Proposal
Animal Care and Control organization and redemption fee structure

Clarifies that Animal Care and Control is a department of the City and the Commission's advisory role to the department. Changes the fee structure for redemption of animals
from a graduated fee based on how many times the animal was impounded and how long the animal was the shelter ($30 to $120) to a flat $65 fee. The fee change is
revenue neutral and intended to allow for quicker animal redemption.
Clarification of insurance and indemnification

Reorganizes section 9-68-020 concerning zone, daily, and professional services residential parking permits for clarity. Cleanup includes: addressing inconsistent terminology
in reference to zone, daily permits and extends not-for-profit pilot program through the end of 2017 (allows not-for-profits in residential zones to purchase one-day passes
for up to 5 employees).
Amendment to Water Management powers and duties

Various

Provides uniformity throughout the Code by amending existing permit-related and license-related insurance and indemnification provisions to substitute the technically
correct term proof of insurance for certificate of insurance. Clarifies the requirement to name the City as additional insured. Clarifies that the duty to indemnify or hold
harmless the City from liability also includes the duty to defend the City. These clarification bring additional sections of the Code in line with 2016 Code clarifications for the
same purpose and brings minimum insurance limits in line with current practice.
Address clarity and inconsistent terminology in parking permits

Amendments to water usage and material standards per IDNR requirement

Section 2 modifies existing requirements that restrict sprinkling, window washing and sidewalk washing during certain hours to match State regulations. Does not apply to
newly seeded and sodded lawns. Section 6 requires that new fixtures, irrigation controllers, and sprinkler systems must be WaterSense labeled, as specified by the US
Environmental Protection Agency and State regulations. State law requires these changes for the purposes of water conservation for all municipalities that draw water from
Lake Michigan.
Waive certain hydrant fees

Authorizes the commissioner of Water Management to waive hydrant fees for work performed for, by, or on behalf of the City.
Water Management code corrections
Article IV, Section 4

Corrects an administrative error where certain sections were repealed on December 2, 2009 but were not removed from publication. Reaffirms the repeal of sections 11-12340, 11-12-440, 11-12-470, and 11-12-690. Certain sections concerning full payment certificates needed for the transfer of property were repealed in error. These sections
(11-12-530 and 11-12-531) are restored.
Utility billing cycle authority

Authorizes the Comptroller to establish a billing period for water utility bills, allowing for the conversion of the six month bill for non-metered accounts to an every other
month bill.
Link maximum lead content for water pipe and fitting materials to Federal standards

Article IV, Sections 7 and 8

Updates City code to conform to Federal requirements and current practice, stating that maximum lead content is to be governed by the federal Safe Drinking Water Act and
applicable regulations. Changing the reference in this manner will allow City Code to stay current with Federal requirements.
Clarification of license revocation for retail tobacco

Creation of the One-Call adjudication process and DIGGER membership
requirements

Clarifies that references to Ward numbers in City Code refer to the ward boundaries at the time that particular reference was enacted. This occurs in sections on late-hour
liquor licenses and some parking restrictions.
Clarification of possessory lien on impounded vehicles

Establishes a new two-year regulated business license of $1,500 for pharmaceutical representatives, requires pharmaceutical representatives to complete at least 15 hours of
continuing education on ethics, pharmacology, laws, and regulations applicable to pharmaceutical marketing in order to receive or renew a pharmaceutical representative
business license. Provides the Commissioner of Public Health with the authority to designate approved continuing education courses and require pharmaceutical
representatives to provide certain information on marketing practices to the City. Also establishes ethical standards related to deceptive marketing, misrepresenting ability
to practice medicine, and attending a patient exam without consent for all representatives, and gives the commissioner the authority to establish additional standards.
Lastly, violations between $1,000 to $3,000 may be levied against any representative for each day s/he violate this ordinance. Effective July 1, 2017.

Clarification of references to Ward numbers

Establishes framework for notification of damage, excavation requirements, marking requirements, and determining liability when underground utilities such as sewer,
water, and electrical lines are damaged as a result of excavation. Brings City in-line with Federal requirements which include a 24-hour service network and an adjudication
process for determining liability for damage during excavation. Effective January 1, 2018.

Pharmaceutical Representative Licensing

Clarifies existing Code provisions that already provide that the City has a possessory lien on vehicles it has impounded, and explicitly affirms applicable Federal law that grants
the City a possessory lien when the City impounds vehicles, providing the City a useful tool to assert its right to contest legal proceeding when individuals attempt to subvert
legal proceedings and retrieve a vehicle in the City's custody without following through on bankruptcy filing or paying applicable fines and fees.

Amendment to Fleet and Facility Management powers and duties

Extends authority to extend lease and right-of-entry agreements from 60 to 150 days. Provides that no initial agreement may extend beyond 180 days without City Council
approval. Authorizes the Commissioner to establish a citywide health, safety, compliance and risk management program for all non-sworn personnel with the goal of
reducing on-the-job injuries and hazards.
Extends CDPH clinical services authority

Clarification of license plate requirements

Creates a definition of legal voter for purposes of signing petitions related to housesharing as the registered voter whose primary residence is in the precinct for which the
petition is being circulated. Clarifies that primary residence is defined the same as elsewhere in Code. Makes explicit that the timeframes for completion of City review are to
provide direction and are not mandatory.
Notification requirements for donation bins placed on private property
