I filed a Candidate Affidavit to run for HD4 on July 22nd, 2016. I believe I am
being denied a fair process according to CRS 1-4-1002 (2.3) (9a-b). According
to resources, I believe I am the only candidate for the Republican Party that
actually filed a Candidate Affidavit due to Ben Higgins withdrawing from the
election. I should have an equal chance and should be eligible to run this
upcoming election. Unfortunately I have been told that decision has already
been made. According to the S.O.S. website, I followed all the procedures to
run and I shouldn't be disqualified. I dont believe I even had a chance,
considering the fact that the HD4 Committee announced at the Dragon Boat
Festival that they had already selected Gavin Halligan to run for HD4. It's
deeply upsetting that I wasn't given a fair chance, and that it seems that the
Candidate for HD4 was predetermined and rubber stamped. I do not believe
election procedures were followed to the capacity they were created for. Also, it
would seem to me that there is a conflict of interest for the Vice Chairman of
the HD4 Vacancy Committee to be rubber stamped as the Candidate on the
ballot for the upcoming election when another Candidate (myself) completed
and followed S.O.S. procedures. I see no neutrality in decision that was made.
Due to the time sensitivity of this matter I would greatly appreciate a response
by August 5, 2016. I would like to thank you in advance for looking into these
matters, and please dont hesitate to ask if you need any additional information.

My concern is that the Vacancy Committee did not meet because it was already predetermined
that the Vice Chair of the Committee was to be appointed. It seems that the best way to move
forward to appointing a member of the committee would be to not hold a hearing, but to have
the State Chairman make the appointment as Statue states is the next step. That is why I feel
there is a conflict of interest, especially with announcing this decision before the deadline of
the 5 day notice to committee members to hold a hearing. Statues can be misleading, but there
is a reason why this statue was created, and why hearings "should" be held. If no one that
attends the hearing or nominates themselves, no votes can be made,and that is when State
Party Chairman shall intervene and make appointment "Only if the vacancy committee fails to
certify the selection within 7 days" In this case the only reason the the selection failed is in
fact because there was no attempt to hold a hearing. If this process was followed, there would
be no conflict of interest and it would in fact be appropriate for Steve House to make the
appointment. Also, there was a hearing held for Ben Higgins, isn't this how he made the ballot
with the same timeline to hold hearing? Did he file a Candidate Affidavit before he was voted
(approved) by vacancy committee, did he nominate himself from floor of hearing, or was this
predetermined before the vote and was he instructed to nominate himself. The HD4 Vacancy
Committee was aware of my filing of Candidate Affidavit before Ben Higgins formally
submitted his request for withdrawal. Which gives reason to hold hearing, because it shows
someone is interested in being given a FAIR chance for the vote. Please let me know your
thoughts.

1-4-1002 of the Colorado Revised Statutes can be a bit misleading. You are correct that it
does govern vacancies. It also mentions, several times, vacancy committees. However, it only
states that a vacancy may be filled by a vacancy committee. It does not actually require it. There is
nothing in Title 1 of the Colorado Revised Statutes that actually requires a political party to hold a
committee meeting to fill a vacancy. This is left to the respective parties themselves and, as I am
sure you are aware, the Colorado Department of State has no oversight when it comes to political
parties.

that a vacancy may be filled by a vacancy committee. It does not actually require it. There is nothing
in Title 1 of the Colorado Revised Statutes that actually requires a political party to hold a committee
meeting to fill a vacancy. This is left to the respective parties themselves and, as I am sure you are
aware, the Colorado Department of State has no oversight when it comes to political parties.

Per Colorado statute 1-4-1002(9), the state chair cannot nominate a vacancy candidate until seven
days have passed after the vacancy occurred and the vacancy committee has not nominated a

I would like to sincerely thank you for your prompt response. Also, I would like to make it
clear for the record that it is not my intention for you to apologize about Colorado Revised
Statues. I do believe; however, that any party or state official should follow these statues. With
that being said, I cannot express enough gratitude for your recommendation on how to follow
up with this situation, which I do plan on doing. I give you my word that I will pursue your
advice, as well as following up with Secretary of State election officials to ensure any
decisions are in fact abided by state laws and party procedures. I do have a few questions in
response to the email I received.
What day was the committee polled, and are there minutes available to the public?
Was this decision made prior to midnight of August 1st? I ask this because of posts that I have
read online that stated Gavin Halligan was already appointed to HD4 dated prior to midnight
of Monday the 1st.
Did this decision have to do with the fact that I have not attended any local caucuses?
Finally, was anybody in this committee aware of my filing of affidavit for candidacy before
this decision was made? From my understanding filing a candidate affadavit was the first step.
I followed the directions that the SOS website provided, shouldn't this have been sufficient?
The parellel between Mr. Higgens and I shows a lot of similarities. Really the only difference
is that I wasn't on a tv show, and I have been a registered Republican my entire adult life.
I also have a few Colorado Revised Statues that I would like to bring to your attention.
CRS 1-4-1002
(2.3) (a) A vacancy in a party nomination, other than a vacancy for a party nomination for lieutenant
governor for a general election occurring after January 1, 2001, that occurs after the day of the primary
election and more than eighteen days before the general election may be filled by the respective party
assembly vacancy committee of the district, county, or state, as appropriate, depending upon the office for
which the vacancy in nomination has occurred in accordance with the provisions of subsection (9) of this
section. A vacancy in a party nomination for lieutenant governor for a general election occurring after
January 1, 2001, shall be filled by a replacement candidate for lieutenant governor nominated by the party's
candidate for governor. A vacancy may be caused by the declination, death, disqualification, resignation, or
withdrawal of the person nominated at the primary election or by the declination, death, disqualification,
resignation, or withdrawal of an elective officer after a primary election at which a nomination could have
been made for the office had the vacancy then existed. No person is eligible for appointment to fill a
vacancy in the party nomination unless the person meets all of the requirements of candidacy as of the date
of the primary election. When a vacancy is filled pursuant to this paragraph (a), the designated election
official shall provide notice by publication of the replacement nomination in the same manner as the notice
required by section 1-5-205.

9) (a) No vacancy committee called to fill a vacancy pursuant to the provisions of subsection (2.3) of this
section may select a person to fill a vacancy at a meeting held for that purpose unless a written notice
announcing the time and location of the vacancy committee meeting was mailed to each of the committee
members at least five days prior to such meeting by the chairperson of the central committee which selected
the members. Mailing of the notice is effective when the notice is properly addressed and deposited in the
United States mail, with first-class postage prepaid.

A person becomes a candidate when they publicly announce and then either receive a contribution or
make an expenditure.
Colorado Law
There were several parts of the Colorado campaign finance law that could have been
violated if FreeForm had broadcast a show about Mr. Higgins campaign while he was
running for office. One example would be the provisions of Colorado law regulating
electioneering communications. Those provisions would be triggered by any
communication broadcasted by television or radio, printed in a newspaper or on a
billboard, directly mailed or delivered by hand to personal residences or otherwise
distributed that:
(I) Unambiguously refers to any candidate; and
(II) Is broadcasted, printed, mailed, delivered, or distributed within thirty
days before a primary election or sixty days before a general election;
and
(III) Is broadcasted to, printed in a newspaper distributed to, mailed to,
delivered by hand to, or otherwise distributed to an audience that
includes members of the electorate for such public office.
Colorado Constitution, Article XXVIII, 2(7). Various other provisions raised concerns as
well.
Lynn Bartels: They are misreading the current law. While Colorado campaign finance law
addresses electioneering communication, there is also a media exemption that is not
addressed in their e-mail.
In other words, they quoted what an electioneering communication is, but they left out
the exemption, which is media. This was the subject of a Citizens United case here two

Id like to thank all of you for taking the time to attend the HD4 Vacancy Committee meeting tonight.
Due to State Statutes, we were under a time deadline both short and unreasonable. You all
DELIVERED! We needed quorum (50 percent plus one). We hit ninety percent attendance of voting
members. (And at dinner time on a Friday night, with a four day notice. Well done!)
This is an amazing outcome of support, and will bullet-proof the assembly vote, should it be
challenged. Awesome! It is a testimony to the dedication that all of you have, to restore Liberty.
Thank you.
Special thanks to Shelby Lewark for serving as Secretary of the assembly (as well as getting on the
phone and calling people who didnt RSVP immediately. You are kick-ass sister!)
Thanks also to Tomoko Kotaka and Sue Moore for stepping up to serve on the Teller Committee.
Certifying the vote is critical to ensuring integrity in the process.
Id also like to give a shout out to Kara Kenfield, who as our notary tonight, crossed the Ts and

has been affiliated with the Republican Party since 2014. As a member of

Because Mr. Higgins missed these deadlines, he is not eligible to run for
House District 4 this year.
