Case No. 3:16-cr-00051-BR

NOTICE TO THE COURT THAT
IMPORTANT DEFENSE WITNESSES
HAVE LEFT AND BEEN RELEASED
FROM SUBPOENA DUE TO THE
COURTS MICROMANAGEMENT OF
THE DEFENSE
Judge: Hon. Anna J. Brown

NOTICE IS HEREBY GIVEN that important Defense witnesses, which the Defense was
relied on for an effective presentation of its defense, have left Portland and/or been
released from subpoena due to the Courts micromanagement of the Defense case.
The Court has applied a number of unusual, extreme impositions on the defense
which were not imposed on the prosecution. Specifically, the Court has ruled repeatedly
that testimony regarding the demeanor and behavior of the Defendants is cumulative,
that evidence of the cleanliness and orderliness of the Refuge (except that which is relied
upon by the prosecution) is cumulative, and that testimony regarding militarization and
other conditions in the town of Burns is irrelevant.
Pursuant to the Courts directives, John Parker, an important defense witness from
southwestern Oregon, has been released and has gone home.

John Parker, a member of the Pacific Patriot Network, would have testified about
an extreme escalation of military and government paramilitary personnel and equipment
around the MWR in mid January 2016. He would have testified that hospitals throughout
Oregon had been put on notice to expect bodies and that large amounts of blood or
plasma had been ordered by local medical professionals in anticipation of an approaching
bloodbath.
Parker would have further testified that he communicated these facts to Ammon
Bundy and other defendants, and that this communication led Ammon Bundy to seek deescalation and offers of peace to the FBI.
This testimony would have refuted and rebutted components of the governments
case in chief.
Respectfully submitted this 13h day of October 2016.
