08-06-13 USC Credit Union – fax transmission from Loan Department – records that were the
legal foundation for unauthorized transactions in collusion with Atty David Pasternak
The enclosed pages were received by fax from Christine M Schwarz, Vice President
of USC Credit Union, Manager of the Real Estate Lending Department.
These records, a total of 7 including cover sheet, were produced in response to request
that USC CU provide evidence of the legal foundation for transactions that were
executed in Dr Zernik's account without Dr Zernik's authorization and without notice to
Dr Zernik.
Notice that such fax transmission, from the Vice President of the USC CU, came
with no fax header imprint whatsoever. As it turned out later, that was not an
isolated incident, but a routine. USC CU refused to change such custom even after
repeated requests, in disregard of UETA - the Uniform Electronic Transactions Act.
Notice that such records were received from the person directly involved in the
alleged wrongdoing. Dr Zernik requested that such records be produced by a
Custodian of Records. In response, USC CU claimed that it had no Custodian of
Records, moreover, both the CEO and the Counsel for the USC CU were insistent
in their refusal to have a Custodian of Record appointed.

Agency holding authority over USC CU opens with the statement:

checks and payment instruments (money orders), money transmitters and premium finance companies. The Department also administers the Local Agency
Security Program, which ensures that public deposits in California financial institutions that exceed the federal deposit insurance limit are secured by pledged
assets.
