The Regional Trial Court convicted Maningding of Murder, that on September 13,
2006 while the victim having a conversation with Marlon near the Sari-sari store of
one of the witnesses, Accused-appelant arrived and suddenly hit the victim with the
knife and because of the massive loss of blood the victim died. Dr. De Guzman
issued findings and death certificate of victim. furthermore the presuction
presented witnesses to further investigate the incident thus Gloria, wife of the
victim establish civil liabilty of the accused.

On the other hand, Accused defense was that the victim was the one who pulled the
knife from his waist and he was able to grab it and accidentally stab the victim upon
the fell but there is no other witness or evidence presented to support its defense.
thus the RTC gave credence to the testimonies of the presuctions of eyewitnesses
Romel and Aladino, moreover the RTC found that treachery was indeed exist.

Whether or not unlawful aggression found from the act of accused.
