AN ORDINANCE PENALIZING ELDERLY ABUSE AS DEFINED, PROVIDING PROTECTIVE
MEASURES THEREFOR, AND FOR OTHER PURPOSES

Whereas, cases of abuse do not involve only women and children but senior citizens
as well;
Whereas, elder abuse which happens within the family, in settings such as hospitals
or nursing homes or in the community, has not been reported as a serious problem in our
society for the simple reason that such cases are severely underreported because some
older persons, particularly women, fail to report it because of shame, privacy concerns, or
as a result of prior unsatisfactory experiences;
Whereas, the identification and awareness of elderly abuse by the public and even
professionals is difficult because older persons are not linked to many social networks such
as schools, jobs and may become isolated in their homes, which can increase the risk of
abuse;
Whereas, it is imperative to have a system for reporting elder abuse and establish a
sustained protection program against the same;
NOW, THEREFORE:
BE IT ORDAINED by the City Council (Sangguniang Panlungsod) of the City of
Cagayan de Oro in session assembled that:
SECTION 1 TITLE. this ordinance shall be known and cited as the Anti-Elderly
Abuse Ordinance of Cagayan de Oro City.
SECTION 2 DECLARATION AND OBJECTIVES. The City hereby finds and declares that, in
keeping with the Filipino tradition of the inherent dignity of the individual in our democratic
society, the older people of the City are entitled to equal opportunity to the full and free
enjoyment of the following objectives:

SECTION 3 DEFINITION OF TERMS. whenever used in this ordinance, the following

terms shall refer to meaning construed herein:
(A ) El d erl y or se ni or m eans an y p erso n w ho is at l east 60 year s o ld.
(B ) El d er ab use m eans the ve rba l and /or phys i cal w i l lf u l d oi ng som e thi ng or
fa i li n g to do some thi ng that res ul t i n harm to an el d erl y per son o r p uts a
hel p l ess ol d er p ers on at ri s k of ha rm . Th i s i n cl u des (a) infliction of injury, unreasonable confinement, intimidation, or cruel punishment
with resulting physical harm, pain, or mental anguish (Physical, sexual and
emotional abuse)
(b) deprivation by a person, including a caregiver, of goods or services that are
necessary to avoid physical harm, mental anguish, or mental illness
(c) Neglecting or deserting an older person you are responsible for
(d) Taking or misusing an elderly person's money or property
SECTION 4 P R O H I B I T I O N . any of the following acts when committed willfully and
unjustifiably shall constitute elder abuse and shall be punishable under this ordinance, to
wit:
(a)

that preserves the confidentiality of records in order to protect the

rights of older individuals;
that provides for the cooperation of law enforcement officials, courts of
competent jurisdiction, and national agencies providing human
services with respect to special problems of elder abuse, neglect, and
exploitation;
that enables an older individual to participate in decisions regarding
the welfare of the older individual, and makes the least restrictive
alternatives available to an older individual who is abused, neglected,
or exploited; and
that includes a city clearinghouse for dissemination of information to
the general public with respect to

making a referral described hereof, shall remain confidential except

public protective service agency, licensing or certification agency,

with respect to confidentiality of the information by entering into memoranda
of understanding that narrowly limit disclosure of information, consistent with
the requirement described above.

SECTION 8 BUDGETARY ALLOCATIONS. there shall be allocated annually the sum of
p500,000.00 in the general fund budget starting cy 2010 to defray expenses for personal
services, maintenance and operating expenses, capital outlay and non-office outlay of the
board.
SECTION 9 PENALTY CLAUSE. - any person who violates any of the provisions of this
ordinance shall suffer the following penalties:

SECTION 9. SEPARABILITY CLAUSE - if for any reason, any section or provision of this
ordinance shall be held unconstitutional or invalid by any court of competent jurisdiction,
such judgment shall not affect or impair the other provisions or parts thereof which shall
continue to be in force and effect.
SECTION 10. REPEALING CLAUSE. - any provi s io n of o ther ordi n anc es , ru l es a nd
regu l ati on s i n consi s tent here w i th are h ereb y rep eal ed or m od ifi ed acco rdi ng l y.
SECTION 11. EFFECTIVITY.- this ordinance shall take effect after ten (10) days
following its publication in a local newspaper of general circulation.
