‘The Department received today the attached copy of Minute Resolution No.
16-0204 dated 29 March 2016, in which the Commission on Elections (COMELEC)
granted the Department's request for exemptions from Sections 261(v) and 26 l(w) of
the Omnibus Election Code prohibiting the disbursement of public funds during the
forty-five (45)-day period leading to the 9 May 2016 Elections,
Thus, the Department may continue to disburse public funds for its
routine and normal programs, projects and activities, including ongoing and
upcoming disaster relief, early recovery and rehabilitation efforts, foreign-assisted
Projects, and ongoing public works. These include all activities — including
procurement transactions - under the same.
However, please be reminded that in no case shall the disbursement of public
funds be used for any partisan political purpose.

This pertains to the Memorandum dated February 17, 2016 of
Commissioner Christian Robert S. Lim, Commissioner-in-Charge,
Campaign Finance Office, relative to the request of the Department of
Social Welfare and Development (DSWD) for exemption of its various
projects and programs from the Public Works Ban [Section 261 (v) and (w)
of the Omnibus Election Code].
The Memorandum of Commissioner Lim reads:
“The undersigned respectfully endorses for the consideration of the
‘Commission En Banc the Letter dated 03 February 2016 from Secretary
Corazon Juliano-Soliman of the Department of Social Welfare and
Development (DSWD), requesting for exemption of its various projects
and programs from the prohibitions stated in Section 261 (v) and (w) of
the Omnibus Election Code. The said Letter was referred to the office of
the undersigned in his capacity as Commissioner-in-charge of the
Campaign Finance Office. The DSWD's request covers the following

The OSWD, as the successor of the Ministry of Social Services and
Development, is specifically mentioned in OEC Section 261 (v) (2), to
wit:
Soc. 261. Prohibited Acts. ~ The following shall be guilty of
an election offense:
(V) Prohibition against release, disbursement or
expenditure of public funds. - Any public official or
employee including barangay officials and those of
government-owned or controlled corporations and their
subsidiaries, who, during forty-five (45) days before a
regular election and thirty (30) days before a special
election, releases, disburses or expends any public funds
for:

(2) The Ministry of Social Services and Development and
any other office in other ministries of the goverment
performing functions similar to said ministry, except for
18 of personnel, and for such other routine and
normal expenses, and for such other expenses as the
Commission may authorize afer due notice and hearing.
Should a calamity or disaster occur, all releases normally
or usually coursed through the said ministries and offices
of other ministries shall be tumed over to, and
administered and disbursed by, the Philippine National
Red Cross, subject to the supervision of the Commission
‘on Audit or its representatives, and no candidate or his or
her spouse or member of his family within the second
civil degree of affinity or consanguinity shall participate,
directly or indirectly; in the distribution of any relief or
other goods fo the vietims of the calamity or disaster, and

After due deliberation, the Commission RESOLVED, as it hereby
_RESOLVES, to grant the request of Secretary Corazon Juliano-Soliman,
Department of Social Welfare and Development (DSWD), for exemption of
its various projects and programs from the prohibitions stated in Section
261 (v) and (w) of the Omnibus Election Code.
