August 4: The rebirth of a new

Kenya
THE FRIDAY BULLETIN COMMENT

Next week on Wednesday August 4 will be a defining moment for Kenya. It is a day when millions
of Kenyans are hoping it will be the culmination of
a two decades old journey in search of a new constitutional dispensation.
This was a tumultuous journey, a macabre and sad period
in the history of the country which saw several Kenyans losing their precious lives, injured, maimed and detained in the
struggle to bring about an atmosphere whereby the rule of
the law and respect of human rights will prevail.
Expectations are high that the proposed constitution will
usher in a new era where individual rights for the first
time in the independent history of the country will
be respected. More so, it is the first time that an
attempt is being made to incorporate the views
of Kenyans in the document, a far cry from the
earlier dispensations where only the privileged
few were chosen to chart a document which affects the livelihood of millions of people.
The culture of injustice and impunity where individual rights were taken for granted has been
engrained in the country since independence.
It should be remembered that Muslims have been
among, if not the worst victims of this perpetual culture of injustice. It is the only community which has officially
been treated as second class citizens, it is only Muslims who
have been in their thousands mistreated and harassed at the hands
of state security agents and we are the only community to be subjected
to carry two national identity cards while others
were only required to have one.
While every Kenyan is free to travel to any part of the
country without any encumbrances, in some Muslim areas it
becomes a crime if you travel without identity papers.
The war on terror terrorized Muslims to a level never witnessed

with. It is no wonder that a section of the security agencies have
been strongly opposed to the document which in their estimation
will curtail their attitudes to circumvent the rights of Kenyans.
While we are not expressly saying that the proposed constitution will
provide an all round solution to some of the longstanding problems
which have plagued the community and the country as a whole,
looking at the bigger picture, it will no doubt go a long way in addressing such ills.
With this presumptions, Muslim leaders after wide consultations
came to the conclusion that the proposed constitution captures the
spirit of justice, equality, good governance, equitable distribution of
national resources and provides a better future for Kenyans where
the rights to vital social services like education and healthcare are
recognized.
In addition to this, it provides a framework for a better system of remedying past injustices to communities which have been wronged.
This is also a document which will ensure more involvement of the
citizens in important national decision making processes, appropriately caters for women and marginalized groups and through
counties will ensure that local authorities have a bigger say in development programmes which are in tandem with the aspirations of
the local people.
Compared to the 2005 referendum where there existed rifts among
Muslims, this time around, it is a united stand from the religious and
political leaders who have expressly affirmed that Muslims have an
obligation to support the proposed constitution as it is positive on
protecting and safeguarding the interests of the community.
We have to realize that we are not living in a cocoon but in a multi
cultural, religious and ethnic society comprising of people of different backgrounds whom we co-exist and interact with at different
levels. On the large part, we live with non-Muslim neighbours, our
children attend schools where their classmates come from different
backgrounds, we interact and do business with people from different faith backgrounds. In these circumstances, we cannot sit aloof
from prevailing issues which will ultimately have a great bearing on
our life as citizens of this country. The constitution is a document
which summarizes the national aspirations and it should be borne
on us that Muslims too have stake in this country and it therefore
becomes incumbent on us to participate in the political affairs of the
country.
A lot of gains have been enumerated which will impart positively on
the Muslim community, far better than what is espoused in the current constitutional framework.
The proposed counties will bring services much closer the people
and in addition to this will allow a decentralized structure where the
local authorities will be able to formulate bylaws which will be in
tandem with the local environment.
Dual nationality will be of greater benefit to Kenyans living in the
diaspora who currently face several constraints in their motherland
after losing their original nationality to take up citizenship of other countries. For Muslims this is welcoming news as it will greatly
reduce on the tribulations many community members with foreign
passports go through at Kenyas entry points and while transacting
business in the country due to the terrorism profiling.
With an avenue to get back their lost citizenship, such obstacles
will be set aside thereby enabling them to further engage more in
social-economic development.
Our girls are facing a hard time in schools where they are denied the
right to wear the hijab and practice their religion. In worst scenarios,
Muslim children are forced to attend Churches in an attempt to force
them to abandon their religion. A significant number of Muslim pupils in many schools including public schools in many parts of the
country are forced to learn Christian Religious Education instead of
the prescribed Islamic Religious Education which is what their faith
entails. The far reaching impact of this is that some of these young
ones will grow up with scanty knowledge of the prescribed teachings
of Islam and leaving them susceptible to spiritual manipulation.
The proposed constitution is emphatic on the protection of the rights
of all individuals and categorical outlaws practices where pupils will
be forced to subscribe to practices which are against their religious
practices.

For the last 47 years, the culture of discrimination has been perpetuated on Muslims. From being treated as second class citizens to
open discrimination in the issuance of vital national documents like
national identity cards and passports, the unfair treatment has been
as a matter of fact an official policy perpetuated on Muslims.
Only a few years ago, a Muslim applying for a passport to go for
Hajj was issued with a passport only limited to travel to Saudi Arabia
despite the payment of the full fees.
It is in this country where twin brothers in Kisumu were subjected
to different procedures based on their faith backgrounds during the
ID application process. While it was an easy task for the Christian
brother to get the document, it was a different case for his brother
who had embraced Islam as he was told to produce document for
his grand parents to attest that he was indeed a Kenyan.
Such discriminatory policies which are based on religion and ethnic
background will have not room in the event that the new constitution
comes to pass.
Some concerns with regard to the Kadhis courts have been expressed by some Muslims who see that the powers of the courts
have been reduced in the proposed constitution. The addition of the
wording And submit to the Kadhis courts somehow waters down
the powers of these courts but contrary to some views this does not
significantly alter the role of the courts in its activities.
A true Muslim is expected to submit to the jurisdiction of Islam and
with the Kadhis courts whose role is to arbitrate on personal matters of Muslims it is expected that EVERY Muslim who will be before
a Kadhis court will SUBMIT to its jurisdiction. For a Muslim who
believes that the Kadhis court has an important role to play in their
lives, the supposed alteration in essence changes nothing.
In addition to this, the present system allows for an appeal at the
high court against rulings from the Kadhis court and this effectively
means that even if the wording in the present constitution was to be
retained, for those who do not wish to submit to the Kadhis courts
will still have their way.
The presumption that the constitution will also allow women to be
Kadhis have also been aptly addressed by Muslim lawyers who
have argued that the courts serve Muslims and their operations are
legally confined within the parameters of beliefs of Muslims.
It is also important to remember that American sponsored evangelical churches are involved in a spirited battle which ultimately aims
at having the more than one thousand year old courts thrown out of
the Kenyan judiciary system. The efforts of the churches achieved
some progress after a three bench Judge declared-against the spirit
of the constitution-that the Kadhis courts were constitutionally illegal.
While it is a big sigh of relief that the government emphatically rejected the ruling and the Attorney General Amos Wako lodged an
appeal against the ruling, there is no firm guarantee that the ruling
will be revoked. It could go either way.
The prevailing scenario means that position of the Kadhis courts in
the present constitution-which is a fallback position in the event that
the proposed constitution -is so to speak hanging on a thin thread
and its fate lies on a few individuals sitting on the appeals bench
who will determine whether it continues to exist in the constitution.
This leaves the proposed constitution is the only sure safeguard
to protect the courts which despite their narrow limitations, at the
very least allow Muslims to conduct marriages divorce, inheritance
and succession in a manner which is in accordance with their faith.
Looked at a wide prism, the proposed constitution is a document
which will go a long way in fulfilling the aspirations of many Kenyans
whose rights have been suffocated by the decades of misrule, impunity and injustice.
For Muslims, it will be a big stride in the quest to attain dignity and
equal treatment as citizens of this country.
On this premise, we are urging upon all Muslims to sacrifice their
time and come out in big number to give their full support in endorsing the document and voting YES for the proposed constitution on
the 4th day of August. This is an individual obligation upon each
of us as a YES vote will contribute to the promulgation of the new
constitution which provides an avenue towards a better future for
Muslims and Kenyans in general.

Preparing for Ramadhan

time. It is not a competition with others but an act of worship for the
sake of Allah Most High.
Of course women who are ill or must take medications during the
day need to consult their doctors in order to see if it will be possible
for them to fast and to change the schedule of their medications.
Discuss the issue with a sheikh if you are not sure about your situation.
Whether a woman misses days of fasting due to menstruation, childbirth, pregnancy, breastfeeding or illness, these missed days should
be made up before the next Ramadhan comes. InshaAllah. Depending on her circumstances and on different schools of thought,
making up the fast may be as simple as fasting one day for each day
missed during Ramadhan, or it may require that she feeds one poor
person each day either in addition to, or in place of, fasting herself.
Women should consult reliable books or scholars to understand their
obligations in this regard. Fiqh us-Sunnah by As-Sayyid Sabiq is an
excellent source of reliable information on how to make up missed
days of fasting.
Understanding and respecting your body's physical needs and limits
during Ramadhan will help you to have more energy for taking care
of your home, family and other responsibilities
Spiritual preparation is also something that needs to be done before Ramadhan comes around it might seem silly really when you
consider we should be spiritually in tune 12 months a year. We all
seem to get caught up with our hectic schedules and all of a sudden you hear Muslims say: oh no Ramadhan is in 2 weeks and its
panic time! Some women busy themselves with spring-cleaning
their homes but often we forget to warm up and fine-tune our selves
in readiness for this mighty month
Cleanliness - Whenever a guest comes, we prepare in advance for
his arrival by vacuuming the carpet, dusting the shelves, and scrubbing the sinks. We should do this for our guest called Ramadhan.
But the scrubbing should not just be of our physical surroundings, it
should include the scrubbing of our sins.
Listen to the words of our Prophet Muhammad (peace be upon him),
speaking about those people that do not want to clean up for Ramadhan, "Whoever does not desist from speaking falsehood and
acting upon it, Allah has no need that he desist from his food and
drink." (Bukhari)
Fasting in Sha'baan (this Month that we are now in) - The biggest
downfall of many Muslims is that they are not properly warmed up
for Fasting, some people only do it once a year making their bodies
very foreign to going without food and drink.
From here we see the following Sunnah: Ummul-Mu'mineen Aisha
(may Allah be pleased with her)- observes, "Allah's Messenger never fasted an entire month other than Ramadan and I haven't seen
him fast more than he did in Sha'baan."
This is a good way to prepare for Ramadhan by fasting in the moth
before. The Prophet (peace be upon him) also fasted Mondays and
Thursdays every week. We should make fasting something we do
all year round not just in Ramadhan so it becomes second nature
to us.

O you who believe! Observing al-sawm (the fasting) is prescribed for you as it was prescribed for those before you, that
you may become al-muttaqoon (the pious). (Quran al-Baqarah
2:183)
As the beautiful month of Ramadhan approaches this year, there
are several things Muslim women can do to prepare themselves
spiritually and physically for the month-long period of fasting which
is obligatory upon all able-bodied Muslims who have reached the
age of maturity.
Giving some thought to the unique concerns that Muslim women
face during this month can help us prepare for them and make the
month a more successful one. This is especially true for new reverts
to Islam (because Ramadhan is such a new experience) and for
married women in general because of the extra responsibility they
typically have to make sure that the iftar (the fast-breaking meal
served at sunset each day) is ready on time for their families and
any guests in addition to continuing to take care of the home, children and other obligations as usual. It is crucial, then, that women
take the time to plan for their sleep, health and other concerns before the month even starts.
It is recommended for Muslims to eat a pre-dawn meal (called sahoor in Arabic) each day before the fast begins. The Prophet, may
the peace and blessings of Allah be upon him, is reported by Anas
(may Allah be pleased with him) to have said,
"Eat a pre-dawn meal for there are blessings in it." (Bukhari and
Muslim)
Other traditions report the Prophet (peace be upon him) as saying,
"You should eat [the] pre-dawn meal for it is a blessed nourishment"
(an-Nasa'i),
and "The pre-dawn meal is blessed so do not neglect it even if you
only take a sip of water. Verily, Allah and His angels pray for those
who have pre-dawn meals." (Ahmad)
The pre-dawn meal provides energy and other benefits to the fasting Muslim during the day so it makes good sense to plan on getting
up early to have sahoor. Of course this is better accomplished if
you also sleep early so try to think about how you will arrange your
schedule once Ramadhan begins. If you typically have trouble waking up for the fajr (dawn) prayer, a new schedule in Ramadan may
be the motivation you need to change your habits for the better even
after Ramadhan has ended. Ramadhan is a great opportunity that
comes once a year to renew your relationship and commitment to
Allah
If you are accustomed to drinking tea or coffee in the morning or
during the day, be aware that caffeine withdrawal can cause severe
headaches while you are fasting. Take some time before Ramadhan to wean yourself from caffeine (perhaps gradually) and decide
whether it will be necessary to have any caffeine during the nonfasting hours in Ramadhan. It may seem like a funny thing to worry
about compared to the greatness of this Holy Month but many Muslims have experienced the phenomena of caffeine withdrawal and
know to prepare themselves ahead of time to ensure they do not
get sick from it.
Women should also know the times that they are prohibited from
fasting, such as when they are menstruating or bleeding after childbirth.
Pregnant and breastfeeding women have special permission not to
fast during Ramadhan if they feel that they or their babies will be
harmed by it, but they are not prohibited from fasting if they feel they
can handle it. This is something best discussed with a doctor and
depends on each woman's unique circumstances. It is, however,
very important that pregnant and breastfeeding women take care to
eat properly during non-fasting hours if they choose to fast. It is also
important that women do not feel any shame or guilt in breaking the
fast if they feel they must; no one has the right to put pressure on
the pregnant or breastfeeding woman to exceed her body's limits.
In fact this allowance not to fast should be considered a mercy from
Allah and not a punishment.
Likewise, women should not fast just because they do not want to
have to make their fasts up later. Health should be the prime consideration in deciding whether or not to fast. Take the fast one day at a

WOMEN ISSUES

Lady Juwayriah
A fragrant biography that lots of people of goodness wanted to be
a part of. There is no more honest, radiant or, luminous biography
than the biography of one of the Mothers of the believers. We stand
on the verge of her biography; to gain an example and a preaching,
to take blessed reachable picks from the mother of the believers' biography whom Allah the Al-Mighty, the Sublime pertained of purity.
O what a beautiful, fragrant biography. May Allah be pleased with
her and may Allah please her.
Her upbringing
She is Barra bint al-Harith bin Abi-Dhirar bin Habib bin Aa'eth bin
Malik from Khuza'a, her father was the master and chief of Bani-alMustalik. Barra lived in her father's house in
honor and respect; she lived a life of luxury in
a house where authenticity and deep- rootedness prevails. While she was quite a young
girl, not more than twenty years of age, Barra (may Allah be Pleased with her) married
Musafi bin Safwan, one of Khuzaas young
men.
The beginnings of the light
Satan started to sneak into the hearts of Bani-al-Mustalik hoodwinking and foretelling them that they are strong and can overcome the
Muslims, so they began to gear up and take preparations to fight the
Islamic community under the leadership of the Prophet Muhammad
thus they gathered to fight the Messenger.
Of their leadership was their master al-Harith bin Abi Dhirar, the result was the victory of the Prophet and the defeat of Bani-al-Mustalik
in their own piece of land. So the Prophet took a lot of men and
women captives. Musafi bin Safwan - Juwayriyah's husband - was
among the ones who were killed by the Muslims' swords and lady
Juwayriah was among the women captives, she fell under the arrow
of Thabit bin Qais bin Shams al-Ansari (may Allah be Pleased with
him), hence she made an agreement with him to pay him a certain
amount of money in return of her freedom because she was eager
to be free.
Lady Juwayriyah's marriage to the Prophet
As fate had wanted lady Juwayriah (may Allah be pleased with her)
went to see the Prophet but lady Aisha (the Mother of the Believers,
may Allah be pleased with her ) saw her and described her, saying:
''She was sweet, beautiful. and said: O by Allah as soon as I saw
her on my rooms door I hated her and I knew that he(prophet) would
see of her what I have seen.''
Lady Juwayriah (May Allah be pleased with her) came to the Prophet and said:'' I am Juwayriah bint al-Harith bin Abi-Dhirar chief of
his people, I have encountered of the matter what you have known,
and fell under the arrow of Thabit bin Qais so I had written on me
nine papers to pay him in return for my freedom, so help me in my
release.'' And because Bani al Mustalik were of the Arabs' noblest
houses, of the most honourable lineage, and for the wisdom of the
Prophet, he said to Juwayriah, "Shall I tell you what would be better
than this? She said: ''And what is that O Messenger of Allah?' .He
said: ''I pay your writing and marry you.''
A while ago she was desperate to inhale the scent of freedom, but
she found what is greater than that, so Juwayriah became very happy, her face became radiant when she heard it from the Prophet, and
security she will find after the loss and the horror, so she answered
him without hesitation or stutter:'' Yes O Messenger of Allah.'' The
Prophet married her and gave her a dowry of four hundred dirham.
Abu Umar al-Qubti in his book the Assimilation (al-Istee'ab) said:''
Her name was Barra so the Prophet changed it and named her Juwayriah.'' So Juwayriah (may Allah be Pleased with her) became a
Mother of the Believers and the wife of the master of the world.
Lady Juwayriyah's blessing
As soon as the Muslims heard the news they sat free the captives
they had and said in greatness:'' They are the in-laws of the Messenger of Allah. So Juwayriyah's blessing was one of the greatest
blessings for her people. Lady Aisha (may Allah be pleased with
her) said about her. The Prophets marriage to her caused the lib-

eration of a hundred of the people of the house of Bani al-Mustalik

- Juwayriyahs tribe-, I never knew a woman with greater blessing
than her.'
Her characteristics and features
Lady Juwayriyah was one of the most beautiful women, she was
also characterized as wise minded, relevant, with sedated opinion, and of generous ethic. She was also known for her pure heart
and inner self, and on top of that she was conscious, pious, pure,
Allah-fearing, Islamic jurist, of radiant soul and of luminous heart
and mind.
The supplicant, always remembrant of Allah
Lady Juwayriyah followed the footprints
of the Mothers of Believers in prayer and
worship quoting from the Messenger of Allah, from his ethics and his praise- worthy
characteristics till she become an example
of virtue and virtuousness. So the Mother
of Believers Juwayryiah was of the best
worshipers, suplicants, patients, and she
was persisting on praising, glorifying and remembering the EverExalted Almighty Allah.
The Hadith transmitter
Ibn-Abbas, Ubaid bin al-Sabbak, Kuraib, the freed slave of Ibn-Abbas, Mujahid, Abu-ayub Yahya bin Malik al-Azdi and Jabir bin Abdullah all reported from Lady Juwayriyah some Hadiths Prophets
sayings. She narrated seven Hadiths, four of them are mentioned
in the Six Books of Hadith, one is mentioned in the Book of Al
Bukhari, and two in the Book of Muslim. Her narrations contain hadiths about fasting, not preferring to fast on Fridays, supplications,
the reward of praising and glorifying Allah, and about mandatory
alms-giving and the liberation of slaves.
Therefore, with seven honourable hadiths, lady Juwayriah (may
Allah be pleased with her) immortalized her name in the world of
narrations. She added to the honour of accompanying the Prophet,
her motherhood to all believers, reporting to the nation some of the
Prophet's traditions.
Her death: Meeting Allah
Lady Juwayriyah has lived after the Prophet pleased and satisfied,
her life extended to the time of Mu'awiyah bin Abi-Sufian (may Allah be pleased with them). The Mother of the Believers died in the
month of Rabi' al-Awwal year fifty A.H, her body was buried in Al
Baqi' and Marwan bin al-Hakam prayed upon her.

YOUTH AND CHILDREN

By Alveena Salim

Fatal Attraction

"Did you see her walk by? I swear she was eyeing me up! My mate
reckons she is well easy!
Rating the fitness of others is one of the most common time-passing activity in most schools, colleges, universities and work places.
We are only looking it is minor. This is the defensive response
of most. So the question arises Is it really not a big deal?
Lowering the gaze is an Islamic command. Why? It is a lustful
glance that can lead to wrong thoughts. These thoughts then turn
into desires, the desires turn into firm intentions and the firm intentions are eventually transformed into actions which lead to the flirty
conversations, the lies, the deceit, the sneaking about, and then
the secret meetings. A Muslim poet once said First a look, then a
smile, then the nod of the head, then a kiss, then a hug, then the
warmth of the bed." In other words prevention is better than cure.
The Holy Prophet ( peace be upon him) said, The adultery of the
eyes is looking (at [that] which is not allowed)." (Bukhari, Muslim)
This does not only refer to those people you may encounter in person. It also means lowering your gaze when viewing members of
the opposite sex that you may see on films, adverts or billboards. It
means changing the channel when you come across images of nakedness or intimate scenes (even though you should not be watching such programmes in the first place).
Temptations, temptations... Obviously, this is not easy. After all, it
seems shameless behaviour amongst youth today is almost a competition. We are confronted with many tempting situations such as
the endless choices of satellite channels, dirty billboards that are
plastered all over the place and the minimal clothing that women
adopt as soon as temperatures increase. You need to remember,
however, that moral degeneration of the society is an excuse that
will not be valid on the Day of Judgement in the court of Allah.
Over the years, attitudes towards promiscuous behaviour has
somewhat changed. The 1960s brought about the sexual revolution where the widespread availability of birth control led to dramatic changes in attitudes towards sex and marriage. The connection
between sex and pregnancy was finally broken. Todays society
encourages equality between men and women in all aspects of life:
including immorality. This has also given birth to the bad culture,
where girls as young as 13 are smoking, swearing, fighting, drinking, disrupting lessons and some are even sexually active. The
anything you can do, I can do better mentality is the main reason
why many youth have failed.
In the eyes of Allah, however, the punishment for premarital and
extra marital sex is equal for both male and female.
In the West, strong emphasis is placed on looks, and women are
valued for their shape, size and beauty. A womans sexuality is
used to sell cars, clothes and even cat food! In Islam, women are
required to dress modestly, so that they are not judged on their
beauty. Many girls and boys dress to impress. They pass off signals
that seem to imply that they WANT people to check them out. Even
so, we are only accountable for our own actions and we will be held
accountable for every single forbidden glance regardless of how
the boy/girl was looking.
Girls, when you get decked up like heroines and go out, people
look at you. You know that. It is irrelevant whether or not youre a
decent girl. Most people judge others based on their appearance.
If someone shows an interest, then make it situation Halal by asking him to come to your house with his parents with a proposal of
marriage. If he refuses or makes lame excuses then you should
know that he does not care about you and only considers you as a
time-pass. You are worth a lot more than that. Do not allow yourself
to be messed about.
Men, honking or whistling at girls, making incoherent noises at
them and driving round and round the same block at least 20 times
in order to get a better view of girls makes you seem pathetic. No
decent girl can respect such a person. Would you like it if some
man leered at your mother or sister like that? I doubt it. So do not
try it on with other peoples sisters.
Staying on the straight path is not easy of course. We, however,
were not put on this Earth to behave like spoilt teenagers. Keeping
away from temptation may be difficult or even frustrating at times

but trust me, it is well worth it in the end. As Muslim youth we try to
live modestly and fulfill our lusts and desires only in Halal manners
and that is through marriage.

Caring for animals

A man once came to Prophet Muhammad (peace be upon
him) carrying with him his belongings and a box. He
said, "O Prophet! While I was passing through a jungle,
I heard the voice of some bird's babies. I took them
and put them in this box. The moment I did that, their
mother came fluttering round my head."
And the Prophet said, "Put them down". When the man
put the box on the ground, the mother of the young
birds joined them. Seeing this, the Prophet asked the
man who now had a look of surprise on his face, "Are you
surprised by the affection of the mother towards her
young? I swear by Him (Almighty Allah) who has sent
me, surely, Allah is more loving to his servants than the
mother to these young birds. Return these baby birds
to the place from where you took them, and let their
mother be with them."
"Fear Allah with regard to animals", said the Prophet of
Islam, "ride them when they are fit to be ridden, and get
off their backs when they are tired; surely, there are
rewards for being kind and gentle to animals, and for
giving them water to drink."
Islam has taught that in the eyes of Allah, animals also
have rights in the same way as man has. They should
not be treated badly, tortured or left to starve without
food or water.
Ali (may Allah be pleased with him) had some ducks under his care in his house. At the time of his death, he
had given particular advice to his sons to take good care
of those animals, or to set them free if it was not possible to look after them properly.
The Holy Qur'an has also guided us by telling us that,
in the eyes of Allah there is no difference between the
human world and the animal world.
"There is no beast on earth, nor bird which flies with its
wings, but they are nations like you - unto the Lord shall
they return".
The Prophet of Islam was once performing ablution
(Wudhu) for prayers from a pot of water. A cat passed
there and turned its eyes at the pot of water with a
thirsty look. The Prophet realised at once that the cat
was very thirsty, so he stopped the ablution (Wudhu)
and placed the pot before the cat. Only after the cat
had fully quenched its thirst, did the Prophet resume
the ablution (Wudhu).
By this action, the Prophet has shown that quenching
the thirst of even a small dumb animal is a noble act full
of virtue and should be given first attention before one
prepares for offering prayers to Allah.

Beware of those preaching lies on the proposed constitution

Muslims in the country have been urged to be vigilant and wary
of some individuals who are using some misconception on the
proposed constitution to create confusion amongst Ummah in the
country.
Speaking while giving the Friday sermon (Khutba) at Jamia Mosque
Nairobi, Sheikh Ibrahim Lethome cautioned Muslims of the propagandists using lies and falsehood to hoodwink them to vote against
the proposed constitution in the upcoming referendum that will take
place next week.
Some months ago, our Muslim scholars and Political leaders widely
consulted and reached an agreement that it was in our interest that
we support the proposed constitution, therefore its important that
as Muslims we are not deceived by a few individuals who are out
on personal and selfish interests to vote against the document, the
sheikh said.
The Sheikh, who is a former commissioner of Constitutional of
Kenya Review Commission (CKRC) said that as much as everyone
was entitled to their opinion and stand on the proposed constitution,
those individuals opposed to it should not purport to be speaking for
the Islamic Ummah as Muslims in the country had decided to vote
in support of the new laws.

He noted that those opposed to it were claiming the constitution will

be more supreme to Allahs Sharia clarifying that the constitution
was only supreme to laws of the land and not the Devine law of Allah as the two dont derive their source from the same place.
He added that in the new constitution, Land issues will clearly be catered for as creating the National Land Commission under section
67 will help manage public land as well as helping Muslims affected
by land issues as it will investigate land injustices in the country.
On the Kadhis court, he noted that those opposed to it were purporting that if the constitution is passed women will become Kadhis
saying that the courts work under the Islamic Sharia which does not
allow for a woman Kadhi.
As Muslims in the country we should unite and come out in large
numbers on August 4th to ensure the new law passes for the benefit
of the ummah and not individual interest, the sheikh said.
He reminded Muslims that the recent ruling on the Kadhis court
by the high court judges terming the Islamic courts unconstitutional
would be used against the Islamic institution in case the document
does not pass so it was imperative the document is supported by all
Muslims in the country.

Call to support to Muslim organisations

Support to Muslim organisation involved in
welfare activities is vital towards achieving
their objectives to extend assistance to the
Ummah.
These comments were made by Sheikh Badru
Jaffar who said that though donor taps from
outside had closed, through mobilizing local
resources, the organisations were playing an
important role in providing welfare assistance
to the Ummah.
Local resources, he added had also ensured
that the organizations were in a better situation
to focus on the prevailing problems facing the
society. In the earlier years, donors were able
to dictate what project the organisations were
to undertake. This is now over because with
mobilizing resources from within, the organizations are able to prioritize the problems of
ummah and try to solve them, he said.
The Sheikh, who sits on the advisory board
of scholars of Jamia Mosque said the situation has contributed to a much improved so-

cial service delivery in the community which

include education, health and economic empowerment projects.
Sheikh Badru also urged Muslims to contribute
financially to Muslim based projects stressing
the support will see to it that many benefits
from the services.
The Sheikh made the remarks during the presentation of the annual activities report of Maahad Dawa Organisation (MDO)
In his remarks, the MDO vice chairman Ibrahim Athman said cooperation among Muslims
in the country was vital in the provision of important social services to the ummah.
The Principal of City Park Masjid and Madrassa Feisal Ibrahim emphasized on the need
of Muslim parents to take Islamic religious education as a primary form of knowledge to see
to it that the young generations are brought up
with Islamic religious values as this will be a
bulwark against social evils like immorality and

Imams and Police to steps up war on Drugs in Coast

The Council of Imams and Preachers of Kenya (CIPK) will join forces with the police to fight the rampant drug trafficking and usage
that has affected many residents of Coast province.
Speaking to the Friday Bulletin, the Secretary General of CIPK and
Nominated MP Sheikh Mohammed Dor said that his organisation
had met police chiefs from various districts in the province to ensure
the fight against drug trafficking intensifies warning those involved
that their days are numbered.
We have already met OCPDs from various districts to ensure that
the war on drugs in the province is fought effectively. Drug abuse
has brought a lot of problems to our people and it is high time we
team up with the police to net the drug lords involved, the Sheikh
said.
Sheikh Dor, who is also the imam of Mbaruk mosque in Mombasa
added that it was imperative for both the regular police and their
administration counterparts to work together with the wananchi to
ensure all those involved are brought to book immediately.
The Nominated M.P appealed to the Minister for Internal Security
Prof.George Saitoti to allocate more police officers in the Coast especially the Anti-narcotic unit to help fight the drug menace as well
as providing sniffer dogs and modern equipments to detect drugs.

Story Continues on Page 8

The Sheikh added that security technocrats need to roll out a raft of
measures to seal all the loopholes that the drug lords exploit to peddle their trade which had enormous negative impact to the society.
While meeting police chiefs in Mombasa, CIPK Organising Secretary Sheikh Mohammed Khalifa said that drug abuse in the province
had caused a lot of problems to the people.
Makupa OCS in Mombasa district Patrick Ngaiywa dismissed reports that the police were only targeting small dealers for arrest and
prosecution leaving out the big fish. He added that most of the drug
lords in the Coast were using small dealers and they usually operate under cover. He asked wananchi to help in giving reliable information to help arrest the big barons who were reaping millions of
shillings from the illegal trade at the expense of the residents of the
province.
CIPK has already met police chiefs from Lamu, Taveta, Malindi,
Mombasa and Kilifi districts in the Coast province to ensure the war
against drugs is done across the province that is estimated to be
home to over 20,000 addicts. The organisation has blamed drug
abuse as the main cause for the rising levels of divorce and school
drop outs in the community adding that the vice needs to be brought
to an end to protect the society.

Faza displaced benefit from French govt assistance

A Sh49 million donation from the French government has enabled
several Faza families to go back to their homes which were destroyed during a deadly fire inferno which hit the island last year.
The financial support also assisted in the construction of a theatre
at the areas central health facility to improve on healthcare delivery
services to the residents.
The four houses were constructed in collaboration with Kenya Red
Cross Society (KRCS) through a Sh 49 million grant provided by the
French government to mitigate the deadly disaster.
The French government also funded two green house farming
technology at Faza secondary school at a tune of Sh2 million for
cultivation of vegetables and address food insecurity among local
community.
French ambassador Elisabeth Barbier said the money splinted into
different projects is part of the wider French government financial
support to larger Lamu community.
The new theater we have commissioned at Faza sub district hospital will provide immediate health care to residents and boast their
health, she added.
The ambassador asked locals to utilize effectively the re-built facilities which she said will improve on the social-economic development of the area.
Meanwhile, shortage of funds has stalled reconstruction of some

100 houses razed down in Faza village fire disaster last year. Kenya
Red Cross Society Secretary General Abass Gullet said extra fund
is needed to house the owners of those houses.
Gullet expressed confidence that reconstruction of those houses
will be realized through concerted efforts from various stakeholders.
I am not sure of how much is needed to complete the reconstruction work but with involvement of local constructors we will spend
less and re-energies the income of local people, he added.
Fisheries Development assistant Minister Mohammed Abu Chiaba
told reporters that each of houses requires at least Sh 1million. He
added that some of Sh 64.8 raised during Faza disaster fund drive
held in Nairobi few weeks after the deadly disaster and spearheaded by President Mwai Kibaki was spent to roof 120 of the razed
houses already occupied by owners. We have Sh 32 million in the
National Faza Disaster account that will be used to reconstruct 40
houses but we have a shortage of Sh 100 million to complete the
remaining 100 houses, said Chiaba whose Faza village falls under
his Lamu East constituency.
Residents of Siu, Pate and Faza villages have also benefited from
three shallow wells constructed by KRCS and according to Mr Gullet the new wells will improve water supply to residents.
At least 2500 villagers were displaced by last year September fire
accident that also gutted down more than 450 houses.

Fafi district gets first girls secondary school

Assistant Education Minister Prof. Ayiecho Olweny has
opened the first girls secondary school in Fafi District in
North Eastern Province, built partly through funding by Safaricom Foundation to the tune of Kshs 5.4 million.
Girls from Fafi District have been crossing over to neighbouring Garissa and Ijara districts for their secondary education.
The Safaricom Foundation Manager Ms. Sanda Ojiambo
said the school will increase access to girl secondary education within the district and entire North Eastern province.
The Executive Director of the Pastoralists Girls Initiative
(PGI) Fatuma Kinsi Abbas, whose organisation approached
Safaricom Foundation for the funding, said the first intake
was done in earlier this year where 54 girls were admitted.
Ms. Ojiambo said the school will play a major role in increasing the number of girls who complete their secondary education, which over the past has been compromised by poverty
forcing the girls to drop out of school.
We believe that education is the key to a brighter future for
both boys and girls. Its for this reason that we donated Kshs
5.4 million to Fafi Girls School, through which a toilet block,
four classrooms have been constructed and learning materials purchased, said Ms. Sanda Ojiambo.
She said girl child education was a sure way of eradicating
poverty as it empowered women and helped them play an
active role in development matters apart from enhancing civilisation from discriminative cultures such as Female Genital
Mutilation (FGM) which are still rampant in the region.
Although the governments introduction of free primary education in 2003 was a big boost for parents who couldnt afford school fees for their children, the initiative also led to
increased school enrolment for both boys and girls. This also
meant that more pupils qualify to join secondary schools
hence the need to put up more schools which can accommodate them.
Ojiambo said offering education opportunities to both sexes
have many benefits to the individual, family, community and
the entire nation.
Since its inception in 2003, Safaricom Foundation funds a
range of projects in the education sector by supporting the
provision of learning environments that allow the students to
thrive and succeed.

Sh 1.3 million for Jamia Iftar

Jamia Mosque Committee plans to spend more than Sh1.3 million for its
daily Iftar (breaking the fast) programme during the month of Ramadhan.
More than 500 people are expected to benefit from the programme which
is carried out on an annual basis during the month of Ramadhan which is
expected to commence on August 10 or 11.
Jamia Mosque Administrator Salim Ibrahim appealed to well wishers to
support the noble initiative to provide meals to those breaking the fast.
Make a contribution during the holy month and help hundreds of our Muslim brothers and sisters break their fast in keeping with the true spirit of
Ramadhan," he said.
"Allah will give you the reward of feeding a fasting person even if you
were to give him just a sip of milk, a date, or a sip of water. He who feeds
a fasting person until he is full, Allah will make him drink out of my river, a
sip of which will never allow him to be thirsty until he enters Jannah," Salim
added quoting a tradition of the Prophet peace be upon him.
Iftar coupons for Sh100 are available at the mosque for those wishing to
partner in the programme.

British PM urges lifting of Gaza siege

David Cameron, the British prime minister, has urged Israel to lift the blockade
of the Gaza Strip, describing the current state of the Palestinian enclave as a
"prison camp".
Speaking on Tuesday at a meeting of a
Turkish business association in Ankara,
Cameron said: "Let me be clear that the
situaion in Gaza has to change ... Gaza
cannot and must not be allowed to remain a prison camp."
Cameron, who also held talks with Recep
Tayyip Erdogan, his Turkish counterpart,
defended his harsh description, saying
that "even thoueyyegh some progress
has been made we're still in a situation
where it's very difficult to get in, it's very
difficult to get out...""We've long supported lifting the blockade of Gaza," he said.

Israel imposed a blockade on the Gaza

Strip in June 2007 after the Islamist Hamas movement took control of the territory.Gaza has been closed to virtually all
supplies, and Palestinians inside the territory have had to deal with food shortages,
lengthy power cuts and no cooking gas.
Following international uproar over a deadly Israeli raid on Gaza-bound aid ships on
May 31, the Jewish state said it would begin allowing all purely civilian goods into
Gaza. t said it would also allow building
materials into the territory but only for internationally supervised projects and that
its naval blockade would remain in place
to keep Hamas from importing militarygrade rockets and other weapons.
The Gazan economy is also being further
stifled by an inability to export goods.

The Hague: Kosova independence doesn't

violate international law, says UN court
The United Nations' hightest court said
in a non-binding opinion Thursday that
the 2008 Kosovo independence declaration does not violate general international law.
While delivering the non-binding advisory opinion, International Court of Justice (ICJ) President Hisashi Owada said:
"The declaration of Feb. 17, 2008 did not
violate general international law."
Owada said that international law contains no prohibition on declarations of
independence.
Serbian Foreign Minister Vuk Jeremic, who was present in the court, said
Thursday that his country would "never,
under any circumstances" recognize a
self-proclaimed, independent Kosovo. [
He also said difficult days are ahead for

his country, and it is crucially important to

keep the entire territory of the province of
Kosovo peaceful and stable.
Kosovo, an autonomous mainly Muslim
Serbian province, unilaterally declared
independence from Serbia two years ago
and remains under U.N. administration.
In October 2008, Serbia demanded that
the U.N. General Assembly ask the ICJ
to issue an opinion on the legality of Kosovo's break from Serbia.
Ahead of the ruling, Jeremic warned that
all of the world's borders would be at risk if
the ICJ supported Kosovo's "secession".
The United States swiftly expressed support to the U.N. court opinion that the
Kosovo independence declaration does
not violate the general international law.

corruption.
Feisal Ibrahim, the principal of City park
Masjid and Madrassa emphasized on the
need of Muslim parents to take Islamic
religious education as a primary form
of knowledge to see to it that the young
generations are brought up according to
the Islamic religious values which act as
a bulwark against socail evils like corruption and immorality.
The Principal lamented that parents were
not effectively living up to their responsibility to impart religious training to their
children but instead focused more on the
attainment of the so-called secular education.
The MDO treasurer Mansoor Kassam
said the organization is committed to
fulfill its mission of addressing the various education and social needs of the
community and called for more support

in achieving this goal.

Some of the projects earmarked for this
year include further developments at Al
Furqan Training Institute at Maili Tissa
near Namanga which will involve the construction of 10 teachers quarters and a
new mosque to cater for the increasing
population of students and the area Muslim residents.
The institute has more than 140 students
and it provides comprehensive Islamic
education together with various academic
courses.
Other projects undertaken by MDO include student sponsorship programme for
secondary and university students, relief
and rehabilitation programme, Ramadhan
iftar distribution, Udhhiyya programme,
social welfare for senior citizens, mosque

Opportunity to donate Food

and clothing to the needy
Extending a helping hand to the disadvantaged
members of the society is one of the meritorious
acts which are highly encouraged in Islam.
Many verses from the Quran and sayings from
Prophet Muhammad salallahu alayhi wa sallam
attests to this noble conduct which contribute
greatly in enhancing Islamic brotherhood.
Helping others is one of the ways to appreciate
Allahs boundless favours upon a person. While
we take for granted the blessing which we have,
food, clothing, shelter and the luxuries of life we
continually enjoy, it is easier to forget the sufferings and struggle which millions of people go
through n the efforts to look after themselves
and their families.
While for some of us, food is something we take
for granted because it is readily available; it is a
different story for others who sometimes go for
days without nothing in their stomach.
In an effort to assist the unfortunate members
of the society, Ummah Foundation has embarked on a project to collect food items and
clothing for distribution to those in need. Similar
programmes have been undertaken in previous
years and have seen thousands of Muslims in
different parts of the country assisted with the
basic needs.
Collection points have been set up in various mosques in Nairobi which include Jamia
Mosque, Parklands Mosque, Landhies Mosque,
Park Road and Westlands mosques where the
donations of dry food items and clothing items
can be made.
Ab Hurayrah relates that Allahs Messenger
(peace be upon him) said: Whoever removes
one of the hardships of a believing soul, Allah
will remove from him one of the distresses on
the Hereafter. Whoever solves someone else's
problem, Allah will make things easy for him
in this world and the Hereafter Allah is ever
assisting His servant as long as that servant is
helping his brother. [Sahh Muslim (4867)]
Ummah Foundation has over the years played
an important role in assisting the less fortunate
in various ways which include education, healthcare assistance, provisions of relief food, distribution of water in drought hit areas and other
similar services aimed at improving the livelihood of the people.
Your support towards the continuation of these
activities is important. We will appreciate if you
will partner with to care for humanity.
