AGREEMENT BETWEEN

OZARKS TECHNICAL COMMUNITY COLLEGE AND


THE SCHOOL DISTRICT OF SPRINGFIELD, R-12
THIS AGREEMENT is effective this
day of
, 2015, by and
between Ozarks Technical Community College (OTC), a public community college, with its
main campus and administrative offices located at 1001 E. Chestnut Expressway, Springfield,
MO 65802, and The School District of Springfield, R-12, an urban school district, with
administrative offices at 1359 E. St. Louis St., Springfield, MO 65802 (SPS), by and through
its Board of Education (Board).
1. Nature of Agreement. OTC offers an educational program called the Middle College
Program (Program). SPS students are enrolled in the Program and attend class on the
OTC campus. The purpose of this Agreement is to establish the roles and responsibilities
of each party.
2. Recruitment and Student Contact Information. OTC and SPS personnel will work
cooperatively to identify, inform, and refer students to the Program.
a.
SPS will provide specified high school student data/information for
marketing and targeted recruitment of students for specific program areas
including, but not limited to, names, addresses, phone numbers, emails,
grades, transcripts, schedules, IEP/504 records, test scores, attendance,
discipline records, A+ status, and free/reduced lunch eligibility, as needed.
b.
OTC employees, working under the educational authority of the Program,
will have access to student records, data, and information as an auxiliary
(Choice) program for SPS in an effort to provide an exemplary Program
model.
c.
Students must meet enrollment criteria as outlined by the application
process.
d.
Students may be referred by an SPS staff member or through self-referral
by a parent or guardian.
e.
Students who apply, must be enrolled or be eligible to enroll in SPS.
3. Access to District Student Management System. OTC Program personnel will be granted
access to the Districts Student Management System to work cooperatively with District
employees to facilitate the correct reporting and recording keeping procedures related to
attendance, grades, credits, test scores, and other significant data management. OTC
Program personnel shall not access or enter data for any other purposes than to facilitate
the partnership agreement between SPS and the Program. OTC personnel shall not share
the passwords or other information that would allow non-designated persons to access the
Districts Student Management System.
4. SPS Personnel. SPS personnel will be housed on OTCs campus to provide general
education courses which are consistent with the Missouri graduation requirements. SPS
personnel will be provided access to email and technology support including, but not
limited to, educational platforms such as Blackboard and Pinnacle attendance and grading

management systems. SPS employees will be encouraged to participate in on-campus


professional development and embraced as a member of the OTC faculty and staff.
5. Confidentiality and College Standards. OTC and its personnel shall maintain
confidentiality concerning the information contained in the Districts Student
Management System, including but not limited to personally identifiable information
concerning any District student, as required by the Family Educational Rights and
Privacy Act, 20 U.S.C. Section 1232g, et seq. and its regulations at 34 C.F.R. Part 99
(FERPA) and the Statutes of the State of Missouri. Prior to allowing any OTC
employee to access the Districts Student Management System, OTC shall ensure the
employee understands the requirements of FERPA and the Missouri Statutes.
a.
Likewise, confidentiality for SPS personnel as visiting instructors or staff
members on OTCs campus assume the responsibility and expectation to
meet OTC employee standards as outlined in the College Policies &
Procedures Manual and the Faculty Handbook located online at
www.otc.edu. The Program administration team is responsible to educate
and implement these standards for all Program staff.
b.
SPS administration is responsible for the evaluation of their employees
with support from the Programs administration.
6. Non-Discrimination. District and OTC give assurance that each is an equal opportunity
employer and does not discriminate against any employee, student, or applicant for
employment or registration in a course of study or in its services to people on the basis of
race, color, religion, sex, national origin, ancestry, age, disability or veteran status. The
parties further agree to comply with all laws and regulations applicable to this
Agreement.
7. Liability. In the performance of the duties and responsibilities set forth on the parties by
this Agreement, OTC agrees to assume responsibility for any liability imposed by law on
it and the District agrees to assume responsibility for any liability imposed by law on it.
Nothing herein shall be construed to waive any sovereign, official, or governmental
immunity applicable to either party, its board, officers, employees or representatives.
8. Term/Termination of Agreement. This Agreement shall be effective on the date it is
approved by the District and OTC. This Agreement may be terminated by either party
after sixty (60) days written notice is provided to the other party. The Agreement will
automatically terminate in the event the Program is discontinued by OTC or the District
ceases to utilize the Program for its students.
9. Miscellaneous Provisions.
a. Entire Agreement. This Agreement constitutes the entire contract between the
parties and supersedes all prior negotiations, representations or agreements,
either written or oral between the parties.
b. Controlling Law/Venue. This Agreement shall be governed by and construed
in accordance with the laws of the State of Missouri.
