To: Roger O'Dell, Temporary Credentials Committee Chairman

2267 Trawood, Ste E2

El Paso, TX 79935

Ref: Appeal directly to Credentials Committee via RPT Rule 27(b)(3), 27

(d),
35, and RPT Rule 5 "Robert's Rules of Order Newly Revised" as
appropriate.

Dear Chairman,

The Attached is a copy of the challenge as originally sent to the

RPT State
HQ and not forwarded to your committee by the Officials Committee.
Based on media inquiries, we believe this challenge has been denied
by the Officials Committee. None of the signatories have received any
notice of an adverse decision.
We the undersigned originators of this challenge appeal this
decision as
provided for by RPT Rule 27 (b)(3). This appeal has been mailed no
later
than ten (10) days prior to the date that the State Convention holds its
first general session.
Appellants contend that Officials Committee (“the Committee”)
exceeded the scope of their authority by “assessing the merit, or lack
thereof” of the challenge in violation of RPT Rule 27 (b)(2). Appellants
suggest the Officials Committee was hypocritical in violating Rule 14 in
reviewing a challenge relating to a violation of Rule 14. Complainants
contend that the Officials Committee meetings “shall be open to any
delegate or alternate to that convention.” If the Committee were
allowed to proceed as it did (directly into executive session), an “open
meeting” would still need to be called to order, before a motion to go
into executive session could be entertained. This would seem to make
the entire Committee subject to the same challenge.
Further, Appellants allege that the Committee relied on a letter,
which was provided by the delegates subject to challenge. Said letter
has yet to be provided to appellants herein. Based on information and
belief, the letter in question contained statements that were
specifically intended to be “testimony”. Appellants contend the
committee violated their respective due process rights by accepting
the letter into the official record, without challenge.
Appellants would further show the Credentials Committee that
they never intended to suggest that meeting of this nature were not
allowed at “private residences”. The reference to the residence was
intended to demonstrate that the choice of an isolated meeting place
was another attempt to disenfranchise the complainants through use
of stealth and secrecy.
We additionally request the delegates in question be listed on the
Temporary roll, and not allowed to vote on their own challenge.
Furthermore, delegates from delegations that are being challenged
should not be seated until the challenge is resolved.
Many of the public comments by the challenged delegates
suggest that the reason the complainants were denied access to the
meeting was based upon their age. This would be a clear violation of
RPT rule #3.

Signed,
