall be set up, hereinafter called the
Committee, whose composition and function shall be determined by the Minister for the
Interior.

Article 2:
The following paragraph shall be added to Article 3 of the same Decree:
The Minister for the Interior, following the opinion of the Committee, shall
acknowledge the equivalence of the level of safety offered by this product to the level of
safety required by the Annexes to this Decree.
Article 3:
Article 4 of the same Decree shall be replaced by the following Article:
The Minister for the Interior may, after hearing the opinion of the Committee, grant
derogations with regard to the implementation of one or more of the technical
specifications contained in the Annexes to this Decree.
New buildings for which a derogation is requested must offer a level of safety that is at
least equivalent to the required level of safety in accordance with the Annexes to this
Decree.
The Minister for the Interior shall set out what is to be contained in a derogation request
and how a request shall be processed.
Article 4:
Our Minister for the Interior shall be responsible for the implementation of this Decree.
