CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This Contract of Lease is entered into by and between:
SPS. ELIAS AND SUSITA LADINES of legal age, Filipino,
married and a resident of PHHC Blk. 6, Lot 4, Bacolod City,
collectively hereinafter referred to as LESSOR ;
-and________________________________ of legal age,
Filipino,

and
a
resident
of
___________________________________________,
hereinafter
referred to as LESSEE;
WITNESSETH:
WHEREAS, the LESSOR are the registered owners of a property covered
by TCT No. _____________________, which contains a family home, a
vulcanizing shop and a commercial space;
WHEREAS, the LESSOR hereby leases unto the LESSEE and the latter
hereby accepts in lease from the former, a commercial space beside 3Gs
Vulcanizing Shop in PHHC Blk. 6, lot 4, Bacolod City covered by TCT No. T________________________________ owned by the LESSOR, under the
following terms and conditions:
1.
That
the
terms
of
this
shall
be
for___________________________________,
starting
from
______________________ to _____________________, and
renewable upon mutual consent of both parties.
That the LESSEE shall have the first priority on the renewal
on rental over any other prospective tenants and that the LESSOR
shall not allow any other tenants with the same line of business as
the LESSEE within the area of the leased premises during the
Contract of Lease.
That the LESSEE shall notify the LESSOR by serving a thirty
day (30) written notice in case the LESSEE desires to preterminate this contract of lease. The LESSEE shall only be liable to
lease rental corresponding to the lease period as actually enjoyed.
2.
That during the period of the lease, the monthly rental
on
lease
premises
shall
be

every _____ day of the month and a ONE MONTH ADVANCE
PAYMENT shall be given to the LESSOR by the LESSEE on

That the LESSEE shall use the leased premises
exclusively for his business use only.

However, a two (2) months deposit equivalent to

which shall answer for unpaid charges such as electric bill and other
charges, however the deposit will be refunded by the LESSOR to
the LESSEE if the said amount will not be applied at the end of this
leased period.
5.
That the LESSOR shall issue to the LESSEE written
receipts on all payments made by the LESSEE arising from the
Contract of Lessee.
6.
That the LESSEE shall not make any alterations,
improvements or addition to or in the lease premises without prior
consent of the LESSOR and all alteration, improvements and/or
additions made on the leased premises shall remain as property of
the LESSOR upon termination of the lease without right to the
reimbursement to the LESSEE for the cost or value thereof.
7.
That the LESSEE shall bear all necessary repairs
occasioned by ordinary wear and tear during the period of the
lease. The LESSEE shall furthermore be responsible for any
damage to the leased premises due to its carelessness or
negligence or of its agents, employees or other persons under its
control which damage must be repaired for the cost or value
thereof.
8.
That all water, electrical, telephone and other bills for
public utilities shall be for the account of the LESSEE during the
period of the lease.

ACKNOWLEDGMENT
BEFORE ME, in the place and on the date above-mentioned, personally
appeared the PARTIES, with their pertinent valid identification data cards as
above-written, declaring to me that the foregoing Contract of Lease is of their
free, voluntary act and deed.
This instrument consists of THREE (3) pages, including the page on which
this Acknowledgment is written and signed by the parties on each and every
page and their witnesses on last page hereof.
