Facts: The petitioner filed a petition for certiorari and writ of injunction against the
respondents. The Faculty Club (private respondent), the union of professors/instructors,
is its sole and exclusive bargaining representative. The petitioner contends that they
dont have employer-employee relationship because the private respondent (Faculty
Club) members were only contractual. The private respondents staged strike when the
demand of the union were not answered by the institutions administration. After the
certification from the President of the Philippines, the CIR acquired exclusive jurisdiction
over the case, under R.A. No. 875. However, the petitioner contends that they dont
have employer-employee relationship because the private respondent (Faculty Club)
members were only contractual and being an educational institution, therefore, the
CIR(under Industrial Peace Act) has no jurisdiction over the case. The petitioner claims
that it is not an employer within the contemplation of R.A. No. 875 because it is not an
industrial establishment.
Issues: Whether or not the case falls under the jurisdiction of CIR.
Whether or not there is labor dispute.
Held: There is very reason to believe that our labor legislation from Commonwealth Act.
No. 103, down through the Eight Hour Labor Law, to the Industrial Peace Act, was
intended by the Legislature to apply only to industrial employment and to govern the
relations between employers engaged in industry and occupations for profit and gain,
and their industrial employees, but not to organizations and entities operated and
maintained not for profit or gain. The court considers the well settled doctrine that the
Industrial Peace Act is applicable to any organization or entity whatever may its
purpose when it was created that is operated for profit or for gain. The court
concludes that the case at bar falls well under the jurisdiction of the court.
The test of whether a controversy comes within the definition of labor dispute depend
on whether the controversy involves or concerns with term, tenure, conditions of work,
or representation.
