SUMMARY
A.

Division 1 of this specification identifies the project and provides a general description
of the work covered by the contract documents, the work scheduled to
be done by other Contractors, the specifications used in specifying the
work and other general matters including coordination, attendance,
material alternatives and substitutes, requirements for testing work and
materials and providing plant.

B.

Specifications given in Division 1 shall apply to all other Divisions unless otherwise
stated.

C.

In examining the requirements of any section of the Specifications the Contractor shall
examine all other sections of the Specifications and the other Documents and
Drawings, which affect the work of that section.

D.

Where proprietary names are mentioned in the Specification and on the Drawings,
alternative acceptable names are generally given.
It should be understood that such
names are given only to indicate the type of standard of materials and workmanship
required unless stated otherwise in individual specification sections.
Should the
Contractor wish to use a different name he is entitled to do so on condition that such
alternative is equal in every respect to that specified in accordance with Particular
Specification Section 01630. The Engineers decision as to the acceptability of any
such alternative shall be final.

E.

The Manufacturers and Sub-contractors once approved by the Engineer cannot be


changed without the Engineers approval.

F.

The term Owner where used in the specification shall also be understood to mean the
Employer as used elsewhere within the documents.

SCOPE OF WORK
A.

The scope of work under this Contract comprises of the construction, completion,
commissioning, handover and maintenance of works related to the

Work briefly, consists of the construction of the following, together with associated
facilities, site improvements and landscape development, as indicated in Contract
Documents:
1.

The New College of Arts will occupy two new buildings; one for the
undergraduate men, the graduate students and the administration, and one
for the undergraduate women and faculty. The two buildings will together
provide approximately 53,250gsm with approximately 19,650gsm on the
male side of the campus and approximately 35,550gsm on the female side of
the campus. The design of the building will provide state-of-the-art
educational facilities for the College of Arts. In addition to the program space
specific to the College of Arts, the new college building will contain several
general facilities to be shared by students and faculty of the adjacent
colleges. The common amenities to be shared are a 500 seat auditorium, a
multi purpose hall, the university broadcast television/radio station and a
large common dining facility. The new College of Arts will be composed of
mostly five story academic, faculty office and administrative office buildings.

The College of Education will be one of the college buildings forming the
core of the new University City at Al Shadadiyah and will occupy two new
buildings; one for the undergraduate men, the graduate students and the
administration, and one for the undergraduate women and faculty. The two
buildings will together provide approximately 46,000 gsm with approximately
15,500 gsm on the male side of the campus and approximately 40,500 gsm
on the female side of the campus. The design of the building will provide
state-of-the-art educational facilities for the College of Education. In addition
to the program space specific to the College of Education, the new college
building will contain several general facilities to be shared by students and
faculty of the adjacent colleges. The common amenities to be shared are a
250 seat auditorium, learning resource center and a large common dinning
facility. The new College of Arts will be composed of mostly five story
academic, faculty office and administrative office buildings.

Pedestrian and Vehicular Tunnels between two campuses (under the Oasis).

4.

External Works consisting of:


i. Hard and Soft Landscape Works.
ii. Irrigation System

Responsibility of coordination:
1.

The Contractor shall be responsible for ensuring that all Works, which interface
with the existing installation and Works of adjacent contractors
(appointed separately by the Employer) of Infrastructure and Building
Works (like External Electro-Mechanical Services Works/Utilities,
Utility trenches and adjacent Buildings) are completely coordinated
with regard to shop drawings, survey of the work, materials, equipment,
installations, testing and commissioning.

The Contractor shall note that the coordination shall remain valid for the
interfacing of all contiguous works whether those works are
shown in the drawings or not, or under construction or not.

A complete picture however shall be obtained from a study of all the Tender
Documents taken together.

Site investigation report: The site investigation report is available at the Employers/Engineer
offices for inspection by participant contractors, The Contractor shall be entirely
responsible for his own assessment, interpretation, use and conclusions drawn from the
information, data, tests, analyses and opinions contained in any Site Investigation report
discussed or related to the project conditions. Whenever needed, additional test borings and
other exploratory operations shall be conducted at the Contractors own cost and expense.
he available soil investigation report and is considered for information only and the Employer
accepts no responsibility for the accuracy or the completeness of the information contained
therein.

WORKS NOT COVERED BY SPECIFICATIONS


A.

For any work/s not covered by the following specifications, the general specification,
laws, bye-laws, rules and regulations issued by the various ministries and
statutory authorities having jurisdiction; such as the Ministry of Public Works
(and its various departments like Sanitary Engineering and Roads/Highway
Department), the Ministry of Energy, Electricity and Water, the Ministry of
Communications, Kuwait Municipality, the Kuwait Fire Brigade, etc. shall apply.
It will be the contractors responsibility to ascertain the names of all the
Ministries and authorities having jurisdiction, the details of their applicable
statutes, and the methods to ensure compliance with them in consonance with
other contract conditions.

WORK PERFORMED UNDER OTHER CONTRACTS


A.

The Employer may during the execution of these works employ Other Contractors on a
direct contract basis to execute other works.

B.

The Contractor shall allow for all costs in connection with scheduling and executing his
construction operations in conjunction with Works by Other Contractors.

C.

Items indicated on drawings as NIC (Not in Contract): Are not included in this Contract
and where indicated in Contract Documents, provide "roughing" services to NIC items.

D.

Cooperate fully with separate contractors so that work under those contracts may be
carried out smoothly, without interfering with or delaying work under this contract.

E.

The Contractor will receive the site excavated up to a certain level, (the bulk excavation of
whole basement area done by other Contractor) which is nearer to the basement foundation
level. The Contractor shall conduct the remaining excavation in order to reach the exact
foundation levels either by manual or mechanical means as per approval of the Engineer.

F.

The Employer does not guarantee the levels of excavation (done by other) as shown in the
drawings or expressed in any documents. The Contractor shall receive the excavated surface
area of his workspace as handed over to him by the Employer. However, if he finds any
discrepancy in such excavation levels and encounter any loose or unsuitable surface he shall
inform the Engineer immediately.

WORK SEQUENCE
A.

Construct Work in phases to accommodate Employers occupancy requirements, and


in compliance with the schedule milestones as approved by the Engineer.

B.

During construction, coordinate construction schedule and operations with the Employer,
Engineer, Engineers Representatives and other Contractors present on the Site. The
Contractor shall allow for all costs resulting from phasing of works around these parties.

CONTRACTOR USE OF PREMISES


A.

Use of the Site: Allow for working outside the Limit of Contract lines indicated in the
Contract Drawings to undertake work included in other trades of the
Contract Documents. Except for these specific trade work items the
Contractor shall confine operations to areas within the contract limits
indicated. Do not disturb portions of the site beyond the areas in which the
work is indicated.

Employer Occupancy: Allow for Employer occupancy and use by other


Contractors.
Driveways and Entrances:
a.
Keep driveways and entrances serving the premises together with
circulation in and around the site clear and available to the

General: During the construction period, various Contractors shall jointly have to use
the premises for construction operations, including the use of the site.

OCCUPANCY REQUIREMENTS
A.

Employer, his employees, other Contractors and emergency


vehicles at all times and be responsible for making good all
damage resulting from such use. Do not use these areas
for parking or storage of materials. Schedule deliveries to
minimize space and time requirements for storage of
materials and equipment on site.
The Contractor shall not use the site for any purpose other than carrying out the
works.
The Contractor shall not display or permit advertisements to be displayed on
site without the consent of the Engineers Representative.
Take all reasonable precautions to prevent damage to adjoining property.
The normal working hours of the Engineer and his Representatives
supervisory staff are fixed by the Engineer, in accordance with the
Kuwait Labour Law, as 8 hours per day 6 days per week. The
Engineer will determine the starting and finishing times of the day
shift considering the benefit to the progress of the Work.

Partial Employer Occupancy: The Employer reserves the right to occupy and to place
and install loose furniture and equipment in completed areas of the buildings
prior to Substantial Completion, provided such occupancy does not interfere
with completion of the Work. Such placing of equipment and partial
occupancy shall not constitute acceptance of the total Work.

The Engineer will prepare a Certificate of Substantial Completion for each
specific portion of the Work to be occupied prior to Employer occupancy.

AUTHORITIES APPROVAL
A.

The Contractor shall be responsible for obtaining the relevant authorities approval. A
list is included in Section 01323 : Network Analysis Schedule.

B.

The Contractor shall observe and comply with all statutory obligations, by laws, rules
and regulations prevailing at the Date of Tender and shall allow for all costs incurred.

C.

The Contractor shall inform the Engineer immediately if the statutory obligations
conflict with other requirements of the Contract Documents.

D.

The Contractor shall provide for any Governmental inspections as required and
applicable fees therefore during various phases of works.

E.

During Construction, the Contractor shall submit to the Supervision Consultant, copies
of all Certificates of Approval, Permits of Licenses from the Authorities having
jurisdiction.

F.

The Contractor shall pay any fees, taxes or levies as required by the Authorities for
permits and connections. The Contractor shall include the details and costs as levied
by the Authorities in its monthly statements, for reimbursement by the Employer.

G.

For temporary facilities, utilities and the like, all costs, including any fees for permits
licenses etc. shall be borne by the Contractor.

CONTRACT
A.

The Contract is a stipulated Lump Sum Contract subject to variation orders authorized
by the Employer as per provision of the contract. The Schedule of Rates and Bills of
Quantities Document (III-4) items shall not be subject to remeasurement unless
indicated as provisional or remeasured or subject to variation orders.

SPECIAL CONDITIONS
A.

The plans and specifications form a guide for a complete installation/execution of the
Contract. Any item/s reasonably necessary to complete the Contract shall
therefore be furnished even if such item/s is not specifically noted in the plans or
tender documents.

B.

Any ambiguity, repetition, similarity or confusion shall be clarified by the Engineer in


response to queries raised by the tenderer during the Tender Period.

C.

Should the Contractor not solicit clarifications and/or interpretation before tender date
this shall signify full and correct understanding of the tender documents
by the Contractor. Further interpretation or clarification during the contract
shall be left to the Engineer/Engineers Representative who shall have the right
to insist on the costliest interpretation to which a reading of the contract
documents can lead.

STANDARDS
A.

All references to codes, specifications and standards made in the Contract Documents
shall mean the latest edition, amendment or revision of such reference standard in
effect as of the Date of these Tender Documents..

ABBREVIATIONS AND SYMBOLS


A.

References to any Technical Society, Institution, Association or Government Authority as


made in the specifications are in accordance with internationally recognized
abbreviations of their names.
