The AAC consists of five large public interest organizations, and represented the largest group of public interest stakeholders. The AAC participated responsibly in this proceeding, fully responding to the Commission's consultation questions, commissioning expert evidence, answering interrogatories from all parties on that evidence and our submissions, putting forward a comprehensive proposal for improving access to basic telecommunications services by all Canadians, appearing at the public hearing and filing final written argument. The AAC believes that its participation in the S.C. 1993, ¢. 38, SOR/2010-277, tof 14 Affordable Access Coalition Application for Final Costs ‘TNC 2015-134 (as amended) Basic Services proceeding contributed toward a better understanding of the issues, including but not limited to telecommunications access and affordability issues. 4, In order for the AAC to be eligible for costs, the AAC must satisfy the Commission that it: is directly interested or is representative of group or a class of subscribers that has an interest in the outcome of the proceeding; assisted the Commission in developing a better understanding of the matters to be considered; and participated in the proceeding in a responsible way, Additionally, the AAC must indicate the amount of costs requested, with receipts or detailed estimates; identify the respondents that should pay the costs; and serve all of the parties to the proceeding, 5. The AAC submits that it meets all of the elements of the test for final costs, as explained in the balance of this application 6. The AAC believes that the appropriate final costs respondents should be the telecommunications services providers by telecommunications operating revenues (TORs) that were active parties to this proceeding, and that the costs be apportioned according to the CRTC guidelines for the apportionment of costs. Il. The test for final costs 7. Subsection 66(1) set out the requirements for an award for final costs: 66 (1) In the application, the applicant must (a) demonstrate that they (i) have, or represent a group or a class of subscribers that has, an interest in the outcome of the proceeding, assisted the Commission in developing a better understanding of the matters that were considered, and (ill) participated in the proceeding in a responsible way; (b) identify the respondents that should pay the costs; and (0) if interim costs were awarded to them, provide an explanation of any difference between those interim costs and the final costs for which they are applying. 8. The AAC notes that on 17 May 2016, in the midst of this proceeding, the Commission introduced, without any notice, further guidance® on costs claims, and specifically regarding representation of a group or a class of subscribers. The Commission noted that the new Guidance for costs award applicants regarding representation of @ group or a class of subscribers, Telecom Information Bulletin CRTC 2016-188, 17 May 2016. 20f 14 Affordable Access Coalition Application for Final Costs ‘TNC 2015-134 (as amended) guidance would apply to all claims filed subsequently to the date of the guidance, subject to its discretion in particular circumstances. 9. The AAC note firstly that the guidance comes very late in a very long proceeding and that the AAC members all proceeded on the basis of former costs rules interpretations. Therefore the AAC submits that the Commission consider this fact when exercising its discretion in this case. (2) AAC members are all representatives of a group or a class of subscribers with an interest in the outcome 10. The criteria for the awarding of final costs are found in s. 68 of the Rules. They are as follows: 68. The Commission must determine whether to award final costs and the maximum percentage of costs that is to be awarded on the basis of the following criteria: (a) whether the applicant had, or was the representative of a group or a class of subscribers that had, an interest in the outcome of the proceeding; (b) the extent to which the applicant assisted the Commission in developing a better understanding of the matters that were considered; and (c) whether the applicant participated in the proceeding in a responsible way. 11. In the Guidance for costs award applicants regarding representation of a group or a class of subscribers, the Commission notes that: “Blanket statements that a costs applicant represents @ group or a class of subscribers, without further elaboration, will generally not be sufficient for the Commission to conclude that a costs applicant satisfies this criterion.” 12, Nonetheless, all members of the AAC represent a group or a class of subscribers with an interest in the proceeding. 13. The Commission then listed a number of potential specifics that would assist the ‘Commission in making a determination that a party met the criteria of s. 63(a) (interim costs) or s. 68(a) (final costs): 10. In its costs application, a costs applicant should make submissions that clearly and specifically identify and describe the group or class of subscribers it purports to represent. This description could involve identifying the specific demographic or socio- of 14 Affordable Access Coalition Application for Final Costs ‘TNC 2015-134 (as amended) economic features of the members of the group or class of subscribers. For example, a costs applicant that represents seniors and/or low-income consumers should clearly identify this in its costs application. 11. Describing the group or class of subscribers could also involve providing information ‘on the region or regions of Canada in which the group or class members are located. For example, a costs applicant that represents subscribers from a particular province should identify this. 12. If the costs applicant is or represents an umbrella organization in which other smaller organizations of subscribers are members, the application should identify these member organizations. 13. A costs application could also include details, if available, of the number of individuals making up the group or class of subscribers being represented. 14. Submissions in respect of this criterion should also explain the specific method or methods by which the costs applicant represents the group or class of subscribers. In other words, a costs applicant should describe how it determined that the positions it put forward in the substantive proceeding for which costs are being claimed reflected the interests of the group or class of subscribers it claims to represent Footnote 4 15. This could be through direct consultation with its members or otherwise. For instance, the costs applicant may have conducted a formal or informal poll of the subscribers who are its members, constituents, or stakeholders, or may have solicited feedback on a matter, for instance, through its website, through social media or other forms of digital communications, via telephone, or through in-person or online meetings. 16. In the event that a costs applicant did not canvass or consult members of the group or class of subscribers it purports to represent, the costs applicant should nonetheless address and explain how its positions reflect the interests of that group or class of subscribers. For instance, the costs applicant may provide evidence of research it has conducted or commissioned. 14, The AAC deals with each area of detail in turn, Para. 10; identify and describe the group or class of subscribers it purports to represent 15. AAC members are the following groups: * The Association of Community Organizations for Reform Now, Canada (‘ACORN Canada’); + The Consumers’ Association of Canada ("CAC"); * The Council of Senior Citizens Organizations of British Columbia (“COSCO”); + The National Pensioners Federation (‘NPF"); and 4of14 Affordable Access Coalition Application for Final Costs. TNC 2015-134 (as amended) ‘+ The Public Interest Advocacy Centre ("PIAC”) 16. ACORN Canada is an independent national organization of low and moderate income families with 70,000+ members in 20+ neighbourhood chapters across 9 cities. See ACORN Canada, online: . 17. CAC is an independent, non-profit, volunteer-based charitable organization with a mandate to inform and educate consumers on marketplace issues, to advocate for consumers with government and industry, and work with government and industry to solve marketplace problems. COSCO is the largest federation of senior citizens’ organizations in the province of British Columbia and is the umbrella organization of 79 seniors’ organizations and a significant number of individual associate members. NPF is a democratic, non-partisan, non sectarian organization with the mission to stimulate public interest in the welfare of aging Canadians, composed of 350 seniors chapters and clubs across Canada with a collective membership of 1,000,000 Canadian seniors and retired workers. PIAC is a federally incorporated non-profit organization and registered charity that provides legal and research services on behalf of consumer interests, and, in particular, vulnerable consumer interests, concerning the provision of important public services, PIAC’s members are its current board of directors, its honourary former members and its group members. PIAC's group members are: Alberta Council on Aging; Canadian Pensioners Concerned; Dying with Dignity; Federation of Metro Tenants’ Associations; Ontario Society of Senior Citizens’ Organizations; PEI Council of the Disabled; and Rural Dignity of Canada. As noted above, ACORN Canada and NPF are national organizations with members across Canada. 22. COSCO's members are based in British Columbia, 23. CAC is a national advocacy organization that has provincial chapters in Saskatchewan and Manitoba, Bof 14 ‘Affordable Access Coalition Application for Final Costs ‘TNC 2015-134 (as amended) 24. PIAC is a national non-profit public interest advocacy organization that has members on its Board (presently 11) from 5 provinces and 1 territory (Nunavut) and has group representation that is itself regional (Alberta, PE!) as well as national. Para, 12: Umbrella organization's member organizations 25.CAC, NPF and COSCO (in B.C.) are umbrella organizations with regional member organizations. More details on each of the regional organizations comprising these groups can be found on their respective websites. 26. ACORN Canada is a standalone group, not an umbrella organization, but has a nationwide membership of low- to moderate income persons — over 80,000 members — organized into twenty neighbourhood chapters in nine cities across Canada. 27.PIAC is not an umbrella organization but has group members that are in turn such organizations (including Federation of Metro Tenants’ Associations and OSSCO), Para, 13: details, ifavailable, of the number of individuals making up the group or class of subscribers being represented 28. Due to the structure of most of the organizations in the AAC, exact number of individuals represented is difficult to state precisely. For ACORN, membership exceeds 80,000 Canadians. For NPF, including its member groups’ membership, over 1,000,000 seniors. CAC is an national advocacy organization with provincial chapters in Saskatchewan and Manitoba; CAC does not reveal its membership as it is not a membership-driven ‘organization. For COSCO, including individuals and members of sub-groups, 10,000. For PIAC, 15 members and honourary members, however, this number is well into the thousands when including members of group members OSSCO (160 seniors groups representing 500,000 individual seniors in Ontario); Alberta Council on Aging (4,500 individual members and 450 organizational members), Canadian Pensioners Concerned (5,000 individual members), Dying with Dignity (2,000 members), PE! Council of the Disabled (1,500 individuals), Rural Dignity (2000 members) and FMTA, which represents 92 tenants’ associations. OSSCO and COSCO are both in turn members of NPF. Paras. 14-16: method or methods by which the costs applicant represents the group or class of subscribers 29. The AAC's various members made efforts to determine their respective members’ and supporters’ views on the matters involved in this proceeding in various ways. The AAC Gof 14 Affordable Access Coalition Application for Final Costs ‘TNC 2015-134 (as amended) members first note the difficulty in attempting to obtain views on specific and technical points in the strategy and proposals put forth by the group. However, feedback of a more general nature was possible from general membership of most groups. Most groups also develop more specific advocacy positions at their higher governance levels — typically at the Board of Directors level 30. Firstly, all of the groups at a senior management level reviewed all of the positions and all interventions, including oral interventions, before they were filed or presented 31. ACORN Canada was able to present the detailed argument of the AAC in its first and second written submissions to its Board. The Board generally approved of the submissions and provided feedback which was relayed to the lawyers on the file, Individual ACORN members filed 400 testimonials/feedback forms with the Commission on the subject of ‘communications affordability. ACORN further organized their membership to bring approximately 25 individual members to the oral hearing in April 2016. Their testimony is on the record. ACORN also was comfortable with the position of the AAC as expressed by their Toronto Director, Judy Duncan, due to previous research work on affordability of ‘communications done in conjunction with PIAC in 2014. 32. NPF also circulated the AAC positions to its national board. As Mr. John stated in the hearing: "We've communicated this by having discussions at our national executive board, with our provincial leaderships, and they in turn have had the discussion with their members at municipal or provincial levels. We've shared this on our website, newsletters, Facebook, and a couple of other forms of communication that we use, and our members do support a direction of improving access to broadband. 33. PIAC's Board of Directors and AGM were informed of the proceeding at the 2015 June ‘Annual General Meeting and were updated on progress at the November 2015 Directors’ meeting. The Board agreed with the position advanced by the AAC. PIAC relied upon public opinion research on: * Communications services to which Canadians of various demographic characteristics were subscribed, as well as barriers to subscription; Importance of telecommunications services to Canadian households; and ‘Types of contributions which Canadians were willing to make to ensure universal access and affordability of telecommunications services. in a random telephone poll. PIAC further relied upon research it had undertaken on communications affordability (the No Consumer Left Behind report, filed as an appendix to the AAC's initial remarks) to inform its position. Finally, PIAC on behalf of the AAC commissioned public opinion research (filed with the AC's second intervention) that surveyed the views of low-income Canadians who were already online towards communications affordability 35. CAC's Board of Directors was informed of the proceeding through their President, Mr. Bruce Cran, during meetings in 2015 and 2016. Mr. Cran was appraised at all steps of the proceeding of the AAC arguments and he agreed with the same. 36. Likewise, COSCO senior management was provided with all submissions and had correspondence with counsel on the file. (c) AAC groups have a direct interest in the outcome; mandates of AAC members are to represent public at large 37. All of the groups represented in the AAC have, either in their constating documents or in their mission statements, commitments to represent the general public interest, or a subset of that general public interest (for example, NPF represents seniors, as does COSCO, while ‘ACORN Canada represents low- and middle-income Canadians). 38. Certain of the AAC groups have a very specific mandate to represent the public in regulatory and related proceedings, and thus claim to have a direct interest in CRTC regulatory proceedings. PIAC is a national non-profit, continued under the Canada Not-for-profit Corporations Act and a registered charity. PIAC's purposes under its Articles of Continuance are: 1. to engage in the research and study of matters of concer and interest to the public and to publish or otherwise make available the results of said research an study or any works of public concern or interest; 2. to act as a liaison between other public interest or citizens’ groups engaged in public interest advocacy, 3. to assist in and promote the activity of public interest representation throughout Canada and elsewhere, and to cooperate with other public interest and citizens’ groups throughout Canada and elsewhere; and 4, to make representations to governing authorities on behalf of the public at large or on behalf of public interest groups with respect to matters of public concern ind interest, and to teach public interest advocacy skills and techniques. Bof 14 Affordable Access Coalition ‘Application for Final Costs TNC 2015-134 (as amended) 39. While PIAC’s particular objects of incorporation may be unique within the AAG, they are the stated purposes, and as part of the AAC, PIAC therefore has a direct interest in the outcome of the proceeding 40. Subsection 70(2) of the Rules states, in reference to “fixing costs or taxing final costs The total amount of the costs must not exceed the total amount of costs necessarily and reasonably incurred by the applicant or the costs set out in the scale of costs established by the Commission under subsection 56(2) of the Telecommunications Act. 41. The AAC submits that it meets all of the requirements of the test for final costs, as explained in the balance of this section, (d) Assisted the Commission in developing a better understanding of matters considered 42. The AAC’s performance to in the Basic Services proceeding was extensive in terms of fling evidence and perspectives that assisted the Commission in developing a better understanding of the matters to be considered. 43. In direct response to the Commission's consultation questions set out in Appendix B of TNC 2015-134, the AAC submitted extensive comments based in relevant law, regulation, and policy, technological knowledge, economic expertise, and empirical evidence, with @ view to the public interest and long-range implications for Canadian society as a whole. In answering the Commission's questions and analyzing key issues in this proceeding, the ‘AAC offered a distinct, user-focused and public interest-oriented perspective, combined with the high level legal expertise and regulatory experience gained through PIAC’s long history of participating in CRTC proceedings. 44. In addition, the AAC further assisted the Commission by taking a practical, solutions- oriented approach, providing concrete proposals, including the development of two funding models to support access to basic telecommunications service, developed by Edgardo ‘Sepulveda, an expert in universal service funding regime. 45. The AAC submits that its contributions to the public record and to the Commission's understanding of key matters—such as the consequences of telecommunications regulatory decisions for more marginalized individuals in Canadian society, or public interest-oriented yet economically feasible solutions ready for potential implementation—were valuable and unique in the context of the Basic Services proceeding of 14 Affordable Access Coalition Application for Final Costs ‘TNC 2015-134 (as amended) 46. The AAC therefore submits that it meets the requirements of subsection 61(1\a\(il) and subsection 68(b) of the Rules in that it assisted the Commission in developing a better understanding of the matters that were considered. (e) Responsible tion 47. The AAC participated in this proceeding in a responsible, thorough, and good-faith manner in all stages of this proceeding, 48. The AAC filed an extensive first-round intervention, with primary survey evidence, and proposed at this early stage two subsidy models, supported by expert evidence, that addressed the Commission's concerns as stated in TNC 2015-134. The AAC then devoted considerable attention to first-round interrogatories, drawing out and clarifying information from other parties for the public record. The AAC also made sure to be responsive to other parties, answering interrogatories to the extent of its abilities—in fact, the AAC received only one request for further response aut of over 150 discrete questions, and moreover simply to confirm a point already resolved. 49. The AAC likewise fully participated in the second round of interventions, filing an updated expert report on our subsidy proposals in response to questions and valid points raised in the interrogatory rounds. The AAC also filed with its extensive and well-reasoned second intervention additional primary evidence in the form of a survey of communications affordability amongst low-income internet users. 50. The AAC presented clear and cogent argument at the oral hearing, with an appearance lasting over two hours. The AAC brought representatives of its major groups to the hearing, who testified directly to the Commission. 51. The AAC promptly and thoroughly answered its undertakings from the oral hearing, 52. The AAC fully answered the Commission's jurisdictional questions on 5 May 2016. 53. The AAC filed final written reply, on time, that was cogent and helped to frame the overall arc of the proceeding. 54. The AAC submits, thal it manifestly assisted the Commission with a better understanding of the issues, at all times bringing a consumer and in particular, low-income consumer perspective to the table. The AAC also submits that it provided the Commission with a 100f 14 Affordable Access Coailtion ‘Application for Final Costs, TNC 2016-134 (as amended) workable subsidy model which it introduced from the start of the proceeding and explained with expert evidence, that would allow the Commission to seriously consider subsidies as part of the decision, 55. Furthermore, work was allocated efficiently among available staff and outside counsel, maximizing use of junior counsel or students where appropriate. 56. The AAC therefore submits that it meets the requirements of subsection 61(1)(a\Xii) and ‘subsection 68(b) of the Rules. (9 The amount of costs requested, with receipts or detailed estimates 57. The AAC requests the full costs detailed in this application for its participation in the Basic Services proceeding. 58. As required by subsection 61(1)(c), the AAC provides time sheets for the counsel, students, and consultants who worked on the proceeding to that date. 59. As required by the Costs Guidelines,’ the AAC is filing an affidavit of disbursements in Form IV, including a summary statement of disbursements as Exhibit A. The AAC also files 2 summary of the total fees and disbursements claimed as prescribed in Form V. 60. These are not estimates but actual time dockets for time and expenses. The costs are calculated using the Commission's costs scale, as set aut in Revision of CRTC costs award practices and procedures - Telecom Regulatory Policy CRTC 2010-963. (g) Costs necessarily and reasonably incurred 61. The proposed final costs award is reasonable and appropriate. The AAC expects some parties to consider the final costs application high. The AAC submits that itis entitled to the entire claimed amount, however, for the following reasons. 62. The Basic Services proceeding was a major, fundamental framework proceeding that could have major impacts for all Canadians regarding the essential service that is broadband internet as well as other telecom services that are essential to Canadians. The AAC brough to the proceeding a distinct consumer and low-income Canadians perspective, and extensive evidence in support of its positions. : At para, 8 11 of 14 Affordable Access Coalition Application for Final Costs TNC 2015-134 (as amended) 63. The AAC has relied on articling students, law students, and junior counsel to the extent possible to avoid incurring excessive costs, as required in the Guidelines. The bulk of the work on this file has been by the most junior of resources, with supervision and involvement by more senior resources. 64. The AAC, however, takes issue with perspectives of some TSPs in our interim costs application that strategy meetings amongst lawyers, staff, experts and clients are somehow “over-lawyering” or “too many people’ or some other inchoate concem. It is AC's submission to the Commission that in a proceeding of this importance and complexity, the importance of reasonable meeting time amongst all participants on an advocacy team to discuss strategy and argument are key to success and an effective and efficient Participation. Therefore the AAC is submitting all such time, which was properly incurred and is permitted on the face of the costs rules, with this claim, 65. We await the Commission's exercise of its overall discretion regarding our costs. However, we submit that given the importance of the proceeding, the extensive and responsible participation of the AAC and its significant and unique viewpoint, the Commission should grant all costs claimed. (h) Identification of interim costs respondents, and apportionment 66. Subsection 61(1)(d) of the Rules requires the interim costs applicant to identify the interim costs respondents. The AAC submits that all TSPs participating in the proceading are the appropriate costs respondent, subject to the comments below. 67. The AAC notes that the Commission has “generally determined that the appropriate costs respondents to an award of costs are the parties that have a significant interest in the proceeding in question and have participated actively in that proceeding,”* 68. The Commission's practice has generally been to “allocate the responsibility for payment of costs among costs respondents based on their telecommunications operating revenues {TORs) as an indicator of the relative size and interest of the parties involved in the proceeding.”” « Determination of costs award with respect to the participation of the Public Interest Advocacy Centre and the Consumers’ Association of Canada in the proceeding regarding the practice by certain telecommunications service providers to charge a fee for paper bils - Telecom Order CRTC 2014-437 (21 ‘August 2014) at para, 12. 7" Determination of costs award with respect to the participation of the Consumers’ Association of Canada and the Public Interest Advocacy Centre in the proceeding leading to Telecom Decision 2016-70 regarding the expity of certain time-limited exogenous factors - Telecom Order CRTC 2018-194 (18 May 2015) at para. 12. 120f14 Affordable Access Coalition ‘Application for Final Costs. ‘TNC 2015-134 (as amended) 69. In Telecom Order 2015-160, the Commission “considered $1,000 to be the minimum ‘amount that a costs respondent should be required to pay due to the administrative burden that small costs awards impose on both the applicant and costs respondents.”* 70. To limit the number of costs respondents, Telecom Regulatory Policy CRTC 2010-963 ‘states that "When a costs award exceeds $20,000, the Commission will generally award no more than one extra costs respondent for each additional $5,000 awarded”, and the Cost Guidelines provide the following scale. ‘Amount Awarded Number of Respondents $ $1,000 Maximum 3 respondents {$1,000.03 to $10,000 Maximum 6 respenderts $10,000.01 to £20,000 Maximum 10 respondents > $20,000 Maximum 1 extra respondent for each additional $5,000 awarded = 71. According to this scale, the number of potential costs respondents for the AAC’s interim costs claim would be up to 97: 10 respondents for the first $20,000 claimed, plus 87 respondents for the balance of the total claim of $455,089.49 72. The AAC recommends that costs should, to be consistent with Commission practice, be apportioned according in proportion to TORS, but be limited to the TSP parties that have a significant interest in the proceeding in question and participated actively in the Basic Services proceeding. Further, should any TOR calculation result in an award of less than $1000, that TSP could be dropped, with their share added to the total to be paid by the remaining TSPs. () Payment 73. The Basic Services proceeding was @ massive, wide-ranging, complex proceeding with many component pars critical to the health of the Canadian telecommunications system, and by extension, the Canadian digital economy and welfare of Canadians, The AAC was pleased to be a part of this important process, 77. The Commission has promised to the intervenors that rulings on final costs claims will be made prior to the release of the final decision. We underline the importance of that promise cof the Commission, and ask that this claim be treated with all due dispatch.
