APPLICATION: Reopening
ORDER:
The respondent filed an untimely motion to reopen on July 7, 2016, seeking an opportunity to
have his removability reconsidered in light of the United States Court of Appeals for the Ninth
Circuit's decision in US. v. Flores-Cordero, 723 F.3d 1085 (9th Cir. 2013). The Department of
Homeland Security ("DHS") has filed an affirmative non-opposition to the respondent's motion.
Given the filings before us, the motion will be granted.
FURTHER ORDER: The record is remanded to the Immigration Court for further
proceedings consistent with this opinion.
