Happy 60th Anniversary Arrow Yacht Club!

It all began in 1956 with the f rst meeting. T e following founding members were present: Art Anderson, Howard Anderson, Jim Seaton, Dr. G. Page, Alex Cumming, Dr. Pat Fowler, John McLeod and E Archibald. Te Arrow Boat Club (as it was initially named until 1976) was located in Robson with docks and fuel facili- ties. Teir mission, ‘To promote interest in recreational boating and boating safety, to protect the rights of boaters and to improve local mooring facilities”. Various fundrais- ing activities helped the club to build and maintain their docks. Te club purchased 200 feet of waterfront, due to the imminent construction of the dam, where they relo- cated from Robson to set up a marina and fuel dock at their present location. Much work was done to build a launch ramp, pilings, anchors and install booms. Te clubhouse was purchased in 1969 and it was moved to its present location. During these years of relocating the clubhouse and building again, a lot of work was done by the volunteer eforts of the membership. As time passed, the marina property and docks were sold to private interests.

In 2006 the club once again built up their docks, orga- nizing and expanding the campground and began the process of a land exchange with the BC Government, due to the very high fees for leasing the campground. Te club sought to exchange the campground land for several acres which was ide- ally suited to sheep habitat. Tis was successful afer many years of negotiations. Te club is presently work- ing on extending the docks into deeper water to ensure a longer mooring season and the clubhouse is being modernized with a new roof and siding. Troughout the years, the Arrow Yacht Club has been involved in promot- ing boating safety. Such as being instrumental in the establishing shore markers (navigation aids) along areas of the Columbia River and Arrow Lake, promoting safe mooring spots, campsites and picnic areas. And in con- junction with the Ministry of Environment, gathering information on tagging fsh and boat safety inspections. Arrow Yacht Club was (and is) not all work! Social activities have always been on the annual calendar – dinners, cruises, commo- dore’s ball, parties, fshing derbies, beach BBQs and boat regattas. Tere have been many social activities throughout the years. New members are always welcome, come out and say hello. Or join us on our 60th anniversary celebration at the Yacht Club, 5540 Broadwater Road, Castlegar on Saturday, August 27. WHAT HAPPENS TO YOUR INHERITANCE IF YOU DIVORCE?

Let’s say you get an inheritance. You’re happily married, but you also realize that not all marriages ulti- mately survive – so what happens to this inheritance if your marriage breaks up?

Since March, 2013, under our new family law rules for division of property (and debts), family property upon separation must generally be di- vided 50-50, no matter which spouse owns it. But some things – like prop- erty (say a fancy car) either of you brought into the relationship and also inheritances you receive while mar- ried – are “excluded property” which typically doesn’t need to be split.

So what happens if you were to put that inheritance, say a $500,000 gi f , into a bank account owned by your spouse or it’s used toward buying a house that’s in your spouse’s name only? Does it stay “excluded” and re- main only your property? Or does it become family property that must be split? Tis question has been hotly debated and led to difering results in earlier cases. Our appeal court has now recently dealt with it for the frst time.

Here, Peter (names changed) re- ceived a $2 million gif by way of inheritance from a former employer.

Te bulk of the money was used for a house that was also placed in his wife Helen’s name only (basically to protect against potential future busi- ness claims Peter might face).

When their 10-year marriage broke up, $2 million from that house sale was set aside, with Peter saying this money was still his and excluded from division. Helen argued it be- longed into the pot of family property.

T e B.C. Court of Appeal agreed with Helen. T ere’s an established rule that if a husband simply trans- fers property outright to his wife during the marriage (like putting money in her bank account or a house in her name), it’s presumed to be a gi f unless he can prove other- wise. Here (as ofen happens years later, regarding what was intended at the time), Peter couldn’t prove or persuade the court that he hadn’t in- tended a gi f to Helen. And like any outright gi f , you can’t take it back later even if the marriage breaks up.

T e court pointed out Peter couldn’t have it both ways – arguing “that’s not my property, it’s my wife’s” had there been business claims against him, yet now saying it was his property, not hers, afer the marriage break-up.
