BORCILLO, CESO V SchopiS Division Superintendent RE : MOONLIGHTING AND PRIVATE PRACTICE OF PROFESSION Date 30 October 2015 1. Under Republic Act 6713 and its Implementing rules and regulations engagement in the private practice of profession by public officials and employees is a ground for administrative disciplinary actions. Unless authorized by the law or regulation, provided further that such practice shall not conflict or tend to conflict with official functions. 2. Section 12 of Rules XVIII of the Revised CSC Rules requires government employees to obtain a permit from the head of the Department, to wit: Sec 12. No officer or employee shall engage directly in any private business, vocation or without a written permission from the head of the Department. Provided that this prohibition sill be absolute in the case of those Officers whose duties and responsibilities require that their entire time be at the disposal of the government. Provided further, that is an ‘employee is granted permission to engage in outside activities, the time so devoted outside the Office will not impair in any way the efficiency of, the other Officer or employee.” 3. DepEd Order No 5, Series of 2008 identified the approving authorities on requests for permission to teach, exercise of profession or engage in business outside office hours. Pursuant to paragraph E of the said Order, itis the Schools Division Superintendent who is the approving authority on the requests for permission to teach or practice of profession by school personnel and Division Office personnel. 4, Accordingly and pursuant to CSC circulars, Republic Act 6713 and RA 3029, all are enjoined to adhere to the following:(ON TEACHING JOB. ‘There shall be absolutely no teaching by goverment officials and employees during Office hours even if time spent is covered by corresponding vacation leave. If permission is granted, teaching load shall be limited to twelve (12) hours a week and in no case shall a government employee be allowed to teach more than three hours a day on regular working holidays (Monday to Friday). No Official or employee shall be allowed to teach in any school or institution over which he directly or indirectly exercises jurisdiction, control, supervision, or influence by reason of his office or position in the Goverment as prohibited under Anti-graft and Corrupt practices act. Officials and employees applying for permission to teach must be physically fit in order not to prejudice the performance of their duties and for this purpose, they shall submit with their applications a record of their physical and medical examination showing fitness, duly certified by government physician. Request of teachers for permission to teach or practice of profession shall be accompanied bya statement of his/her official loads with the schedule, signed by the School Head; To ensure compliance to the load limitation, the applicant shall submit a certification from the authorized official of the private school or entity, where the profession is practiced, as her to his/her official loads with corresponding number of units and the schedule, addressed to the concerned Schools Division Superintendent; ‘The permission shall be good for one school year except for college teaching which shall be per semestral ba: Permission to teach may be withdrawn or revoked anytime whenever the exigencies of the service so require, or if the herein conditions prescribed has been violated. This is without prejudice to administrative disciplinary action for violation hereof and in case of misrepresentations on the part of the applicant. (OTHER JOBS No official or employee shall hold in any school, college, university any position or assignment involving management or administrative duties and/or responsibilities; Private schools engaging the services of public school teachers and employees after Official time shall observe the limitation. The certification on load shall be deemed an Official action of the school concerned unless proven otherwise. As such, any untruthful certification on load ‘or any entry thereof shall be acted accordingly. Moonlighting shall be dealt with in accordance with the law and rules. For immediate dissemination.
