Dear Sir/ Madam,

I am sending you this submission to explain the full story about charges that have been brought
against me in the Holland Park and Brisbane Magistrate’s Courts by Queensland Police. They are
listed for trial hearing on 24 October (Holland Park) and 10 November (Brisbane Magistrate’s Court).
They are based on false and misleading reports by my father, Brian Senewiratne and my neighbours,
Heidi and Jeff Miller of 74 Fegen Drive, Moorooka. As such, I am requesting that the charges be
dropped.

The charges are

1. Contravention of a Domestic Violence Order (DVO) based on reports by my father (Holland


Park)
2. Going Armed So As To Cause Fear based on reports by Jeff Miller who falsely claimed to be
my “victim” (Brisbane)
3. Committing a Public Nuisance based on a report by Heidi Miller (wife of Jeff) in which she,
again falsely, claimed to be my victim. (Holland Park)
4. Possession of Dangerous Drugs (Brisbane) due to the police finding a small bowl of mull
(tobacco mixed with cannabis, cashews and sultanas) that I was preparing for my own use
when they came to my house on 22nd September 2015 (my 55th birthday). I have smoked
cannabis for its mental health benefits as well as its physical benefits since I was in my
twenties, and noted that in my case my health has deteriorated when I have stopped, for
various reasons. I do not regard cannabis as more dangerous than alcohol – which is legal
and not regarded as a dangerous drug, while it causes much more morbidity, mortality and
social problems, including violence, than cannabis, which has been ingested by my ancestors
in South Asia for thousands of years and can be smoked safely if mixed in such a mull. The
word “ganja” is derived from “ganga” in Sanskrit meaning river, and it was one of the

earliest human crops, used for building, ropes and fabrics as well as ingested for its health
benefits. It also has a number of specific medical uses, including for depression, glaucoma,
epilepsy and AIDS. I have been active, over the years, in the campaign to have cannabis for
personal use legalized, and do not abuse this herb, which I, and many others, do not regard
as a “dangerous drug”. It is of note that the President of the USA, which has led the global
prohibition of cannabis in its ill-conceived “war on drugs”, has admitted to smoking cannabis
when he was younger and made light of it when asked if he inhaled (“yes, that was the
idea”).

I have been the victim of a criminal conspiracy between my father, Brian Senewiratne and my
neighbour, Jeff Miller, to have me falsely labelled as mentally ill, assaulted, falsely incarcerated and
poisoned, defamed and have my human rights abused in other ways. This has been mainly done by
making false and misleading reports about me to the Princess Alexandra Hospital at which my father
was a consultant physician since we migrated to Australia from Sri Lanka in 1976. False and
damaging reports have also been made by them to the Queensland Police and to the Courts and to
others. Since at least 2010, when he first reported me to my father and my father relayed the
further embellished report to the PA Hospital’s psychiatric unit, Miller has had my father’s mobile
phone number and my father has been accepting calls from him and acting on them against my
interests. Meanwhile he refuses all phone contact with me and hangs up the phone if I ring him (now
that the DVO has expired and before he took out this vexatious DVO).

In July 2012 my father approached the Holland Park Magistrates Court for an Interim Domestic
Violence Order, in the vain hope that this would prevent me from publishing further critical articles
and comments about him on the internet, to avoid answering questions I was asking about his links
to terrorism and biological warfare and to try and prevent me from having contact with and getting
support from my mother. In his affidavit to the court he claimed that the PA Hospital had indicated
that it would “help them” if he was successful in obtaining a DVO against me, though I have never
been violent to him or threatened him with violence. I have raised my voice to him on the phone,
and told him he was an evil person, swearing at him at times. He has also sworn at me and abused
me over the phone on many more occasions. In 2012 he sent me a text message that if I came
around to his house he would smash my face and this time he would finish me off. I have also
reported him to the International, Australian and Sri Lankan authorities for his support of the LTTE
(Tamil Tigers) and his terrorist-supporting propaganda and lobbying activities.

If what I was publishing about him was false or defamatory my father was at liberty to sue me,
however instead he inappropriately took out a Domestic Violence Order (DVO), though I have never
been violent to him or anyone else (whereas he has been violent to me both physically and
emotionally).

When I was summoned to the Magistrate’s Court to contest the Interim DVO (from July 2012) I felt
intimidated and outnumbered, since I was told that an Indian Tamil psychiatrist from the PA Hospital
named Subramanian Purushothaman (“Dr Subu”) who had kept me confined for several weeks in
2011 for saying that my father was a supporter of the Tamil Tigers (the terrorist organization that
was fighting for a separate state in Sri Lanka) would be sending his lawyer to support my father’s
case. Consequently, I agreed to consent to the DVO, though the Magistrate made the point that the
evidence was never tested in court.

A few weeks after the final order was consented to (October 2012) I became concerned about the
whereabouts of my 3-year-old daughter Zoe and her mother Sara Di Genova after I went around to
her house and found that she was not there. I tried contacting my mother on her mobile phone, but
she did not answer. I then rang her on the landline and she scolded me and told me “you’re not
allowed to ring on this line”. The DVO had prohibited me from ringing my father at his home or work,
but I did not intend to speak to him and neither did I. A few days later I was more distressed about
the disappearance of Sara and Zoe (it turned out that Sara had driven her down to Melbourne to be
with her family, without telling me). I rang my mother again on her mobile phone, but again she did
not answer and I called on the land-line. My mother answered the phone but while I was speaking to
her my father picked up the second line and shouted that I was not allowed to ring on this line and
that he was going to report me to the police. In her letter to the courts my mother has confirmed
this account – her description of my phone “conversation” with my father that evening was that he
(my father) “picked up the other phone and blasted him (me)”. My father has claimed that I was
“talking nonsense” and that I said he was an evil man and asked if he was afraid of me. This is untrue,
though I have told my father that I thought him an evil man on other occasions and asked if he was
afraid of me (because my mother has told me that he was) and have also threatened him with legal
action (and reporting him to the authorities) but never with violence. My father’s claim to the police
that he “picked up the phone by mistake” is also patently false. He has had the habit of silently
listening in on conversations I have with my mother for many years.

In addition to my father taking out a vexatious domestic violence order (DVO) against me in the
Holland Park Magistrate’s Court (Interim order July 2012 and final order, to which I consented
against my better judgement, in October 2012) and then reporting me to the police for contravening
it (when I rang my mother at their home because I was desperately worried about the whereabouts
of my 3-year-old daughter), despite the fact that I have never been violent to him or threatened
violence against him, he has used his influence in the hospital system to have me locked up and
drugged with injections against my will on numerous occasions (saying it was the only treatment
that “worked”). He began doing this in 1995 when I was 34 years old and living in Melbourne and
has done it on numerous occasions in addition to conducting a vicious smear campaign against me.
He has also prevented me from earning a living as a doctor by misrepresenting my medical and
scientific views in secret letters he wrote or dictated and had his secretary and lover, Joyce Achong
type and fax to the medical and psychiatric authorities in Melbourne and Brisbane from 1995
onwards.

There have never been complaints about the standard of medical care I provided – on the contrary I
was regarded as a good, patient and caring doctor by my many patients when my father and other
members of my medical family had me locked up as a mental patient in the public hospital system in
Melbourne.

When I moved back to Brisbane for a year in 2002 he organized for me to be locked up and injected
on several occasions at the PA Hospital, communicating by phone and fax directly with the Clinical
Director of Psychiatry, Dr Paul Schneider and the Director of Psychiatry Dr Monica Des Arts, both of
whom were senior colleagues of his during the many years he worked as a medical consultant at the
hospital. In the following letter he wrote that he refused to clinically verify the injuries I had suffered

at the hands of the police when they came to my house (rented) in Fairfield with psychiatry workers
from the PA Hospital. This, he wrote, was because he did not want to support my case for damages.

Between June and October 2002 my father arranged with Schneider and the PA Hospital that I be
locked up and “treated” (injected with depot antipsychotic drugs that made it difficult to walk or
speak) on 4 occasions. On two of these occasions I was locked up briefly because I refused to attend
the West End clinic to be injected with further doses of a drug that was obviously making me unwell.
My father was motivated by long-standing hostility to me, and was trying to silence me over a Peace
Plan for Sri Lanka that I was developing to counter his own war plan, in which he was urging the
Tamil Tigers not to take the 2002 ceasefire agreement seriously and to prepare for more “guerrilla
warfare” because it was “too late for reconciliation” and that the only language the Sri Lankan
government understood was “the weapons struggle”. My Peace Plan for Sri Lanka was for a unitary
sovereign state with a focus on trilingual education in Singhalese, Tamil and English, among 40 other
proposals. I also called for disarmament of the Tamil Tigers and demilitarisation of the Sri Lankan
state and investigation of the LTTE and Sri Lankan armed forces regarding possible war crimes since
1984. My father was opposed to anything other than division of the country and eventual victory for
the LTTE and was strongly opposed to the LTTE being investigated for war crimes.

During the final of these admissions (for 2002) my rib and finger were broken by security guards
while in Paul Schneider’s ward. They were immobilizing me by putting me in a stress position by
twisting my fingers while kneeling on my chest so I could be injected in my buttocks by nurses,
though I was mentally well, and not resisting. When the x-ray (which I insisted on and would not
otherwise have been done) showed that I had a fractured rib I was hastily discharged, though
without an apology. I was told my things had been taken out from the home I was renting and put
into storage, and my car parked (at my expense) at the Princess Alexandra Hospital. Nursing my
broken rib and finger, I drove down to Melbourne where I rented a house and lived till 2008 when I
returned to Brisbane. This is the relevant letter from my father to Paul Schneider:

My father, Brian Senewiratne, has been regularly pulling strings to get me locked up and discredited
as a mental patient since he was first successful at doing so in April 1995. This was when I was still
living in Melbourne and working as a 34-year-old general practitioner in my own practice in

Melbourne. I was vocationally registered and highly regarded by my patients and colleagues. I had a
troubled marriage but a lovely young daughter and had recently bought a house in Richmond where
I lived with my wife Sue (a nurse) and daughter Ruby (born in 1992). I was also actively involved in
music and had established a recording company and an organization called Groove On records in
addition to leading my own band, the Figgs. Groove-On had its first recording of three leading
Melbourne bands before a live audience of about 500 people in February 1995.

My father wrote me a cheque for $10,000 towards the Groove-On project in January 1995. Later he
falsely claimed that I had spent the money “on a spending spree with no insight as to where the
money was coming from” in a letter to the psychiatric authorities, in a clear attempt to frame me as
having the serious psychotic illness of mania (of which overspending is cited as a classical sign). At
the time my father colluded with my sister’s boyfriend, Robert Purssey, who was working as a
psychiatry registrar in Melbourne and was able to influence the psychiatrists at the Royal Park
Hospital and the Medical Board. During my first incarceration in April-May 1995 Robert Purssey and
my sister took me, drugged and confused with haloperidol, to the Guardianship and Administration
Board, where I consented under duress to have my legal and financial rights taken over by the State
Trustees. Custody of my daughter was given to my ex-wife, who later cut me off from contact from
my daughter. The State Trustees then closed my practice after my family claimed that the locum I
had employed was not up to the job. I received no payment for my practice that I had built up since
1988 and bought in 1991. The State Trustee and my wife also sold our family home in Richmond for
$10,000 more than we had bought it a few years earlier. My parents wanted the money since they
had contributed $10,000 to the bank loan. Again I received nothing and neither did my wife Sue.

Since 1995 I have lost count of the number of times police have come to my home, in Melbourne
and Brisbane and told me that I had to “go with them to the hospital”. I have nightmares about it,
and what has happened at the hospital after they delivered me there, usually in handcuffs, though I
had usually not resisted what was effectively a false arrest, since I was mentally well and minding my
own business in the privacy of my home, from which I have worked since I was prevented from
working in a medical clinic due to the relentless efforts of my medical family. I have been inevitably
drugged, sometimes by injection, as well as by mouth. My repeated and verifiable claims that my
father was working in support of the LTTE (Tamil Tigers) terrorists was “diagnosed” as the “delusions”
of “paranoid schizophrenia”. My refusal to agree with this misdiagnosis was labelled “lack of insight”
and my refusal to take drugs for a “mental illness” that I did not have was labelled “non-compliance”
and blamed for my having so many “admissions”. In reality the admissions were all caused by a long-
running conspiracy by my father to have me silenced, due to the truths I had been trying to tell the
world to counter the propaganda he has publishing about himself since 1984 when he first started
acting as an amateur, but financially rewarded, propagandist for the Tamil Tigers through his
contacts with the Tamil Diaspora in the Australia, UK, Canada and USA.

Background:

My parents were born in Sri Lanka and married in 1957. My father, Brian, is of Sinhalese ethnicity
and comes from a land-owning family with political connections that he makes much of in his
propaganda writings and speeches. My mother, Kamalini, is Tamil and comes from an academic
family, with a father (Winslow Alagaratnam) who was the Director of Irrigation in the 1950s and a
mother (Daisy) who gained a degree in mathematics in India in the 1920s. My father was unable to
get into medicine in Sri Lanka due to his inability to pass Sinhala language exams but had been able
to get the finance, from his and my mother’s family, to study medicine as a private fee-paying
student at Cambridge University. He also obtained a medical degree from the University of London
and studied a course in Tropical Medicine before he returned to Sri Lanka in 1968 with positions of
Senior Lecturer in Medicine at the Peradeniya University and physician at the nearby Kandy Hospital.

While working at the Kandy Hospital between 1968 and 1976 my father was awarded a grant by the
British Nuffield Foundation to build a “clinical research laboratory” at the Kandy Hospital, which he
did with considerable opposition, at times, from the University of Peradeniya and his seniors at the
Kandy Hospital. He developed life-long hatreds of the professor of medicine, the dean and other
seniors, and even in his seventies was writing about how they were “cretins”, “morons”, “crazy”,
“mad”, and “drunken fools”. He uses similar invectives when denouncing and character-
assassinating his political and professional enemies and opponents (including myself). He has written
that he “quit Sri Lanka” because he was being harassed and also because they refused to give the
position of professor of Medicine to “a black Englishman”. There were also rumours that he had to
leave the country because he was being charged over a hit and run accident. My sister and I were
told that he “sacrificed his career” for our education by coming out to Australia; my mother told me
recently that it was to prevent my sister and I from being “ragged” at University because we were his
children and he had been valiantly trying to stop the cruel practices of ragging of freshers at the
Peradeniya University, where he was a lecturer (and not an “associate professor” as he has claimed).

At the research laboratory, which was always called “Brian’s Lab” or just “The Lab”, my father did a
number of things that raised my concerns many years later, when I had graduated in medicine and
been working in general practice for many years, placing me in a better position to evaluate medical
ethics and medical research. These include experiments he did on Tamil tea estate workers, with
funding from drug companies, research into poisoning and fluoride, uniformly fatal experiments on
patients with rabies and groundwork he did for the separatist war, of which he was always a
supporter, and indeed became a key player. It is these concerns that I have been trying to draw
public attention to over the years, in addition to his role in supporting terrorism, notably the
terrorism of the Liberation Tigers of Tamil Eelam (LTTE or Tamil Tigers). My father was a supporter of
the Tamil Tigers and the separatist “cause” and was sent around the world, in secretive deals, to
canvass and lobby for the LTTE, including trips to the USA, UK, Canada, New Zealand, Europe,
Malaysia and India. His copious writings were regularly published on pro-Tiger websites like
TamilNet and Tamil Sangam through the 1990s through to the defeat of the LTTE in 2009. From 2005
or so he had been marketing home-made propaganda DVDs presenting a distorted view of the war
in Sri Lanka and the island’s history in addition to trying to make money by copying and distributing
professional recordings of speeches and interviews when he was on his lobbying trips to the USA,
Canada and UK. I was unaware of the details of what he had been doing until I myself was connected

to the Internet in 2002 and temporarily moved back to Brisbane from Melbourne (where I had lived
since 1988).

Regarding my father’s activities with the deadly rabies virus in Sri Lanka, this is a posting I did on
Cambridge University website some months ago:

Romesh Senewiratne-Alagaratnam “I have just had a conversation with my parents about the most
deadly virus known - the rhabdovirus rabies. I wanted to know about the experiments my father did
on the virus in Sri Lanka in the 1970s, and why, when I was a thirteen-year-old schoolboy he
deliberately exposed me to the rabies virus, by taking me to see a patient of his who was dying of
rabies in a small dark room in the Kandy hospital.

I remember the event clearly because it is one of the most terrifying childhood memories I have. My
father, Brian Senewiratne, drove me to the Kandy Hospital, saying there was something he wanted
me to see. I thought he was going to show me something in the laboratory he had built at the
hospital, but instead he took me to a dark room, where a man was lying on a bed with tubes coming
out of him. My father told me he was being dialysed but that he was going to die, and that he had
rabies. He told me that they were going to have to stop their rabies research because a lab worker in
England had contracted the virus through the air conditioner - showing that the virus could be
spread by air. He pointed to the air conditioner he had installed in his "dialysis room". That's when I
was terrified, and why I remember the event so clearly.

I also remember being taken to the home of my father's cousin Terrence Senewiratne, at the
Peradeniya University. Terrence was professor of agriculture and is a breeder - he bred animals,
including beagles, and also white experimental rabbits. I remember these animals clearly, since I had
never seen albino rabbits before. My father told me they were infecting the rabbits with rabies for
research.

Today he denied this, saying he didn't know what his cousin Terrence was breeding rabbits for, and
that they were Terrence's rabbits. He did not deny taking me to the see the man dying of rabies - his
response was "so what?". My mother's response was the same. She did not think there was anything
wrong with taking a thirteen year old child to see a man he doesn't know who is dying of the most
deadly virus known, and telling him he could catch the virus through the air.

My father did other experiments with rabies, that I tried to discuss with him for the second time this
week and third time in the past 15 years. These involved removing cerebrospinal fluid (CSF) by
lumbar puncture, supposedly to "reduce the viral load" and replace it with a mixture of saline and
protein. All the patients he did this procedure on died.

When he first told me about these experiments, over the phone, in 2001, he said that he did this
experiment on six patients, all of whom died - emphasising the point that "they would have died
anyway". Knowing how dangerous rabies-infected CSF is, but without thinking about how much the
CSF would be worth on the black-market, I asked my father what they did with the CSF. He was
vague about it - he said the virus was inactivated by irradiating it at the Peradeniya University and
"buried somewhere in Kandy". Two days ago he said something different. Rather than irradiating it,
he is now saying that they put the rabies-infected CSF in formaline to kill it. His story has changed,
and he is now saying he did the experiment on only one patient.

Brian Senewiratne responded that "rabbits don't get rabies", when asked about the white rabbits his
cousin was breeding. It is true that rabbits rarely die of rabies, however it was the standard animal
used for culturing the virus for the rabies vaccine developed by Louis Pasteur. Brian Senewiratne
needs to be properly questioned about this by ICC prosecutors and the Australian and Sri Lankan
police.”

These are YouTube uploads of three of the home-made propaganda DVDs my father produced using
his elderly wife to turn the camera on and off, and edited clumsily before trying to market them as
an invaluable contribution to truth and ammunition against the “Sri Lankan government propaganda”
through various Tiger-supporting websites in the USA, UK and Canada. He began these marketing
and propaganda activities before the Tamil Tigers were defeated (2006 to 2009) but continued to try
and make money out of them (despite their poor quality and dated, incorrect information) after his
side had lost the war (to the present day):

When it was evident that the LTTE was losing the war in 2008 my father travelled around the world
urging that the Tamil Tigers be de-banned. He also appeared as the keynote speaker at LTTE
fundraising events in Australia and overseas. These included annual celebrations of “hero’s day”
which glorified the LTTE’s suicide bombers (Black Tigers). In his propaganda DVDs he does admit that
the LTTE had done atrocities and acts of terrorism (when these could not be denied) but glosses over
these, while embellishing and repeating every claim against the Sri Lankan government and armed
forces that was sent to him by the government’s enemies, including the LTTE media. He also
expresses hatred towards the Buddhist clergy and the “Mahavamsa Mindset” that he accuses
Sinhalese Buddhists (including all the political leaders) of having. The Mahavamsa is an ancient
historical, though partly mythical and legendary, chronicle of Sri Lankan kings and Sri Lankan
Buddhism which is venerated by many Sri Lankan Buddhists. My father has been recorded declaring
to Tamil students at the Toronto University in 2008 that there will not be peace in Sri Lanka until the

last copy of the Mahavamsa is burnt. He has written, inflammatorily, that the Mahavamsa is a
“textbook of anti-Tamil racism”. These are extreme views and statements, to say the least.

For many years my father insisted in his speeches and interviews that the Tamil Tigers would not be
defeated. By 2009 he and everyone else could see that they were about to be. At this stage he
started saying that though the LTTE could be disarmed this would be sending the Tamil people to a
genocidal extinction, and that the Tamil people would be all dead by 2016. This was patently untrue
and intended to terrorise his Tamil audience and motivate them to contribute more money to my
father’s campaign to sue the political and military leaders of Sri Lanka in International Courts. He
also accused the Sri Lankan government of building concentration camps and executing “any young
Tamil”, putting old men to slave labour as well as trying to kill them with starvation and infectious
disease. He claimed that the Tamil women in the IDP camps were being systematically raped,
routinely aborted and sterilized, saying that he knows this because “all his students were doctors in
Jaffna”. These were also false claims, designed to terrorise the Tamil people into supporting him in
the legal campaigns he said they desperately needed the “money and the men for”. This can be seen
in the following YouTube clips, recorded at a speech in Australia in August 2009 (three months after
the LTTE was defeated).

This speech was given by my father in Sydney under an Australian flag in a school hall. The audience
is not seen, but from the applause and his comments it is clear that it is an LTTE-supporting Tamil
audience.

He begins the speech with his stock introduction that he is a Sinhalese and not a Tamil and a
“member of the Bandaranaike family”. He always mentions this, and it is meant to bring him
credibility among those who oppose the Bandaranaikes, whom he accuses of being racist against the
Tamils and much worse.

In fact he is not a “member of the Bandaranaike family” though he is related to them. His
grandmother, Charlotte Dias Bandaranaike married his grandfather Solomon Senewiratne, of whom
his father Philip was one of seven sons. Charlotte Dias Bandaranaike was the aunt of SWRD
Bandaranaike, who was Prime Minister of Sri Lanka in the 1950s. My father, in line with Tamil
nationalists, accuses SWRD Bandaranaike for “introducing the Sinhala Only Act” in 1956, when
Singhala, the language of 80 percent of Sri Lankans, was made the official language instead of English
which had been the language of government during the British Colonial times. My father never
mentions that two years later, in 1958 a further act was passed recognising the Tamil language for
various government and educational areas. He does mention that Bandaranaike was assassinated by
a Buddhist priest (as he was) because this lends credence to his claim that the Buddhist clergy in Sri
Lanka are violent “thugs and hoodlums in yellow robes”.

The Bandaranaike family has been famous in Sri Lankan politics and after SWRD Bandaranaike was
assassinated, his wife Sirima became the nation’s and world’s first female Prime Minister, her
daughter, Chandrika following her parents into politics, becoming President in the 1990s. Sri Lanka
has a democratic system of government and the Bandaranaikes have lost power at times, however
they are highly respected in Sri Lanka and abroad. My father mentions the Bandaranaikes only to
vilify them for “what they did to the Tamils”. This jealousy reaches insane degrees with my father’s
hatred of his second cousin Chandrika Bandaranaike Kumaratunga, who he frequently mentions in
his writings and speeches to this day. Since 1995 he has accused her, falsely, of “carpet-bombing
Jaffna”, referring to the successful reclaiming of the Jaffna peninsula, initially the homeground of the
Tamil Tigers, by the Sri Lankan armed forces when Chandrika Kumaratunga was President. He has
accused her of being a liar and a closet racist and vilified her in other ways. He also claims that this
erudite and distinguished woman is a “female barbarian” who should be sued, along with the others
who defeated the LTTE.

Immediately after the end of the war my father was shouting at Tamil people that he needed the
“money and the men” and the “money and the muscle” to “sue the blaggards” who had defeated
the Tamil Tigers. These included, especially, Defence Secretary Gotabaya Rajapaksa who was, with a
humble title, in charge of the war effort and a trusted brother of the President Mahinda Rajapaksa.
Lt Col Gotabaya Rajapaksa had served in the armed forces before living in the USA, later to return to
Sri Lanka to defeat the LTTE, whom many of the previous political leaders had thought invincible.
The Tamil Tigers hated and feared Gotabaya Rajapaksa and my father has singled out this respected
Sri Lankan leader and war hero for his greatest venom and malice. He has compared him to Hitler
and Goebbels, and published on the anti-government Colombo Telegraph website a vindictive and
defamatory “psychiatric analysis” of Gotabaya Rajapaksa that constituted a thorough and malicious
character assassination of this popular statesman, in addition to trying to raise funds and arrange
legal advice (through the barrister Geoffrey Robertson) to try and charge Gotabaya Rajapaksa in the
International Criminal Court or some other international court. This cause was taken up by the
Transnational Government of Tamil Eelam (TGTE) under his advice as a senator. He acted as the go-
between between the TGTE and Robertson, who agreed to help them prepare charges although he
wanted to be paid his usual fees. He has been an unelected “senator” of the bogus “Transnational
Government” since it was first formed from the vestiges of the defeated LTTE in 2010.

“The Responses

The responses I have had from the many I have called, have been disappointing, inaccurate and
unacceptable.

1. “He is ‘nuts’. “He is ‘crazy’. I take this to mean that he is ‘mad’ (medically speaking
‘psychotic’). This is unacceptable since there is no good evidence that he is.
2. “He is a ‘fart’. Medically, ‘flatus’ – gaseous emissions from the bowel – which he is not. Flatus
comes in different forms. 1) Inaudible and inoffensive. That he is not. 2) Audible – causing

embarrassment to the ‘emitter’. That he is not. 3) Offensive in odour but one which dispersers
quickly. That he is not. While what comes out of his mouth may be offensive it does not
quickly drift off.
3. “He is an arse-hole”. Medically, the anus. He has one, but cannot be one.

A proper analysis of what he said, and the language used, and its possible consequences are
important. Consider this, he is the Defence Secretary, possibly the next Prime Minister nominated by
his brother, and, as I have said, the de facto President of Sri Lanka.

There were many more similar comments, “an arrogant shit, a thug, a dim-bat, a pompous ass”, which
are wrong for obvious reasons. Some whom I contacted were so worked up that they challenged me:
“You can present all your medical clap-trap, but he is simply an arrogant shit”. Ironically, I found
myself defending Rajapaksa, something I never thought I would have to do: “Steady on, you are now
drifting into Rajapaksa’s language. Although he has not taken out a patent on these words, let us not
get into the gutter ourselves. While he might well be what you say he is, can you reserve your
judgement until you have read, what you call, my medical clap-trap?”

In the six decades I have observed and commented on those who hold power in Sri Lanka, I have
never had such negative comments about any of them. They include dreadful people like Cyril
Matthew, his replacement today, Hon Mervin Silva, and others of their ilk. Gotabaya Rajapaksa
seems to be universally hated (and feared). Perhaps I telephoned the wrong people.

The impression I got was that people (the ones I called) were seething with anger – anger they could
not express without the risk of a ‘white van without numberplates’ coming for them or, as happened to
Lasantha and so many others, simply being murdered. Amnesty International has reported that at
least 15 journalists and media workers have been killed and 30 seriously injured since January 2006
(the Rakapaksa regime took over the country in November 2005).

I began to worry. If there is so much anger, anything could happen. Very angry people do some crazy
things. We do not want a martyr. This is one of the reasons why I decided to do a proper analysis.

What follows is an analysis of what he said, and the language used, and its possible consequences.

The language used

The language used by Rajapaksa as printed in the papers (including the Sunday Leader), is ‘sanitised’
– ‘f……g’. That was NOT the word used. He used the full word.

I know this because I have been subjected to this same language (and worse) by ‘patriotic’ supporters
of the Rajapaksa regime on many occasions, every time I write an article or address a meeting
(recently one even in a Church here in Australia), on the violation of human rights by the Sri Lankan
government. I too will use the ‘sanitised’ version to make it less offensive, although I am not
convinced that I should. If it is acceptable for these people to use these words, then, by the same
token, it must also be alright for us to print them (as said).

It is on this same dubious reasoning that I removed some of the photos of children raped by the Sri
Lankan Armed Forces from my dvd “Sri Lanka: Genocide, Crimes against Humanity, Violation of
International Law”. If it is acceptable for the Armed Forces to do these terrible things it must also be
alright for us to show this to the world. The UK Channel 4 video did not ‘sanitise’ anything – hence its
impact.

The only reason for quoting, albeit sanitised, what I have been subjected to is to show how they
should be dealt with. Frederica Jansz did this superbly. To the vituperative, threatening and obscene
language, she simply said, “I hope you can hear yourself, Mr Rajapaksa”.

So do I. I keep my cool and stick to the Queen’s English and not get into gutter language which I last
heard in real life, many moons ago in the Pettah fish-market. Getting into crude, vulgar and obscene
language seems to be a measure of Sri Lankan (I hasten to clarify this, Sinhalese) patriotism.

Here is just one of many examples, which have kept me awake night after night, to be sure I do not
sleep, and day after day to be sure I cannot see my patients. It is ‘Gotabaya Rajapaksa language”.

“You mother f…..g Tamil Tiger c…t (the vagina)”. My measured response: “No, Sir (or Madam – some
of the most obscene ones come from ‘ladies’), I have never done any such a thing to my mother. I
hope you have not done this to your mother. If you have, then you have a problem. Call my secretary
for an appointment to see me (professionally, I mean). There will be no charge for this.
Sir, you are anatomically confused because the organ needed for the former act is not possessed by
the owner of the latter organ. So, I suggest that you get the anatomy right.
And Sir, I am not a Tamil, nor am I a Tiger but a member of the ‘Lion race’ as your patriotic self. Good
night and may the blessings of Almighty God or the Triple Gem, which ever you like, be on you. I say
this as a Christian whose mother was a devout Buddhist. Now go to sleep and thank you so much for
staying awake so late to keep me awake.”

Some of these calls are much more dreadful, and deeply worrying. In addition to exporting tea, rubber,
garments etc, an important export from the “Asian Wonder” has been obscene language and thuggery.
Listen to the Channel 4 video – never mind the execution of naked bound and blindfolded prisoners,
and slicing of their throats with a pen knife. Just listen carefully, about 20 minutes from the start, to the
language used. It is ‘Gotabaya-language’, presumably learnt for Lieutenant Colonel. Nandasena
Gotabaya Rajapaksa from the Gajaba regiment before he ‘patriotically’ left for the USA in 1992 (and
became an American citizen!)

As Viktor Klemperer said in The Language of the Third Reich, “Language reveals all”. Sri Lanka is
surely moving towards Nazi Germany, if it has not got there already.”

It is clear that my father is not a reliable witness. It is also clear that he is a hypocrite, accusing
Gotabaya Rajapaksa of mental disorder because he used the word “fucking” when scolding an
impertinent and troublesome journalist over the phone. My father dwells on Mr Rajapaksa’s
swearing using the expletives “fuck” and “fucking”, claiming the this is evidence of serious mental
disorder (“intermittent explosive disorder” which he claims is a “new disorder” in the American
Psychiatric Association’s Diagnostic and Statistical Manual or DSM). Mr Rajapaksa dismissed the
event by saying that people in the USA, where he lived for many years, swear like that all the time.
People in Australia do too, and my father, though he doesn’t say “fuck” or “fucking” much, swears a
great deal and refers to people as “cretins”, “morons”, “idiots”, “dim-bats”, “stupid buggers” and
other terms of abuse and in his speeches has used phrases such as “bloody backsides”, “bloody
bullshit” and other violent phrases, even with children in the audience and on stage. His language at
home is far worse than his language when on show. In his speeches and writings he has a crude and
violent turn of phrase. At the same time he makes much of the swearing and abuse he gets from
people who ring him “day and night”, apparently preventing him from seeing patients (or sleeping)
by their abusive phone-calls, which are motivated by fury at his political activities (in support of the
LTTE). In his affidavit to the Holland Park Magistrates Court in support of a vexatious DVO against me,
my father made similar claims about me – that I was ringing him constantly – when in fact I hardly
ever rang him.

In the third of these clips from August 2009 (part 3) my father argued that the “Tamil struggle is just
starting” in line with an article he published in the expatriate Tamil press around the same time
titled “Real War is Just Beginning – Get Involved”. My father said, to a Tamil audience in Sydney, that
the “destruction” of Kilinochchi, Mullaitivu and the Vanni has “proved beyond any conceivable doubt
or argument that there can never be a solution where the Tamil people can be left at the mercy of
the Sinhala government” and that “You have to talk of separation”. He then says “This may not be
the time to talk of separation. Today the talk is to a humanitarian crisis.”

At the time that the LTTE were just about to be defeated he shouted through a megaphone to an
LTTE-supporting audience of young people, including members of the Australian Socialist Alliance
that if the LTTE were defeated people “more virulent and extreme” would come forward to lead the
“Tamil struggle”. The “Tamil struggle” has long been a euphemism for the war for a separate state.

In his August 2009 speech, which was delivered in school hall in Sydney, my father received some
applause for shouting that there needed to be “sanctions” amounting to a complete boycott of Sri
Lanka. He said that he and one of the Tamil expatriate “leaders” in Australia (Rajeswaran) would
have to “give a thought to” how they could get a boycott of Sri Lankan cricket, in addition blocking
all goods coming and going from the country, investment and tourism. Though the campaign to
boycott Sri Lanka has a website (established from the USA), it has been a dismal failure and, contrary
to my father’s claims and his strongest efforts, tourism and the economy boomed in Sri Lanka after
the end of the war and the killing of the LTTE’s military leader Prabakaran in May 2009. My father
argues that the only thing that worked against the Apartheid regime in South Africa was the trade
boycott and boycott of cricket. In doing so he dropped the name of Archbishop Desmond Tutu,
whom he quotes as saying, “You know, Brian just two things dismantled South Africa – the Apartheid
regime. One, the economic sanctions and two, stopping of playing cricket”. He continues, “Those are
the only two things that worked. And we are talking of a country rolling in diamonds and in gold. The
other one is a tin-pot, fascist dictatorship that is broke. How easy it is going to be to render that
country broke.”

A patriot or even a friend of Sri Lanka and a good global citizen would not want to render Sri Lanka
broke, especially when it was just recovering from a 30 year war against Vellupillai Prabakaran and
the Tamil Tigers. In fact it is worse than that – it is an attempt to destroy the Sri Lankan economy and
destroy the peace by waging economic warfare against the country – something my father has been
doing for a long time. Waging economic warfare is against International Law along with other forms
of unconventional warfare. There is no doubt, from the video and documentary evidence that I have
provided, that my father is an unrepentant warmonger, who has continued to try and disrupt the
peace after his side was militarily defeated. Instead of reasonably reflecting on what he had done
wrong and how he had misled the Tamil people and misinformed the Australian and non-Sri Lankan
community through his propaganda DVDs, he continued to give speeches and make videos in which
he promotes these home-made, amateur “documentaries” that he made before the LTTE lost the
war. After the war he accepted a position as “senator” in the LTTE-linked TGTE, which he still holds.

In the same August 2009 speech (part 3 on the list above) my father goes on to chastise his Tamil
audience (who one doesn’t get to see in the YouTube video) for “sitting on their bloody backsides”
and “doing bugger all” and that “Prabakaran and the Tigers did what they could with what they had”.
He gathered some applause for his rhetoric that the Tamil Tigers “put guts into Tamil stomachs that
lacked guts” and “a spine into the Tamil people so that they could stand”.

In part 4 of his August 2009 speech in the Sydney hall my father boasts about doing something that
he knows to be “very illegal”. He explains how he propagandises for “Tamil rights” by giving his LTTE-
supporting propaganda DVDs to his patients. He provides an example of a “Mr Brown” who is sent to
see him because of his diabetes. My says that after he has talked for half an hour about diabetes he
tells Mr Brown, “There’s a bit of a problem with Tamil Eelam. Here’s a DVD. Can you watch it and
when you come back next week, tell me what you think?” When “Mr Brown” returns, my father
claims that he questions him, “Mr Brown, where is Mullaitivu”? Mullaitivu is small town in the Vanni
(northern Sri Lanka) that was a final holdout of the LTTE. When Mr Brown doesn’t know where
Mullaitivu is my father claims he says, “Mr Brown, I can see that you haven’t watched this DVD. If
you want your diabetes properly treated you’ll have to watch it.”

This is, indeed illegal and also against all medical ethics. The taxpayer-funded Medicare system of
Australia, that my father uses to make his money from when he sees these patients, should not be
used to propagandise for war in another country. My father’s boastful claim (to a Tamil audience)
that 50,000 “white” people in his area are able to give a dissertation on Tamil rights as a result of his
propaganda activities should be investigated by the police, and constitutes brainwashing his patients
with racist, hateful propaganda against the Sinhala people, the Buddhist clergy, various Sri Lankan
politicians and the Sri Lankan armed forces. Such brainwashing would predicably have negative
effects on their mental and physical health, and should furthermore not have been charged on
Medicare. He actually says that there is no point in giving the DVDs to “Sinnathamby” or
“Subramaniam” (meaning Tamils) but they should give them to “white people”. He knows that non-
Sri Lankans and white Australians who know nothing about Sri Lanka, the LTTE and the war are more
easily convinced by the many falsehoods in his DVDs.

In 2010, after the Sri Lankan government defeated the LTTE in Sri Lanka (May 2009), my father was
made a “senator” of the “Transnational Government of Tamil Eelam” (TGTE), a political organization
developed from the international vestiges of the Tamil Tigers based in the USA but with branches in
the UK, Australia, France, Germany, Norway, Switzerland, Malaysia and India. It is proscribed as a
terrorist organization in Sri Lanka and is led by a self-styled “Prime Minister” who is a Sri Lankan
Tamil lawyer in New York who now works as a refugee lawyer for asylum seekers but was previously
the Tamil lawyer for the LTTE. This is Vishvanathan Rudrakumaran, who can be seen in this photo
with the Tamil Tiger leader Prabakaran and the LTTE’s ideological leaders Anton and Adele
Balasingham, from 2002.

It is of note that Adele and Anton Balasingham (on the left) were based in London, from where they
coordinated the international activities of the LTTE. Anton Balasingham who described himself as the
“theoretician and strategist” of the LTTE was a British citizen; his wife Adele Wilby is an Australian
nurse who was the leader of the Tiger’s women’s wing as has been documented handing out cyanide
vials to young female recruits to the LTTE, when Anton and Adele Balasingham were still in Sri Lanka
with Prabakaran. They later moved to London, from where they flew to Sri Lanka for the 2002 peace
talks, when this photo was taken.

In 2016, after more than 5 years as a “senator” my father attended a ceremony in the USA where he
was awarded a “lifetime achievement award” by none other than Rudrakumaran. It was publicised
by another “senator” of the TGTE, a Canadian Tamil writer by the name of Usha Sri-Skandarajah,

to lift the ban on the LTTE.

If the LTTE no longer exists, as my father has claimed since the end of the war, what would be the
purpose of de-banning it? At the same time my father has written that it is a sign of paranoia to
believe that the LTTE is trying to resume its activities.

When we were In Sri Lanka I attended Trinity College, a private boy’s school, where I was a prize and
scholarship-winning student from grade 4 to grade 10, after which I continued to win academic
prizes in Year 11 and 12 at the Church of England Grammar School in Brisbane. In 1977 I was
awarded the Tyrwitt Cup (dux) of the Church of England Grammar School (Churchie) and entered the
medical school at the University of Queensland. I graduated in 1983 and worked at the Royal
Children’s Hospital and Royal Brisbane Hospital until I entered family medicine in 1987. I moved to
Melbourne and was working as a successful family doctor in my own clinic in South Dandenong
when my father and other members of my family arranged for the first of numerous involuntary
admissions to the public hospital system as a mental patient. My older sister Shireen was a year
ahead of me, also studying medicine and later to become a plastic surgeon, while my father had an
appointment as a “Clinical Associate Professor of Medicine” at the University of Queensland and was
a consultant physician at the Princess Alexandra Hospital, while also engaged in private practice, the
overseas doctors program and a range of political activities. These included support and propaganda
activities, in writing, interviews and speeches for the Tamil Tigers on whose side he was on in the
separatist war in Sri Lanka. Between 1995, when he first started claiming that I was mentally ill
because of our medical and political differences and May 2009, when the Tamil Tigers lost the war,
my father acted as a propagandist, lobbyist and international organizer for the LTTE (Tamil Tigers).

on the Internet on pro-LTTE websites, You Tube and Brian Senewiratne’s own blog (“Brian

I returned to Brisbane from Melbourne in 2008 after I was rendered homeless and incomeless after
another psychiatric detention instigated by my family. I was forced to live in the garage of a man
called Pawel Obrocki for a year before my mother bought this house in Moorooka, into which I
moved with my girlfriend Sara, who followed me up from Melbourne and was soon pregnant with
our only child, Zoe, who was born on 30 August 2009.

Two days after Zoe was born my father and Pawel Obrocki reported me to the PA Hospital. Obrocki
also called the police claiming, falsely, that I had “barricaded myself in my house with my newborn”.
This false claim was repeated by the police to the PA Hospital where I was locked up for 5 days. I was
devastated about missing out on these special days with my new daughter.

The day before, I had a confrontation with my father over the phone, when I told him that it was I
who had reported him to the Federal Police (via the National Security Hotline) towards the end of
the war in April 2009 after watching the 13 DVDs he was selling on the black market of his home-
made propaganda and recordings of speeches he had given in Australia and overseas. I was induced
to ring the National Security Hotline towards the end of the war, when TV reports showed that the
Tamil Tigers were shooting Tamil civilians who were trying to cross to the government side as well as
cadres who wanted to surrender. After I called the National Security Hotline I was visited by counter-
terrorism officers from the Australian Federal Police who came to my house in Brisbane and asked
for a recorded interview. I gave them my father’s propaganda DVDs and provided what information I
had about the LTTE’s international operations. After the war had ended with the defeat of the LTTE I
had a letter of thanks from officer Nicole East who conducted the interview, with the returned DVDs.

The LTTE cadres were indoctrinated to commit suicide with cyanide if captured in order to preserve
the secrets of the organization. They also had a division known as the Black Tigers, who were
specially trained and commemorated suicide bombers. Many of these were women and the LTTE
pioneered “suicide vests” with hidden explosives. In addition to assassinating the Prime Ministers of
India and Sri Lanka, they blew up trains and buses killing hundreds of Sinhalese civilians, and
attacked Singhalese and Muslim villagers whom they drove out of their homes in the hope of
creating a militarised mono-ethnic state for Sri Lankan (or Eelam) Tamils. They also attacked
Buddhist places of worship and killed Buddhist monks. The Tamil intellectuals and others who were
opposed to separatism or who worked with or for the government, and especially for the military
were specifically branded “traitors” and targeted for killing all over Sri Lanka. Numerous Tamil
leaders were killed, in addition to members of rival Tamil armed groups and Sinhalese political and
military leaders (plus members of the Sri Lankan armed forces that battled them over 30 years). The
LTTE also forced poor Tamil children to fight for them, and were notorious for their use of child
soldiers, who were ritually garlanded with a vial of cyanide poison that they were supposed to
swallow of captured. The LTTE was financed by millions of dollars raised in the West and channelled
to buy weapons for the “Tamil struggle”. They were involved in smuggling drugs and people, credit
card fraud and wanton acts of terrorism, massacres, murders and torture. Throughout the war,
which my father made a career of talking up, the LTTE used poor Tamil civilians as cannon-fodder
and human shields, terrorising them to give up at least one child “to the cause”. These children were
mistreated and brainwashed into fanatical hatred of the Sinhalese and Buddhists, especially those of
the armed forces who they were indoctrinated to fear would rape them, torture them and kill them
if they were caught (hence the cyanide capsule was promoted as a “safety measure” against a worse
death at the hands of the “barbaric Sinhalese army”). The FBI described the LTTE as the most
ruthless terrorist organization in the world and the organization was eventually banned in over 30
countries, including the European Union, India, Canada and the USA, but, significantly, not in
Australia.

Some of my father’s propaganda DVDs have been uploaded to YouTube as well as speeches he has
given between 2008 and 2009 in which he clearly supports the LTTE and consistently calls for their

de-banning as well as justifying their deplorable and illegal recruitment of child soldiers and suicide
bombers. He is completely silent about the LTTE’s many atrocities while shouting (through a
megaphone at times) that the Tigers were the sole legitimate representatives of the Tamil people
“because they were the only ones prepared to lay down their lives for our people”:

Significantly, my father is not Tamil, though he has claimed to be on the “Tamil side” of the conflict
in Sri Lanka. He simultaneously makes much of the fact that he is of Sinhala ethnicity and belongs to
the “majority community” – the Sinhalese. The fact is that he cannot read Sinhalese or Tamil,
understands no Tamil at all and only a smattering of Sinhalese. One reason he became an enemy of
the Sinhalese was because he blamed his failure to get into Medicine at the Colombo University in
the 1950s on his failure to pass the year 10 Sinhala language exams. The fact is that my father is
deeply racist to both the Sinhalese (his own race) and the Tamils. He hides this racism and only
reveals the fact that he regards the Tamils as intelligent but stingy to his wife, my mother, who is
Tamil, though both she and my father were brought up speaking English at home and educated in
the English language in addition to calling themselves as Protestant Christian (most Tamils are Hindu
and most Singhalese are Buddhist).

My father is a fanatical opponent of the Buddhist clergy of Sri Lanka, whom he has long blamed as
being behind the war and other violence in Sri Lanka. Recently he has continued this paranoia about
Buddhist priests who he says are “very violent” and he wouldn’t put it past them to assassinate the
(Buddhist) president of Sri Lanka (Maithripala Sirisena) “if the need arises” emphasising that in the
1950s “(his) uncle the Prime Minister SWRD Bandaranaike” was killed by a Buddhist monk.

The video above was uploaded to the Brian Senewiratne YouTube site on 7 November 2015. It has
not had many views and takes the form of a video address to a future TGTE conference audience in
South Africa. In addition to denouncing the “politically active Buddhist monks” and the Mahavamsa,
he has harsh words for Ban Ki-Moon, the Secretary General of the UN, the new Sri Lankan Prime
Minister and President as well as the previous Rajapaksa government members but lavish praise for
two female Indian South African lawyers – Navi Pillay and Yasmin Sooka, who he says should be
employed by the Tamils to take the Sri Lankan government to court. He says that “if Rajapaksa is
guilty of war crimes, so is Sirisena” referring to current president Maithripala Sirisena and former
president Mahinda Rajapaksa, because at the end of the war, Sirisena was apparently the acting
defence minister (in the Rajapaksa government). He claims, against all reasonable evidence, that
things have got worse for the Tamils despite the end of the war and the change of government and
that there is an “epidemic of rape in the North and East” by the “Sinhalese armed forces” and their
employees. This is an epidemic of rape that only he appears to be aware of, about which he has self-
published a book that he is currently marketing (and has been marketing for the past two years).
This book bizarrely proposes that the Indian government invade Sri Lanka under the auspices of the
UN to ensure that “internationally credible human rights organizations Amnesty International,
Human Rights Watch and International Crisis Group are allowed into the country”. He also urges that
Sri Lanka be invaded by UN troops under the “R2P laws” to rid the north and east of Sri Lanka of a

“military occupation” by the Sinhalese Armed Forces, which he says are “treating the Tamil people
like the spoils of war” and engaging with impunity in an “epidemic of rape” of Tamil civilians. He
lambasts the new Sri Lankan president for refusing to “end the military occupation” of the North and
East.

In truth there is no Sinhalese military, there is only a Sri Lankan military, and they have a duty to
protect all of Sri Lanka including its north, east, south and west. During and after the war the Sri
Lankan government has tried to attract Tamils to serve in the armed forces. Their activities were
kept secret from the LTTE, since they were targeted for killing as “traitors”. My father played a key
role in spreading hatred against these so-called “traitors to the Tamil cause” who were really loyal
and courageous patriots with a multicultural, inclusive vision of Sri Lanka, who regarded themselves
as Sri Lankan ahead of being Sinhala or Tamil. Since the war ended the Rajapaksa government
expanded a policy of trilingualism in Sinhalese, Tamil and English in order to foster harmony and
reconciliation and President Mahinda Rajapaksa (who is a human rights lawyer) even learned
enough Tamil to give speeches to Tamil people in the North and East of Sri Lanka in Tamil. This is
never mentioned by my father, who accuses ex-President Rajapaksa and all the previous Sinhala
leaders of “anti-Tamil racism” but never bothered to learn a word of Tamil from his wife in 50 years
of dominant marriage.

In fact, it is my father who is obsessed by race and ethnicity and bigoted against women, Tamils,
Sinhalese, Chinese, Muslims, Buddhists, Hindus, Timorese, non-professionals and a range of other
groups, including “politicians” despite accepting a public role as a “senator” of the farcical
“Transnational Government of Tamil Eelam” (an obviously political appointment).

At the end of the video, which is titled “The Future of the Tamil People in the North and East” my
father further embellishes his version of the meeting between him and Archbishop Desmond Tutu
and “some of the leaders of the ANC” , leaving out the fact that the trip was organized by the LTTE,
who were encouraged by Tutu writing that ANC leaders who were regarded, during the Apartheid
regime, as “terrorists” are now “honourable members of parliament”. They and my father have tried
to draw parallels between “the Tamil struggle”(the separatist war of the LTTE) and the struggle of
the ANC against the white-supremacist Apartheid regime. My father has repeatedly made this
comparison, even taking credit (as “us”) for defeating Apartheid. He played no role in the South
African black rights movement whatsoever.

His embellished version of his meeting with Desmond Tutu (which he has elsewhere referred to as
an “audience” with the archbishop) has Tutu “walking up and down” saying, “isn’t it wonderful that
a Sinhalese from the majority community should be campaigning for so long, six and a half decades,
for the rights of the Tamil people to exist”. He exaggerates whatever the exchange really was, to
claim that “when I heard that for the third time I said, ‘Bishop Desmond Tutu, with due respects I
disagree. This is not a Sinhalese problem or a Tamil problem, it is a humanitarian problem that
should arouse the concerns of every human being if he calls himself a human being’.” This is one of
his standard, much rehearsed and repeated lines, which he uses at every opportunity, after
disingenuously drawing attention to the fact that he was one of the few Sinhalese who was
“campaigning for the Tamils”.

In 2008 my father organized another trip to Canada because, in his own words, “the Tamil people
were depressed and despondent” because they thought they were losing the war (which they were,
if they were on the side of the Tamil Tigers – noting that many Tamil people were not and were
actively resisting the tyranny and terrorism of the LTTE). The speech was at an event organized by
the LTTE in Canada called Tamil Pongu at which he was the star speaker. The audience of several
thousand were waving mass-distributed posters of the LTTE leader Prabakaran as well as Tamil Tiger
flags, cheering him whenever he said anything in support of the LTTE, separatism and their
inevitable victory in the war for a separate Tamil state (Tamil Eelam).

It should be clear from the video evidence provided that my father is a dominant, intimidating man
who is authoritarian and outspoken. He has made many enemies over the years and when he falls
out with people or takes a dislike to them from the outset he spreads poisonous words about them.
These have included his professional and political rivals and they have also included me. It was
vexatious, inappropriate and illegal for him to take out a domestic violence order against me, when,
despite considerable provocation, I have never been violent to him or threatened violence against
him. These are important laws to protect vulnerable women and children from domestic violence. In
my case, my father used to hit me (frequently enough for me to be scared of him) when I was a child
and then used his glare and cruel words, disapproval and control of money to keep me in line and
ensure my obedience when I was older. When I stood up to him in my thirties, established on my
own as a successful family doctor, husband and father, he declared me mad and made every effort
to have me locked up and silenced. He tried to render me destitute and devoid of family support or
social support, and did what he could to sabotage my medical career and businesses. He has had me
locked up and injected dozens of times since 1995, and continues to do so to this day – either in a
psychiatric hospital or in jail (his objective in taking out a DVO against me).

When I rang my mother in January 2013 it was to ask her if she knew where my daughter was, and
not to speak to my father and he lied to the police about the supposed conversation we had and
that I was speaking nonsense. I do not speak nonsense. He also lied to police when he said he picked
up the phone “by mistake”. My father doesn’t make such mistakes and had a long-standing habit of
listening in on my phone conversations with my mother. When he picks up the other phone I can
hear it, but if I ask him if he’s listening he doesn’t answer and sometimes puts the phone down. But
it’s all done deliberately and not by accident.

The Other Charges:


I have been issued with two charges that are listed for summary trial at the Holland Park
Magistrate’s Court on 24 October 2016. These are “Contravene Domestic Violence Order” (based on
allegations by my father from January 2013) and “Commit Public Nuisance” (based on false and
misleading allegations made to the police on 19 September 2015 by my neighbour at 74 Fegen Drive,

Heidi Miller). Heidi Miller is the wife of Jeff Miller who is inappropriately listed as “the victim” in a
further vexatious charge, to be heard in the Brisbane Magistrate’s Court on 10 November 2015 of
“going armed so as to cause fear”. This charge is to go to trial hearing on 10 November 2016 in the
Brisbane Magistrates Court.

This charge was brought against me by QPS after Miller reported that I was trying to intimidate him
when I walked across the road from my house at 76 Feegn Drive, Moorooka, to the paperbark tree
on the footpath on the opposite side of the road (outside 72 Fegen Drive) on my 55th birthday (22nd
September 2015) to remove bark for art that I was doing. I used a fragile glass knife that I had made
with Melaleuca bark wrapped around a shard of glass and glued down with PVA glue. It was the first
knife I had ever made and the glue had just dried on it. I had no intention of threatening or
frightening anyone with it when I walked across the road to the Melaleuca tree on the opposite side
of the road to cut a groove in the bark so I could peel larger pieces of bark more easily. This peeling
of the bark is good for the health of the tree. I was experimenting with paperbark (Melaleuca) for
cleaning and for art and was doing murals on my walls that incorporated its beautiful bark (which is
used in Aboriginal art). I was not disturbed in any way and the claim that Miller made to police that I
had been “upset” and “taunting and threatening” him earlier in the morning is simply false.

Miller blames “mental health issues” for the fact that I don’t like him. I don’t like him because, since
2010 he has been spreading the rumour that I’m mad, and ringing up the PA Hospital and my hostile
father, Brian Senewiratne to report on the supposedly “mad” things I have been doing. In 2010 he
reported that I was throwing things out of the window when I was cleaning my house and from 2012
he began reporting me to the Council, Police and hospital that I was “leaving my taps running” and
had “flooded” my and his garden. This resulted in Police coming to my house and turning off the
taps on several occasions and several forced incarcerations at the PA Hospital after mental health
workers came to my house and agreed that my running my external taps to create a stream of
running water radiating from the house (and under it, keeping it cool) was a sign of mental illness.

At the time I was actively pursuing a project called Cosmopolitan Green Architecture, in which I was
running or trickling water constantly while diverting the flow of my outside taps into small pools,
which I dug with a spade, in which I was breeding Striped Burrowing and Green Tree frogs close to
the house. I have a deliberately forested garden, while Miller has chopped down all the trees on his
block and mows his lawn and trims his hedge regularly with machinery more often than necessary.
When I first experimented with Cosmopolitan Green Architecture in 2012 I ran my outside taps
continuously for several weeks to soften the hard clay soil and landscape the garden. My long-term
plan was to design a series of release points for fresh water to travel down the natural contours of
the land to create a series of streams that would flow into the creeks and Brisbane River, cleaning
them gently and naturally, without the use of heavy machinery. If enough of them were constructed
they would be a defence against further floods of the Brisbane river like those we had in 2012 (when
the Wivenhoe Dam became overfilled) and would also help re-establish native wildlife including
frogs, birds, lizards and other reptiles and insects. Having this water flowing would prevent
mosquitoes, which breed only in stagnant water. By running my front and back taps constantly, I
created small freshwater streams and rock pools around my house which I decorated with my rock

collection (collected over several decades) and plants I bought at Bunnings. I planted several bird-
attracting native plants at this time and tried to establish a small bird sanctuary on my property.

Over the next two years Miller made numerous complaints about me “flooding” my “yard” and his.
The police and psychiatric workers reported that I was “digging trenches in my yard” and that I had
“dug a moat and filled it with glass”. These were then repeated as evidence that I was mentally ill. In
truth I was constructing beautiful rock gardens and pools in which I had the tadpoles of green tree
frogs and striped burrowing frogs. The ponds and streams also attracted forest birds to the garden,
noting that there is no constantly running water in nearby Toohey Forest. All the work was done by
hand and spade, and what they called “trenches” was terracing and small frog ponds laced with
shallow irrigation channels. It is true that when I first ran my taps constantly some water trickled
under the fence between our properties (in 2012) but I fixed up the problem by building small
retaining walls with hard clay. Miller kept complaining about my garden when I stopped running my
taps after doing the necessary landscaping work (partly because of opposition, and partly because of
expense), this time complaining that my forested block of land could be breeding vermin like rats
and mice. These complaints were made to the police, Brisbane City Council, my parents and the
mental health services of the Princess Alexandra Hospital (as well as our local council member). At
one stage he took out a Justice’s Examination Order (JEO) against me, resulting in my being
handcuffed and taken to the Princess Alexandra Hospital for assessment.

With a long psychiatric history, Miller and my father discovered that it was easy to make life difficult
for me by getting me locked up every few months. My father had been getting me locked up by
making false reports about me since 1995, Miller began in 2010, since which time he has had my
father’s mobile phone number and rung my father on numerous occasions. Around the time the
Millers made these false reports to police in September, Miller also rang my father claiming that I
was chasing him in my car. This was after my parents drove, unannounced, to my house but chose to
drive past though I waved for them to stop and come in. When they didn’t, I just went inside my
house – I did not get in my car and follow them as Miller told my father I did after ringing him on his
mobile phone when he knew he was driving, frightening him maliciously.

Jeff Miller has claimed to police that I was “stabbing and slicing” the tree across the road and that I
was doing so to intimidate him. He claimed that I had a home-made knife shaped like a large dagger.
These are false claims. There was no one visible in the street when I walked across the road to the
tree, from which I had removed bark from (for my art and cleaning) several times before. I thought I
would be able to remove larger intact pieces of bark if I cut a horizontal groove from which I could
carefully peel larger sections of bark. I was doing this when I noticed that grass was stifling the roots
of the young tree and cleared some grass away from the trunk. At this stage Sylvia Collis, an elderly
British woman and friend of the Millers who lives with her husband Ken at 72 Fegen Drive pulled up
in a taxi, got out and shouted at me “leave my tree alone”. I said, “It’s not your tree”, but picked up
my things, including the peeled bark and walked back across the road to my home. Ken and Sylvia
are friends of Heidi and Jeff Miller and the four of them have long expressed hostility as well as
racism towards me saying to my face that they wanted me out of the neighbourhood. Miller has
taken to mocking me as mad, and has shouted across the fence that I am a mummy’s boy, and that I
am crazy and need to be in a mental hospital. My neighbour on the other side has called me a “black
bastard”, a “fucking gollywog” and accused me of being crazy and needing to be locked up for good.
Sylvia and Ken have given me Nazi salutes and said “Heil Hitler” to me, and around this time Ken

crossed the road with his fists raised to hit me, though he backed off (and I am not in the habit of
reporting such things to the police). These hostile neighbours ganged up against me in 2015, and
made my mother agree to evict me from the home she had previously said she had bought for me to
live in till I died. They had previously mobbed and harassed my mother about me in 2013 after Miller
had arranged for me to be locked up at the PA Hospital for “running my taps” and my mother came
to my house to secure and inspect the house after I had been locked up.

Nowadays Miller and I rarely speak, although I tried to be friendly to him and his family when my
partner, Sara, and I first moved here in 2008 (and prior to him first reporting me to my father and
the psychiatric system in 2010). I did not know Miller was watching when I walked across the road to
cut a groove in the tree on the footpath opposite our houses in a good mood on my 55th birthday
(22nd September 2015). The knife I had made – the first one I have ever made, was fashioned from a
cleaver-shaped piece of glass, from a sheet I had accidentally stood on and broken. Rather than
throw the glass away, I thought I’d fashion an artistic knife by wrapping paperbark around one end
and pouring PVA glue on it. It was a delicate object and would have broken if I was stabbing or
slashing at the tree. I was trying to carefully cut a groove with the glass knife. I am not in the habit of
making knives and this was an artistic effort on which the PVA glue had just dried the Melaleuca bark
in place and I wanted to see if it was functional. Photos of the tree and the some of the artwork can
be seen in Appendix 1.The police confiscated the knife after they came back to my house after taking
me to the PA Hospital. Regarding Miller, who is recorded by the police as the “victim”, I did not even
see him, though he was obviously watching me from across the road. I was not threatening in any
way and did not carry the knife across the road to intimidate Miller or anyone else.

When I returned to my house I was dirty, having been in the garden before I tried to get the bark
and, leaving the kitchen door open, climbed into the bath, which was mostly full of water, since I
was washing my coin collection with the paperbark. I was in the bath when the police arrived, after
being called by Miller. The police threatened me with Tasers while I was still in the bath and insisted
on handcuffing me and marching me stark naked to the police car. I was driven naked to the PA
Hospital, where I was allowed to put some clothes on before being taken in to Casualty. The QPS has
claimed that they returned me to the hospital on an Authority to Return (ATR) and not because of
the complaint by Miller.

Once I was taken away the police did not secure my house, and persons unknown stole my amplifier
and video camera as well as my memory sticks and then, by his and my mother’s own admission, my
father entered the house with some other men and took all my property from my house (which was
owned by my mother, and bought by her in 2008 against my father’s wishes), loading it into his
trailer with the help of some Tamil men and dumping it, in complete disarray, in a self-storage unit
at the Mount Gravatt Storage King, close to where my parents live and distant from Moorooka,
where I live. He then employed men to “clear around the house”. All my landscaping was bulldozed
and my rock gardens were destroyed. My precious rock collection was left in a pile under the house
and many of my possessions were stolen or thrown away. When I checked the bins after I was
released from the hospital I found that my credit card (including my signature) had been placed at
the top of the yellow-topped bin so it could be stolen, and my art and my daughters’ art had been
torn down from the walls and thrown out along with CDs and DVDs of my work over the years. The
trees and shrubs I had planted around the house, many of which were in flower, were all chopped
down and the fern garden stolen or destroyed. I did not know this was planned by my father when I

was instructed by the psychiatrist Justin O’Brien in an interview in the mental health unit’s
consultation room, that I would never be allowed home, not even on leave, and that my parents had
sold the house. This was based on a note that my father sent to the PA Hospital and O’Brien to this
effect immediately after I was admitted on the 22nd September 2015. This was a patently false claim
and two months later when my mother agreed to allow me to return to my house it had still not
been sold or even put on the market.

I was then confined to the locked ward of the PA Hospital’s mental health unit for two months
where I was forced to take oral antipsychotic drugs and told that the doctors had decided to “start
me on depot” again. I was not allowed to go home even on leave to secure my house and
possessions or to get a change of clothes. Meanwhile my father was arranging the destruction of my
work. I was told that they were re-starting injections of a new and very expensive antipsychotic drug
marketed by Johnson and Johnson called “Invega Sustenna” (paliperidone). This drug is for
schizophrenia and other psychotic disorders and is the active ingredient in Risperidone, which I was
injected with for some months in the past. I have also been forced to take Rispiradone tablets and
other antipsychotic drugs by mouth under threat of worse injections (while in hospital). The drug has
had the effect of making me gain more than 10 kg of weight in the past year, and is known to
increase the risk of diabetes, of which disease I have a strong family history. Paliperidone and
Rispiradone also have the adverse effects of completely sterilizing me and grossly reducing or
stopping completely my ejaculate. They make me tired and dull my motivation and creativity. They
are, however, much better (in terms of side effects) than the haloperidol that was injected into me
in the 1990s. This drug rendered me severely Parkinsonian as well as akathesic (physically restless),
apathetic, listless, and impotent. The effects wore off once the drugs were out of my system. There
has never been a clinical or psychiatric justification for this drugging, and I have always been in
better health when off them.

Charge of Causing a Public Nuisance

The charge of causing a public nuisance is based on a misleading report by Jeff Miller’s wife Heidi
about an altercation I had with her on 19 September 2105. I was angry at her husband for
repeatedly making false and misleading reports about me to the authorities that resulted in my
being locked up and told her I thought it was her husband who should be charged by the police. I did
not threaten her and I did not spit on her as she has claimed (she actually said that I shouted at her
from so close that spit went on her face – when I raise my voice I do not spit, having many years of
experience with microphones on stage. Perhaps she has been watching too many cartoons). An
argument between neighbours does not constitute a public nuisance and there were no members of
the public present at this dispute between neighbours and the charges should, I submit, be dropped
or, if it comes to court, dismissed.

Conclusion:

I am the clear victim in my acrimonious relationships with my father and my neighbours, the Millers.
I have endured many weeks of being locked up and stigmatised as a mental patient because of them
and am still on an ITO because of my father’s influence over the PA Hospital, where he worked as a
senior consultant physician from 1976 to 2001 (when he was asked to leave because of his
troublemaking). I have good relationships with the people of Moorooka, other than my immediate
neighbours who have displayed open prejudice against me for many years. In addition I am a good
Australian and global citizen, who has fought against the terrorism of the Tamil Tigers for many years
but otherwise been engaged in providing education and health advice, writing, creating music and
art and beautifying my house and garden. My father has relentlessly tried to destroy my credibility
and physically vandalised my home office and my beautiful garden in 2015, when I was locked up for
two months and drugged with such huge doses of depot antipsychotic drugs that the PA Hospital
pharmacist questioned it and refused to comply with the doctor’s orders at one stage. I am still
being injected monthly with paloperidone, though the dose has been lowered and I am feeling
better as a result of this.

Regarding the conspiracy to falsely imprison me, I have other evidence to support this serious charge,
including letters and faxes sent by my father and the hospital notes from the PA Hospital as well as
the Monash Medical Centre and Alfred Hospital in Melbourne, where my father engineered my false
confinement and drugging on numerous occasions between 1995 and 2008, when I returned to
Brisbane, following which he has organized my imprisonment in the PA Hospital and also tried to get
me locked up in jail for breaching a “domestic violence order” when I have never been violent, while
he has been an ardent supporter and promoter of the violence of the Tamil Tigers as well as
subjecting the close members of his family to physical and mental abuse.

I ask therefore that the charges against me be dropped and investigations commenced into the
crimes of my father, Brian Senewiratne, that I have reported in this submission. I believe there are
grounds for prosecuting Brian Senewiratne and Jeff Miller for conspiracy to falsely imprison,
conspiracy to defame, vandalism and lying to police. There is also the matter of the theft of my
stereo amplifier and video camera, as well as some of the coins in my coin collection. When I
retrieved by jumbled property from storage, these things as well as some of my SD cards and USB
memory sticks, as well my garden tools, for some reason, were missing. In the past Jeff Miller had
complained to the police about the loudness of my music, and also expressed displeasure at my
filming him with a videocamera and my gardening and landscaping efforts. I submit that he should
be questioned about my missing property.
