AN ORDINANCE PENALIZING ALL PRIVATE AND PUBLIC VEHICLES WITHIN THE
MUNICIPALITY OF LEZO, AKLAN FOR USING MODIFIED MUFFLERS WHICH
CREATES IRRITATING, EXCESSIVE SOUND WHICH RESULTS TO NOISE
POLLUTION
Be it ordained by the Sangguniang Bayan of Lezo, Aklan that:
ALL VEHICLES USING MODIFIED MUFFLERS OTHER THAN THAT OF THE
ORIGINALLY INSTALLED BY THE MANUFACTURES OF SUCH VEHICLE ARE
PROHIBITED FROM PLYING ALL PRIMARY, SECONDARY AND BARANGAY
ROADS WITHIN THE MUNICIPALITY OF LEZO, AKLAN.
Section 1. Prohibited Act
An act committed by the vehicle owners/operators, drivers for using modified mufflers
which create excessive and irritating sound which result to noise pollution within the
Municipality of Lezo, Aklan;
Section 2. Declaration of Policy
It is the policy of this municipality to see to it that all existing laws, rules, regulations,
decrees, ordinances and resolutions promulgated by authorities be observed and
respected;
Section 3. Enforcement Clause
The Philippine National Police, the Local Chief Executive, duly deputized nongovernment organization;
Section 4. Penalty
Violation of this Ordinance shall be punished or meted the following:
1.
For the first offence, the offender shall pay a fine of P500.00, wherein the motor
vehicle shall be impounded for one (1) day at the Lezo PNP Headquarters;
2.
For the second offence, the offender shall pay a fine of P800.00, wherein the
motor vehicle shall be impounded for two (2) days at the Lezo PNP Headquarters;

3.
For the third offence, the offender shall pay a fine of P1,500.00, wherein the motor
vehicle shall be impounded for three (3) days at the Lezo PNP Headquarters;
4.
The MTOP of public motor vehicles such as tricycles, jeeps or other mode of
public transportation within the municipality shall be automatically cancelled. Pending
the restoration of its original muffler.
5.
After serving corresponding penalty of each offence, the offender of this Ordinance
will be given a maximum period of three (3) days to restore, replace, or repair its original
muffler.
Section 5. Repealing Clause
All ordinances, rules and regulations, or parts thereof, whose provisions are in conflict
with or contrary to the provisions of this ordinance are hereby repealed, amended and
modified accordingly;
Section 6. Effectivity Clause
This ordinance shall take effect upon its approval;
RESOLVED FURTHER, let copy of this Resolution be immediately furnished all
parties concerned;
