Census Uproar
Leaders dismiss alleged 4.3 million gure for Muslims

uslim leaders have roundly dismissed the recently released national population and housing census results indicating that the total number of Muslims in the country comprise a mere 4.3 million.
They termed the gures released by planning minister Wycliffe Oparanya on Tuesday as
ridiculous saying they did not reect the true population of Muslims in the country.
According to the gures, Somalis make up 2.3 million while the combined Muslim population from other ethnic groups across the country comprise only two million.
This is ridiculous. The results do not reect the true number of Muslims in the country,
said Supreme Council of Kenya Muslims (SUPKEM) secretary general Adan Wachu.
He said previous demographic programmes indicated that the number of Muslims in the
country is not less than 12 million.
Wachu pointed to a comprehensive HIV/Aids Household survey conducted by SUPKEM
ve years ago which covered the whole country and revealed that the number of Muslims
then was approximately 9 million. This survey covered almost all the households across
the country and it is incomprehensible that the gures now indicate that Muslims are only
4.3 million, he told The Friday Bulletin.

The secretary general also took issue with the
Kenya National Bureau of Statistics for presenting Somalis as Kenyan Somalis. Somalis
are not the only people living in border areas.
Why only single out Somalis and not Maasais,
Turkanas or Luhyas, this is discrimination, he
said.
On his part, the SUPKEM director general
Abdullatif Shaaban stressed that the population of Muslims was not 4.3 million. Dont
be cheated, we are more than 11 million, he
said.

New constitution a boon for Muslims-Sheikh Hammad


Retired Chief Kadhi Sheikh Hammad Muhammad Kassim retreated
back to pre- referendum Kadhi courts debate saying those opposed
to the courts had lost sight on its contribution to delivery of justice
in the country.
He said despite handling matters of divorce, inheritance and marriage, the courts had played a crucial role in dispensing justice
without delay in the Muslims community in the country for several
decades.
Speaking during the closing of the annual Quran memorization
competition at Makadara grounds, Mombasa over the weekend,
Sheikh Kassim said the endorsement of the new constitution at the
referendum and its subsequent promulgation on Friday was a great
achievement for Muslims in the country.
He also said the move is a wake up call to other Muslims in the
neighbouring countries of Tanzania and Uganda to push their governments to entrench the courts in their countries constitutions.
There is no fear about the Kadhi courts and the resounding passage of the new constitution with the Kadhi courts in place at referendum was a clear message that the court is only meant to deliver justice, he told the gathering including Muslims scholars from
Uganda , Zanzibar and Tanzania , Rwanda and Congo .
Sheikh Hammad called for cordial relationship between Kenyans
of different religious backgrounds as the country embraces new
constitutional changes and asked Muslims to fully participate in the
implementation of the new constitution.
While asking them to desist from indulging into worldly pleasure,
the retired Chief Kadhi directed the faithful to guide their lives along

the path of Islam as stipulated in the Holy Quran and teachings of


Prophet Muhammad, peace be upon him.
In the competition which entered its eighth edition this year, Muhammad Maalim Hassan from Migori, Nyanza and Rahma Ali Mahmoud
of Munawarah Al-Islamiyah, Mombasa emerged the winners in the
event that brought participants from East and Central African countries.
Muhammad emerged the winner in the competition among male
participants and was awarded two packages worth Sh600,000 for
his parents to undertake the pilgrimage to the holy city of Makkah.
He also earned a cash prize of Sh20,000.
Amour Yusuf Mashi from Zanzibar was the only foreign participant to

with Abdulaziz Hassan Mohammad of Kenya in third place taking
away a cash prize of Sh50,000.

Laylat Al-Qadr, the night of power


If any one of you goes to the mosque and the prayer has commenced, he should join the congregation with the Imam rather than
praying two rakahs ahead of the congregation, as joining the congregation takes priority in this case.
Allah Says (what means): Indeed, We sent it (i.e. the Quran) down
in the Night of Decree. And what can make you know what is the
Night of Decree? The Night of Decree is better than a thousand
months. The angels and the Spirit (i.e. Gabriel) descend therein by
permission of their Lord for every matter. Peace it is until the emergence of dawn. [Quran 97: 1-5]

If one cannot draw spiritual benet during this month (Ramadhan),


then in what other month can he nd benet? If one does not turn
in repentance to his Lord during this month, then at what other time
will he do so? If one slackens from doing good deeds now, then
when will he do them? You should hasten to seize the opportunity
in this month, before it is too late! You should preserve your souls
from the ways of misery and destruction.
The blessed month is waning; its precious days and nights are
approaching their end. Try to utilize the remaining period by doing
good deeds and repenting to Allah. All is well that ends well. It is
therefore important to make your deeds at the end of this month as
good as you can. Two-thirds of the month of Ramadhan is over and
one-third, which is the best of all the three parts, still remains. Exert your efforts during these ten days by spending in charity, doing
righteous deeds and offering optional night prayer, submitting yourselves to Allaah, hoping for His good reward and seeking protection
from His punishment. Allaah Says (what means): And when My
slaves ask you (O Muhammad) concerning Me - indeed I am near. I
respond to the invocation of the supplicant when he calls upon Me.
So let them respond to Me (by obedience) and believe in Me that
they may be rightly guided.[Quran 2: 186]
Our Lord descends each night to the sky of the earth when the nal
third of the night remains. He offers His slaves out of His generosity,
saying: Who is saying a prayer to Me, that I may answer it? Who
is asking something of Me, that I may give it to him? Who is asking
forgiveness of Me, that I may forgive him? (Bukhari and Muslim)
In the last ten days of Ramadhan, there is Laylat Al-Qadr (the Night
of Decree) in which every precise matter of wisdom is made distinct and all events of the coming year are decreed. It is on this
night that angels descend from the heavens and blessings become
abundant. Whoever prays its nights, believing in it, and hoping for
its reward from Allah, will be forgiven all his previous sins. Whoever
misses this night and deprives himself of its good; he is to blame.
Allah did not specify its order among the ten nights so that people
may exert their utmost efforts during all ten days in worship, performing optional night prayer, reciting the Holy Quran and doing
righteous deeds. This is also a means of distinction between those
who are active in devotion and those who are not. If Laylat Al-Qadr
were identied, many people would have limited themselves to devotion on that night only, neglecting other nights. There would also
be no criteria for evaluation between the hardworking people and
the lazy ones.
Seek the reward of Laylat Al-Qadr by doing good deeds consistently and sincerely. Ask Allah for a share of His reward and to protect
you from coming out of Ramadhan empty-handed.
If you hear or recite a Quranic verse that mentions His mercy, ask
Allah to provide you from His bounties. When you hear or recite a
Quranic verse that contains a warning, ask Allahs protection from
His punishment. Utter glorications of Allah many times in your
Ruku (bowing) and make many supplications in your Sajdah (prostration), as a Muslim is nearest to Allah when he is in prostration. A
person may supplicate Allah for himself, his parents, children, relatives and all those who are dear to him from among the Muslims.
Prolong the Qiyaam (standing) after rising from Ruku (bowing) and
the Jalsah (sitting) after rising from Sajdah (prostration), so that you
may maintain an equilibrium among all the positions of Salah. The
standing after the rising from Ruku (bowing) is a stance of praising
Allah, utter many greetings, praises and extolments of Allah in it.
The sitting position that is between the two Sajdah (prostrations) is
a stance of supplicating Allah for forgiveness, ask Allahs forgiveness therein.
You may start your Qiyaam (the optional night prayers) with two
short rakahs, because Shaytaan (Satan) ties three knots at the
back of your head when you sleep, and he seals each of them saying, 'You have a long night ahead, so sleep.' If you wake up and
remember Allah, a knot is untied. If you purify yourself then another
knot is undone and if you pray, the third one also gets unknotted.

Supplication on the Night of Al-Qadr


In a Hadeeth on the authority of Aishah, may Allah be
pleased with her, she said, I said, O Messenger of Allah, if
I know which night is the Night of Al-Qadr, what should I say
on that night? He said: Say: Allaahumma innaka afuwwun
tuhibbu al-afwa fafu anni (O Allaah, You are Ever Pardoning and Generous and You love pardoning, so pardon me!)
[At-Tirmithi: Hasan Saheeh]
In another narration, she said, I said, O Messenger ofAllaah, if I witness the Night of Al-Qadr, what should I say? Hesaid: Say: O Allah, You are Ever Pardoning and Generous,
and you love pardoning, so pardon me. [Ibn Majah]

were inaccuracies with the census results and they will not be nationally acceptable to all the people of the country.
Leaders from Upper Eastern reacted with anger at the census gures accusing the government for grossly underestimating numbers
in the mainly Muslim region. Special Programmes Assistant minister
Muhamoud Mohammed Ali called for a fresh count arguing that the
results had gross inconsistencies.
While the numbers for religious groupings were not given during the
last census in 1999, the estimated number of Muslims in the country
was approximated to be 10 million out of the 28 million Kenyans.

Worship in Ramadhan for a Menstruating Woman

The Prophet (Allah bless him and give him peace) said about menstruation, Verily this is a matter Allah has written upon the women
of Prophet Adam (Allah bless him) [Bukhari]
Those who see menstruation as a punishment because one cannot perform acts of worship are severely mistaken. On the contrary, there are many forms of worship that a woman can do while
menstruating aside from what is legally prohibited. Allah says in the
Quran, He who obeys Allah and His messenger, and fears Allah,
and keeps duty (unto Him): such indeed are the victorious. [Nur:
52]
Allah Most High has commanded menstruating women and women
in a state of post-natal bleeding to refrain from the ritual prayer and
ritual fasting. Thus, if a menstruating woman fullls this command
with the intention to submit to Allahs order, she is actually worshipping Allah the entire time that she refrains from the ritual prayer and
ritual fasting. As one of the scholars said, Her praying while pure is
worship (ibada) and her refraining from prayer while menstruating is
worship. All of it is worship
Therefore, there is nothing dreadful or awful about menstruation or
post-natal bleeding, rather it is a persons attitude towards it.
Suggested Acts of Worship During Menstruation in Ramadhan
These suggestions are not specic to the last ten nights of Ramadhan but to the month in general. Furthermore, they also apply to
women in a state of post-natal bleeding.
Listen to the Quran
The month of Ramadhan in which was revealed the Quran, a guidance for mankind, and clear proofs of the guidance, and the Criterion (of right and wrong). [Baqara: 185]
While she cannot read the Quran, she should listen to the Quran
as much as possible, while simultaneously pondering about its deep
meanings. She should cry when she hears about the eternal punishment, hoping that Allah will save her from its blazing ames. She
should feel happiness and joy when hearing about the bounties of
Paradise and desire that Allah will make her of those that will be
honored to experience its bliss.
Make Much Remembrance (Dhikr) of Allah
and men who remember Allah much and women who remember - Allah hath prepared for them forgiveness and a vast reward.
[Ahzab: 35]
She should use every free moment to exalt the Lord of the Worlds.
There are many related dhikrs that a woman can recite. She should
buy a supplication (dua) book and recite its invocations as it will
strengthen her relationship with her Lord and draw her nearer to
Him with each word uttered.
Send Blessings on the Prophet (Allah bless him and give him
peace)
Allah says in the Quran, Lo! Allah and His angels shower blessings
on the Prophet. O ye who believe! Ask blessings on him and salute
him with a worthy salutation. [The Surah Ahzab: 56]
She seeks the tremendous benet of sending blessings and praise
(salawat) upon the Prophet (Allah bless him and give him peace)
because it is an act that increases her love for him (Allah bless him
and give him peace). She reects upon his nature and expresses
her gratitude to Allah for sending mankind such a wonderful example of mercy and piety. 4. Give Generously In Charity
The Prophet (Allah bless him and give him peace) said, The best
charity is that given in Ramadhan. [al-Tirmidhi]
She should reach into her pocket and give whatever she can without hesitation. She longs to give to those in need, and she thanks
Allah for bestowing upon her the nancial ability to help others.
Be Kind to Others, Including Spouses and Family Members
The Companion Salman al-Farasi related that the Prophet (Allah
bless him and give him peace) said about Ramadhan in a sermon
given on the last day of Shaban, It is a month of patience and the
reward for patience is Paradise [Sahih ibn Khuzayma;]

She uses this time to rebuild and mend any broken relationships.
She showers her loved ones with words and acts of gentleness,
compassion, consideration, patience, and love. She doesnt use
her menstruation as an excuse to wrong others and resort to bad
temper. She forgives those that have mistreated or offended her.
She prays that Allah will forgive her if she wronged others. She
keeps the company of the righteous and those who will increase
her in piety.
Make Dua for the Ummah
The Prophet (Allah bless him and give him peace) said about Ramadhan, Verily, Allah frees people (from the Hellre) in every day
and every night and for each Muslim among them is a supplication
which will be answered. [Ahmad] She supplicates for the entire
ummahpraying for their forgiveness, their well-being, and Allahs
mercy upon them.
Make Much Repentance
She asks Allah to pardon her, cover her sins, and save her from
the Hell-re. She begs for forgiveness and realizes her absolute
neediness to His mercy. She wakes up in the middle of the night,
even though she is menstruating, and repents in a time when Allah
promises to forgive.
Feed Fasting People
The Prophet (Allah bless him and give him peace) also said in the
aforementioned sermon, Whoever feeds a fasting person in (the
month of Ramadhan), for him is the forgiveness of his sins and freeing his neck from the Fire [Sahih ibn Khuzayma]
Show Allah Goodness
The Messenger of Allah (Allah bless him and give him peace) said,
Ramadhan has come to you. (It is) a month of blessing, in which Allah covers you with blessing, for He sends down Mercy, decreases
sins and answers prayers. In it, Allah looks at your competition (in
good deeds), and boasts about you to His angels. So show Allah
goodness from yourselves, for the unfortunate one is he who is deprived in (this month) of the mercy of Allah. [Tabarani]
She utilizes her free time to help and assist others with their needs.
She is a means for them to achieve benet in this great month. She
wakes her family up to perform worship in the night and encourages them to do extra works of obedience. She sacrices her own
time to volunteer at her Islamic community center or local charities.
She helps baby sit a mothers child so that the mother can attend
tarawih. She does whatever she can to aid the believers in completing the good with excellence.
She avoids looking at and listening to what is unlawful. Instead,
she directs her eyes, ears, and spirit to that which is advantageous
for her Hereafter. She attends classes, and lectures given by recognized scholars in an effort to surround herself with people of sound
religion. She seeks benecial knowledge and aims to implement
what she has learnt in her own life. She actively pursues furthering her understanding of Islam and afrms her faith every time the
wisdom of this great religion touches her heart.
Carry Out Any Righteous Deed
Abu Huraira (Allah be pleased with him) reported that Allahs Messenger (Allah bless him and give him peace) said, When the month
of Ramadhan starts, the gates of the heaven are opened and the
gates of Hell are closed and the devils are chained [Bukhari, Muslim]
She realizes that now is the perfect time to carry out any act of
good. The devils are chained and there is nothing to hold her back
from committing herself to absolute slavehood to her Lord.

Eid: Etiquette and rulings


The Sunnahs that the Muslim should observe on the day of Eid are
as follows:
Doing ghusl before going out to the prayer.
It was narrated in a saheeh hadeeth in al-Muwatta and elsewhere
that Abd-Allah ibn Umar used to do ghusl on the day of al-Fitr before going out to the prayer-place in the morning. (Al-Muwatta).
Al- Nawawi (may Allah have mercy on him) said that the Muslims
were unanimously agreed that it is mustahabb to do ghusl for Eid
prayer.
The reason why it is mustahabb is the same reason as that for doing ghusl before Jumuah and other public gatherings. Rather on
Eid the reason is even stronger.
Eating before going out to pray on Eid al-Fitr and after the
prayer on Eid al-Adha:
Part of the etiquette is not to go out to pray on Eid al-Fitr until one
has eaten some dates, because of the hadeeth narrated by alBukhari from Anas ibn Maalik, who said that the Messenger of Allah
(peace and blessings of Allah be upon him) used not to go out on
the morning of Eid al-Fitr until he had eaten some dates of which
he would eat an odd number. Al-Bukhari, 953.
It is mustahabb to eat before going out to emphasize the fact that
it is forbidden to fast on that day and to demonstrate that the fast
has ended.
Ibn Hajar (may Allah have mercy on him) suggested that the reason
for that was so as to ward off the possibility of adding to the fast,
and to hasten to obey the command of Allah. Al-Fath, 2/446
Whoever does not have any dates may break his fast with anything
that is permissible.
But on Eid al-Adha it is mustahabb not to eat anything until one
comes back from the prayer, so he should eat from the udhiyah if
he has offered a sacrice. If he is not going to offer a sacrice there
is nothing wrong with eating before the prayer.
Takbeer on the day of Eid
This is one of the greatest Sunnahs on the day of Eid because Allah
says (interpretation of the meaning):
(He wants that you) must complete the same number (of days),
and that you must magnify Allah [i.e. to say Takbeer (Allahu Akbar:
Allah is the Most Great)] for having guided you so that you may be
grateful to Him [al-Baqarah 2:185]
It was narrated that al-Waleed ibn Muslim said: I asked al-Awzaai
and Maalik ibn Anas about saying Takbeer out loud on the two Eids.
They said, Yes, Abd-Allah ibn Umar used to say it out loud on the
day of al-Fitr until the Imam came out (to lead the prayers).
Ibn Abi Shaybah narrated with a saheeh isnaad that al-Zuhri said:
The people used to recite Takbeer on Eid when they came out of
their houses until they came to the prayer place, and until the imam
came out. When the imam came out they fell silent, and when he
said takbeer they said takbeer. See Irwa al-Ghaleel, 1/121
Saying takbeer when coming out of one's house to the prayer place
and until the Imam came out was something that was well known
among the salaf (early generations). This has been narrated by a
number of scholars such as Ibn Abi Shaybah, Abd a l-Razzaaq
and al-Firyaabi in Ahkaam al-Eidayn from a group of the salaf. Ibn
Shihaab al-Zuhri (may Allah have mercy on him) used to say, The
people used to recite takbeer from the time they came out of their
houses until the imam came in.
The time for takbeer on Eid al-Fitr starts from the night before Eid
until the imam enters to lead the Eid prayer. In the case of Eid alAdha, the takbeer begins on the rst day of Dhul-Hijjah and lasts
until sunset on the last of the days of tashreeq.
Description of the takbeer:
It was narrated in the Musannaf of Ibn Abi Shaybah with a saheeh
isnaad from Ibn Masood (may Allah be pleased with him) that he
used to recite takbeer during the days of tashreeq:
Allahu akbar, Allahu akbar, laa ilaaha ill-Allah, wa Allahu akbar, Allah akbar, wa Lillaah il-hamd (Allah is Most Great, Allah is most
Great, there is no god but Allah, Allah is Most great, Allah is most

great, and to Allah be praise).


It was also narrated elsewhere by Ibn Abi Shaybah with the same
isnaad, but with the phrase Allahu akbar repeated three times.
Al-Mahaamili narrated with a saheeh isnaad also from Ibn Masood:
Allahu akbaru kabeera, Allahu akbaru kabeera, Allahu akbar wa
ajallu, Allahu akbar wa Lillaah il-hamd (Allah is Most Great indeed,
Allah is Most Great indeed, Allah is most Great and Gloried, Allah
is Most Great and to Allah be praise). See al-Irwa, 3/126.
Offering congratulations
The etiquette of Eid also includes the congratulations and good
wishes exchanged by people, no matter what the wording, such as
saying to one another Taqabbala Allah minna wa minkum (May Allah accept (good deeds) from us and from you or Eid mubaarak
and other permissible expressions of congratulations.
It was narrated that Jubayr ibn Nufayr said: When the companions
of the Prophet (peace and blessings of Allah be upon him) met one
another on the day of Eid, they would say to one another, May Allah accept (good deeds) from us and from you. Ibn Hajar said, its
isnaad is hasan.
Offering congratulations was something that was well known among
the Sahaabah, and scholars such as Imam Ahmad and others allowed it. There is evidence which suggests that it is prescribed to
offer congratulations and good wishes on special occasions, and
that the Sahaabah congratulated one another when good things
happened, such as when Allah accepted the repentance of a man,
they went and congratulated him for that, and so on.
Undoubtedly these congratulations are among the noble characteristics among the Muslims.
The least that may be said concerning the subject of congratulations is that you should return the greetings of those who congratulate you on Eid, and keep quiet if others keep quiet, as Imam Ahmad (may Allah have mercy on him) said: If anyone congratulates
you, then respond, otherwise do not initiate it.
Adorning oneself on the occasion of Eid.
It was narrated that Abd-Allah ibn Umar (may Allah be pleased
with him) said that Umar took a brocade cloak that was for sale
in the market and brought it to the Messenger of Allah (peace and
blessings of Allah be upon him), and said, O Messenger of Allah,
buy this and adorn yourself with it for Eid and for receiving the delegations. The Messenger of Allah (peace and blessings of Allah be
upon him) said to him, Rather this is the dress of one who has no
share (of piety or of reward in the Hereafter) (Bukhari).
The Prophet (peace and blessings of Allah be upon him) agreed with
Umar on the idea of adorning oneself for Eid, but he denounced
him for choosing this cloak because it was made of silk.
It was narrated that Jaabir (may Allah be pleased with him) said:
The Prophet (peace and blessings of Allah be upon him) had a
cloak which he would wear on the two Eids and on Fridays. Saheeh
(Ibn Khuzaymah)
Al-Bayhaqi narrated with a saheeh isnaad that Ibn Umar used to
wear his best clothes on Eid.
A man should therefore wear the best clothes that he has when
going out for Eid.
With regard to women, they should avoid adorning themselves
when they go out for Eid, because they are forbidden to show
off their adornments to non-mahram men. It is also haraam for a
woman who wants to go out to put on perfume or to expose men
to temptation, because they are only going out for the purpose of
worship.
Going to the prayer by one route and returning by another.
It was narrated that Jaabir ibn Abd-Allah (may Allah be pleased
with him) said: On the day of Eid, the Prophet (peace and blessings of Allah be upon him) used to vary his route. Narrated by alBukhaari, 986.
It was said that the reason for that was so that the two routes would
testify for him on the Day of Resurrection, for the earth will speak
on the Day of Resurrection and say what was done on it, both good

new constitution
Imams across the country will start educating faithful in civic education on bill of rights among other contents of the countrys new constitution.
Council of Imams and Preachers (CIPK) directed its members across
the country to use the daily ve times prayers as platforms to inform
followers on bill of rights as reected in chapter four of the new constitution.
Nominated MP Sheikh Mohammed Dor who is also CIPK secretary general held meeting with 100 imams from Mombasa, Likoni,
Changamwe and Kisauni districts and asked them to acclimatize with
the new constitution.
As leaders your have an integral responsibilities to inform ordinary
citizen on the need of respecting this constitution we have all fought
for as patriotic Kenyans for its realization, he told a press conference
at the organization Mombasa ofces.
He said soon after the end of the Holy month of Ramadhan, top CIPK
ofcials will conduct forums in several parts of the country to educate
more Muslims on their need to understand the new constitution accordingly.
The MP said they will use such forums to sensitize residents of the 48
counties on the need of electing suitable Governors and Senator who
are people of integrity.
Sheikh Dor observed that Kenyans should take keen interest of putting
the bill of rights on theor nger tips as a defensive weapon against
government institutions and ofcials notorious in breaking laws.
He particularly called on senior police ofcers to make their juniors
aware of the fundamental human rights as stated in the new constitution while in the course of discharging their duties of maintaining the
country security.
In accordance to this new constitution, an arrested person has a right
to be informed the cause of his arrest and police should execute the
same politely and in an orderly way, he added.
The MP also called on Kenyans to end the culture of bribing public
ofcers employed at the expense of their taxes in state agencies to
offer them their rightful services.
You should not go to immigration ofces to bribe ofcers because
that is a bad precedent to the new constitution and it is your right to
get a passport without offering any inducement.

The lawyer representing ve Kenyans accused of carrying out the


deadly killings in Uganda has called on the government to provide
consular services to the detainees. In a correspondence to the
Foreign Affairs minister Moses Wetangula, human rights lawyer
Mbugua Mureithi said despite pledges from Kenya High Commission in Kampala that it will look after the welfare of the Kenyans,
nothing has so far happened.
According to Mureithi, the Deputy Head of Mission J.K. Maikara
and the Consular Ezekiel K. Serem had on August 12 promised
to visit the four Kenyans in custody and also to implore on the
Ugandan authorities to guarantee their wellbeing and safety in detention. The ve are Muhammad Hamid Suleiman, Hussein Hassan Agade, Idris Magondu, Muhammad Adan Abdow and Ismail
Abubakar.
The lawyer also appealed for the ministers intervention to ensure that that the Kenyans were guaranteed a free trial. He expressed concern that the continued interrogations by Ugandan
and Kenyan security operatives as well as the Federal Bureau of
Investigations (FBI) agents were being done in a manner which
contravened the rights of the detainees. As you well know from
your distinguished career as an advocate, continued police interrogation after arraignment offends the basic adversarial nature
of a criminal trial and such interrogations convert the trial into an
inquisition and deprive the accused the right to remain silent and
the right to adequate time and facilities to prepare their defence,
he said.
The lawyer maintained that the ve are innocent and were kidnapped from Kenya and forcibly rendered to Uganda by Kenyan
authorities in blatant disregard and violation of extradition proceedings.
He said apart from Hussein Hassan Agade, who had been to
Uganda for trade months before the bombing, the rest of the
accused had never been to Uganda as it was claimed by Kenyan
security ofcials. Our clients cannot comprehend why they are
charged with commission of offences in Uganda at a time when
they were all in Kenya, he said.
Mureithi and a Ugandan lawyer will be representing the Kenyans
during the trial. The Muslim Human Rights Forum (MHRF) is coordinating the defence process.

Call to support the forgotten people of Western


There is need to extend social economic programmes to Muslims in
Western Kenya as they have seldom beneted from such activities
undertaken by Muslim organisations.
The vice chairperson of Women in Development Jamilla Kiragu said
poverty levels and the deciency in Islamic knowledge among residents was on the rise and there is need to develop programmes to
improve on their welfare.
Speaking after the organisation made a donation of food items and
clothing to the residents of Kimilili, she called on Muslim organisations to work on empowering the people of the region.
Many organisations focus on Nairobi, Coast and North Eastern areas of the country and forget that they are people who also need
assistance in other parts of the country, she said.
It is a sad state of affairs among the residents. Poverty levels are
on the increase and something needs to be done to address their
situation, she said.
The ve-tonne donation was distributed over the weekend at the Kimilili Jamia mosque and saw more than 200 people beneting from
the exercise.
She spoke after the women group made a donation of various food
items and clothing to the people of Kimilili. The items were collected
through donations from various mosques and individuals in Nairobi.
Due to the sad situation we found in the area, another caravan will
be heading to the region just before the end of Ramadhan to extend
a hand of assistance to our brothers and sisters, she said.

Zakatul Fitr is often referred to as
Sadaqah al-Fitr. The word Fitr means
the same as Iftaar, breaking a fast and
it comes from the same root word as
Futoor which means breakfast. Thus,
Islamically, Zakatul Fitr is the name
given to charity which is distributed at
the end of the fast of Ramadhan.
Zakatul Fitr is a duty which is Waajib on every Muslim, whether male or
female, minor or adult as long as he/
she has the means to do so.
The proof that this form of charity is
compulsory can be found in the Sunnah whereby Ibn `Umar reported that
the Prophet (sallallahu `alaihi wa sallam) made Zakatul Fitr compulsory on
every slave, freeman, male, female,
young and old among the Muslims;
one Saa` of dried dates or one Saa`
of barely. [Bukhari]
The head of the household may pay
the required amount for the other
members. Abu Sa'eed al-Khudhri
said, "On behalf of our young and
old, free men and slaves, we used to
take out during Allah's Messenger's
(sallallaahu 'alaihi wa sallam) lifetime
one Saa` of grain, cheese or raisins".

The signicant role played by Zakah
in the circulation of wealth within the
Islamic society is also played by the
Zakatul Fitr. However, in the case
of Zakatul Fitr, each individual is required to calculate how much charity
is due from himself and his dependents and go into the community in
order to nd those who deserve such
charity. Thus, Zakatul Fitr plays a very
important role in the development
of the bonds of community. The rich
are obliged to come in direct contact
with the poor, and the poor are put in
contact with the extremely poor. This
contact between the various levels
of society helps to build real bonds
of brotherhood and love within the
Islamic community and trains those
who have, to be generous to those
who do not have.
Purpose
The main purpose of Zakatul Fitr is
to provide those who fasted with the
means of making up for their errors
during the month of fasting. Zakatul
Fitr also provides the poor with a
means with which they can celebrate
the festival of breaking the fast (`Eed
al-Fitr) along with the rest of the Muslims.
Ibn Abbas reported, "The Prophet
(sallallahu 'alaihi wa sallam) made
Zakatul Fitr compulsory so that those
who fasted may be puried of their
idle deeds and shameful talk (committed during Ramadhan) and so that
the poor may be fed. Whoever gives it
before Salah will have it accepted as

Zakah, while he who gives it after the Salah has given Sadaqah." [Abu Dawood]
Hence, the goal of Zakatul Fitr is the spiritual development of the believers. By making them give
up some of their wealth, the believers are taught the higher moral characteristics of generosity,
compassion (sympathy for the unfortunate), gratitude to God and the righteousness. But, since
Islam does not neglect man's material need, part of the goal of Zakatul Fitr is the economic wellbeing of the poorer members of society.
Conditions
Zakatul Fitr is only waajib (obligatory) for a particular period of time. If one misses the time period
without a good reason, he has sinned and can not make it up. This form of charity becomes obligatory from sunset on the last day of fasting and remains obligatory until the beginning of salatul
'Eed' (i.e. shortly after sunrise on the following day). However, it can be paid prior to the above
mentioned period, as many of the Sahaabah (companions of the Prophet(sallallahu 'alaihi wa
sallam) ) used to pay Zakatul Fitr a couple days before the `Eed.
Naa reported that the Prophet's companion Ibn `Umar used to give it to those who would accept

Little hope of ME peace as talks begin in US


The US president has called on Israeli
and Palestinian leaders not to let the
chance for peace slip away as he opened
a US-sponsored summit to re-launch direct talks.
Barack Obama promised to put the "full
weight" of the United States behind the
effort to forge peace in direct talks between the two sides that begin at the
state department on Thursday.
"As I told each of them today, this moment
of opportunity may not soon come again.
They cannot afford to let it slip away,"
Obama said after one-on-one talks with
Binyamin Netanyahu, the Israeli prime
minister, and Mahmoud Abbas, the Palestinian president, on Wednesday.
"I am hopeful, cautiously hopeful, but
hopeful," the US president said later with
the leaders of Jordan, Egypt, Israel and
the Palestinians beside him in the crowded East Room of the White House.
A top Palestinian ofcial said Wednesday any resumption of Israeli settlement
construction would spell the end of the
peace talks. The settlements must be
halted and continuing them will signal
the end of the peace process, Palestinian spokesman Nabil Abu Rudeina told

journalists. He was speaking after Netanyahu said there was no change in Israels
position on ending the 10-month freeze on
settlement construction.
Abu Redeina told reporters before the Palestinian leader went to the White House that
negotiations with the Israelis will fail almost
as soon as they begin unless Israel extends
a moratorium on construction in Jewish settlements in the West Bank.
An aide to Netanyahu said Wednesday Jerusalem should remain the undivided capital of Israel, clarifying Israels position after
published comments from Defense Minister
Ehud Barak suggested division was a possibility.
The position of the prime minister is that Jerusalem is one of the core issues that are
on the table at the talks, the aide said. Our
position is that Jerusalem will remain the undivided capital of Israel.
In an interview published earlier Wednesday, Barak suggested parts of Jerusalem
could be handed over to the Palestinians.
West Jerusalem and 12 Jewish neighborhoods settlements in Arab east Jerusalem would remain in Israels hands.
The Arab neighborhoods in which close
to a quarter million Palestinians live will be
theirs, he told the Haaretz newspaper.

OIC mobilises $1b in pledges for ood victims


Organisation of Islamic Conference
(OIC) Secretary General Dr Ekmeledin
Ihsanoglu said on Tuesday that member
countries had mobilised pledges of $1
billion for Pakistans ood victims.
Talking to President Asif Ali Zardari in
Karachi on Tuesday, Dr Ihsanoglu said
that the OIC will allocate funds for Pakistans ood victims during the organisations next meeting. The secretary general also said that the OIC will establish
a fund Emergency Fund for Natural
Disaster to help victims of disasters
occurring in any Muslim country.
Brieng the media on the meeting, the
presidents spokesperson Farhatullah
Babar said that Dr Ihsanoglu had also

offered his condolences on the loss of lives


and property as a result of the recent ood
disaster. I am touched by the losses I have
seen myself during the aerial visit of the affected areas, Babar quoted Dr Ihsanoglu
as saying.
Babar said that the general secretary has
assured the president that the OIC will
make all-out efforts to help rehabilitate ood
victims. The president thanked Dr Ihsanoglu
for the support OIC is extending to Pakistan
at this time of crisis.
According to Babar, President Zardari told
the secretary general that the scale of devastation is so large that Islamabad cannot
handle the situation without the support of
the international community.

Ibn `Umar reported that the Prophet (sallallahu 'alaihi wa sallam) ordered that it
(Zakatul) be given before people go to
make the Salah ('Eed).
And Ibn `Abbas reported that the Prophet
(sallallahu 'alaihi wa sallam) said, "Whoever gives it before the Salah will have it
accepted as Zakah, while he who gives it
after the salah (will not, for it will only be
considered as) ordinary charity. Therefore, one who forgets to pay this Zakatul
Fitr on time should do so as soon as possible even though it will not be counted
as Zakatul Fitr.

Rate
The amount of Zakah is the same for everyone regardless of their different income
brackets. The minimum amount is one Saa`
(two and half kilogrammes) of food, grain
or dried fruit for each member of the family. This calculation is based on Ibn `Umar's
report that the Prophet(sallallaahu 'alaihi wa
sallam) made Zakaah al-Fitr compulsory
and payable by a Saa` of dried dates or a
Saa` of barley.
The Sahaabi, Abu Sa`eed al-Khudhri said,
"In the Prophet's time, we used to give it
(Zakatul Fitr) as a Saa` of food, dried dates,
barley, raisins or dried cheese". [Bukhari]

Ummah Foundation
Ramadhan Activities
The last few weeks were full of many activities
that emanated from the clear fact that Ummah
Foundation is indeed caring for humanity. The
Ummah Foundation crew went round Nairobi
and the outskirts distributing food stuffs to
Mama Fauzia Childrens home, Umoja Madrasah, GK Remand prison industrial area,
Matuu Madrasah for Tahdh of the Holy Quran
and Kithimani Madrasah. The snacks were
donated by Brother Tajdin Jafer of Kigali street
who has been an ardent supporter of Ummah
Foundation especially during the Month of
Ramadhan. We ask Allah to reward our brother and give him jannatul rdaus inshallah.
The exercise was undertaken by the Ummah
Foundation staff that comprised of brother
Musa Wekesa the Executive Ofcer, Ali
Khamis - the Program Manager and Sheikh
Subki who co-ordinates the Daawah activities.
Food items that comprised of rice, wheat our,
maize our, cooking oil, salt, sugar, tea leaves
were also distributed to Majengo home for the
old in Pumwani area.
After experiencing turbulent times with the
high inux of refugees particularly from the
great lakes region, GTZ Camp management brought to our attention the plight of 60
refugees from war torn Eastern Democratic
Republic of Congo a few days after the commencement the fasting of the holy month of
Ramadhan. Ummah Foundation responding
by supporting the refugees with an assortment
of clothes, dates for breaking the fast, foodstuffs and copies of the Holy Quran.
Brother Musa Wekesa and Sheikh Subki
Shee made the presentation of the donation
to the refugees who expressed their gratitude
for the support.
Through our sister programme, Prisoners Rehabilitation Programme (PRP) Ummah Foundation gave a hand of support to the Muslim
inmates at Naivasha Maximum Prison donating an assortment of dates for breaking the
fast. The inmates also expressed gratitude
to PRP for constructing a mosque within the
prison complex. The mosque with a capacity
of more than 400 worshippers now serves as
the centre for Islamic activities in the prison.
Our prayer and thanks goes to Brother Zool
Nimji, the Secretary General of Ummah Foundation who within a short span had to make
this possible. We all beseech Allah to reward
him abundantly for his efforts.

participated in the realization of these noble
activities and be showered with the blessings
