TITLE, DECLARATION OF POLICY, OBJECTIVES AND
SCOPE OF APPLICATION
Section 1. TITLE. -This Ordinance shall be known as the "Tourism Code oflloilo City".

interest and importance, the City of Iloilo hereby declares sustainable tourism as an essential
means to spur investment, employment and growth towards sustainable development and to
inculcate an enhanced sense of heritage, culture and pride for all the Ilonggos.

Destinations - are sites of greater historic, cultural or economic significance, thus, worth
to be visited by tourists and guests such as; Fort San Pedro, Plaza Libertad, Museo de
Tloilo, Plaza La Paz, Science Centrum, Iloilo National High School, Nelly Garden,
Sanson-Montinola Ancestral-Antillean House, Magdalena Jalandoni Museum, Jaro
Cathedral and Plaza Lizares Mansion-Angelicum School, Central Philippine University,
Casa Mariquit, Graciano Lopez-Jaena Shrine, Molo Plaza and Church, Rosendo Meii;a

y. Potential Tourist Properties - these refer to sites and attractions not yet developed
including but not limited to, lakes, waterfalls, volcanic hot springs, caves and rainforests.
z. Primary Tourism Enterprises - refers to travel and tour services; land, sea and air
transport seivices exclusively for tourist use; accommodation establishments;
conventions and exhibitions organizers, tourism estate management services; and such
other enterprises as may be identified by the Department of Tourism (DOT) Secretary,
after due consultation with concerned sectors.
aa. PTA - Philippine Tourism Authority
bb. Running Tour - is a kind of guiding where tourist are inside a moving van, coaster or
bus while tour guides are pointing to sites of historic, cultural or economic significance
without disrupting the traffic flow.
cc. Sites - shall include parks and plazas
dd. Standard Tour - is an organized tour with no exact theme rather highlight general
infonnation with the purpose of leveling up awareness of the general public.
ee. Sustainable Tourism Development - means tourism development that leads to
management of all resources in such a way that economic, social, and aesthetic needs can
be fulfilled, while maintaining cultural integrity, essential ecological processes, biological
diversity and life support systems.
ff. Tour - is a tourist/excursionist or group of tourists/excursionists visiting a specific
area/site with a specific purpose/s, governed by an itinerary or program with a time
frame. Also refers to sightseeing, educational tours, conventions, seminars, athletic meet
and other activities related to the movement of tourists/excursionists within a given area.
gg. Tourism - a major city activity in which private sector investment, effort and initiative
are encouraged, fostered and supported, and through which socio-economic development
may be accelerated and the appreciation of the city's natural beauty, history and culture
appreciated with greater pride and commitment.
hh. Tourist - is any person, whether local or foreign, travelling to any specific place for the
purpose of business, leisure and pleasure trip staying 24 hours or more in a given area.

kk. Tourism Infrastructures - have three major components, namely: physical, human
resource and legal regulatory.
11. Tourism-Related Activities - shall include act1v1t1es such as sightseeing, educational
tours, conventions, seminars and athletic meets provided, however, that the contracting of
ordinary day to day passengers of the airport or seaport or along the route for a particular
public utility service shall not be considered as tourist related.
mm. Tourism-related transport - for the purpose of this ordinance shall refer to the
Department of Tourism accredited transport, bearing rainbow plates or a regular public
utility transport so contracted for tour-related activities.
nn. Tourism Resources - refer to natural, cultural, human, or capital resources that either are
being used or can be utilized to attract or serve tourists.
oo. Tourist Transport Service - may mean car, van, coaster, or bus whose specific purpose
under the special permit shall be to transfer tourists/excursionists from one place to
another and governed by an itinerary.
pp. Tour Operator - shall refer to any person or entity which extends to individuals or
groups related to toriusm services, such as but not limited to those mentioned in
paragraphs (f), (i), G), (k), (m), (n), (q), (r), of Article l of Regulation Ordinance No,
2012-307, whether or not for a fee, commission, or any form of compensation.

ILOILO CITY TOURISM COUNCIL
Section L DECLARATION OF PURPOSE. - Pursuant to Sec.17 of the Local
Government Code of 1991 and Republic Act 9593, the existing Iloilo City Tourism Council
created through E.0. 05, Series of2013, is hereby institutionalized.

The existing ICTC with its officers and members is hereby recognized and shall continue
to serve subject to Section 5 of this article.
Section 3. NATURE. - The ICTC, jointly with the City Tourism and Development
Office (CTDO), is tasked with the implementation of the provisions of this article.
Section 4. PURPOSES. - The following are the purposes for which the ICTC is created:
a. To meet the demand for professional services in the field of employment generation and
investment, domestic tourism promotion and product competitiveness;
b. To enable the different groups in the government and the private sector who are involved
in the travel industry to collaborate, to fuse their strength in the promotion of the area as a
destination;
c. To encourage local action and leadership in planning, coordinating, financing and
standards of the industry;

ILOILO CITY CULTURAL IIERITAGE CONSERVATION COUNCIL

REGULATION ORDINANCE NO. 00-054
An Ordinance Declaring Certain Building Structures Or Sites In Doilo City As Local
Heritage Or Legacy Buildings, Structures Or Sites Prescribing Its Use And Conservation,
And Creating The lloilo City Cultural Heritage Conservation Council, And For Other
Purposes.
WHEREAS, the old buildings, structures or sites in lloilo City always speak of the
culture and history not only of the Ilonggos, but of the Filipinos in general;
WHEREAS, while these buildings are integral parts of our national history in general and
our regional history in particular, it also provides evidence of the craftsmanship and industry of
the llonggo artisans and workers;
WHEREAS, such cultural heritage or legacy buildings are now presently in danger of
disappearing because of new and modern constructions and infrastructures in its stead;
WHEREAS, if not conserved, these historical or heritage buildings will only be literally a
''thing of the past" in the City oflloilo;
WHEREAS, under the Local Government Code, the Sangguniang Panlungsod can
prescribe reasonable limits and restraint upon the use of properties within the jurisdiction of the
City, there is therefore an urgent need for the passage of this ordinance.
NOW, THEREFORE, be it ordained by the Sangguinang Panlungsod, that:
Section 1. - Title. This ordinance shall be known as the Local Cultural Heritage
Conservation Ordinance oflloilo City.
Section 2. -Meaning of Terms. For purposes of this ordinance, the following shall mean:
2.a. Building and structures should be taken as similar terms and refer to vertical
construction either for human habitation or for residential or commercial purposes.
2.b. Fa\:ade is used to refer to that front part of the building usually with a veranda or
balcony, or that which depicts the overall architectural design of such buildings.
2.c Heritage historical, landmark or legacy building shall have similar meaning and refer
o buildings in existence for SO years or more.

2.d. Council refers to the Tloilo City Cultural Heritage Conservation Council.
2.e. Conservation includes all efforts towards the perpetuation or preservation of the
whole or part of the building and includes rehabilitation or construction of a new one in its stead
provided that the fa\:ade showing its being a cultural heritage, landmark, historical or legacy
building is preserved and restored.
2.f. Sites shall include parks and plazas and other places of historical value as determined
by the Council.

a. Chairperson who shall be an official of the City ofiloilo, or non-official who will serve
on a volunteer basis.
b. Vice Chairperson who represents the associations of architects in the City ofiloilo, and
c. Nine (9) other members preferably from the arts and culture community.
Section 5. - It shall be the responsibility of the ICCHCC to:
a. Identify and inventory these cultural heritage or legacy buildings as above defined and
to keep a register for such purpose.
b. Promulgate rules and regulations within 30 days from its organization to carry into
effect the purposes herein set forth.

Section 6. PROHIBITION. -

6 (a) Upon promulgation of the rules and regulation of the Council above mentioned, the
owner, administrator, lessee or any person who is in charge of such heritage or legacy buildings
or structure duly identified by the council referred to in the preceding paragraph, prohibited from
undertaking any repair, rehabilitation. or construction of any kind therein. unless with the
favorable recommendation of the Iloilo City Cultural Heritage Conservation Council, which
recommendation shall be appended to the application for building permit to be issued by the
building official or the city engineer. Provided, however, that should the rehabilitation or repair
be urgent in the interest of the safety of persons, such owner, administrator, lessee or personnel
in charge, in coordination with said Council, shall make sure that the facade showing the
architectural design of the building or structure be retained, restored, copied or preserved.
Section 6 (b). The public plazas above enumerated shall not be used for any historical,
cultural, or fiesta celebration or the like where structures whether permanent or temporary are
built in the grassy or planted portions or enclosures are built in the area. The outer rim or
perimeter of the said plazas or its outer promenade and the streets or roads adjacent to it
including the basketball court or mini gym may be temporarily enclosed and used for purposes of
such activities which in no event shall exceed one (1) week.
Section 6 (c). The restoration. revival, and revitalization of old Central Business District,
located at the whole street of J.M. Basa, Mapa, Aldeguer, Guanco, and Iman Streets, shall be
initiated by the Council with the full support of the City Government and other non-government
or civic institutions and shall be designated officially as lloilo City Heritage Zone. Its purpose is
to revive and revitalize the thriving businesses of the past. The area shall likewise be used for
tourism purposes.
Section 6 (d). All businesses located within the heritage zone shall be entitled to the following
incentives:
For every ten (10) years of existence in the area, one (1) year of exemption from business
taxes but not exceeding three years.

For those putting up new business with a capitalization of at least One Million Pesos 25% of exemption on business taxes for every One Million for one year;

Section 9. Violation of any provision of this ordinance shall carry with it a penalty of not
less than two (2) months imprisonment or a fine of not less than P2,000.00 but not exceeding
P5,000.00 or both such fine and imprisonment at the discretion of the Court.
Section 10. This ordinance shall take effect upon approval.

ARTICLEV
CRITERIA IN THE DECLARA TJON OF HERITAGE SITES AND BUILDINGS
Section 1. Without prejudice to such other criteria that it may promulgate pursuant to
Section 5(b) of Article lV hereof,_the ICCHCC may declare or designate a property as having
cultural heritage value, based on but not limited to, the following circumstances:
a. The property is deemed to be of cultural heritage value if it possesses cultural, historical,
architectural, archaeological, aesthetic, scientific or educational worth.
b.The property/structure is within the Downtown Central Business district oflloilo City.
c. The property/structure is not within the Downtown Central Business District of Iloilo City and
has been in existence for 50 years or more.
ARTICLE VI
INCENTIVES ON HERITAGE SITES AND BUILDINGS AND
TOURISM RELATED ESTABLISHMENTS
Section 1. HERITAGE ZONE. - Preservation, reconstruction and restoration of legacy
or heritage buildings within or outside the heritage zone-The owner may be granted a fifty
percent (50%) tax incentive on annual basic real property tax on the houses and buildings
certified by or to be certified by the Iloilo City Cultural Heritage Conservation Council as
Heritage Site, in accordance with Regulation Ordinance No. 2010-296.
Section 2. INVESTMENT PRIORITY AREAS. - Tourism-oriented industries are
among the investment priority areas as provided for under Sec. 9 of Regulation Ordinance No.
2009-256.
Section 3 PERIOD OF A VAILMENT. - A registered enterprise shall enjoy the fiscal
incentives provided herein for a fixed period corresponding to the actual amount of investment
put up by the investor/enterprises under the following brackets:

GENERAL REQUIREMENTS FOR THE AV AILMENT

ARTICLE VIII
SPECIAL PERMITS FOR LEGITIMATE TOURISM ACTIVITIES
Section I The City Mayor shall be auth<)rized to issue special permits for legitimate
tourism-related activities, subject to the guidelines provided under this ordinance, and after
paying a fee of two hundred pesos (P200.00) per transport until to be used_
Section 2. Guidelines to be followed in securing a special permit to enter the (~ity beyond
the li1nitations set forth by the Perimeter Boundary ordinance. for tour related acti\'ities.

IV hereof or if during occasions.
c) The TMTRO recommends to the City .Mayor the approval and issuance of special
permit after payment of corresponding fee.
2. For conventions, seminars and educational trips a) Convenor/organizer/school submits letter request to the City Mayor, copy furnished
the Chief T.MTRO with the following information:
1. Name of convention/seminar. School of origin (for educational tour)
2. Name of requesting tour operator/primary tourism/tourism enterprise

5. Itinerary and route
6. Type and number of tour related transport vehicles to be used

ARTICLE IX
REGISTRATION, LICENSING AND ACCREDITATION OF
TOURISM-RELATED ESTABLISHMENTS
Section 1. REGISTRATION, LICENSING AND ACCREDITATION OF
TOURISM ORIENTED ESTABLISHMENTS. - No person, natural or juridical, shall keep,
manage, or operate any building, edifice or premises, or completely independent part thereof, for
the purpose of engaging in the tourism oriented business without having first secured from a
certificate of registration of the establishment, and valid license from the BPLO to operate the
same.
The accreditation of primary tourism oriented establishments is mandatory while that of
secondary tourism oriented establishments, voluntary, as provided for in Section 39 ofR.A 9593.
Section 2. Owners and/or operators of hotels operating in the city of Iloilo shall pay the

ARTICLE XI
CLOSURE OF TOURISM-ORIENTED OR RELATED ESTABLISHMENTS,
IMPOSITION OF FINE, FORFEITURE OF BOND, SUSPENSION, CANCELLATION
OF AND/OR NONRENEW AL OF LICENSE
Section 1. Grounds For The Closure Of Tourism Establishmen~ Imposition Of
Fine, Forfeiture Of Bond, Suspension, Cancdlation of and/or Non-Renewal License

(a) Making any false declaration or statement or making use of any such declaration
or statement or any document containing the same of committing fraud or any at
of misrepresentation for the purpose of obtaining the issuance, grant or renewal of any
certificate of registration/accreditation/re-accreditation or license;
(b) Failure to comply with or contravene any of the conditions set forth in license;
(c) Failure to meet the standards and requirements for the operation of
tourism establishments, as prescribed in this Ordinance;
(d) Serious physical injury or lost of life of any guest due to the fault or negligence of
its official or employee (for resort/hotel/tourist inn/apartel/and other tourismrelated establishments);
(e) Allowing or permitting the tourism establishment, including any of its facilities, to
be used for illegal, immoral, illicit activities, such as: gambling, prostitution, etc.
(for resort/hotel/tourist inn/apartel/or other tourism-related establishment); Managers
and/or operators shall exerts all possible efforts not to permit a person whom they know
to be drunk and/or have reason to believe to be either a prostitute, a pedophile or a bad
character to occupy any room or to frequent the premises. To accomplish this end, they
shall immediately report the nearest police station the presence in the premises of any
such person.
(f) Violation of any of the conditions of the LTFRB franchise (for tourist
transport operation);
(g) Tolerance of gross misconduct, discourtesy, dishonesty, or misrepresentation
and/or fraudulent solicitation of business committed by any of the officers or
employees against their clients to the detriment of the tourism industry;
(h) Willful violation of agreements and/or contracts entered into by the
tourism establishment and its clients;
(i) Failure to pay fine, as well as fees, dues and contribution imposed under existing rules;
G) Non-settlement of account and/or non-remittance of collections due to carrier of their coagencies, or any agency of the government or any individual within the

ARTICLE XII
TOURISM TRAINING INSTITUTION
Section I. COORDINATION WITH BOTII GOVERNMENT AND PRNATE
TOURISM INSTITUTIONS. - The CTDO should coordinate with both government and
private tourism entities to institutionalize tourism training programs, formal and informal, with
corresponding certification upon completion.
Section 2. LINKAGES. - the CTDO and the ICTC shall strengthen their networking and
linkages to access financial and technical resources including organizing a pool of trainers to
provide other skills trainings needed by the industry.
Section J. TRAINING PROGRAMS AND LABORATORY. - Local communities
shall have priority access to all tourism training programs.
ARTICLE XIII
MISCELLANEOUS PROVISIONS
Section 1. GRANT OF TAX INCEN TIVES.- The City Government, through
ordinances passed by the City Council, may grant additional tax incentives to tourism
establishments that duly comply with the provisions of this Ordinance.
Section 2. SEPARABILITY CLAUSE - The provisions of this Ordinance are
separable, and in the event that any or more of such provisions are declared invalid, the validity
of all the other provisions shall not be affected thereby.
Section 3. REPEALING CLAUSE - Any Ordinance, Executive Order, Local
Issuance and Rules and Regulations, or parts thereo( which are inconsistent with this Ordinance
are hereby repealed and/or modified accordingly.
Section 4. EFFECTIVITY - This Ordinance shall take effect in accordance with
the provisions of the Local Government Code of 1991.
