REGULATION ORDINANCE NO. 2014-404
AN ORDINANCE BANNING BIKINI OPEt,1 AND OTHER INDECENT SHOWSIACTIVITIES IN
THE CITY OF ILOILO AND PROVIDING PENALTIES THEREOF

WHEREAS, per Section 11 of the 1987 Constitution of the Republic of the Philippines, it is hereby
declared that the state shall value the dignity of women and children and guarantees full respect for human righ1S;
WHEREAS, the United Nation's Convention in the Elimination of Discrimination Against Women
(CEDAW) advocates that women have the right to the prevention of, and protection from all forms of violence and
oercion against their person, their freedom, their sexuality and their individuality;
WHERES, per Section 458 (vii) of R.A. 7160, otherwise known as the Local Government Code of 1991,
the Sangguniang Panlungsod, as the legislative body of the City shall enact an ordinance in order to protect the
social and moral well being of the community;

WHEREAS, the ordinance is in consonance with the Executive Order No. 29, Series of 2014 issued by
the City Mayor and in line with the provisions of RA 9262 otherwise known as the "Anti Violence Against Women
and their Children Act of 2004";

WHEREAS, Section 9 of the Gender and Development Code, indecent shows, as used in this Code
includes nude and other provocative shows, public or private, which exhibit women and children as sex objects.
As such, it is a violation of human rights to influence _or force men, women and children to dance naked in public
or private places for commercial or entertainment purposes. Persons or agencies engaging in such shows, public
or private, shall be penalized in accordance with law.
WHEREAS, Section 10 of the Gender and Development Code, exposure of women's body in any beauty
contest that tend to commodity, humiliate and abuse women's bodies shall be considered as a form of violence
against women. The city shall create a body to regulate and monitor beauty contests and similar activities.
NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of lloilo, in session duly
assembled, that
Section 1. TITLE. - This ordinance shall be known as "AN ORDINANCE BANNING BIKINI OPEN AND
OTHER INDECENT SHOWSIACTIVITES IN THE CITY OF ILOILO AND PROVIDING PENALTIES THEREOF;
Section 2. PURPOSE. - To set public moral standards to promote quality of life and to protect our
women from abuse, harassment and exploitation.
Section 3. DEFINITION OF TERMS. - For the purpose of this ordinance, the following terms are
hereby defined as follows:
a) Bikini - a type of women's swimwear characterized by two separate parts - one covering the breasts,
the other the groin (and optionally the buttocks), leaving an uncovered area between the two garments, trunks for
men and other creative swimwear
b) Event Organizer - is the person who organizes and schedules an event, making sure it runs smoothly,
and if there are any problems, resolved them. They are responsible for the event from start to finish.
c) Indecent Show - any public display, exhibition or show, such as dancing in nude designed to deprave
or corrupt those whose minds are open to such immoral influences, be they cultured or not, or are offensive to
public morals and are naturally calculated to excite impure imagination.
d) Lascivious Conduct - an act done by a person with a wicked, lustful, unchaste. licentious or sensual
intent.
e) Patronal Fiesta - a yearly celebration held in countries influenced by Spanish culture usually dedicated
to a saint or virgin, who is the patron of whichever city that holds the fiesta.

f) Public Moral Standard - moral and ethical standards enforced in a society, by law or police work or
social pressure, and applied to public life, to the content of the media and to conduct in public places.
g) Sex Object - is a person regarded exclusively as means to the observer's gratification or solely the
focus of sexual interest.

h) Sexual Exploitation - taking the advantage of sexuality and attractiveness of a person to make a
personal gain or profit It is the abuse of a position of vulnerability, differential power, or trust for sexual plfll05eS.

i) Swimsuit Competition -a competition in which the participants, usually women wear swimsuits, are
judged on their attractiveness, with a prize and often a tiUe, awarded to the winner.
j. Establishment - venue where the said event will be conducted.

Section 4 - PROHIBITED ACTS. a) It shall be unlawful for any individual or event organizer/s to engage in the conduct of
sponsoring/hosting bikini open and other indecent shows/activities in the City of lloilo.
b) It shall be unlawful for any business establishment operating in the City of lloilo to allow, tolerate and
consent in the conduct the hosting of bikini open and other indecent shows/activities within the premises and
outside of their establishment.
c) It shall be unlawful for bikini open and other indecent shows/activities in the guise of beauty contest
which tend to commodity, abuse, humiliate and treat women as sex objects be held in school, communities and
barangays in the City of lloilo.
Section 5. EXCLUSIONARY CLAUSE. - When the City Government will conduct its festivals and special
celebration sponsored by the City like Dinagyang Festival/Paraw Regatta and other school related activities
provided that they secure a special permit from the City Mayor.
Section 6. PENALTIES. a) Any person found guilty violating this ordinance shall be penalized with a fine of five thousand pesos
(P5,000.00) and one (1) year imprisonment upon the discretion of the court.
b) Any establishment found guilty of viotating this ordinance shall be penalized with a fine of five
thousand pesos (P5,000.00) and revocation of business permit to operate.
In case the offender is a corporation, partnership, association or similar entity, the President or Manager
shall be held liable for the offense.
Section 7. - IMPLEMENTING CLAUSE. - The City Mayor through the Task Force on Moral and Vafues
Formation is hereby mandated in coordination with the Law Enforcement Agencies for the proper implementation
of this ordinance.
Section 8. - SEPARABILITY CLAUSE. - If any provision of this ordinance shall be declared invalid or
unconstitutional by appropriate court, other provisions hereof which are not affected shall continue to be in full
force and effect.
Section 9. REPEALING CLAUSE. - Any and all existing ordinances of the City of lloilo which are
contrary or inconsistent herewith are hereby amended or modified accordingly.
Section 10. EFFECTIVITY CLAUSE. - This ordinance shall take effect upon approval.
