WHEREAS, the Sangguniang Panlungsod of Iloilo City passed a Regulation Ordinance
No. 2011-726 prohibiting any form of conveyancing of the awarded lot on the relocation sites of
the Iloilo City Government and providing penalties for violation thereof.

WHEREAS, said Regulation Ordinance No. 2011-726 was passed to prevent unscrupulous
people from selling their awarded lots and again illegally occupy other properties for the purpose
of reenlisting their names as beneficiary for lot awards in other relocation sites;
WHEREAS, said ordinance under Section I paragraph (a) provides as follows;
"Section 1. - Definition of Terms. -

a. Conveyance as the act of transferring property including rights."

WHEREAS, certain circumstances warrant the conveyance of awarded lots to certain
individuals without circumventing the purpose for the passage of the said ordinance;

WHEREAS, certain specific exceptions must be included in the definition of term

"conveyance", so as to allow meritorious and justifiable transfers of ownership and rights over
awarded lots in relocation sites;
IN VIEW THEREOF, let it be ordained by the Sangguniang Panlungsod ofiloilo City in
session assembled that Section 1 paragraph (a) of Regulation Ordinance No. 2011-726 he amended
to read

as follows;

Section I. - Definition of Termsa) Conveyance is defined as the act of transferring property including rights BUT DOES
NOT INCLUDE TRANSFERS OR RIGHTS OVER REAL PROPERTY FROM
PARENT TO CHILD, TRANSFERS BETWEEN SIJlL!NGS, AND TRANSFERS
FROM AUNTS/UNCLES TO NEPHEWINIECES WITH WE 3RD DEGREE OF
CONSANGUINITY. PROVIDED THAT THE FOLLOWING CONDITIONS ARE
COMPLIED WITH:
1. THE TRANSFER IS PURELY GRATUITOUS

2, THE TRANSFEREE IS ALSO QUALIFIED AS BENEFICIARY

FOR THE LOT AWARD;
3. THAT WE TBANSFEROR SHALL NO LONGER BE ELIGIBLE
OR OUALIFIED AS BENEFICIARY IN ANY SUBSEOUENT
RELOCATION SITE WITH mis PROGRAM AND IN ANY
EVENT THAT WE TRANSFEROR IS PRESENTLY IN
POSSESSION OF WE SIMILAR AWARDED LOT IN ANY
RELOCATION SITE. SUCH PROPERTY SHALL BE DEEMED
FORFEITED IN FAVOR OF WE GOVERNMENT"
4. IN ALL SUCH TRANSFERS OF RIGHTS OVER REAL
PROPERTY.
THE
TRANSFEROR
MUST PRESENT
PROOF
COMPETENT
TO
ESTABLISH
BLOOD
RELATIONSHIP SUCH AS. BUT NOT LIMITED TO,
MARRIAGE AND BIRUI CERTIFICATES.
All of the above provisions shall be reported to the Iloilo City Urban Poor Affairs Office
(ICUP AO). Let a copy of this Ordinance be furnished to the Office of the City Mayor. This
ordinance should take effect fifteen (15) days after its publication in a newspaper of general

circulation in the City of Iloilo.
