(a)makeappointments,ordertransfers,takedisciplinaryactionanddealwithotherservicemattersin

respectofthemembersoftheprescribedlocalgovernmentservicecadre
(b)setupandoperatepensionfundandsuchotherfundsasmaybeconsiderednecessaryforthebenefit
andwelfareoftheemployeesoftheBoardandtheprescribedlocalgovernmentservicecadreand
(c)performsuchotherfunctionsasmaybeprescribed.
(7)ThebusinessofBoardshallbeconductedinsuchmannerasmaybeprescribed.
126.Dissolutionoflocalgovernments.(1)Notwithstandinganythingtothecontrarycontainedinsection
30, where, before the expiry of the term of the local governments, the general elections for National or
ProvincialAssemblyareannounced,theGovernmentmay,bynotificationintheofficialGazette,dissolvethe
localgovernments.
(2)Onthedissolutionofthelocalgovernmentsundersubsection(1),allpowersandfunctionsofthelocal
governmentsshallbeexercisedandperformedbysuchpersonsorauthoritiesastheGovernmentmayappointin
this behalf as Administrators and the funds and properties belonging to the local governments shall vest in
Governmenttillsuchtimetheelectedlocalgovernmentsassumeoffice.
CHAPTERXVII
LOCALGOVERNMENTPROPERTY
127.Ownershipofimmovableproperty.(1)Subjecttoanyreservationsmadeoranyconditionsimposedbythe
Government,thepropertyspecifiedbelowshallvestintherespectivelocalgovernmentifitis
(a)vestedinthelocalgovernmentthroughsuccessionasprovidedinsection3
(b)transferredtothelocalgovernmentbytheGovernmentoranyotherauthority,organisationoran
individual
(c)constructedoracquiredbythelocalgovernmentwithitstitleand
(d) a road, street or any other immovable property developed by the local government for public
purposeswithexpressorimpliedconsentoftheowner.
(2)UntilotherwisedirectedbytheGovernment,thepropertiesoftheGovernmentinpossessionofthelocal
governmentsestablishedunderPunjabLocalGovernmentOrdinance,2001(XIIIof2001)shallpassontotheir
successorsasprovidedinsection3.
(3)Thesuccessorlocalgovernmentsshall,subjecttopolicyoftheGovernmentorcontractualobligations,
makebyelawsfortheuse,developmentandmanagementofthelocalgovernmentproperties.
(4)TheGovernmentshallnot,exceptwiththepriorconsentofthelocalgovernment,transferanimmovable
propertyvestedinthelocalgovernment.
128. Transfer of property by the Government. Subject to such conditions as may be prescribed, the
Governmentmay,onitsownaccordoronarequestbyalocalgovernment,transferthemanagementofnazul
land,auqaflandoranyotherGovernmentorpublicpropertytoitforadministrationasatrustee.
129.Stocktakingbythelocalgovernment.(1)EverylocalgovernmentshallonceineveryyearinJuly,take
thephysicalstockofitsmovableandimmovablepropertiesandpublishthereportintheprescribedmanner.
(2)Thereportreferredtoinsubsection(1)shallcontain
(a)particularsofthepropertiesheldduringtheprecedingyear
(b)totalvalueoftheproperty,annualreturntherefromandchangeinitsvalue,ifany
(c)particularsofunserviceablearticles
(d)particularsoflosses,ifanyand
(e)proposalforutilization,developmentandimprovementduringthefollowingyear.
130.Useofpropertiesoflocalgovernments.(1)Thepropertiesoflocalgovernmentsshallbeusedonlyfor
publicpurposes.
(2)Subjecttothissection,alocalgovernmentshallnotsellorpermanentlyalienateanyofitsimmovable
property.
(3)Alocalgovernmentmaygrantleaseofitsimmovablepropertythroughcompetitivebiddingbypublic
auctionintheprescribedmanner.
(4)TheGovernmentmayconstituteaCommitteeheadedbytheChiefOfficerofthelocalgovernmentto
identifytheencroachedorredundantpropertiesofalocalgovernmentthatmaybesoldintheprescribedmanner
withtheapprovaloftheGovernmentandthefundsgeneratedfromthesaleofsuchpropertiesshallbekeptina

separateaccountandbeusedonlyforpurposesofdevelopment.
(5) The movable property of a local government which is required to be disposed of shall be sold through
competitivebiddingbypublicauction.

131. Acquisitionofimmovableproperty.(1)Whenever any local government considers it necessary or


expedientitmayacquireanyimmovablepropertyforapublicpurpose.
(2) A local government may, in the prescribed manner, purchase an immovable property through an
agreementwhensuchpropertyisrequiredforapublicpurpose.

CHAPTERXVIII
OFFENCESANDENFORCEMENT
132. Offences, punishments and their cognizance. (1) The offences specified in Fourth and Fifth
Schedules shall be liable to punishment by way of imprisonment, fine, seizure, forfeiture, confiscation and
impoundingandsuchotherpenaltiesasareprovidedinthisAct.
(2)Ifapersoncommitsanoffencespecifiedin
(a)PartIofFourthSchedule,suchpersonshallbepunishablewithimprisonmentforatermwhichmay
extendtosevenyears,orwithfinewhichmayextendtofivehundredthousandrupeesorwithboth
andwhereanaccusedwasdirectedbytheInspectorforimmediatediscontinuanceoftheoffence,the
Court may impose a further fine which may extend to fifty thousand rupees for every day for the
periodtheaccusedhaspersistedintheoffencefromthedateofitscommission
(b)PartIIofFourthSchedule,suchpersonshallbepunishablewithimprisonmentforatermwhichmay
extendtothreeyears,orwithfinewhichmayextendtoonehundredthousandrupeesorwithboth
andwhereanaccusedwasdirectedbytheInspectorforimmediatediscontinuanceoftheoffence,the
Court may impose a further fine which may extend to ten thousand rupees for every day for the
periodtheaccusedhaspersistedintheoffencefromthedateofitscommission
(c)PartIIIofFourthSchedule,suchpersonshallbepunishablewithimprisonmentwhichmayextendto
six months or fine which may extend to twenty five thousand rupees or with both and where an
accusedwasdirectedbytheInspectorforimmediatediscontinuanceoftheoffence,theCourtmay
impose a further fine which may extend to five hundred rupees for every day for the period the
accusedpersistedintheoffencefromthedateofitscommissionand
(d)FifthSchedule,suchpersonshall,inthefirstinstance,beliabletofinebyissuingaticketspecifiedin
SixthScheduleandwhereanaccusedrepeatstheoffencewithinaperiodofthreemonthsforwhich
theaccusedwassubjectedtofine,heshallbeliabletothesamepunishmentasprovidedinclause(c).

[(2A)IfanoffenceofillegaldumpingofsolidwasteandrefuseunderPartIIoftheFourthScheduleis
committedbyapersonforthefirsttime,heshallbeadministeredawarninginwritingand,incaseherepeats
theoffencewithinoneyearfromearliercommission,heshallbepunishedwithimprisonmentwhichmayextend
to three years but which shall not be less than seven days, and with fine which may extend to one hundred
thousandrupeesbutwhichshallnotbelessthantwentythousandrupeesand,whereanaccusedwasdirectedin
writingbytheInspectorforimmediatediscontinuanceoftheoffence,theCourtmayimposeafurtherfinewhich
mayextendtotenthousandrupeesforeverydayfortheperiodtheaccusedhaspersistedintheoffencefromthe
dateofitscommission.]
(3)Theoffencesspecifiedinclauses(a)and(b)ofsubsection(2)shallbecognizableandinformationinthis
regardshallbeforwardedtotheofficerinchargeofapolicestationbytheInspectorafterpriorapprovalofthe
ChiefOfficerforregistrationofacaseagainsttheaccusedinaccordancewiththeprovisionsofsection154of
theCode.
(4)A Courtshalltakecognizanceoftheoffencesspecifiedinclause(c)ofsubsection(2)onacomplaint
madeinwritingbytheInspectorafterpriorapprovaloftheChiefOfficerinaccordancewiththeprovisionsof
section200oftheCode.
(5)TheoffencesspecifiedinPartIIIofFourthScheduleandFifthScheduleshallbetriedinasummarymannerin
accordancewiththeprovisionsofsection260to265oftheCodebutthelimitofpunishmentmentionedinsubsection
(2)ofsection262oftheCodeshallnotbeapplicable.
(6)ThefinesimposedbyaCourtforanoffencespecifiedinFifthScheduleshalloncollectionbedeposited
inthePublicAccountofthelocalgovernment.

(7) The Government may, by notification in the official Gazette, entrust to a local government the
enforcementofanyotherlaw.

133.AppointmentandcontrolofInspectors.(1)TheMayorortheChairmanshall,withtheapprovalof
the local government, authorize the officials of the local government as Inspectors for the enforcement of the
offencesspecifiedintheSchedules.
(2)TheprescribedofficershallbethecontrollingauthorityandadministrativeheadofanInspectorandthe
InspectorshallreporttotheofficerfortheenforcementofprovisionsofthisChapter.

134.Impositionoffinethroughticketing.(1)NotwithstandinganythingcontainedinthisChapter,where
any person, in the opinion of an Inspector, is contravening any provision of the law relating to the offences
specifiedinFifthSchedule,theInspectorshallchargetheaccusedbyissuingaticketintheprescribedformfor
paymentoffinespecifiedinSixthSchedule,ifsuchoffencehasbeencommittedforthefirsttimebytheaccused
withinthreemonths.
(2)Theticketreferredtoinsubsection(1)shallbeissuedinquadruplicatebydeliveringthreecopiestothe
accusedafterobtaininghissignaturesorthumbimpressiononthefourthcopytoberetainedbytheInspectorfor
record.
(3)Thefinemaybedepositedinthebankaccountofthelocalgovernmentwithintendaysfromthedateof
impositionoffineforcreditinthePublicAccountofthelocalgovernment.
(4)Thepersontowhomatickethasbeenissuedunderthissectionmayeithercontesttheimpositionoffinein
the Court within ten days from the date of the issuance of the ticket or deposit the fine within that period and
provideacopyofpaymentreceipttotheofficeofthelocalgovernment.

135. Court proceedings for default in deposit of fine. (1) The prescribed officer shall, on daily basis,
provideascrollofallunpaidticketstotheCourt.
(2)TheCourtreceivingthescrollshallissuesummonstotheaccusedforthwithstatingthedateofhearing
for summary trial in accordance with the provisions of section 260 to 265 of the Code but the limit of
punishmentmentionedinsubsection(2)ofsection262oftheCodeshallnotbeapplicable.
(3)Whereonthefirstdateofhearing,theaccusedappearsbeforetheCourtandproducestheproofofdepositof
fine,orunconditionallyadmittinghisfailure,depositsthefineforthwithalongwiththepenaltywhichshallnotbe
less than ten percent and not more than twenty five percent of the amount of fine determined by the Court in
accordancewiththeprocedureprovidedinsubsection(2)ofsection388oftheCodefurtherproceedingsagainstthe
accusedmaybedroppedandnoconvictionshallberecordedagainsthim.
(4)UponthefailureoftheaccusedtoappearbeforetheCourtinresponsetothesummonsissuedbyit,theCourt
shallforthwithissuewarrantsforarrestoftheaccusedanduponissuanceofsuchwarrantstheaccusedwillbeliable
topunishmentunderclause(c)ofsubsection(2)ofsection132.

136. Compounding of offences. Subject to this Act, a local government shall constitute a committee
consistingoftheMayorortheChairmanasitsConvener,anofficerofthelocalgovernmentandamemberof
thelocalgovernmentasitsmembersforcompoundingtheoffencesintheprescribedmanner.

137.MunicipalWardens.(1)Alocalgovernment,otherthanaUnionCouncil,may,withthepriorapproval
oftheGovernment,establishandmaintainMunicipalWardensintheprescribedmanner.
(2)TheGovernmentmay,notwithstandinganythingcontainedinthePoliceOrder,2002,orinanyother
law,specifythedutieswhichsuchforcemayberequiredtoperform.

138.GeneralpowersofInspectors.(1)Incaseofanyseriousthreattothepublichealth,safetyorwelfare
ordangertolifeandproperty,orwhereviolationofanyruleorbyelawisbeingcommitted,theInspectormay,
inhisareaofjurisdiction,inadditiontoimpositionoffineorinitiatingprosecutionunderthisAct
(a)suspendanywork
(b)seizethegoods
(c)sealthepremises
(d)demolishorremovetheworkor
(e)issuedirectionsfortakingcorrectivemeasureswithinthespecifiedtime.

(2)AnInspectorshallnotenteranydwellingunitwithoutpermissionoftheoccupierortheCourt.
(3)AnInspectorauthorizedundersection133may,inrelationtotheoffencesspecifiedinFourthSchedule
(a)issuenoticesinwritingonbehalfofthelocalgovernment
(b)initiatelegalproceedingsintheCourtand
(c)assistindefendinglegalproceedingsinitiatedagainstthelocalgovernment.

139.Rightsofcitizennotaffected.NothingcontainedinthisChaptershallrestrictorlimittherightofthe
citizensorresidentsofalocalareatobringanysuitorotherlegalproceedingsagainstanylocalgovernment,its
officersorotherfunctionariesviolatinghisrightsprovidedbyanylaw.

CHAPTERXIX
MISCELLANEOUS
140.Righttoinformation.(1)Subjecttoanyreasonablerestrictionsimposedthroughrules,apersonmay
seekanyinformationinpossessionofalocalgovernment.
(2)Everydesignatedfunctionaryofalocalgovernmentshall,withinfifteendaysofanapplication,provide
requisiteinformationtotheapplicantonpaymentofsuchfeeasmaybeprescribed.
(3)Alocalgovernmentshall,onquarterlybasis,publishonitswebsiteoratprominentplaceinformation
aboutthestaffingandtheperformanceoftheofficesofthelocalgovernmentduringtheprecedingthreemonths.
(4) A local government shall maintain records in the prescribed manner with the special emphasis on
electronicrecordkeeping.

141. Municipal entities. (1) A local government other than a Union Council, with the approval of the
Government, may establish an authority, agency or company answerable to the local government for the
performanceofmunicipalfunctions.
(2)A local government, other than a Union Council may, with the approval of the Government and in
coordinationwithanyotherlocalgovernment,establishanauthority,agencyoracompanyforanareacovering
morethanonelocalgovernment.
(3)Anentityestablishedunderthissectionshallbesubjecttosuchcontrolasmaybeprescribed.

142.Localgovernmentservants.(1)Notwithstanding anything contained in any other law, the Government


shall,intheprescribedmanner,createaservicecadreforalocalgovernmentoragroupoflocalgovernments.
(2)Themembersofthefollowingservicesshallcontinuetoworkinthelocalgovernments
(a)membersoflocalcouncilserviceappointedunderthePunjabLocalCouncil(AppointmentandConditions
ofService)Rules,1983
(b)servantsofthelocalgovernmentsappointedunderthePunjabLocalCouncilServants(Service)
Rules,1997and
(c)employeesappointedunderthePunjabLocalGovernmentDistrictService(Tehsil/TownMunicipal
AdministrationsCadre)Rules,2005and
(d)employeesoftheHealthandEducationDepartmentsdevolvedunderthePunjabLocalGovernment
Ordinance,2001(XIIIof2001).
(3)AlocalgovernmentotherthanaUnionCouncilmay,intheprescribedmanner,absorbanemployee
mentionedinsubsection(2)withtheconsentoftheemployeeagainstanequivalentpayscale.

143.Appeals.Apersonaggrievedbyanyorderpassedbyalocalgovernmentoritsfunctionariesmayprefer
anappealtosuchauthority,insuchmannerandwithinsuchtimeasmaybeprescribedandanorderpassedin
appealshallbefinal.

144.Powertomakerules.(1)TheGovernmentmay,subjecttopreviouspublicationandbynotificationin
theofficialGazette,makerulesforcarryingoutthepurposesofthisAct.
(2)Inparticularandwithoutprejudicetothegeneralityoftheforegoingpowers,suchrulesmayprovidefor
alloranyofthemattersspecifiedinPartIofSeventhSchedule.
(3)Therulesmadeundersubsection(1)shallmeetthefollowingconsiderations:
(a)consistencywithdemocraticdecentralisation
(b)enhancementofwelfareofthepeople

(c)fairnessandclarityand
(d)naturaljusticeanddueprocessoflaw.

forreasonstoberecorded,dispensewiththerequirementofpreviouspublicationrequiredundersubsection(1).]

145. Byelaws. (1) A local government may, and if required by the Government shall, make byelaws not
inconsistentwiththisActandtherulestogiveeffecttotheprovisionsofthisAct.
(2) The byelaws made by a local government shall come into force from the date the byelaws are
publishedintheofficialGazetteoronthewebsitespecifiedbytheGovernment.
(3)Inparticularandwithoutprejudicetothegeneralityoftheforegoingpower,thebyelawsmayprovide
foralloranyofthemattersspecifiedinPartIIofSeventhSchedule.

146. Delegation of powers. (1) The Government may, subject to such conditions as may be specified,
delegate any of its functions under this Act to an officer subordinate to it except the power to make rules, to
suspendorremoveaMayororChairmanortodissolvethelocalgovernments.
(2)Subject to the rules, a local government may delegate any of its powers, including financial powers
under this Act or rules or byelaws to the Mayor, Chairman, Deputy Mayor or Vice Chairman or any of its
members or officers as it may deem fit, except the powers to make byelaws and to pass annual or revised
budget.

[146A. Companies for cattle markets. (1) Notwithstanding anything contained in this Act, the
GovernmentmayestablishaCompanyundertheCompaniesOrdinance,1984(XLVIIof1984)forestablishing
andmaintainingacattlemarketforanareaconsistingoftwoormoreDistricts.
(2)Alocalgovernmentshallnotorganize,establishandmaintainacattlemarketwithouttheconsentof
theCompanyestablishedundersubsection(1).
(3)All the Chairmen and Mayors of the local governments, except the Chairmen of Union Councils or
AuthoritiesintheareaofaCompany,shallbemembersoftheCompany.
(4)Acattlemarketestablishedundersubsection(1)shallbedeemedtobeacattlemarketorganizedbya
localgovernmentundersections77,81orsection87ofthisAct.

147.Actiontakeningoodfaith.Nosuit,prosecution,orotherlegalproceedingsshalllieagainstanypublic
servantservinginalocalgovernmentforanythingdoneingoodfaithunderthisAct.

148. General powers of local governments.Notwithstanding any specific provision of this Act, a local
governmentshallperformitsfunctionsconferredbyorunderthisActandexercisesuchpowersandfollowsuch
proceduresasareenumeratedinEighthSchedule.

149.Membersandservantsoflocalgovernmentstobepublicservants.Everymemberandeveryservant
ofalocalgovernment,andeveryotherpersondulyempoweredtoactonbehalfofalocalgovernment,shallbe
deemed to be a public servant within the meaning of section 21 of the Pakistan Penal Code, 1860 (XLV of
1860).

150.Baragainstemployment.TheMayor,Chairman,DeputyMayor,ViceChairmanoramemberofalocal
governmentshallnotbeemployedundersuchlocalgovernmentforaperiodofoneyearfromthedateonwhich
heceasestobetheMayor,Chairman,DeputyMayor,ViceChairmanormember.

CHAPTERXX
TRANSITIONALPROVISIONS
151.Interimauthorities.(1)OncomingintoforceofthisAct,anyoffice,authorityoralocalgovernment
established under the Punjab Local Government Ordinance, 2001 (XIII of 2001) shall continue providing
serviceswithoutanyinterruptionuntilalocalgovernmentisestablishedunderthisActforthelocalarea.
(2)AllfunctionariesofalocalgovernmentestablishedunderthePunjabLocalGovernmentOrdinance,2001
(XIII of 2001) shall continue to perform their respective duties and responsibilities with the successor local

governmentunderthisAct,untiltransferredtoanyotherlocalgovernment.
(3) The Government shall appropriately reorganize the authorities, agencies and bodies of the local
governmentsestablishedunderthePunjabLocalGovernmentOrdinance,2001(XIIIof2001)anddecentralize
suchauthorities,agenciesandbodiestothelocalgovernmentsestablishedunderthisAct.

152.Interimmaintenanceofinstitutions.WhereontheenforcementofthisActinanyarea,anyservice
undertakenorinstitutionmaintainedbytheGovernmentisrequiredunderanyoftheprovisionsofthisActtobe
compulsorilyundertakenormaintainedbyalocalgovernment,suchserviceorinstitutionshall,notwithstanding
anything contained in this Act, continue to be undertaken or maintained by the Government until the
managementthereofistransferredtothelocalgovernment.

153.Financialtransition.(1)Alltaxes,cesses,fees,rates,rents,tollsorchargeswhichwerebeingcharged,
levied and collected by any office of a local government under the Punjab Local Government Ordinance, 2001
(XIIIof2001)shallcontinuetobecharged,leviedandcollectedunderthisActbythesuccessorlocalgovernment
andeverypersonliabletopaysuchatax,cess,fee,rate,rent,toll,chargeoranyarrearofthetax,cess,fee,rate,
rent,tollorchargeshallcontinuetomakethepaymentuntilsuchtax,cess,fee,rate,rent,tollorchargeisrevised,
withdrawnorvariedunderthisAct.
(2)Where any local government established under the Punjab Local Government Ordinance, 2001 (XIII of
2001) was receiving any grant or any compensation in lieu of Octroi or Zila tax, the successor local government
underthisActshallcontinuetoreceivesuchgrantorcompensation.
(3)WherealocalgovernmentassumestheofficeunderthisActforthefirsttime
(a)theGovernmentshall transfer grantsto the local government onthe basis ofaninterimPunjab
FinanceCommissionAwardannouncedbyaninterimcommitteeconstitutedbytheGovernmentand
(b)itsbudgetforthefinancialyearduringwhichitassumestheofficeshallrelatetotheremaining
periodofthatyearandprovisionsregardingbudgetunderthisActshall,asfaraspossible,applyto
suchabudget.
(4)Onallocation,reallocationortransferoftheemployeesoftheGovernment,localcouncilservice,Tehsil/Town
Municipal Administration cadre, City District Government, District Government, Tehsil/Town Municipal
Administration and Union Administration or any other body of any local government established under the Punjab
LocalGovernmentOrdinance,2001(XIIIof2001),thesalaries,emolumentsandpensionsofsuchemployeesshallnot
bereducedonsuchallocation,reallocationortransfer.
(5)TheGovernmentshallensurepaymentofsalariesandotheremolumentsoftheemployeesreferredtoin
subsection(4)tillsuchtimeastheGovernmentmaydeemappropriate.

[153A. Transitional arrangement. Until a Union Council is notified under the Act, the respective
Metropolitan Corporation, Municipal Corporation or District Council shall perform the functions of the Union
Council.]

154. Repeal and saving. (1) The Punjab Local Government Ordinance, 2001 (XIII of 2001) is hereby

repealed .
(2)SaveasotherwisespecificallyprovidedinthisAct,nothinginthisActshallaffect orbe deemedto
affectanythingdone,actiontaken,investigationorproceedingscommenced,order,rule,regulation,byelaws
appointment, conveyance, mortgage, deed, document or agreement made, tax or fee levied, resolution passed,
directiongiven,proceedingstakenorinstrumentexecutedorissued,underorinpursuanceofthePunjabLocal
GovernmentOrdinance,2001(XIIIof2001)andanysuchthing,action,investigation,proceedings,order,rule,
regulation, byelaws, appointment, conveyance, mortgage, deed, document, agreement, tax, fee, resolution,
direction,proceedingsorinstrumentshall,ifinforceatthecommencementofthisAct,continuetobeinforce,
andhaveeffectasifitwererespectivelydone,taken,commenced,made,directed,passed,given,executedor
issuedunderthisAct.
(3)TheLocalGovernmentBoardestablishedunderthePunjabLocalGovernmentOrdinance,1979(VIof
1979) for the administration of officers and officials of the local council service and Tehsil/Town Municipal
AdministrationcadreshallcontinuetofunctiontilltheBoardisreconstitutedunderthisAct.

155.Removalofdifficulty.TheGovernmentmay,withintwoyearsofthecommencementofthisAct,by
orderconsistentwiththisAct,providefortheremovalofanydifficultywhichmayariseingivingeffecttothe
provisionsofthisAct.

156.AmendmentofSchedules.TheGovernmentmay,bynotificationintheofficialGazette,amendthefines
specifiedintheFifthScheduleorexcludeanyoffencefromtheFourthScheduleorFifthSchedule.

GENERALPOWERSOFLOCALGOVERNMENTS
Animals
1.Prohibitionofpicketingortetheringinstreets.Noanimalshallbepicketedortetheredinsuchstreetsor
placesasmaybespecifiedbythelocalgovernmentandanyanimalfoundpicketedortetheredinanysuchstreet
orplaceshallbeliabletoseizureandimpounding.

2.Prohibitionagainstkeepingandmaintainingcattle.(1)Notwithstandinganythingcontainedinanyother
laworanyagreement,instrument,customorusageordecree,judgmentororderofanycourtorotherauthority,
thelocalgovernmentmaydeclareanypartofitslocalareaasaprohibitedzone.
(2)Atanytimeafteradeclarationundersubparagraph(1)hasbeenmade,thelocalgovernmentmay,by
generalorspecialnotice,prohibitthekeepingandmaintainingofthecattlebyanypersonintheprohibitedzone.
(3)Nopersonshall,aftertheexpiryoftheperiodfixedundersubparagraph(2),keepormaintaincattlein
anypartoftheprohibitedzone:
Providedthattheprohibitionshallnotapplyto
(i)cattlekeptbonafideforsacrificialpurposes
(ii)cattlekeptfordrawingcartsoruseinmills,withthepermissionofthelocalgovernmentandsubjectto
suchconditionsasitmayimpose
(iii)cattleundertreatmentinanyveterinaryhospital

[(iv)cattlebroughttoacattlemarketand]
(v) cattle brought to a slaughterhouse or kept by butchers for purposes of slaughter within the area
demarcatedbythelocalgovernment.
(4)Personsaffectedbytheprohibitionorderundersubparagraph(2)tomeettheirgenuineneedsmaybe
allowedtokeepandmaintaintheircattleattheplacesearmarkedascattlecoloniesbythelocalgovernmenton
suchtermsandconditionsasitmayimpose.

3.Dangerousanimals.Alocalgovernmentmay,bybyelaws,definetheanimalswhichshallbedeemedtobe
dangerous animals and the circumstances under which animals not otherwise dangerous shall be deemed to be
dangerousandsuchbyelaws,amongothermatters,mayprovideforthedetention,destructionordisposalotherwise
ofsuchanimals.

4. Disposal of carcasses. Whenever an animal in the charge of a person dies, otherwise than by being
slaughteredforsaleorconsumptionorforsomeotherreligiouspurposesuchpersonshalleither
(a)conveythecarcasseswithintwentyfourhourstoaplace,ifany,fixedbythelocalgovernmentforthe
disposalofthedeadbodiesofanimalsor
(b)givenoticeofthedeathtothelocalgovernmentwhereuponthelocalgovernmentshallcausethecarcasstobe
disposedofandchargesuchfeesfromthepersonconcernedasthebyelawsmayprovide.

5. Animal husbandry. (1) A local government may provide for the establishment, maintenance and
managementofveterinaryhospitalsanddispensariesandbybyelawsregulatetheirworkingandfixthefeesto
bechargedfortreatmentinsuchhospitalsanddispensaries.
(2) A local government may, by byelaws, define contagious diseases among animals and provide for
measures that shall be adopted for prevention of the spread of such diseases including the compulsory

inoculation of animals, and the subjection to such treatment as may be necessary of such animals as may be
suspectedtohavebeeninfectedwithcarriersofanysuchdisease.
(3)Alocalgovernmentmay,throughbyelaws,providemeansandmeasurestopreventcrueltytoanimals.

6.Animalfarms.Alocalgovernmentmayestablish,maintainandmanagecattlefarmsandpoultryfarms,
andsuchfarmsshallbemanagedandadministeredinsuchmannerasthebyelawsmayprovide.

9. Registration and control of dogs. (1) A local government may make byelaws to provide for the
registrationofalldogskeptinsuchareaorareaswithinitslocalareaasmaybespecified.
(2)Suchbyelawsshall
(a)requiretheregistration,bythelocalgovernment,ofalldogskeptwithintheareaorareasspecifiedor
anypartthereof.
(b)requirethateveryregistereddogshallwearacollartowhichshallbeattachedametaltokentobe
issued by the registration authority of the local government and fix the fee payable for the issue
thereof
(c)requirethatanydogwhichhasnotbeenregisteredorwhichisnotwearingsuchtokenshall,iffound
inanypublicplace,bedetainedataplacesetapartforthepurposeand
(d)fixthefeewhichshallbechargedforsuchdetentionandprovidethatanysuchdogshallbeliableto
bedestroyedorotherwisedisposedofunlessitisclaimedandthefeeinrespectthereofispaidwithin
oneweek,andmayprovideforsuchothermattersasthelocalgovernmentthinksfit.
(3)Alocalgovernmentmay
(a)causetobedestroyedorconfinedforsuchperiodasitmaydirect,anydogorotheranimalwhichis,oris
reasonablysuspectedtobe,sufferingfromrabies,orwhichhasbeenbittenbyanydogorotheranimal
sufferingorsuspectedtobesufferingfromrabies
(b)bypublicnoticedirectthat,aftersuchdateasmaybespecifiedinthenotice,dogswhicharewithout
collarsorwithoutmarksdistinguishingthemasprivatepropertyandarefoundstrayingonthestreets
orbeyondtheenclosuresofthehousesoftheirownersifanymaybedestroyed,andcausethemtobe
destroyedaccordingly
(c)requiretheownerorpersoninchargeofanydog
(i)torestrainitsothatitisnotsetatlargeinanystreetwithoutbeingmuzzled,leashedorchained
and
(ii)toprovideimmediateinformation,ifthedogbelongingtohimhasbeenbittenbyanyanimal
sufferingorreasonablysuspectedtobesufferingfromrabiesoranyotherinfectiousdisease.
(4)Nodamagesshallbepayableinrespectofanydogorotheranimaldestroyedorotherwisedisposedof
underthisparagraph.

10.Powertoseize.(1)Acultivator,tenant,occupier,vendeeormortgageeofanylandorcroporproduceor
anypartthereoforanypersonwhohasadvancedcashforthecultivationofcropmayseizeorcausetobeseized
anyanimaltrespassingonsuchlandanddoingdamagethereto,oranycroporproducethereon,tosendthemor
causethemtobesentwithintwentyfourhourstoapoundestablishedunderthisAct.
(2)Personsinchargeofpublicroads,pleasuregrounds,plantations,canals,drainageworks,embankments
andthelike,andtheofficersofpolice,mayseizeorcausetobeseizedanimalsdoingdamagethereto,andshall
sendthemorcausethemtobesent,withintwentyfourhoursoftheseizure,tothenearestanimalpound.

11.Pounds.Alocalgovernmentmayestablishsuchnumberofanimalpoundsasmaybenecessaryandmay
fix,fromtimetotime,thelocationoftheanimalpounds,therateoffeeding,wateringandaccommodatingthe
impoundedanimals.

12. Pound keepers. A local government may appoint poundkeepers on wholetime or parttime basis on such

termsandconditionsasmaybefixed.

13.Registersandreturns.(1)Apoundkeepershallkeepsuchregistersandfurnishsuchreturnsasmaybe
requiredbythelocalgovernment.

(2)Whenanimalsarebroughttothepounds,thepoundkeepershallenterintheregisterthenumberand
descriptionofanimals,thedayandhouronwhichtheyweresobrought,thenameandresidenceoftheseizurer
andthatoftheowner,ifknown,andshallgivetheseizurerorhisagentacopyofsuchentry.

14.Possessionandfeeding.Thepoundkeepershalltakechargeof,feedandwatertheanimalsuntiltheyare
disposedofashereinafterprovided.

15.Finesforimpoundedanimals.ForeveryanimalimpoundedunderthisAct,thepoundkeepershalllevya
fineinaccordancewiththescalefixedbythelocalgovernmentandthefinessochargedshallformpartofand
becreditedtothelocalfund.

16.Deliveryorsaleofanimals.(1)Iftheownerofanimpoundedanimalorhisagentappearsandclaimsthe
animal,thepoundkeepershalldeliverittohimonpaymentofthefineandchargesincurredinrespectofsuch
animalunderproperreceipttoberecordedbytheownerorhisagentintheregister.
(2)Iftheanimalisnotclaimedwithinsevendaysofimpounding,thepoundkeepersshallinformtheofficer
inchargeofthePoliceStationwhoshallthereupondisplayataconspicuousplaceinhisofficeanoticestating
thenumberanddescriptionofanimalsandplacesofseizureandimpounding.Asimilarnoticeshallbedisplayed
ataconspicuousplaceintheofficeofthelocalgovernment.
(3)Iftheanimalisnotclaimedwithinsevendaysofthenoticeitshallbesoldbythelocalgovernmentby
openauctionaftergivingsufficientpublicityinthelocalarea:
Provided that the person auctioning the animals or the poundkeeper or his relatives shall not bid for or
purchasetheimpoundedanimals.
(4)Theproceedsofthesaleoftheanimalshallbepaidtotheownerifheappearswithinsixmonthsofthe
sale,afterdeductionoffines,feedingandothercharges.

Arboriculture
17.Arboriculture.Alocalgovernmentshallplanttreesonpublicstreetsandotherpublicplaceswithinitslocal
areaandtakeallsuchstepsasmaybenecessaryfortheplantationandprotectionoftreesonsuchstreetsandplaces.

18. Forests. A local government may, in the manner prescribed, frame and enforce plans providing for the
improvement,developmentandexploitationofforestsandmaintain,planandworkforestsinaccordancewith
suchplans.

19.Nuisancepertainingtotreesandplantations.(1)Alocalgovernmentmay,bybyelaws,determinethe
pestsoftreesandplantsandprovidefortheirdestruction.
(2) If any land or premises within the local area of the local government is grown with rank or noxious
vegetation,orundergrowth,thelocalgovernmentmaybynoticerequiretheownerortheoccupierofsuchlandor
premisestoclearsuchvegetationorundergrowthwithinaspecifiedtimeandifhefailstodosowithinsuchtime,
thelocalgovernmentmayhavesuchvegetationorundergrowthclearedandthecostincurredshallbedeemedtobe
ataxleviedontheowneroroccupierunderthisAct.
(3)Alocalgovernmentmay,inthemannerprovidedinthebyelaws,prohibitthecultivationofanycrop
whichisconsidereddangeroustopublichealthwithinsuchpartofitslocalareaasmaybespecified.
BoundariesandTrees
20.Boundarywalls,hedgesandfences.(1)Noboundarywall,hedgeorfenceofanymaterialordescription
shallbeerectedinsuchpartsofalocalareaasarespecifiedbyalocalgovernmentwithoutthepermissionin
writingofthelocalgovernment.
(2)Alocalgovernmentmay,bynoticeinwriting,requiretheownerorlesseeofanylandinitslocalarea
(a) to remove from the land any boundary wall, hedge or fence which is, in its opinion unsuitable,
unsightlyorotherwiseobjectionableor

(b)toconstructonthelandsufficientboundarywalls,hedgesorfencesofsuchmaterial,descriptionor
dimensionsasmaybespecifiedinthenoticeor
(c)tomaintaintheboundarywalls,hedgesorfencesofsuchlandsingoodorder.
Providedthat,inthecaseofanysuchboundarywall,hedgeorfencewhichwaserectedwiththeconsentor
undertheordersofthelocalgovernmentorwhichwasinexistenceatthecommencementofthisAct,thelocal
governmentshallmakecompensationforanydamagecausedbytheremovalthereof.
(3)Alocalgovernmentmay,bynoticeinwriting,requiretheowner,lesseeoroccupierofanysuchlandto
cutortrimanyhedgeonthelandinsuchmannerandwithinsuchtimeasmaybespecifiedinthenotice.

21.Felling,loppingandtrimmingoftrees.(1)Where,intheopinionofthelocalgovernmentthefellingofany
tree of mature growth standing in a private enclosure in its local area is necessary for any reason, the local
governmentmay,bynoticeinwriting,requiretheowner,lesseeoroccupierofthelandtofellthetreewithinsuch
timeasmaybespecifiedinthenotice.
(2)Alocalgovernmentmay
(a)causetobeloppedortrimmedanytreestandingonlandinitslocalareawhichbelongstothelocal
governmentor
(b) by public notice require all owners, lessees or occupiers of land in its local area or by notice in
writingrequiretheowner,lesseeoroccupierofanysuchland,toloportrim,insuchmannerasmay
bespecifiedinthenotice,alloranytreesstandingonsuchlandortoremoveanydeadtreesfrom
suchland.

22.Diggingofpublicland.Nopersonshallwithoutthepermissioninwritingofthelocalgovernmentdigup
thesurfaceofanyopenspacewhichisnotaprivatepropertyortakeoutearththerefrom.

23.Improperuseofland.(1)Ifintheopinionofalocalgovernmenttheworkingofaquarryinitslocalareaorthe
removal of stone, sand, earth or other material from the soil in any place in its local area is dangerous, to persons
residinginorfrequentingtheneighbourhoodofsuchquarryorplace,orcreates,orislikelytocreate,anuisance,the
localgovernmentmay,bynoticeinwriting,prohibittheowner,lesseeoroccupierofsuchquarryorplaceortheperson
responsibleforsuchworkingorremoval,fromcontinuingorpermittingtheworkingofsuchquarryorthemovingof
suchmaterial,orrequirehimtotakesuchstepsinthematterasthelocalgovernmentmaydirectforthepurposeof
preventingdangerorabatingthenuisanceorlikelytoarisetherefrom.
(2)If,inanycasereferredtoinsubparagraph(1),thelocalgovernmentisoftheopinionthatsuchacourse
isnecessaryinordertopreventimminentdanger,itmay,byorderinwriting,requireaproperhoardingorfence
tobeputupfortheprotectionofpassersby.

BuildingandLandUseControl
24.Sanctionforbuildings.Nopersonshallerectorreerectabuildingorcommencetoerectorreerectabuilding
on any land in a local area except with the previous sanction of the local government nor otherwise than in
accordancewiththeprovisionsofthisActandoftherulesandbyelawsmadeunderthisActrelatingtotheerection
andreerectionofbuildings:
Providedthatalocalgovernmentmay,withtheapprovalofthelocalgovernment,exemptanyUnionora
partthereoffromapplicationofanyspecificprovisionsofthebuildingbyelawsoranymatterprovidedforin
paragraphs25to34.

25.Noticeofnewbuildings.(1)Whoeverintendstoerectorreerectanybuildinginalocalareashallapply
forsanctionbygivingnoticeinwritingofhisintentiontothelocalgovernment.
(2)ForpurposesofthisAct,apersonshallbedeemedtoerectorreerectabuildingwho
(a)makesanymaterialalterationofenlargementofanybuilding,or
(b)convertsintoaplaceforhumanhabitationanybuildingnotoriginallyconstructedforthatpurpose,
or
(c)convertsintomorethanoneplaceforhumanhabitationabuildingoriginallyconstructedasonesuch
place,or
(d)convertstwoormoreplacesofhumanhabitationintoonesuchplaceorintogreaternumberofsuch
places,or

(e)convertsabuildingorasiteorlandmeantforoneparticularuseorinoneparticularzoningareainto
anyotheruseorausemeantforanotherzoningarea,or
(f) converts into a stable, cattleshed or cowhouse any building originally constructed for human
habitation,or
(g)makesanyalterationwhichthereisreasontobelieveislikelytoaffectprejudiciallythestabilityor
safetyofanybuildingortheconditionofanybuildinginrespectofdrainage,sanitationorhygiene,
or
(h)makesanyalterationtoanybuildingwhichincreasesordiminishestheheightof,orareacoveredby,
or the cubic capacity of, the building, or which reduces the cubic capacity of any room in the
buildingbelowtheminimumprescribedbyanybyelawmadeunderthisAct.

26. Conditions of valid notice. (1) A person giving the notice required by paragraph 25 shall specify the
purposeforwhichheintendstousethebuilding.
(2)Whereaplantorelayastreethasbeenapprovedbythelocalgovernment,apersonwhointendstoerect
orreerectabuildingorcommencestoerectorreerectabuildingshalladopttheapprovedbuildingorstreet
lineandforthispurposeanyspacerequiredtobeleftvacantshallvestinthelocalgovernment.
(3)NonoticeshallbevaliduntilitismadeinthemannerprescribedinthebyelawsmadeunderthisAct
alongwithplansandotherinformationwhichmayberequiredtherein,havebeenfurnishedtothesatisfactionof
thelocalgovernmentalongwiththenotice.

27. Power of Local Government to sanction or refuse. (1) A local government may, for reasons to be
recordedinwriting,eitherrefusetosanctiontheerectionorreerectionofthebuilding,ormaysanctioniteither
absolutelyorsubjecttosuchdirectionsasitthinksfitinrespectofalloranyofthefollowingmatters,namely:
(a)thefreepassageorwaytobeleftinfrontofthebuilding
(b)thespacetobeleftaroundthebuilding
(c)theventilationofthebuilding,theminimumcubicareaoftheroomsandthenumberandheightofthe
storeysofwhichthebuildingmayconsist
(d)theprovisionandpositionofdrains,latrines,urinals,cesspoolsorotherreceptaclesforwastes
(e)thelevelandwidthofthefoundation,thelevelofthelowestfloorandthestabilityofthestructure
(f)thelineoffrontagewithneighbouringbuildingsifthebuildingabutsonastreet
(g)themeanstobeprovidedforegressfromthebuildingincaseoffire
(h)the materials and method of construction to be used for external and internal walls for rooms, floors,
fireplacesandchimneys
(i) the height and slope of the roof above the uppermost floor upon which human beings are to live or
cookingoperationsaretobecarriedonand
(j)anyothermatteraffectingtheventilation,sanitation,safetyorenvironmentalaspectsofthebuildingand
itsrelationshipwiththesurroundingbuildingsorareas
andthepersonerectingorreerectingthebuildingshallobeyallsuchwrittendirections.
(2)Alocalgovernmentmayrefusetosanctiontheerectionorreerectionofanybuilding,eitherongrounds
sufficient in the opinion of the local government affecting the particular building, or in pursuance of a notified
generalschemeorplanofthelocalgovernment,restrictingtheerectionorreerectionofbuildingswithinspecified
limitsorforanyotherpublicpurpose.
(3)Alocalgovernmentbeforesanctioningtheerectionorreerectionofabuildingonlandwhichisunder
themanagementoftheFederalorProvincialGovernmentoranyagencythereof,shallascertaininwritingwithin
thirty days of application whether there is any objection on the part of the concerned Government to such
erectionorreerection.
(4)Alocalgovernmentmayrefusetosanctiontheerectionorreerectionofanybuilding
(a)whenthelandonwhichitisproposedtoerectorreerectthebuildingisheldonaleasefromthe
FederalorProvincialGovernmentif,theerectionorreerectionconstitutesabreachofthetermsof
thelease,or
(b)whenthelandonwhichitisproposedtoerectorreerectthebuildingisnotheldonaleasefromthe
Government,iftherighttobuildonsuchlandisindisputebetweenthepersonapplyingforsanction
andtheGovernment.
(5)Ifthelocalgovernmentdecidestorefusetosanctiontheerectionorreerectionofabuilding,itshall

communicateinwritingthereasonsforsuchrefusaltothepersonbywhomnoticewasgiven.
(6)Wherethelocalgovernmentneglectsoromits,forfortyfivedaysafterthereceiptofavalidnotice,tomake
andtodelivertothepersonwhohasgiventhenoticeanyorderofanynaturespecifiedinthisparagraph,andsuch
personthereafterbyawrittencommunicationsentbyregisteredposttothelocalgovernmentcallstheattentionofthe
localgovernmenttotheneglectoromission,then,ifsuchneglectoromissioncontinuesforafurtherperiodoffifteen
days from the date of such communication the local government shall be deemed to have given sanction to the
erectionorreerectionunconditionallytotheextentthatitdoesnotcontravenetheprovisionsofthebuildingbye
lawsandanynotifiedgeneralschemeforthearea:
Providedthat,inanycasetowhichtheprovisionsofsubparagraph(3)apply,theperiodoffortyfivedays
hereinspecifiedshallbereckonedfromthedateonwhichthelocalgovernmenthasreceivedthereportreferred
tointhatsubparagraph.
(7)Alocalgovernmentmay,aftergivingnoticeandforreasonstoberecorded,cancel,modifyorwithdraw
thesanctionofasiteplanatanytimebeforeconstructionhascommencedorbeenmade.
(8)Nothinginthisparagraphshallapplytoanywork,additionoralterationwhichthelocalgovernmentmay,by
byelaws,declaretobeexempt.

28.Compensation.(1) No compensation shall be claimed by any person for any damage or loss which he may
sustaininconsequenceoftherefusalofthelocalgovernmentofsanctiontotheerectionofanybuildingorinrespect
ofanydirectionissuedbyitundersubparagraph(1)ofparagraph27.
(2)Alocalgovernmentshallmakecompensationtotheownerofanybuildingforanyactualdamageorloss
sustainedbyhiminconsequenceoftheprohibitionofthereerectionofanybuildingorofitsrequiringanyland
belongingtohimtobeaddedtothestreet:
Providedthatthelocalgovernmentshallnotbeliabletomakeanycompensationinrespectoftheprohibition
ofthereerectionofanybuildingwhichforaperiodofthreeyearsormoreimmediatelyprecedingsuchrefusalhas
notbeeninexistenceorhasbeenunfitforhumanhabitation.

29.Lapseofsanction.Everysanctionfortheerectionorreerectionofabuildinggivenordeemedtohavebeen
givenbythelocalgovernmentashereinbeforeprovidedshallbeavailableforoneyearfromthedateonwhichitis
given, and, if the building so sanctioned is not begun by the person who has obtained the sanction or someone
lawfully claiming under him within that period, it shall not thereafter be begun unless the local government, on
applicationmadetherefor,hasallowedanextensionofthatperiod.

30.Periodforcompletionofbuilding.Alocalgovernment,whensanctioningtheerectionorreerectionofa
building as herein before provided, shall specify a reasonable period after the work has commenced within
whichtheerectionorreerectionistobecompleted,and,iftheerectionorreerectionisnotcompletedwithin
the period so fixed, it shall not be continued thereafter without fresh sanction obtained in the manner
hereinbefore provided, unless the local government on application made therefor has allowed an extension of
thatperiod:
Providedthatnotmorethantwosuchextensionsshallbeallowedbythelocalgovernmentinanycase.

31.Illegalerectionandreerection.Nopersonshallbegin,continueorcompletetheerectionorreerectionof
abuilding
(a)withouthavinggivenavalidnoticeasrequiredbyparagraphs25and26orbeforethebuildinghasbeen
sanctionedorisdeemedtohavebeensanctioned,or
(b)withoutcomplyingwithanydirectionmadeundersubparagraph(1)ofparagraph27,or
(c) when sanction has been refused, or has ceased to be available, or has been suspended by the local
government.

32.Powertostoperectionorreerectionortodemolish.Alocalgovernmentmay,atanytime,bynoticein
writing,directtheowner,lesseeoroccupierofanylandinitslocalareatostoptheerectionorreerectionofa
building in any case in which the local government considers that such erection or reerection is an offence
underparagraph31,andmayinanysuchcaseorinanyothercaseinwhichthelocalgovernmentconsidersthat
the erection or reerection of a building is an offence under paragraph 31 within twelve months of the
completion of such erection or reerection in like manner direct the alteration or demolition, as it thinks
necessary,ofthebuilding,oranypartthereof,soerectedorreerected:

Provided that the local government may, instead of requiring the alteration or demolition of any such
buildingorpartthereof,acceptbywayofcomposition,suchsumasitthinksreasonable.

33.Completionofbuildingoralterationofbuildings.(1)Everypersonwhohaserectedorreerectedabuilding
shall,withinthirtydaysofthecompletionofthebuilding,reportsuchcompletiontothelocalgovernment.
(2)Alocalgovernmentmaycausetobeinspectedanybuildingofwhichconstructionhasbegunorwhich
hasbeenerectedorreerectedinviolationorcontraventionofanyprovisionofthisAct,rulesorthebyelawsor
of the master plan or site development scheme, if any. A local government may require the alteration of the
building so as to be in compliance therewith, and where such alteration is not possible, it may require the
buildingoranypartthereoftobedemolished,orontheapplicationoftheownerofsuchbuildingcompoundthe
offenceonpaymentofsuchcompositionfeeasmaybedeemedreasonable.
(3) If a building is required to be demolished under the provisions of subparagraph (2) and such
requirement is not complied with, within the specified period, a local government may have the building
demolishedthroughitsownagencyandthecostsoincurredshallbedeemedtobeataxleviedontheowneror
occupierofthebuildingunderthisAct.

34.Regulationofbuildings.(1)Exceptwiththepriorsanctionofthelocalgovernment,nobuildingshallbe
puttoauseotherthanshowninthebuildingplanaccordingtowhichitwaserectedorreerected:
Providedthatthelocalgovernmentshallnotsanctionanychangeintheuseofabuildingwhichmaybein
violationorcontraventionofthemasterplanorsitedevelopmentscheme,ifany.
(2)Ifanybuildingoranythingfixedthereonbedeemedbythelocalgovernmenttobeinaruinousstateor
islikelytofallorisinanywaydangeroustoanyinhabitantofsuchbuildingorofanyneighbouringbuildingsor
toanyoccupierthereofortopassersby,thelocalgovernmentmay,bynotice,requiretheowneroroccupierof
suchbuildingtodemolishitortotakesuchactioninregardtothebuildingasmaybespecifiedinthenotice,and
ifthereisdefault,thelocalgovernmentmaytakenecessaryactionandthecostsoincurredshallbedeemedtobe
ataxleviedontheowneroroccupierofthebuildingunderthisAct.
(3)Ifabuildingissoillconstructed,orisdilapidatedorisindangerousconditionorisotherwiseunfitfor
human habitation, the local government may prohibit the occupation of such building till it has been suitably
repairedtothesatisfactionofthelocalgovernment.
(4)Ifthebuildingisindangerousconditionanddeclaredunfitforhumanhabitation,thelocalgovernment
mayforpurposesofdemolition, eject the owner or occupier from such building with such necessary force as
mayberequiredorinthemannerlaidowninparagraph47.
(5)Whereitappearstothelocalgovernmentthatanyblockofbuildingsisinanunhealthyconditionby
reason of the manner in which the buildings are crowded together, or of the narrowness or closeness of the
street,orofthewantofproperdrainageorventilation,oroftheimpracticabilityofcleansingthebuildingsor
other similar cause, it may cause the block to be inspected by a committee consisting of such officials of the
localgovernmentasmaybeprescribedinthebyelaws
(6)Thecommitteeshallmakeareportinwritingtothelocalgovernmentonthesanitaryconditionoftheblock,
andifitconsidersthattheconditionthereofislikelytocauseriskofdiseasetotheinhabitantsofthebuildingorof
theneighbourhoodorotherwisetoendangerthepublichealth,itshallclearlyindicateonaplanverifiedbyasenior
technicalprofessionalofthelocalgovernmentthebuildingswhichshouldinitsopinionwhollyorinpartberemoved
inordertoabatetheunhealthyconditionoftheblock.
(7)If,uponreceiptofsuchreport,thelocalgovernmentisoftheopinionthatalloranybuildingindicated
shouldberemoved,itmay,bynoticeinwriting,requiretheowners,thereoftoremovethem:
Providedthatthelocalgovernmentshallmakecompensationtotheownersforanybuildingssoremoved
whichmayhavebeenerectedunderproperauthority:
Providedfurtherthatthelocalgovernmentmay,ifitconsidersitequitableinthecircumstancessotodo,pay
totheownerssuchsumasitthinksfitascompensationforanybuildingssoremovedwhichhadnotbeenerected
underproperauthority.
For purposes of this subparagraph buildings includes enclosure walls and fences appertaining to
buildings.
(8) Where it appears to a local government that any building or part of a building which is used as a
dwellinghouseissoovercrowdedastoendangerthehealthoftheinmatesthereof,itmay,aftersuchinquiryas
itthinksfit,bynoticeinwritingrequiretheowneroroccupierofthebuildingorpartthereofwithinsuchtime,

not being less than one month, as may be specified in the notice, to abate the overcrowding of the same by
reducingthenumberoflodgers,tenants,orotherinmatestosuchnumberasmaybespecifiedinthenotice.

35. Projections and obstructions. (1) No owner or occupier of any building in a local area shall, without
permissioninwritingofthelocalgovernment,addtoorplaceagainstorinfrontofthebuildinganyprojection
orstructureoverhanging,projectinginto,orencroachingon,anystreetoranydrain,seweroraqueducttherein.
(2)Alocalgovernmentmay,bynoticeinwriting,requiretheowneroroccupierofanysuchbuildingto
alterorremoveanysuchprojectionorencroachmentasaforesaid:
Providedthat,inthecaseofanyprojectionorencroachmentlawfullyinexistenceatthecommencementofthis
Actthelocalgovernmentshallmakecompensationforanydamagecausedbytheremovaloralterationthereof.

36. Unauthorized buildings over drains, etc. A local government may, by notice in writing, require any
person who has, without its permission in writing, newly erected or reerected any structure over any public
sewer,drain,culvert,watercourseorwaterpipeinitslocalareatopulldownorotherwisedealwiththesameas
itthinksfit.

37.Drainageandsewerconnections.(1)Alocalgovernmentmay,bynoticeinwriting,requiretheowneror
lessee of any building or land in any street, at his own expense and in such manner as the local government
thinksfit,toputupandkeepingoodconditionpropertroughsandpipesforreceivingandcarryingrainwater
from the building or land and for discharging the same or to establish and maintain any other connection or
communicationbetweensuchbuildingorlandandanydrainorsewer.
(2)Forpurposesofefficientlydraininganybuildingorlandinitslocalarea,thelocalgovernmentmay,by
noticeinwriting,requiretheownerorlesseeofthebuildingorland
(a)topave,withsuchmaterialsandinsuchmannerasitthinksfit,anycourtyard,allyorpassagebetween
twoormorebuildings,or
(b)tokeepanysuchpavinginproperrepair.

38.Powertoattachbracketsforlamps.Alocalgovernmentmayattachtotheoutsideofanybuilding,ortoany
treeinitslocalarea,bracketsforlampsinsuchmannerasnottooccasioninjurytheretoorinconvenience.

39.Powertomakebyelaws.Alocalgovernmentmaymakebyelawsprescribing
(a)themannerinwhichnoticeoftheintentiontoerectorreerectabuildinginitslocalareashallbegiven
tothelocalgovernmentandtheinformationandplanstobefurnishedwiththenotice
(b)thetypeordescriptionofbuildingswhichmayormaynot,andthepurposeforwhichabuildingmayor
maynot,beerectedorreerectedinitslocalareaoranypartthereof
(c)theminimumcubiccapacityofanyroomorroomsinabuildingwhichistobeerectedorreerected
(d)thefeespayableonprovisionbythelocalgovernmentofplansorspecificationsofthetypeofbuildings
whichmaybeerectedinthelocalareaoranypartthereof
(e)thecircumstancesinwhichamosque,templeorchurchorothersacredbuildingmaybeerectedorre
erectedand
(f)anyothermatterwhichthelocalgovernmentmayconsidernecessary,includinganyspecificexemptionfrom
theapplicationofthebyelaws.

BurialPlaces/GraveyardsandCremation
40.Powertocallforinformationregardingburialandburninggrounds.(1)Thelocalgovernmentmay,by
noticeinwriting,requiretheownerorpersoninchargeofanyburialorburninggroundwithinitsareatosupply
suchinformationasmaybespecifiedinthenotice.
(2)NoplacewhichhasnotbeenusedasaburialorburninggroundbeforethecommencementofthisAct
shallbesousedwithoutthepermissioninwritingofthelocalgovernment.
(3)Nonewburialorburningplaceshallbeestablishedwithinthelocalareaofalocalgovernmentexcept
underalicencegrantedbythelocalgovernmentandinconformitywiththeconditionsofsuchlicence.
(4)Aburialorburningplacewhichisnotadministeredbyalocalgovernmentshallberegisteredwiththe
localgovernmentandshallbesubjecttoregulation,supervisionandinspectionbyitinsuchmannerasthebye
lawsmayprovide.

(5)TheGovernmentmay,bynotificationintheofficialGazette,declarethatanygraveyardorburialorburning
placewhichisopentopublicforburialorburningshallvestinalocalgovernmentandthereuponsuchburialor
burningplaceshallvestinthelocalgovernmentanditshalltakeallmeasuresnecessaryforthepropermaintenance
andadministrationthereof.
(6)Alocalgovernmentmayprovidesuitableplacesforthegraveyardorburialorburningofthedead,and
shalltakenecessarymeasuresforpropermaintenanceandadministrationofsuchburialandburningplaces.
(7)(a)Wherealocalgovernmentaftermakingorcausingtobemadealocalinquiry,isofopinionthatany
burial or burning ground in its local area has become offensive, to, or dangerous to, the health of,
persons living in the neighbourhood, it may, by notice in writing, require the owner or person in
chargeofsuchgroundtoclosethesamefromsuchdateasmaybespecifiedinthenotice.
(b) Where such notice is issued, the local government may provide at its own expense or, if the
communityconcernediswillingtoprovideanewburialorburningground,shallprovideagrantto
bemadetowardsthecostofthesame.
(8)Nocorpseshallbeburiedorburntinanyburialorburninggroundinrespectofwhichanoticeissued
underthisparagraphisforthetimebeinginforce.

Culture
41.Culture.Alocalgovernmentmay
(a)establishandmaintaininformationcentresforthefurtheranceofciviceducationanddisseminationof
informationonsuchmattersascommunitydevelopmentandothermattersofpublicinterest
(b)provideandmaintainpublichallsandcommunitycentres
(c)celebratenationaloccasions
(d)encouragenationalandregionallanguages
(e)promotephysicalcultureandencouragepublicgamesandsportsandorganizeralliesandtournaments.
(f)provide,promoteorsubsidisefacilitiesfortherecreationofthepublic.

42.Libraries.A local government may establish and maintain such libraries, reading rooms and circulation
librariesasmaybenecessaryfortheuseofthepublic.

43.Fairsandshows. A local government may make such arrangements on the occasion of any fairs, shows or
publicfestivalswithinitslocalareaasmaybenecessaryforthepublichealth,publicsafetyandpublicconvenience,
andmaylevyfeesonthepersonsattendingsuchfairs,showsandfestivals.

DangerousandOffensiveArticlesandTrades
44.Dangerousandoffensive articles and trades.(1) The articles and trades specified in Second Schedule
shallbedeemedtobedangerousoroffensiveforpurposesofthisparagraph.
(2)Exceptunderandinconformitywiththeconditionsofalicencegrantedbythelocalgovernment
(a)nopersonshallcarryonanydangerousoroffensivetrade
(b)nopremisesshallbeusedorofferedtobeusedforanydangerousoroffensivetradeand
(c)nopersonshallstoreorkeepinanypremises
(i)anydangerousoroffensivearticlesfordomesticuseor
(ii)anydangerousoroffensivearticlesinexcessofsuchlimitandquantityasmaybefixedbythe
byelaws.
(3)Notwithstandingthegrantofalicenceundersubparagraph(2),thelocalgovernmentmay,forreasonsto
berecorded,andafternoticetothepersonaffected,passanorderfortheprohibition,closureorremovalofany
offensiveanddangeroustradeorarticleifsuchactionisdeemedexpedientornecessarytoimplementtheorder.

DrainageandSewerage
45.Drainage.(1)Alocalgovernmentshallprovideanadequatesystemofpublicdrainsinitslocalareaandall
such drains shall be constructed, maintained, kept cleared and emptied with due regard to the health and
convenienceofthepublic.
(2)Everyowneroroccupierofanylandorbuildingwithinthelocalareaofthelocalgovernmentmay,with
its previous permission, and subject to such terms and conditions, including the payment of fees, as it may
impose,causehisdrainstobeemptiedintopublicdrains.

(3)Allprivatedrainsshallbesubjecttocontrol,regulationandinspectionbythelocalgovernment.
(4)Subjecttotheprovisionsofanyotherlawforthetimebeinginforce,thelocalgovernmentmay,by
notice,directacommercialorindustrialconcerntoprovideforthedisposalofitswasteoreffluentinthemanner
specified,andfailureonthepartofowner,tenantoroccupierthereoftocomplywithsuchdirections,shallbea
municipaloffence.
(5)Alocalgovernmentmay,bynotice,requiretheownerofanybuilding,landoranindustrialconcern
withinitslocalarea
(a)toconstructsuchdrainswithinthebuildingorlandorthestreetadjoiningsuchbuildingorlandandtotake
suchothermeasuresfortreatmentanddisposalofeffluentasmaybespecifiedinthenotice
(b)toremove,alterorimproveanysuchdrainsand
(c)totakeotherstepsfortheeffectivedrainageofthebuildingorlandasmaybespecified.
(6)Incaseoffailureofownertocomplywiththerequirementsofnoticeundersubparagraph(5),thelocal
governmentmayitselfcausesuchrequirementstobecarriedout,andthecostsoincurredshallbedeemedtobea
taxleviedontheownerofthebuildingorlandunderthisAct.

46.Drainageandsewerageschemesforcommercialandindustrialarea.(1)Alocalgovernmentmay,by
notice, require the owners, tenants and occupiers of commercial and industrial concerns in any area or areas
withinitslocalareatohaveattheirowncostpreparedaschemefortheadequateandsafedrainageanddisposal
of their wastes and effluent of the quality permitted under the rule or the byelaws and submit it to the local
governmentwithinthetimespecifiedinthenotice:
Provided that the time limit may be extended by the local government for a maximum period of three
monthsattherequestoftheowners,tenantsoroccupiersofthecommercialandtheindustrialunitsconcerned.
(2)Thedrainage,sewerageanddisposalschemeasapprovedbythelocalgovernmentwithmodifications,if
any,shallbeexecutedandimplementedbytheowners,tenantsoroccupiersofthecommercialorindustrialunits
attheirexpenseinsuchmannerandwithinsuchtimeasmaybespecifiedbythelocalgovernment.
(3)Incaseofthefailureoftheowners,tenantsoroccupiersofthecommercialorindustrialconcernsto
complywiththeprovisionsofsubparagraphs(1)and(2),thelocalgovernmentmayitselfpreparethedrainage,
sewerageanddisposalschemeandexecuteandimplementitatitsownexpense,andthecostsoincurredshall,
underthisAct,bedeemedtobeataxleviedontheowners,tenantsoroccupiersoftheindustrialandcommercial
unitsconcerned.

Encroachments
47.Encroachmentandsubsistingleasesandlicences.(1)Nopersonshallmakeanencroachment,movableor
immovable,onanopenspaceorlandvestedinormanaged,maintainedorcontrolledbyalocalgovernment,oron,
overorunderastreet,road,graveyard,withinitslocalareaoradrain.
(2)Thelocalgovernmentmay,aftersuchnoticeasmaybeconsideredreasonable,removetheencroachment
mentionedinsubparagraph(1)withsuchforceasmaybenecessary.
(3)Apersonwhotrespassesintoorisinwrongfuloccupationofabuildingorpropertywhichisvestedinor
ismanaged,maintainedorcontrolledbyalocalgovernmentmay,inadditiontoanyotherpenaltytowhichhe
maybeliableunderthisActoranyotherlawforthetimebeinginforce,aftersuchnoticeasmaybeconsidered
reasonable by the local government, be ejected from such building or property by the local government with
suchforceasmaybenecessary.
(4)Anypersonaggrievedbythenoticeissuedundersubparagraph(3)may,withinsevendays,oftheservice
ofnotice,appealtosuchauthorityasmaybeprescribedinthebyelawsanditsdecisionthereonshallbefinal.
(5) Notwithstanding anything contained in any other law, no compensation shall be payable for any
encroachmentremovedorejectmentcarriedoutunderthisparagraph.
(6)The cost of removal of encroachment or ejectment under this paragraph shall be payable to the local
governmentbytheencroacherorwrongfuloccupier,andifthecostisnotpaidondemandthelocalgovernment
maycauseittoberecoveredasarrearsoflandrevenueorcausethematerialsorarticlesusedbytheencroacheror
thewrongfuloccupierofencroachmentorwrongfuloccupationtobesoldinauctionandiftheproceedsofthesale
arenotsufficienttocoverthecostthebalanceshallberecoverableasarrearsoflandrevenuebutifsuchproceeds
exceedthecost,theexcessshallbepaidtotheencroacherorthewrongfuloccupier.
(7)Inthisparagraph,encroacherorwrongfuloccupiershallincludeapersonwhoownsthematerialsor
articlesusedforencroachmentorwrongfuloccupationatthetimeofremovalofencroachmentorejectmentand

alsoanypersoninpossessionthereofonhisbehalforwithhispermissionorconnivance.

EnvironmentalProtection
48.Environmentalpollution.(1)Alocalgovernmentmayprepareandimplementschemesforthepreventionof
thepollutionofairbygases,dustorothersubstancesexhaustedoremittedbyautomobileengine,factories,brickor
limekilns,crushingmachinesforgrain,stone,saltorothermaterialsandsuchothersourcesofairpollutionasthe
byelawsmayprovide.
(2)Alocalgovernmentmayprepareandimplementschemesforthepreventionofthepollutionofwateror
landfromsuchsourcesandinsuchmannerasthebyelawsmayprovide.
(3)Alocalgovernmentmay,bynoticeinwriting,requiretheownerorpartowner,orpersonclaimingtobethe
ownerorpartowner,ofanybuildingorlandintheareaofthelocalgovernmentorthelesseeorthepersonclaiming
tobethelesseeofanysuchland,which,byreasonofdisuseordisputedownershiporothercause,hasremained
unoccupiedandhasintheopinionofthelocalgovernmentbecomeasanitaryorenvironmentalhazardorotherwise
occasionsorislikelytooccasionanuisance,tosecureandenclosethesamewithinsuchtimeasmaybespecifiedin
thenotice.

FoodandMarkets
49.Publicmarketsandslaughterhouses.(1)Alocalgovernmentmayprovideandmaintainwithinitsown
local area, public markets and public slaughterhouses, in such number as it thinks fit, together with stalls,
shops,sheds,pensandotherbuildingsorconveniencesfortheuseofpersonscarryingontradeorbusinessinor
frequenting such markets or slaughterhouses, and may provide and maintain in any such market buildings,
places,machines,weights,scalesandmeasuresfortheweighmentormeasurementofgoodssoldtherein.
(2)Alocalgovernmentmay,atanytimebypublicnotice,eithercloseorrelocateanypublicmarketor
publicslaughterhouseoranypartthereof.

50.Useofpublicmarkets.(1) An officer or servant of the local government authorized by it in this behalf


may summarily remove a person from a market if the person conducting business in the market without the
generalorspecialpermissionofthelocalgovernment.
(2)Anypersoncontraveningtheprovisionsofthisparagraphandanyanimalorarticleexposedforsalebysuch
person may be summarily removed from the market by or under orders of the local government by an officer or
servantofthelocalgovernmentauthorizedbyitinthisbehalf.

51.Levy of stallages, rents and fees. A local government may, in respect of a public market and a public
slaughterhouse
(a)chargesuchstallages,rentsandfeesasitthinksfitfortheoccupationoruseofanystall,shopstanding,
shedorpeninapublicmarket,orpublicslaughterhouse,orfortherighttoexposegoodsforsaleina
public market, or for weighing or measuring goods sold therein, or for the right to bring in goods on
vehiclesoranimals,orforanimalsbroughtforsaleorsold,orfortherighttoslaughteranimalsinany
publicslaughterhouseor
(b)put up to public auctions or dispose of by private sale, the privilege of occupying or using any stall,
shops, standing, shed or pen in a public market or public slaughter house for such term and on such
conditionsasitmayapprove.

52.Stallages,rents,etc.tobepublished.Acopyofthetableofstallages,rentsandfees,ifany,leviable in any
publicmarketorpublicslaughterhouseandofthebyelawsmadeunderthisActforthepurposeofregulatingtheuse
ofsuchmarketorslaughterhouse,printedinUrduandinsuchotherlanguageorlanguagesasthelocalgovernment
maydirect,shallbeaffixedinsomeconspicuousplaceinthemarketorslaughterhouse.

53.Privatemarketsandslaughterhouses.(1)Noplaceinalocalareaotherthanapublicmarketshallbe
usedasamarket,andnoplaceinalocalareaotherthanapublicslaughterhouseshallbeusedasaslaughter
house,unlesssuchplacehasbeenlicensedasamarketorslaughterhousebythelocalgovernment.
(2)Nothinginsubparagraph(1)shallbedeemedtorestricttheslaughterofanyanimalinanyplaceonthe
occasion of any festival or ceremony, subject to such conditions as to prior or subsequent notice as the local
governmentwiththeprevioussanctionofthelocalgovernmentmay,bypublicorspecialnotice,imposeinthis

behalf.

54. Conditions of grant of licence for private market or slaughterhouse. (1) A local government may
chargesuchfeesasmaybeapprovedforthegrantofalicnecetoanypersontoopenaprivatemarketorprivate
slaughterhouse and may grant such licence subject to such conditions, consistent with this Act and any bye
laws,asitthinksfittoimpose.
(2)Alocalgovernmentmayrefusetograntanysuchlicenceforreasonstoberecorded.

55.Prohibitionofkeepingmarketorslaughterhouseopenwithoutlicence,etc.(1)Nopersonshallkeep
openforpublicuseanymarketorslaughterhouseinrespectofwhichthelicencehaseitherbeensuspendedor
cancelled.
(2)Whenalicencetoopenaprivatemarketorprivateslaughterhouseisgrantedorrefusedorissuspendedor
cancelled,thelocalgovernmentshallcauseanoticeofthegrant,refusal,suspensionorcancellationtobepastedin
Urduandinsuchotherlanguageorlanguagesasitthinksnecessary,atsomeconspicuousplacenearbytheentrance
oftheplacetowhichthenoticerelates.

56. Prohibition of using unlicensed market or slaughterhouses. No person, knowing that any market or
slaughterhousehasbeenopenedtothepublicwithoutalicencehavingbeenobtainedthereforwhensuchlicenceis
requiredbyorunderthisAct,orthatthelicencegrantedthereforisforthetimebeingsuspendedorthatithasbeen
cancelled,sellorexposeforsaleanyarticleinsuchmarket,orslaughtersanyanimalinsuchslaughterhouse.

57.Prohibitionandrestrictionofuseofslaughterhouses.(1)Where,intheopinionofthelocalgovernment
itisnecessaryonsanitarygroundssotodo,itmay,bypublicnotice,prohibitforsuchperiod,notexceedingone
monthasmaybespecifiedinthenotice,orforsuchfurtherperiod,notexceedingonemonth,asitmayspecify
by like notice, the use of any private slaughterhouse specified in the notice, or the slaughter therein of any
animalofanydescriptionsospecified.
(2)Acopyofeverynoticeissuedundersubparagraph(1)shallbeconspicuouslypostedintheslaughter
housetowhichitrelates.
58.Powertoinspectslaughterhouse.(1)Anyservantofalocalgovernmentauthorizedbyorderinwritingin
this behalf by the local government may, if he has reason to believe that any animal has been, is being, or is
about to be slaughtered in any place in contravention of the provisions of this Act enter into and inspect any
suchplaceatanytime,whetherbydayorbynight.
(2)Everysuchordershallspecifytheplacetobeenteredandthelocalityinwhichthesameissituatedand
theperiod,whichshallnotexceedsevendays,forwhichtheorderistoremaininforce.

59.Powertomakebyelaws.AlocalgovernmentmaymakebyelawsconsistentwiththisActtoprovidefor
alloranyofthefollowingmatters,namely:
(a)thedayson,andthehoursduring,whichanyprivatemarketorprivateslaughterhousemaybekeptopen
foruse
(b) the regulation of the design, ventilation and drainage of such markets and slaughterhouses and the
materialtobeusedintheconstructionthereof
(c)thekeepingofsuchmarketsandslaughterhousesandlandsandbuildingsappertainingtheretoinaclean
andsanitarycondition,theremovaloffilthandrefusetherefrom,andthesupplythereinofpurewater
andofasufficientnumberoflatrinesandurinalsfortheuseofpersonsusingorfrequentingthesame
(d)themannerinwhichanimalsshallbestalledataslaughterhouse
(e)themannerinwhichanimalsmaybeslaughtered
(f)thedisposalordestructionofanimalsofferedforslaughterwhichare,fromdiseaseoranyothercause,
unfitforhumanconsumption
(g)thedestructionofcarcasseswhichfromdiseaseoranyothercausearefoundafterslaughtertobeunfit
forhumanconsumptionand
(h)anyothermatterwhichthelocalgovernmentmayconsidernecessaryincludinganyspecificexemptions
fromtheapplicationofthebyelaws

60.Byelawsforarticlesoffoodanddrink.Alocalgovernmentmay,bybyelaws

(a)prohibitthemanufacture,saleorpreparationortheexposureforsaleofanyspecifiedarticlesoffoodor
drinkinanyplaceorpremisesnotlicensedbythelocalgovernment
(b)prohibittheimportintoitslocalareaforsaleorhawkingforsale,ofanyspecifiedarticleoffoodor
drinkbypersonnotsolicensed
(c)prohibitthehawkingsofspecifiedarticlesoffoodanddrinkinsuchpartsofitslocalareaasmaybe
specified
(d)regulatethetimeandmanneroftransportwithinitslocalareaofanyspecifiedarticlesoffoodordrink
(e)regulatethegrantandwithdrawalofalicenceunderthisparagraphandthelevyingoffeesthereforor
(f)providefortheseizureanddisposalofanyanimal,poultryorfishintendedforfoodwhichisdiseased,or
anyarticleoffoodordrinkwhichisnoxious.

61. Milk supply. (1) Except under a licence granted by the local government and in conformity with the
conditionsofsuchlicence,nopersonshall,unlessexemptedbythelocalgovernment,keepmilchcattleforthe
saleofmilkorsellmilkorexposeorimportmilkforsaleormanufacturebutter,ghee,oranyothermilkforsale
ordairyproduct,norshallanypremisesbeusedforsuchpurpose.
(2)Alocalgovernmentmay,inthemannerprescribed,frameandenforceamilksupplyschemewhichmay
among other matters provide for the establishment of milkmens colonies, the prohibition of the keeping of
milchcattleinthelocalareaoranypartthereof,andtheadoptionofsuchothermeasuresasmaybenecessary
forensuringanadequatesupplyofpuremilktothepublic.

62.Feedinganimalsondirt,etc.Nopersonshallfeedorallowtobefedonfilthyordeleterioussubstancesany
animal,whichiskeptforpurposesofsupplyingmilkto,orwhichisintendedtobeusedforhumanconsumptionor
allowittograzeinanyplaceinwhichgrazinghas,forsanitaryreasons,beenprohibitedbypublicnoticebythe
localgovernment.

63.Powersofentryandseizure.(1)Anofficerorservantofalocalgovernmentauthorizedbyitinwritingin
thisbehalf
(a)may at any time enter into any market, building, shop, stall or other place in the local area for the
purposeofinspecting,andmayinspect,anyanimal,articleorthingintendedforhumanfoodordrinkor
formedicine,whetherexposedorhawkedaboutforsaleordepositedinorbroughttoanyplaceforthe
purpose of sale, or of preparation for sale, or any utensil or vessel for preparing, manufacturing or
containinganysucharticle,orthing,andmayenterintoandinspectanyplaceusedasaslaughterhouse
andmayexamineanyanimalorarticletherein
(b)mayseizeanysuchanimal,articleorthingwhichappearstohimtobediseased,orunwholesomeor
unfitforhumanfoodordrinkormedicineortobeadulteratedortobenotwhatitisrepresentedtobe,or
any such utensil or vessel which is of such a kind or in such a sate as to render any article prepared,
manufacturedorcontainedthereinunwholesomeorunfitforhumanfoodorformedicine.
(2)Anyarticleseizedundersubparagraph(1)whichisofaperishablenaturemayforthwithbedestroyedif,
inhisopinion,itisdiseased,unwholesomeorunfitforhumanfood,drinkormedicine.
(3)Every animal, article, utensil, vessel or other thing seized under subparagraph (1) shall, if it is not
destroyedundersubparagraph(2),betakenbeforeacompetentcourtwhichshallgiveordersastoitsdisposal.
ExplanationI.Ifanysucharticle,havingbeenexposedorstoredin,orbroughtto,anyplacementionedin
subparagraph(1)forsaleasasli(pure)ghee,containsanysubstancenotexclusivelyderivedfrommilk,itshall
bedeemed,forpurposesofthisparagraph,tobeanarticlewhichisnotwhatitisrepresentedtobe.
ExplanationII.Meatsubjectedtotheprocessofblowingshallbedeemedtobeunfitforhumanfood.
ExplanationIII.Thearticleoffoodordrinkshallnotbedeemedtobeotherthanwhatitisrepresentedto
bemerelybyreasonofthefactthattherehasbeenaddedtoitsomesubstancenotinjurioustohealth:
Providedthat
(a) such substance has been added to the article because the same is required for the preparation or
production thereof as an article of commerce in a state fit for carriage or consumption and not
fraudulentlytoincreasethebulk,weightormeasureofthefoodordrinkorconcealtheinferiorquality
thereof,or
(b)intheprocessofproduction,preparationorconveyanceofsucharticleoffoodordrink,theextraneous
substancehasunavoidablybecomeintermixedtherewith,or

(c)theownerorpersoninpossessionofthearticlehasgivensufficientnoticebymeansofalabeldistinctly
andlegiblywrittenorprintedthereonortherewith,orbyothermeansofapublicdescription,thatsuch
substancehasbeenadded,or
(d)suchownerorpersonhaspurchasedthatarticlewithawrittenwarrantythatitwasofacertainnature,
substanceandqualityandhadnoreasontobelievethatitwasnotofsuchnature,substanceandquality,
andhasexposeditorhawkeditaboutorbroughtitforsaleinthesamestateandbythesamedescription
asthatinandbywhichhepurchasedit.

LeaseandLicencesforLandandBuildings
64.Leaseandlicencesforlandandbuildings.(1)Alocalgovernmentmaygrantalicenceorleaseinrespect
ofanyland,openspace,buildingorpropertyvestedinitormanaged,maintainedorcontrolledbyitonsuch
termsandconditionsasmaybeprovidedinthebyelaws.
(2) Notwithstanding anything contained in any other law or a subsisting lease or licence, the local
governmentmay,aftergivingareasonablenoticetothepersonconcerned,varythetermsandconditionsofany
leaseorlicenceoflandorbuildingsoranyotherpropertyowned,managed,maintainedorcontrolledbyit,in
suchmannerandtosuchextent,asitmaydeemfit,andmayalsocanceltheleaseorlicenceifthevariedterms
andconditionsarenotacceptabletothelesseeorthelicensee.
(3)If,onthecancellationofanyleaseorlicenceundersubparagraph(2)orontheexpiryoftheperiodofany
leaseorlicenceoronthedeterminationorcancellationofaleaseorlicenceonthebreachofanyofthetermsand
conditionsthereofinrespectoflandorbuildingoranypropertyofwhichalocalgovernmentisthelessororlicensor,
anylesseeorlicenseeholdsonorcontinuesinpossessionofsuchland,buildingorpropertyorifinanycasesuch
landorbuildingorpropertyisrequiredforanypublicpurpose,thelesseeorlicenseeonbeingrequiredtohandover
vacant possession within a specified time refuses or fails to vacate that land or building or property, the local
governmentoranofficerauthorisedbyitinthisbehalfmayenteruponandtakepossessionofsuchland,buildingor
otherproperty,andmayalsodemolishandremovethestructures,ifany,erectedorbuiltthereon.
(4) The cost of demolition and removal of structure under subparagraph (3) shall be payable to the local
government by the lessee or licensee and if the cost is not paid on demand, the local government may cause the
material of the structures demolished and removed to be sold in auction, and if the proceeds of the sale are not
sufficienttocoverthecost,thebalanceshallberecoverableasarrearsoflandrevenue,butifsuchproceedsexceed
thecost,theexcessshallbepaidtothelesseeorthelicensee.
(5)Insubparagraphs(3)and(4),thelesseeandthelicenseeshallbedeemedtoincludeapersonwhoowns
thestructureatthetimeofremovalordemolitionandalsoanypersoninpossessionthereofonhisaccountor
withhispermissionorconnivance.
(6)For purposes of eviction of the lessee or licensee under the provisions of this paragraph, an officer
authorisedbyalocalgovernmentinthisbehalfmayuseorcausetobeusedsuchforceasmaybenecessaryand
mayseekMagisterialorPoliceassistance.
(7)Ifanysumispayablebythelesseeorlicenseeasrentorfeeinrespectofanyland,buildingorother
propertyonthedayofrecoveryofpossessionthereof,thesameshallberecoverablefromhimasarrearsofland
revenue.

Licencing:GeneralProvisions
65.Powertovarylicence.Ifalocalgovernmentissatisfiedthatanyplaceusedunderalicencegrantedbyit
underthisActisanuisanceorislikelytobedangeroustolife,healthorproperty,thelocalgovernmentmay,by
noticeinwriting,requiretheowner,lesseeoroccupierthereoftodiscontinuetheuseofsuchplaceortoeffect
suchalterations,additions,orimprovementsaswill,intheopinionofthelocalgovernment,renderitnolongera
nuisanceordangerous.

66.Carryingontrade,etc.,withoutlicenceorincontraventionofparagraph.Nopersonshallcarryonany
trade, calling or occupation for which a licence is required without obtaining a licence therefor or while the
licencethereforissuspendedorafterthesamehasbeencancelled,orafterreceivinganoticeunderparagraph
65,useorallowtobeusedanybuildingorplaceincontraventionthereof.

OpenSpaces
67.Gardens.(1) A local government may layout and maintain within its local area such public gardens as

maybenecessaryfortherecreationandconvenienceofthepublicandsuchpublicgardensshallbemaintained
andadministeredinsuchmannerasthebyelaws,mayprovide.
(2) For every public garden there shall be framed and enforced, in the manner prescribed, a garden
developmentplan,whichshallprovideforthedevelopmentandimprovementofthegarden.

68.Openspaces.Alocalgovernmentmayprovideandmaintainwithinitslocalareasuchopenspacesasmay
benecessaryfortheconvenienceofthepublicandsuchspacesshallbegrassed,hedged,plantedandequipped
withsuchamenitiesandinsuchmannerasthebyelawsmayprovide.

Planning
69.Spatialplan.Alocalgovernmentmaydrawupspatial(master)Planforitslocalareawhichshall,among
othermatters,providefor
(a)asurveyofitslocalareaincludingitshistory,statistics,publicserviceandotherparticulars
(b)development,expansionandimprovementofanyareawithinthelocalarea
(c)restrictions,regulationsandprohibitionstobeimposedwithregardtothedevelopmentofsites,andthe
erectionandreerectionofbuildingswithinthelocalareaand
(d)suchothermattersasthelocalgovernmentmayrequiretobeincludedintheplan.

70.Sitedevelopmentschemes.(1)WhereaPlanhasbeendrawnupunderparagraph69andsuchPlanhas
beenapproved,noowneroflandexceedingsuchareaasmaybespecifiedinthisbehalfinthePlansoapproved
shalldevelopthesiteorerectorreerectabuildingonanyplotoflandcoveredbythePlan,exceptinconformity
withtheprovisionsofasitedevelopmentschemesanctionedfortheareainthemannerprescribed.
(2)WhereaPlanhasnotbeendrawnupunderparagraph69,noowneroflandshalldevelopthesiteorerect
or reerect any building on any plot or land except in conformity with the provisions of the site development
schemesanctionedbythelocalgovernment.
(3)An owner of land who desires to develop a plot or a piece of land belonging to him for which no
sanctioned site development scheme exists, or where the proposed development is not in conformity with the
existing development scheme, he may apply to the local government for sanction of his development scheme
andthelocalgovernmentmay,onsuchtermsandconditionsandonpaymentofsuchfeesorchargesasmaybe
laiddownbyitinitsbyelaws,sanctionthesame:
Providedfurtherthatthelocalgovernmentmay,aftergivingnoticeandforreasonstoberecorded,cancel,
modifyorwithdrawthesanctionanytimebeforeconstructioninpursuanceoftheschemehascommencedor
beenmade.
(4)Amongothermatters,thesitedevelopmentschemeshallprovidefor
(a)thedivisionofthesiteintoplots
(b)provisionforstreets,drainsandopenspaces
(c)reservationoflandforpublicutilityservicestobetransferredtothelocalgovernment
(d)provisionsforacquisitionoflandbythelocalgovernment,ifany
(e)theworksthatshallbeexecutedatthecostoftheownersofthesiteorsitesand
(f)theperiodduringwhichtheareashallbedeveloped.
(5)ThelandreservedforpublicutilityservicesintheSiteDevelopmentSchemeshallbetransferred,freeofcost,
by the owner or the owners to the local government before the sanction of the scheme. Such land shall not be
convertedorusedforanypurposeotherthanthatshowninthesamescheme.

71.Executionofsitedevelopmentschemes.(1)Theexecutionofsitedevelopmentschemeshallbesubjectto
theinspectionandcontrolofthelocalgovernmentandthelocalgovernmentmay,fromtimetotime,givesuch
directionswithregardtotheexecutionoftheschemeasmaybedeemednecessary.
(2)Ifanyareaisdevelopedorotherwisedealtwithincontraventionoftheprovisionsofthesanctionedscheme,
the local government may, by notice, require the owner of such area or the person who has contravened the
provisionstomakesuchalteration,inthesiteasmaybespecifiedinthenotice,andwheresuchalterationisnotmade
orforanyreasoncannotbecarriedout,thelocalgovernmentmayrequireandenforcethedemolitionofunauthorized
structureandnotwithstandinganythingtothecontrarycontainedinanylaw,nocompensationshallbepayablefor
suchdemolition.
(3)Ifanareaforwhichaschemehasbeensanctionedisnotdevelopedwithintheperiodprovidedinthe

schemeandfurtherextensionisnotallowedbythelocalgovernment,orifthedevelopmentisnotinconformity
with the terms of the site development scheme, the local government may take over the development of the
scheme and execute the necessary works and the cost so incurred shall be deemed to be a tax levied on the
ownerorownersunderthisAct.

Developmentplanning
72.DevelopmentPlans.StrategicPlans,MasterPlansandDevelopmentPlansinalocalgovernmentshallbe
preparedintheprescribedmanneronspecifiedsectoralproformawiththefollowingasessentialinformation:
(a)NameandLocation:Thenameoftheprojectandlocationmustbeclearlyindicatedbygivingthename
oftheArea,UnionCouncilandVillagealongwithrelevantdetailstosignifytheexactlocality.Themapof
theareashouldbeattachedtomagnifyprojectlocation.
(b)Cost:Cost estimates should be indicated with source of financing and allocation in the current year
budget. The narration should touch on the basis (e.g. market survey, schedule rates, estimation of
previousworkdone)ofdeterminingthecapitalcost.
(c)Objectives:TheLocalgovernmentmusthaveclearroadmapoftargetsandobjectivestoachieveinthe
arenaofitsresponsibilityfordevelopment.Everyprojectmustfitintothisframeandshouldhavestrong
linkagewithoveralldevelopmentobjectivesofthelocalgovernment.
(d)DescriptionandJustification:Thissectionshoulddescribetheprojectintermsofexistingfacilitiesand
justificationfortheProject.Thissectionshouldalsoincludetechnicalparameters,detailsofcivilworks,
machineryandotherphysicalfacilitiesrequiredfortheproject,andmusthighlightofissuesrelevantto
theprojectandthestrategytoresolvethem.
(e)OperatingandMaintenanceCost:Thissectionshouldindicateitemizedoperationalcostforfiveyears
aftercompletionoftheprojectwithsourceoffinancingandresponsibility.
(f)FinancialPlan:Thissectionshouldindicatethequantumoftotalresourcesrequiredfortheprojectandthe
sourcestoprovidethecost.
(g)ProjectBenefitsandAnalysis:Thissectionshouldgiveabriefnarrationoftheprobableincometobe
generatedfromtotheprojectandmustquantifysocialbenefitstothetargetgroup.
(h)EnvironmentalImpact:thissectionshouldgiveafairassessmentofthenegativeorpositiveimpactofthe
projectontheenvironment.
(i)ImplementationSchedule:Thissectionshouldindicatethestartingandcompletiondateoftheproject
withdetailedscheduleofphysicalactivities.Thedetailsshouldincludeadministrativearrangementsand
manpowerrequirementsduringexecutionandoperationoftheproject.

73. Community Development Projects. A local government may sponsor or promote community
development projects for its local area or any part thereof and may, in this behalf, subject to the approval of
Government,performsuchfunctionsasmaybenecessary.

74. Commercial Schemes. A local government may, with the previous sanction of Government, promote,
administer,executeandimplementschemesforundertakinganycommercialorbusinessenterprise.

75. Urban Improvement. An urban local government may, with prior approval of the Government, frame
projectsforimprovementinitsareaandconstituteanUrbanImprovementCommitteewhichshallperformsuch
functionsandexercisesuchpowersasmaybeprescribed.

76.DevelopmentSchemes.WhereanUrbanImprovementCommitteeisconstituted,theGovernmentmay,in
theprescribedmanner,providefor
(a)thetypesofschemestobeundertaken
(b)initiationofschemesbyanUrbanImprovementCommitteeonthedirectionofGovernmentoronmove
bythelocalgovernment
(c)matterstobeprovidedforinaschemesuchasacquisitionofland,retention,managementordisposalof
landsvestedinthelocalgovernment,demolitionofunhygienicbuildings,andredistributionoflandina
scheme,layingoutandalterationofschemes,provisionandmanagementofopenspaces,reclamationof
landanditsreservationfortheproductionoffruit,vegetables,fuel,fodderandthelikefortheresidentsofa
local area, water supply and lighting, drains and sewerage, health measures, erection and reerection of

buildings,advancestoowners,communicationsandothermater
(d)alterationandabandonmentofschemesandacquisitionofland
(e) furnishing of information by a local government or by the Government or other agency and which is
necessaryforpurposesofframingofaschemeorofassistanceinitsexecutionormaintenance
(f)powersofsuchsanctionorofrejectionormodificationofascheme
(g)powerstofacilitatemovementofpopulationandpowersofentry
(h)powerstomakeasurveyorcontributetowardsitscostsand
(i)suchothermattersasmaybenecessary.

77.Noticeofschemes.(1)As soon as may be, after a scheme has been framed by the Urban Improvement
Committee,theUrbanImprovementCommitteeshallprepareanoticestatingthefactthattheschemehasbeen
framedandthattheboundariesofthelocalitiescomprisedthereinandtheplaceorplacesatwhichandthetime
at which the scheme including a statement of the land proposed to be acquired and the general map of the
localitycomprisedinthescheme,maybeinspected.
(2)TheUrbanImprovementCommitteeshall,notwithstandinganythingcontainedinthesanctionedscheme,
causethesaidnoticetobenotifiedandalsopublishedinanewspaperweeklyonthreeconsecutiveweeksalongwith
astatementoftheperiodwithinwhichobjectionsshallbereceived.
(3)Onthenotificationandpublicationofnoticeundersubsection(2),theschemeshallbedeemedtobein
forceandnopersonshallthereaftererect,reerect,addoralteranybuildingorbuildingswithintheareaofthe
schemeexceptwiththepermissionoftheUrbanImprovementCommittee.
(4)Theobjectionsundersubsection(2)shallbedisposedofintheprescribedmanner.

78.Noticeofacquisitionoflandandnotificationofschemes.(1)Duringthirtydaysfollowingthefirstday
onwhichthenoticeisnotifiedandpublished,theUrbanImprovementCommitteeshallserveanoticeonevery
person whom the Urban Improvement Committee has reason to believe to be owner or occupier of any
immovablepropertywhichisproposedtobeacquiredinexecutingtheschemeandsuchnoticeshallstatethat
theUrbanImprovementCommitteeproposestoacquiresuchpropertyforpurposesofcarryingoutaschemeand
requiringsuchperson,ifheobjectstosuchacquisition,tostatehisreasonsinwritingwithinaperiodofsixty
daysfromtheserviceofthenotice.
(2)Thesanctionoftheschemebytheauthoritycompetenttodosoundertherulesshall,onnotification,be
conclusiveevidencethattheschemehasbeendulyframedandsanctioned.

79.ApprovalofDevelopmentPlan.TheDevelopmentPlanofalocalgovernmentshallbesanctionedinits
meeting.

80.DevelopmentPlanstobeincludedintheBudget.Asfarasmaybe,theschemesincludedintheDevelopment
Planshallbeincludedinthebudget.

PublicHealthandSanitation
81.Insanitarybuildingsandlands.(1)Alocalgovernmentmay,bynotice,requiretheownersoroccupierof
anybuildingorlandwhichisininsanitaryorunwholesomestate
(a)tocleanorotherwiseputinitinaproperstate
(b)tomakearrangementstothesatisfactionofthelocalgovernmentforitspropersanitationand
(c)tolimewashthebuildingandtomakesuchessentialrepairsasmaybespecifiedinthenotice.
(2)Ifintheopinionofalocalgovernmentanywell,tank,reservoir,pool,depression,orexcavation,oranybank
ortree,isinaruinousstateorforwantofsufficientrepairs,protectionorenclosureisanuisanceorisdangerousto
personspassingbyordwellingorworkingintheneighbourhood,thelocalgovernmentmay,bynoticeinwriting,
requiretheownerorpartownerorpersonclaimingtobetheownerorpartownerthereof,or,failinganyofthem,the
occupierthereoftoremovethesame,ormayrequirehimtorepair,ortoprotectorenclosethesameinsuchmanner
asitthinksnecessaryand,ifthedangeris,intheopinionofthelocalgovernmentimminent,itshallforthwithtake
suchstepsasitthinksnecessarytoavertthesame.

82.Removal,collectionanddisposalofrefuse.(1)Alocalgovernmentshallmakeadequatearrangementsfor
theremovalofrefusefromallpublicroadsandstreets,publiclatrines,urinals,drainsandallbuildingsandlands

vestedinthelocalgovernmentandforthecollectionandproperdisposalofsuchrefuse.
(2)The occupiers of all other buildings and lands within the local area of a local government shall be
responsiblefortheremovalofrefusefromsuchbuildingsandlandsubjecttothegeneralcontrolandsupervision
ofthelocalgovernmentwhererelevant.
(3)Alocalgovernmentshallcausepublicdustbinsorothersuitablereceptaclestobeprovidedatsuitableplaces
and where such dustbins or receptacles are provided, the local government may, by public notice, require that all
refuseaccumulatinginanypremisesorlandshallbedepositedbytheowneroroccupierofsuchpremisesorlandin
suchdustbinsorreceptacles.
(4) All refuse removed and collected by the staff of a local government or under their control and
supervisionandallrefusedepositedinthedustbinsandotherreceptaclesprovidedbythelocalgovernmentshall
bepropertyofthelocalgovernment.
(5) A local government may, by notice, issue directions with regard to the manner in which and the
conditionssubjecttowhich,anymatterreferredtointhisparagraphmaybecarriedout.

[82A.Landfill.(1)Theconcernedlocalgovernmentshallprovidelandfill,subjecttotheclearancebythe
Provincial Environmental Protection Agency, established under section 5 of the Punjab Environmental
ProtectionAct,1997(XXXIVof1997)forproperdisposalofsolidwasteandrefuse,anduntilaprovisionis
made,suchlocalgovernmentshallnotifyordesignateadumpingsiteforthepurpose.
(2)The concerned local government shall maintain landfill or dumping site, as the case may be, in such
mannerasthebylawsmayprovide.]
83. Latrines and urinals. (1) A local government shall provide and maintain in sufficient number and in
propersituationspubliclatrinesandurinalsfortheseparateuseofeachsex,andshallcausethesametobekept
inproperorderandtoberegularlyandproperlycleaned.
(2)Alocalgovernmentmay,bynoticeinwriting
(a)requireanypersonhavingthecontrolwhetherasowner,lesseeoroccupierofanylandorbuilding
(i)tocloseanycesspoolappertainingtothelandorbuildingwhichis,intheopinionofthelocal
governmentanuisance,or
(ii)tokeepinacleancondition,insuchmannerasmaybeprescribedbythenotice,anyreceptacle
orfilthorsewageaccumulatingonthelandorinthebuilding,or
(iii)topreventthewaterofanyprivatelatrine,urinal,sinkorbathroomoranyotheroffensive
matter, from soaking, draining or flowing, or being put, from the land or building upon any
streetorotherpublicplaceorintoanywatercourseorotherspecifiedwaterbodyorintoany
drainnotintendedforthepurposeor
(iv)tocollectanddepositforremovalbytheconservancyestablishmentofthelocalgovernmentwithin
such time and in such receptacle or place, situated at not more than thirty five meters from the
nearestboundaryofthepremises,asmaybespecifiedinthenotice,anyoffensivematterorrubbish
whichsuchpersonhasallowedtoaccumulateorremainunder,inoronsuchbuildingorlandor
(b)requireanypersontodesistfrommakingoralteringanydrainleadingintoapublicdrainor
(c)require any person having the control of a drain to cleanse, purify, repair or alter the same, or
otherwiseputitingoodorder,withinsuchtimeasmaybespecifiedinthenotice.
(3)Whereanypremisesarewithoutprivyorurinalaccommodation,orwithoutadequateprivyorurinal
accommodation, or the privy or urinal is on any ground objectionable, the local government may, by notice,
requiretheowneroroccupierofsuchpremises
(a)toprovidesuchorsuchadditionalprivyorurinalaccommodationasmaybespecifiedinthenotice
(b)tomakesuchstructuralorotheralterationintheexistingprivyorurinalaccommodationasmaybe
sospecified
(c)toremovetheprivyorurinaland
(d)tosubstituteconnectedprivyorconnectedurinalaccommodationforanyserviceprivyorserviceurinal
accommodationwherethereisanyundergroundseweragesystem.
(4)Incasetheowneroroccupierofanybuildingorlandwhohasbeenservednoticeundersubparagraph(3),
failstomakearrangementstothesatisfactionofthelocalauthorityforthematterreferredtointhisparagraph,the
localgovernmentmaymakesucharrangementsandthecostsoincurredshallbedeemedtobeataxleviedunderthis
Actontheowneroroccupier.


84.Privatelatrines.Alocalgovernmentmay,bynoticeinwriting
(a)requiretheownerorotherpersonhavingthecontrolofanyprivatelatrineorurinalnottoputthesameto
publicuseor
(b) where any plan for the construction of private latrines or urinals has been approved by the local
governmentandcopiesthereofmaybeobtainedfreeofchargeonapplication:
(i)requireanypersonrepairingorconstructinganyprivatelatrineorurinalnottoallowthesametobe
useduntilithasbeeninspectedbyorunderthedirectionofthelocalgovernmentandapprovedbyit
asconformingwithsuchplanor
(ii) require any person having control of any private latrine or urinal to rebuild or alter the same in
accordancewithsuchplanor
(c)requiretheownerorotherpersonhavingthecontrolofanysuchprivatelatrineorurinalwhich,intheopinion
ofthelocalgovernmentconstitutesanuisance,toremovethelatrineorurinalor
(d)requireanypersonhavingthecontrolwhetherasowner,lesseeoroccupierofanylandorbuilding
(i)tohaveanylatrinesprovidedforthesamecoveredbyasufficientroofandwallorfencefromthe
viewofpersonspassingbyordwellingintheneighbourhood,or
(ii)tokeepsuchlatrineorurinalinproperstatetothesatisfactionofthelocalgovernmentandshall
employ such staff for the purpose as may be necessary or as may be specified by the local
governmentand
(e)requireanypersonbeingtheownerandhavingthecontrolofanydraintoprovide,withintendaysfrom
theserviceofthenotice,suchcoveringasmaybespecifiedinthenotice.

85. Infectious diseases. (1) A local government shall adopt measures to prevent infectious diseases and to
restraininfectionwithinitslocalarea.
(2)Alocalgovernmentshallestablishandmaintainoneormorehospitalsforthereceptionandtreatmentof
personssufferingfrominfectiousdiseases.

86.Bathingandwashingplaces.(1)Alocalgovernmentmayfromtimetotime
(a)setapartsuitableplacesforusebythepublicforbathing
(b)specifythetimeatwhichandthesexofpersonsbywhomsuchplacesmaybeusedand
(c)prohibitbypublicnotice,theusebythepublicforanyofthesaidpurposesofanyplacenotsosetapart.
(2)No person shall establish, maintain or run a hamam or a bath for public use except under a licence
grantedbythelocalgovernmentandinconformitywiththeconditionsandtermsofsuchlicence.

PublicSafety
87. Firefighting. (1) For the prevention and extinction of fires, the local government shall maintain a fire
brigadeconsistingof such staff and such number of fire stations and such implements,machinery,equipment
andmeansofcommunicatingintelligenceasmaybenecessary.
(2)Alocalgovernmentshallprepareafirefightingplanandreviseitatleastonceayear.

88.Civildefence.Alocalgovernmentshallberesponsibleforthecivildefenceofitslocalarea,andshallin
thisbehalf,performsuchfunctionsasmaybespecifiedbyGovernment.

89. Floods. For fighting of floods, rescuing of people from the floodaffected areas and affording relief to
floodstricken people, the local government shall provide such boats, appliances and equipment as may be
specifiedbyGovernment.

RegistrationofBirths,Deaths,MarriagesandDivorces
90.Birth,deathsetc.Alocalgovernmentshallregisterallbirths,deaths,marriagesanddivorceswithinthe
limits of its local area and information of such births, deaths, marriages and divorces shall be given by such
personsorauthoritiesandshallberegisteredinsuchmannerasthebyelawsmayprovide.

SocialWelfareandCommunityDevelopment
91.Socialwelfare.Alocalgovernmentmay

(a)establish,manageandmaintainwelfarehomes,asylums,orphanages,widowhomesandotherinstitutionsfor
thereliefofthedistressed
(b)providefortheburialorcremationofunidentifieddeadbodieswithinitslocalareaatitsownexpense
(c)adoptsuchmeasuresasmaybespecifiedbytheGovernmentforthepreventionofbeggary,prostitution,
gambling,takingofinjuriousdrugsandconsumptionofalcoholicliquor,juveniledelinquencyandother
socialevils
(d)organizesocialservicevolunteersand
(e)adoptsuchmeasuresasmaybeprescribedforthepromotionofthewelfareofbackwardclasses,families
ofthepersonsservinginthearmedforces,womenandchildren.

StreetsandStreetsLighting
92.Publicstreets.(1)Alocalgovernmentshallprovideandmaintainsuchpublicstreetsandothermeansofpublic
communicationsasmaybenecessary.
(2) A local government shall, in the manner prescribed, prepare and execute a road maintenance and
developmentprogramme.

93.Streets.(1)Nonewstreetshallbelaidoutexceptwiththeprevioussanctionofthelocalgovernmentandin
conformitywiththetermsandconditionsofsuchsanction.
(2)Allstreetsotherthanpublicstreetsshallbemaintainedinsuchmannerasthebyelawsmayprovide.
(3)Alocalgovernmentmay,bynotice,requirethatanystreetmaybepaved,metalled,drained,channeled,
approvedorlightedinsuchmannerasmaybespecifiedandintheeventofdefault,thelocalgovernmentmay
havethenecessaryworkdonethroughitsagencyandthecostsoincurredshallbedeemedtobeataxleviedon
thepersonconcernedunderthisAct.
(4)Governmentmayprescribethemannerinwhichastreetotherthanapublicstreetmaybeconvertedinto
apublicstreet.
(5) A local government shall not name or rename a road or a street or a chowk or an underpass or a
flyover/interchangewithoutthepreviousapprovaloftheGovernment.

94.Streetlightingandelectrification.(1)Alocalgovernmentshalltakesuchmeasuresasmaybenecessaryfor
the proper lighting of the public streets and other public places vested in the local government by oil, gas,
electricityorsuchotherilluminantasthelocalgovernmentmaydetermine.
(2) A local government shall also provide or cause to be provided electricity in coordination with the
concerneddepartmenttoitslocalareaforpublicandprivatepurposes.
(3)Alocalgovernmentmayframeandenforcestreetlightingandelectrificationschemes.

95.Streetwatering.A local government shall take such measures as may be necessary for the watering of
publicstreetsforthecomfortandconvenienceofthepublic,andmay,forthispurpose,maintainsuchvehicles,
staffandotherapparatusasmaybenecessary.

TradesandOccupations
96. Provision of washing places. (1) A local government may provide suitable places for the exercise by
washermenoftheircalling,andmayrequirepaymentofsuchfeesasmaybeprescribedbythelocalgovernment.
(2)Wherethelocalgovernmenthasprovidedsuchplacesasaforesaiditmay,bypublicnotice,prohibitthe
washingofclothesbywashermenatanyotherplacewithinthatpartofthelocalarea:
Provided that such prohibition shall not be deemed to apply to the washing by a washermanofhis own
clothesoroftheclothesofanyotherpersonwhoisanoccupieroftheplaceatwhichtheyarewashed.

97.Licencesrequiredforcarryingonofcertainoccupation.(1)Nopersonofanyofthefollowingclasses,
namely:
(a)butchersandvendorsofpoultry,gameorfish
(b)personskeepingmilchcattleormilchgoatsforprofit
(c)personskeepingforprofitanyanimalotherthanmilchcattleormilchgoats
(d)dairymen,buttermenandmakersandvendorsofghee
(e)vendorsoffruitorvegetables
(f)manufacturersoficeoricecreamandvendorsofthesame
(g)vendorsofarticlesoffoodordrinkforhumanconsumption(otherthanmilk,butter,bread,biscuits,

cake, fruit, vegetables, aerated or other potable water or ice or icecream) which are of a perishable
nature
(h)vendorsofwatertobeusedfordrinkingpurposes
(i)washermen
(j)personscarryingonanytradeoroccupationfromwhichoffensiveorunwholesomesmellsarise
(k)vendorsofwheat,riceandothergrainorflour
(l)makersandvendorsofsweetmeats
(m)barbersandkeepersofshavingsaloonsand
(n) any other trades and occupations specified in the byelaws, or through public notice by local
governmentfromtimetotime
shall carry on his trade, calling or occupation in such part of a local area as may be designated by the local
governmentunlesshehasappliedforandobtainedalicenceinthisbehalffromthelocalgovernment.
(2)Alicencegrantedundersubparagraph(1)shallbevaliduntiltheendoftheyearinwhichitisissued
andthegrantofsuchlicenceshallnotbewithheldbythelocalgovernmentunlessithasreasontobelievethat
thebusinesswhichitisintendedtoestablishormaintainwouldbeoffensiveordangeroustothepublic.
(3)Notwithstandinganythingcontainedinsubparagraph(1)
(a)nopersonwhowas,atthecommencementofthisActcarryingonhistrade,callingoroccupationin
anypartofalocalareashallbeboundtoapplyforalicenceforcarryingonsuchtradeoroccupation
in that part until he has received from the local government not less than three months notice in
writingofhisobligationtodoso,andifthelocalgovernmentrefusestogranthimalicence,itshall
paycompensationforanylossincurredbyreasonofsuchrefusaland
(b)nopersonshallberequiredtotakealicenceforthesaleorstorageofpetroleumorforthesaleor
possessionofpoisonsorwhitearsenicinanycaseinwhichheisrequiredtotakealicenceorsuch
sale,storageorpossessionunderanyFederalorProvinciallaw.
(4)Alocalgovernmentmaychargefeesforthegrantoflicencesunderthisparagraph.

98.Conditionswhichmaybeattachedtolicences.Alicencegrantedtoanypersonunderparagraph89shall
specifythepartofthelocalareainwhichthelicenseemaycarryonhistrade,callingoroccupation,andmay
regulate the hours and manner of transport within the local area of any specified articles intended for human
consumption and may contain any other conditions which the local government thinks fit to impose in
accordancewiththebyelawsmadeunderthisAct.

TransportandTraffic
99.Trafficcontrol.(1) A local government shall, by byelaws, make such arrangements for the control and
regulationoftrafficasmaybenecessarytopreventdangertoandensurethesafety,convenienceandcomfortof
thepublic.
(2)Alocalgovernmentmayprovideforparkingmotorsonsuchpublicplacesasmaybedeterminedbyit.

100.Publicvehicle.(1)Nopersonshallkeeporletforhireordriveorpropel,withinthelimitsofthelocal
areaofthelocalgovernment,anypublicvehicle,otherthanamotorvehicle,exceptunderalicencegrantedbythe
localgovernmentandinconformitywiththeconditionsofsuchlicence.
(2)Nohorseorotheranimalshallbeusedfordrawingapublicvehiclewithinthelocalareaofthelocalgovernment
exceptunderthelicencegrantedbythelocalgovernmentandinconformitywiththeconditionsofsuchlicence.
(3)Alocalgovernmentshall,insuchmannerasthebyelawsmayprovideandwiththepreviousapproval
ofGovernment,fixtherateoffaresfortheuseofpublicvehiclesandnopersonplyingapublicvehicleshall
chargearateinexcessthereof.
(4)Inthisparagraph,apublicvehiclemeansanyvehiclewhichordinarilypliesforhire.

101.Publicferries.(1)Alocalgovernmentmay,bybyelaws,provideforthelicensingofboatsandother
vesselsplyingforhireinapublicwatercourseandmayspecifythetermsandconditionsforthegrantoflicences
andthefeestobechargedtherefor.
(2)Governmentmaydeclareanypartofthepublicwatercoursetobeapublicferryandmayentrustthe
managementthereoftothelocalgovernmentwhichshallmanageandoperatethepublicferryinsuchmanner
andlevysuchtollasmaybenecessary.


WaterSupply
102.Watersupply.(1)Alocalgovernmentshallprovideorcausetobeprovidedtoitslocalareaasupplyof
wholesomewatersufficientforpublicandprivatepurposes.
(2)Whereapipedwatersupplyisprovided,thelocalgovernmentshallsupplywatertoprivateandpublic
premisesinsuchmannerandonpaymentofsuchchargesasthebyelawsmayprovide.

103.Privatesourceofwatersupply.(1)Allprivatesourcesofwatersupplywithinthelocalareaofthe
localgovernmentshallbesubjecttocontrol,regulationandinspectionbythelocalgovernment.
(2)Nonewwell,waterpumporanyothersourceofwaterfordrinkingpurposes,shallbedug,constructed
orprovidedexceptwiththesanctionofthelocalgovernment.
(3)Alocalgovernmentmay,bynotice,requiretheowneroranypersonhavingthecontrolofanyprivate
sourceofwatersupplyusedfordrinkingpurposes
(a)tokeepthesameingoodorderandtocleanitfromtimetotimeofsilt,refuseanddecayingmatter
(b)toprotectthesamefromcontaminationinsuchmannerasthelocalgovernmentdirectsand
(c)ifthewaterthereinisprovedtothesatisfactionofthelocalgovernmenttobeunfitfordrinking
purposes,totakesuchmeasuresasmaybespecifiedinthenoticetopreventtheuseofsuchwaterfor
drinkingpurposes.

104. Public watercourses. (1) A local government may, with the previous sanction of the Government,
declareanysourceofwater,river,spring,tank,pondorpublicstream,oranypartthereofwithinitslocalarea,
whichisnotprivateproperty,tobeapublicwatercourse.
(2) A local government may, in respect of any public watercourse, provide such amenities, make such
arrangementsforlifesaving,executesuchworksand,subjecttotheprovisionsofanylawforthetimebeingin
forcerelatingtoirrigation,drainageandnavigation,regulatetheusethereofinsuchmannerasthebyelawsmay
provide.

105. Tanks, ponds and lowlying areas. A local government may take such steps with regard to the
excavation or reexcavation of tanks and ponds and the reclamation of lowlying areas as it thinks fit or the
Governmentdirects.
