AWARD

This was an application for an order of non-compliance of Article 12

clause (2) of the collective agreement dated 28 April 2008 between Sime Darby
Industrial Sdn. Bhd. (hereinafter referred to as the

respondent) and the

National Union of Commercial Workers (hereinafter referred to as the

complainant), cognizance number 138/2008.

The matter was resolved amicably and a consent award was entered as
follows :-

1.

The company has re-designated and transferred the

workman, Mr. Perumal Muthusamy as Documentation
Clerk

(Clerical

Grade

1)

to

the

Marketing

and

Administration Department.

2. The above re-designated and transfer has taken effect on

April 1, 2010 via the letter issued on March 31, 2010.

3. Mr. Perumal Muthusamy has accepted the above redesignation

and

transfer

to

the

Marketing

and

Administration Department without any objection.
