The Commission directs the PIO to inform the Appellant in writing that AMIE course

is not

approved by AICTE and that he is therefore not eligible for the post of Assistant Professor.

ORDER

1. The Applicant filed an RTI Application dt.4.2.10 with the PIO, AICTE seeking information against 4

points regarding his eligibility to the post of

Assistant Professor in Technical Institutions (Degree)

according to Regulations 2010 which shall come into force w.e.f the date of their publication in official

gazette including whether AMIE Course is equivalent to BE/B.Tech and M.Tech with First Division, In

this connection the Applicant also wanted to know whether he was eligle for the psot of Assistant

Professor.

On not receiving any reply, he filed an appeal dt.8.4.10 with the Appellate Authority

reiterating his request for the information.

Dr.R.S.Rathore, CPIO replied on 1.4.10 stating that the

information being sought is not as per definition of information given in Section 2(f) of the RTI Act,

2005. Being aggrieved with the reply, the Applicant filed a second appeal dt.20.5.10 before CIC.

Decision

During the hearing, the Appellant wanted to know whether his AMIE qualification is recognized by

AICTE. The Respondent stated that information could not be provided also because the Appellant

had not provided his educational qualifications.

When the

Appellant provided further information

regarding his educational qualifications including the fact

that he had completed his

AMIE from

Institute of Engineers, Kolkatta and had studied at Govt. College, Deenbandhu Institute of Science

and Technology, Sonepat, Haryana, the Respondents clarified that the AMIE course is not approved

by AICTE.

The Commission after hearing the submissions by both sides directs the PIO to inform the Appellant

in writing that AMIE is not approved by AICTE by 5.2.11 and the Appellant to submit a compliance

report to the Commission by 10.2.11.

The appeal is disposed of with the above directions.
