ORDER AND JUDGMENT*
Before BRORBY, EBEL, and KELLY, Circuit Judges.**
Mr. Amen appeals from the district courts dismissal of his complaint against the
United States based upon the magistrates report and recommendation, I R. doc. 67, the
magistrates order denying him leave to file a second amended complaint, I R. doc. 68
and the district courts decision to dismiss 31 parties for misjoinder, leaving only the
government remaining. Aplee. App. 60-61 (doc. 49). He also seeks leave to proceed on
This order and judgment is not binding precedent, except under the doctrines of
law of the case, res judicata, and collateral estoppel. This court generally disfavors the
citation of orders and judgments; nevertheless, an order and judgment may be cited under
the terms and conditions of 10th Cir. R. 36.3.
