REGULATION ORDINANCE NO. 2014-516


ESTABLISHING THE HIGHLY URBANIZED CITY
AN ORDINANCE
AGRICULTURAL AND FISHERY COUNCIL OF ILOILO CITY (HUCAFCIC) AND OTHER RELATED PROVISIONS
Sponsored by Councilor Jose Efrain G. Trefias 111, co-sponsored by Councilors
Joshua C. Alim, Eduardo L. Peiiaredondo, Liezl Joy Zulueta-Salazar and Jason R.
Gonzales, and duly seconded by Councilor Lyndon V. Acap

WHEREAS, DA's Executive Order 116 series of 1987 creates the National Agricultural
Fishery Council or NAFC which replaces the National Food and Agricultural Council (NFAC) via an
EO No. 183 series of 1969. NAFC's functions now including "included supervising and coordinating
food production programs to ensure and coordinate private sector participation in the development of
the agriculture and fisheries sectors "as the nationwide mother agricultural and fisheries organization
created by the Department of Agriculture;
WHEREAS, the Department of Agriculture Order No. 06 mandates the implementing Rules
and Regulations (IRR) for the Agriculture and Fisheries Modernization Act of 1997 (RA 8435) tasked
NAFC to "assist the DA in monitoring and coordinating the agriculture and fishery modernization
process and serve as the integrative and consultative structure for the inter-agency and intersectoral
coordination".

WHEREAS, in the AFC Manual of Regulations as of July 2003, Chapter 1, Article "Mandate"
provides that in Section 1. "The National Agricultural and Fishery Council (NAFC) is hereby
replicated in the regions, provinces, independent component cities, municipalities and barangays to be

known as Regional Agricultural and Fishery Councils (RAFC's), Provincial Agricultural and Fishery
Councils (PAFC's), Independent Component City Agricultural and Fishery Council (CCAFCs),
Highly Urbanized Cities, for Independent Component Cities, Municipal Agricultural Fishery Councils
(MAFCs) and Barangay Agricultural and Fishery Councils (BAFCs) respectively, pursuant to EO No.
116 Rule 113.l of the Department of Agriculture (DA) Administrative Order AO No. 06 Series of
1998 as affinned by AO No. 34 Series of 2000, and the mandate on the Agricultural and Fisheries
Modernization Act of 1997 (AFMA);
WHEREAS, in compliance to the above provisions of laws, the establishment of the Highly
Urbanized City Agricultural and Fishery Council or HUCAFC in the City of Iloilo as highly-urbanized
city is a must "in order to encourage the peoples participation and empowerment in agriculture and
fishery development through sectoral representation in agricultural policy making bodies so that its
policies, plans and programs are formulated/executed to satisfy the needs of its clientele and likewise
to use bottom-up; self reliant farm systems approach that will emphasize social justice, equity,
productivity and sustainability in the use of agriculture and fishery resources".
NOW, THEREFORE, be it ordained, as it is hereby ordained by the City Council of Iloilo,
that:
Section 1.- Title. This ordinance shall be known as the Highly Urbanized City Agricultural and
Fishery Council oflloilo City or HUCAFC-IC;
Section 2. - Definition of Terms.
terms/acronyms shall be defined as follows:

For the purpose of this ordinance the following

a) HUCAFC - Highly Urbanized City Agricultural and Fishery Council, agricultural and
fishery council operating within any independent city and highly urbanized city.
b) Highly Urbanized City - are those whose voters are prohibited from voting for the
provincial elective officials including those classified as Highly Urbanized Cities
(HUC's)
c) AFC - (Agricultural and Fishery Council) a special body created under Executive
Order No. 116 of the DA to encourage private sector participation in the agriculture and
fishery development through consultative, integrative, coordinative, advocacy/advisory,
monitoring and evaluation.
d) AFMA - Agricultural and Fisheries Modernization Act or RA 8435 series of 1997
which mandates the creation of the NAFC.
e) IRR - defined under the DA Order No. 6 as Implementing Rules and Regulations for
the RA 8435 series of 1997 otherwise known as "Agriculture and Fisheries
Modernization Act of 1997."
f) BAFC - Barangay Agricultural and Fishery Council - this council shall be composed
of Chairpersons of barangay-wide and purok-wide organizations Barangay FARMC
Chairperson and government sector representatives.

g) FARMC - Fisheries and Aquatic Resources Management Councils - institutionalizes


the major role of the fisherfolk and other resources in the planning and formulation of
policies and programs for the management, conservation, protection and sustainable
development of fisheries and aquatic resources.

Section 3. - Composition of the Highly Urbanized City Agricultural and Fishery Council of
Iloilo City or HUCAFC-IC.

HUCAFC of Iloilo City shall be represented by the Chairmen and Coordinators of


BAFC from different Barangays, NGOs (Fanners Association, 4-H Club, P4MP and
RIC), GOs (LGU/OCA/SPiloilo City).
Section 4. - OBJECTIVES OF THE HUCAFC-IC: The objectives and functions of this
Highly Urbanized City Agricultural and Fisheries Council in the City of Iloilo as LGU are:

a) To provide for a consultative and continuing discussions within the agriculture and
fishery sectors of the city;

b) To act as an integrative and coordinating body for agriculture and fisheries


modernization;

c) To serve as advisory, monitoring and evaluating body of the city agriculture and
fisheries sectors;

d) To link the city's LGU and other line agencies to business sectors and civil society; and
e) To help the city as an LGU ensure the success of the programs and activities related to
agriculture and fishery.
Section 5. - FUNDING
The City of Iloilo shall provide for an appropriate fund for the mobilization and operation of
HUCAFC-IC.
Section 6. - SEPARABILITY CLAUSE.

In the event that any provision of this ordinance is declared invalid, the other provisions not
affected thereby shall remain in full force and effect.
Section 7. -REPEALING CLAUSE.
All local laws, rules and regulations which is inconsistent with this ordinance are hereby
repealed or modified accordingly.
Section 8. -EFFECTIVITY CLAUSE.
This ordinance shall take effect fifteen (15) days from publication in a local newspaper of
general circulation.
