Ordinance No. 2012-398 Series of 2012, "the Revised Zoning Ordinance of lloilo City" was
forwarded to the Office qf the City Mayor on April 4, 2014, but the same Regulation Ordinance
was not returned to this Office up to the present time, approved or vetoed; and pursuant to
Section 54 (b) of R.A. 7160 (The Local Government Code of 1991), said Ordinance is deemed
APPROVED as if the Local .Chief Executive had signed it.

AN ORDINANCE AMENDING CITY ORDINANCE NO. 2012-398 SERIES
OF 2012, "THE 2012 REVISED ZONING ORDINANCE OF ILOILO
CITY"
Sponsored by Councilor Lyndon V. Acap and seconded by Councilor Jose Efrain
G. Trefias III and Carlos P. Guarin
WHEREAS, Republic Act 7160 (Local Government Code of 1991) sec 458 (a)(2)(IV)
dated 10 October 1991 authorizes the City through the Sangguniang Panlungsod to adopt Zoning
Ordinance subject to the provisions of existing laws;
WHEREAS, the implementation of the Iloilo City Comprehensive Land Use Plan
(CLUP) would require the enactment of regulatory measures to translate its planning goals and
objectives into reality and a Zoning Ordinance is one such regulatory measure which is an
important tool for the implementation of the Comprehensive Land Use Plan;
NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of the City oflloilo,
that:
Section 1. Title. This Ordinance shall be known as An Ordinance Amending City
Ordinance No. 2012-398 series of 2012 "The 2012 Revised Zoning Ordinance of Iloilo City."
Section 2. The following are the proposed amendment in the 2012 Revised Zoning
Ordinance to wit:
Section 43 (5) All other Zones unless otherwise specified by existing national laws or
regulations, building heights may be regulated by the Sangguniang Panlungsod upon the
recommendation of the City Zoning Board of Adjustments and Appeals for zones other than
residential, considering environmental and other factors or cases
Section 60. Innovative Techniques or Designs - When it is impractical to apply the
requirements of these Zoning Regulations to certain developments, the proponent may apply for
a permit with the City Zoning Board of Adjustment and Appeals (CZBAA) subject to the
approval of the Sangguniang Panlungsod, on grounds of Innovative techniques, provided, that
the following conditions are complied with:
Section 60 (2) The final development plans that was recommended by the ICZBAA
and approved by the Sangguniang Panlungsod must be submitted to the Zoning Administrator
for appropriate action
Section 61. Special Use Permit - A special use permit shall be required for each of the
following uses, subject tq the review of the Iloilo City Zoning Board of Adjustments and
Appeals and the approval by the Sangguniang Panlungsod.
Section 69. Exceptions, Variances, Deviations. Exceptions, variances or deviations from
the provisions of this Ordinance may only be allowed upon review and recommendation of the
lloilo City Zoning Board of Adjustments and Appeals (ICZBAA) to the Sangguniang
Panlungsod for authmj'ization thru a resolution duly approved by the majority of its
members and only when the following terms and conditions are exisiting:

recommendation of tht application for Locational Clearance or Zoning Compliance
Certification on the follo:wing nature:

Decisions of the City Zoning Board of Adjustment and Appeals (CZBAA) shall be
appealable to the Housing and Land Use Regulatory Board (HLURB) within the reglementary
period prescribed by the latter Board. The CZBAA shall serve copies to both parties of the
decision within ten (10) days from its approval.
IT SHOULD BE DELETED.
Section 3. Effectivity. This Ordinance shall take effect upon its approval.,
