Dear Sir,
With reference to the above, the WBSEDCL is pleased to accept your tender &
place an order with you for execution of the work of Internal electrical wiring for Control
room & Switch yard lighting work for the proposed Fulbari 33/11 Kv sub station under
Cooch Behar RE Project as per offered rate and terms & conditions mentioned hereunder:

The work shall be executed strictly in accordance with the specification &
instruction of the Controlling Officer/Supervising Officer or their authorized

TERMS & CONDITIONS:

Completion Time: The entire work is to be completed within 30 (Thirty) days
from the date issuance of formal order. The completion time is the essence of the
contract.

Material: All the materials required for the job have to be supplied by you except WBSEDCL
supplied materials like 05 nos, 9 mt long steel tubular pole, 02 sets 30v,75AH lead acid plate storage
battery with 02 sets fioat cum boost charger (30v,16A,auto/Manual) will be provided by the company
(from Cooch Behar Division store) on the basis of your requisition

Guarantee: 10% value of order will be kept deducted to constitute guarantee for

Risk & Insurance: WBSEDCL shall no way be held responsible or liable for any

accident, mishap of

any worker during the execution of work, any loss or damage caused to any

Nodal Officer: The Manager (HR&A), RE Head Quarter, WBSEDCL, Bidyut Bhawan, Kol-91.
is the Nodal officer of the work. You shall have to intimate the Nodal Officer about the date of
payment to several classes of labour employed by you and payment is to be done in presence of
the departmental officials at work site on scheduled dates. You shall have to arrange for issuance
of employment card in such form as may be prescribed by the Controlling officer/Nodal Officer
i.r.o several classes of labour employed by you from time to time. You shall have to follow the
labour laws & rules.

Supervising Officer: The DE(E)/AE(E), Cooch Behar RE Project will be the
supervising officer of the
work.

Labour License, EPF & MP Act etc.

a. The Principal employers certificate will be issued by the Company for the
purpose of obtaining Labour License from the concerned Registering
Officer under Contract Labour (Regulation and Abolition) Act, 1970.
Payment of compensation under Workmens Act, 1923 and rules made there
under by a contactor being the immediate employer who deploys worker for
performance of job under contractual obligation with WBSEDCL, is statutory
obligation.

b. You shall be responsible for compliance of all statutory obligations under
the Contract Labour (R&A) Act, 1970, Minimum Wages Act, 1948.
Payment of Wages Act, 1936, Payment of Bonus Act, 1965 and also be
responsible for payment of contributions (both employers & employees)
under the employees state Insurance Act, 1948(wherein Applicable) and
employees Provident Fund & Miscellaneous Provisions Act, 1952 in
respect of your employees.

c.

The contractor will be solely responsible for any accident that may occur
during the progress of the work and also for injury to person during
execution of the work.

In the event of any such accident, the Contractor will be responsible and
must pay proper
compensation for the same as per Workmens &
Compensation Act, 1923 (Wherein the Employees State Insurance Act,
1948 is not applicable.).
d. No Labour of minor age shall be employed in the work.
e. You shall have to pay statutory minimum wages to the unskilled workers
employed by you in terms of the rule 75 (a) of West Bengal Contract
Labour (R & A) Rules, 1972. You shall have to follow the Notification
issued by the Appropriate Government from time to time in this reg

You shall have to submit a programme of work duly supported by Bar Chart

before starting of
execution for approval of the controlling officer.

The contractor shall be responsible for true and proper setting out the work and
for the correctness of
position, level, dimension or alignment of any part of the work. The contractor
on being asked to do any
rectification shall have to rectify the effects at his own cost.

Payment: First & Final Bill will be allowed after full completion & satisfaction of the
Controlling / Supervising Officer. Payment will be made from the Addl. General
Manager (F&A), REHQ, WBSEDCL after endorsement of necessary certificate from
the controlling officer.

Liquidated damage: If the contractor fails to complete the work within the time
prescribed herein, the contractor shall pay to the WBSEDCL a sum amounting to
% (half percent) of the value of work as liquidated damage for such default for
every week or part there of which shall elapse between the time prescribed or
extended time as the case may be and the date of completion of work subject to a
maximum of 10% of the total contract price. The WBSEDCL may without prejudice
to any all other method of recovery deducting the amount of such damages shall
not relieve the contractor from his obligation to complete the work or from any
other of his obligations and liabilities under this contract.

ESI & PF Code: you are to furnish the documents towards ESI (for works under
coverage area of ESI) and PF code compliance to the controlling officer.

SERVICE Tax: Service tax has not been included in the contract amount. The
service tax will be as per prevailing Act. You shall keep WBSEDCL indemnified in
case any action is taken against WBSEDCL by the competent authority on account
of contravention of any of the provisions of service tax by you. You may be
required to submit documents towards compliance of service Tax Act as per
statute.

In terms of clause no-14 of the notice of tender CESS @ 1% on total quoted

value to be deducted at the time of payment.
