ANTECEDENT: The 1 respondents from the Bureau of Printing Employees Association (NLU) filed a

complaint against the 2Bureau of Printing for an alleged unfair labor practices by interfering with the
respondent's right to selforganization in regard to hire and tenure of their employment in order to
discouragethemfrompursuingtheunionactivities.

The petitioners denied the allegations and asserted that the respondents were in suspension
pending investigations asaresultforbreachof Civil Service rulesandregulations. Accordingly,theBureau
of Printing ,created by the Administrative Code of 1916, is an agency of the Republic 3 performing
governmentfunctions, thus, has nojuridicalpersonalitytosueand besued. Thereafter, petitionersfiledan
"OmnibusMotion" askingfor a preliminaryhearing for lackofjurisdictionandtodismiss thecase.However,
having this petition denied by the Industrial Courtand by the courtinbanc,thepetitionersbroughtthecase
totheSupremeCourtthroughthepresentpetitionfor

certiorariandprohibition.

HELD: No. the Court of Industrial Relations did not acquire jurisdiction over the respondent Bureau of
Printing,and isthus devoidof anyauthoritytotakecognizanceofthecase.ThisCourthasnojurisdictionto
hear and determine the complaint for unfair labor practice filed against institutions or corporations not
organizedforprofitand,consequently,notanindustrialorbusinessorganization.
