Mandating the Incorporation of Tribes as Formal Local
Government Units, Outlining Ancestral Domain, And Other
Purposes
Be it enacted by the Members of the Congress of the Republic of the Philippines assembled:
Chapter I
General Provisions
SECTION 1: Short Title. This act shall be known as the Indigenous Peoples
Incorporation Act
SECTION 2: Declaration of State Policy. It is the intention of the State to
provide for indigenous people according the the mandates set upon by the 1987
Constitution, specifically:
Article 2, Section 22: The State recognizes and promotes the rights of
indigenous cultural communities within the framework of national
unity and development.
Article 12, Section 5. The State, subject to the provisions of this
Constitution and national development policies and programs, shall
protect the rights of indigenous cultural communities to their ancestral
lands to ensure their economic, social, and cultural well-being.
Article 13, Section 6: The State shall apply the principles of agrarian
reform or stewardship, whenever applicable in accordance with law,
in the disposition or utilization of other natural resources, including
lands of the public domain under lease or concession suitable to
agriculture, subject to prior rights, homestead rights of small settlers,
and the rights of indigenous communities to their ancestral lands.
SECTION 8: The government shall allocate funds to them given that theyre
under the local government unit for the purpose of establishing a learning system.
Chapter III
Miscellaneous Provisions
SECTION 9: Separability Clause. - The provision of this Act are hereby declared
to be separable from, and independent of, one another and that should one or more
of such provisions be declared unconstitutional, the validity of the remaining
provisions shall not be affected thereby.
SECTION 10: Repealing Clause. - All laws, decrees, executive issuances, rules
and regulations inconsistent with this Act are hereby repealed and/or modified
accordingly.
SECTION 11: Effectivity Clause. - This Act shall take effect immediately upon its
approval.
