What can be the valid grounds (true and realistic) for termination of

service ?
Ans. Violation of grounds mentioned at Rule 123 od DSEAR 1973.
Is the permission from The Director , Directorate of Education, NCT , Delhi
"MANDATORY" for termination of any employee ?
Yes, in light of judgment of Supreme Court in

Raj Kumar v Director of Education.

Can any school terminate any employee if he / she ask the institution to
clear the salary dues or ask to implement any service condition approved
by Central as well as State Government ?
No. Because such demand is legal. However, such demand should not create a
ground mentioned under R. 123, as then school will get a valid legal ground to act
against teacher.
Can any school terminate any employee if he / she complaint against the
institution to DoE regarding grievances and harassment ?
No. Because such action is legal. However, such demand should not create a ground
mentioned under R. 123, as then school will get a valid legal ground to act against
teacher.
What kind of legal relief or remedy is available to a person if he is
removed without prior approval of Director, DoE ?
Approach Director, DoE who is authorized to quash illegal action taken by the school
management.
